JOSEPH PO BOX 668 St. Joseph MN 56374 320 -363 -7101 Jweyrens @cityofstjoseph. corn June 13, 2011 (4) Norbert Bechtold — Conditional Use Permit BACKGROUND INFORMATION: The property located at 30171 County Road 2 is included in the Orderly Annexation Agreement between the City of St. Joseph and St. Joseph Township. December 2010 the City and Township of St. Joseph executed an amendment the Orderly Annexation Agreement that changed the manner in which land use applications are considered. This hearing notice was originally sent by Stearns County as a hearing to be held before the County Planning Commission, but was canceled as the subject property is in the Orderly Annexation Area. Norbert Bechtold is requesting a conditional use permit to replace three (3) confinement barns and replace with two (2) new facilities, abandon an open lot, construct a slurry and increase the animal county from current 324.1 to 326. The Stearns County staff has reviewed the application and indicated that the requested meets the requirements of the Ordinance and Comprehensive Plan. In addition the matter has been reviewed by the Wetland staff and the feedlot committee who both have supported the approval. The staff at Stearns County has also stated that there is not an impact to the CR 2 Improvement project. I am waiting for confirmation from the Engineering staff. Q Ann Reischl Town Clerk �y0 G� City / Township of St. Joseph IN RE: Application of Norbert Bechtold ETAL Conditional Use Farming Operation FINDINGS OF FACT FINDINGS OF FACT AND DECISION On September 26, 2011 the St. Joseph City/Township Joint Planning Board conducted a public hearing to consider the application of Norbert Bechtold Etal to 1) Replace 32'x 40' partial confinement barn; 2) Replace a 32' x 72' partial confinement barn; 3) Replace a 16' x 100' partial confinement barn; 4) Abandon a 10' x 32' partial confinement barn; 5) Construct a 56'x 85' partial confinement barn; 6) Abandon a 3.85 acres open lot; 7) Construct a 81' diameter by 19' high slurry store; and 8) increase from 324.1 animal units to 326 animal units o dairy and beef cattle. The request for rezoning impacts parcel identification numbers 31.20687.000. The matter was duly published and notice was provided to property owners within 350 feet of the above referenced property. The Joint Planning Commission hereby finds the following facts as it relates to the request of Norbert Bechtold Etal for Conditional Use the aforementioned properties: 1. The subject property is zoned Industrial A -40 and the proposed conditional use permit is consistent with the Stearns County Zoning regulations and the Stearns County Comprehensive Plan. 2. The subject property is located in St. Joseph Planning District 5 and since the property is not being developed at this time the existing land use is allowed to continue as it currently operates. 3. The feedlot registered with Stearns County on September 29, 2009. 4. The proposed project when completed will address and satisfy runoff compliance issues from feedlot areas that flow to the Northwest towards the South Fork on Watab River. 5. Stearns County staff has indicated that the both the Feedlot Committee and Wetland Staff have reviewed and recommended approval of the conditional use permit. DECISION AND CONCLUSION Based on the foregoing Finding of Fact and Decision and Conclusion of the City /Township Joint Planning Board, the request for Conditional Use Permit for Norbert Bechtold is hereby approved with the following contingencies: 1. The owner shall maintain records of land application of manure as required by Minnesota Rules, Chapter 7020 or successor rules and Stearns County Ordinance #439. 2. The owner shall maintain the Manure Management Plan for the form per Minnesota Rules, Chapter 7020 or successor rules and Stearns County Ordinance # 439. 3. The applicant shall construct all proposed improvements according to engineering plans, specifications, and guidelines submitted with the application, unless otherwise approved by ESD or MPCA. 4. The open lot to the north of the South Fork of the Watab River will be maintained as pasture. Open lot during any season will be prohibited. 5. A berm will be constructed so as to protect the South Fork of the Water River in the event of a spill. 6. The applicant will secure all necessary permits. SITE INFORMATION: Location The feedlot is located in the SW4 of Section 9, T124N, R29W, St. Joseph Township Property This existing feedlot is located on a 159.55 acre parcel. County Zoning The site is zoned A -40, adjacent properties to the North, West are also zoned A -40. Adjacent property to the South and East is the city of St. Joseph. The property shares a common property corner with Commercial zoning to the Northwest. The Orderly Annexation Agreement between St. Joseph Township and the City of St. Joseph borders the parcel the East and South. Page 1 of 4 CONSISTENCY WITH THE STEARNS COUNTY COMPREHENSIVE PLAN: The following portions of the Comprehensive Plan are related to this application: LAND USE PLAN (Pg 3 -9) Goal 1: Sustain agriculture as a desirable land use for the long term. • Objective 1: Nurture and preserve a sound agricultural economy. Goal 2: Minimize land use conflict between agriculture and other land uses. Goal 5: Use existing infrastructure & resources efficiently. ADDITIONAL RELEVANT INFORMATION: The feedlot registered with the county on 9/29/2009. • The proposed project when completed will address and satisfy runoff compliance issues from feedlot areas that flow to the Northwest towards the South Fork on Watab River. • The applicant has a Manure Management Plan for the 2011 crop year. • An EAW, NPDES and SDS permit are not required at this time. • The site is not currently located in floodway, could be floodway in the future due to preliminary information. • Wetland staff reviewed site 9 -6 -2011, found no issues with proposed slurry store or berm to be located within current feedlot and pasture area. See attached memo. Feedlot Review Committee Recommendations: