PREVIOUS COUNCIL ACTION: The City Council in 2010 approved the plat for Rivers Bend Plat 2, as part
of the developers agreement, one lot was allowed to be built prior to completion of the road. This
permit would allow for a spec home.
BACKGROUND INFORMATION: The developer has indicated that he has a buyer that is interested in lot
1 block 1 providing the developer can have the homes constructed and completed for occupancy in
August. Therefore he would like to have authority to allow a second lot to be constructed without the
permanent road. The two lots referred to are located on CR 121 and be accessed easily.
In discussing the matter with Randy Sabart he indicates: "My opinion is that it probably doesn't
create any greater access concerns than was contemplated with the spec /display home lot on the
south side of the street. In the event of a fire, the trucks would likely have to stage /fight the fire
from CR 121. Police /EMT vehicles should still have reasonable access via the temporary access
road. If the lot was more interior to the subdivision, I believe I would have greater concern..."
The following is an extract from the Developers Agreement:
(c) Construction of Temporary Road and One Home. The City will allow the
construction of one home and a temporary paved road prior to installation
of street, curb and gutter. Maintenance and snow plowing of this
temporary road will be the responsibility of the Developer and at the
expense of the Developer. The temporary road and construction of the
home will not be allowed until approval of the final plat.

REQUESTED COUNCIL ACTION: Authorize the developer to secure two building permits for the Rivers
Bend Plat 2 before the permanent road is constructed to allow for the construction of a model home
and custom built.
