BOARD /COMMISSION /COMMITTEE RECOMMENDATION: The Planning Commission considered an extension
of the Interim Use Permits for owner occupied rental in business zoning districts. As none of the areas are ready
for conversion to business, the Planning Commission unanimously recommend extending the Interim Permits for
an additional three years at which time they expire.
PREVIOUS COUNCIL ACTION: Approved the initial interim use permits for the properties listed below.

REQUESTED COUNCIL ACTION: Accept the recommendation of the Planning Commission and extend the interim
use permits for the following properties:
a. 119 College Avenue N
b. 34 College Avenue N
c. 104 -1St Avenue NW
d. 30 Birch Street E
e. 409 College Avenue N
Note: The above permits are renewed each year as are all other interim use permits.
Note: This item has been placed on the consent agenda as the Council has previously agreed to place
unanimous recommendations of the Planning Commission under the consent agenda. Please note that
no residents attended the public hearing and the City had no complaints on this property.

PREVIOUS PLANNING COMMISSION ACTION: The Planning Commission previously agreed to allow
the Interim use Permits to be renewed administratively provided the property did not have Ordinance
infractions.
BACKGROUND INFORMATION: The City staff processed the Interim Use Permit applications as can be
seen from the attached summary. All but one, Bryan Traut has completed the process. Several
attempts have been made to contact Bryan without resolve. Therefore it is recommended that the
Planning Commission terminate interim use permit for 329 — 4th Avenue SE.
Five of the Interim Use Permits are ones that have a three year expiration date which are eligible for an
additional three year extension. Last year the Council changed the expiration date so they all expired in
August of 2011. Staff is recommending that the Planning Commission recommend a three year
extension for the property listed, with an annual review as required by the Ordinance.

1. Terminate the Interim Use Permit for 329 — 4th Avenue SE due to lack of submission for renewal.

b. 34 College Avenue N
c. 104 —1s` Avenue NW
d. 30 Birch Street E
e. 409 College Avenue N