Page 2 of 4 Allison Remer went over the application & map that was handed out. Dale Walz asked if feedlot run -off was being addressed and commented that Stearns County Soil & Water Conservation District has worked with the family for ten years and that nothing had been done until now, he's glad something was being done. Dale Walz also stated that north of the river there is a large feedlot & asked if that was being addressed. Allison Remer stated that the applicant's have purchased another farm to house the cattle that were located on the lot north of the river, the lot will be used as pasture. Engineering plans for the slurry store were provided by Genex and the engineering plans will be reviewed by the MPCA. The open lot runoff for the site is being address by curbing, around open lots, a roofed structure over an existing open lot and the proposed slurry store. The applicant's have purchased another farm to house the cattle that were located on the lot north of the river. Becky Von Holdt suggested that the Feedlot review committee recommend placing a condition that the north lot be maintained as pasture. Earl Udermann asked about a proposed county road that is to go through the property, he had heard that the project is supposed to be done in 2012. Dale Walz agreed that the road issue should be addressed. Allison Remer stated that the proposed changes to the site would not further encroach the proposed road. Craig Roerick asked how big slurry storage is and asked about the capacity of the slurry store. Allison Remer stated that the proposed slurry store is a 81' diameter x 19' high, and that the storage will be addressed by the MPCA in their review. Becky VonHoldt mentioned that a condition was placed in a previous site's application that a berm be placed around the slurry store as added insurance. Allison Remer also stated that wetland staff had reviewed the slurry store location, with no concerns. Dale Walz stated they never applied for financial assistance for this. Mike Wehlage asked if a letter has been issued regarding compliance. Becky Von Holdt answered that there was a t least one letter issued in the past and another letter would be issued once compliance is verified. Dale Walz asked about stockpiling at the site. Allison Remer stated that stockpiling is to be done on adequate soils and or on registered open lots. Dale asked if CUP's are subject to review by Environmental Services. Becky VonHoldt replied that CUP's are subject to review and can be brought back to Planning Commission if a site is not following the conditions placed. A motion to bring the application to the Planning Commission & to proceed with staff recommendations with the 2 conditions (pasture conditions for the lot north of the river and a berm placed for the proposed slurry store) was made by Craig Roerick. Dale Walz seconded the motion. Motion passed unanimously. ACCESS: The farm has one driveway access off County. Road 2. Although the area would be identified as a Type 3 (shallow marsh) wetland, it could likely meet the incidental wetland standard found in the Wetland Conservation Act. The land surrounding the wetland is clearly not wetland and is in a topographically high position. The soil survey does not show soil as being hydric and the wetland is not listed on the National Wetland Inventory. 2) An incidental wetland is defined under MN Rules 8420.0105, Subp. 2 D as, "...wetland areas that the landowner can demonstrate, to the satisfaction of the local government unit, were created in nonwetland areas solely by actions, the purpose of which was not to create the wetland..." 3) The north end of the open lot near the fence line appears to contain Type 1 (seasonally- flooded basin) wetland. Construction of a berm designed to prevent waste water from entering Watab Creek, would likely meet at least 2 exemption standards. One standard states, "A replacement plan is not required for impacts resulting from agricultural activities in a wetland that was planted with annually seeded crops or was in a crop rotation seeding of pasture grass or legumes in six of the last 10 years prior to January 1, 1991. The other standard states, "A replacement plan is not required for projects that impact (less than) 400 square feet of type 1, 2, or 6 wetland outside of the building setback zone, as defined in the local shoreland management ordinance, but within the shoreland wetland protection zone." 4) As the project was explained to me, a slurry store will be located within the existing farm yard and a berm will be located along the existing fence line on the north side of the feedlot/pasture area. The berm will help contain waste water and divert it to the incidental wetland. The berm will help prevent waste water from the slurry store or feedlot /pasture from getting to Watab Creek. Number of Acres with Potential Development Considerations: 45 acres within this district have potential considerations for development (flood plain and public water). Areas of Stability and Areas of Change: Areas of stability and areas of change have been identified within this district. Portions of the district occupied by the Clinton Village, Park Terrace and Hollow Park subdivisions have been identified as areas of stability wherein the planning emphasis will be focused on protecting existing development from intrusion by incompatible uses. Areas with the potential for change have been identified in the western half of the planning district between the proposed CSAH 2 re -route and existing corporate limits. The city expects to direct resources (either new development or redevelopment, public and /or private resources) as available and /or requested to areas of change. Prominent Features Prominent features within Planning District Five include the Watab River, Clinton Village Subdivision, Park Terrace Subdivision, Hollow Park, St. Joe Townhomes, portions of the original townsite located west of Second Avenue NW, Memorial Park, and Old Highway 52. Existing Land Use Existing land uses primarily agricultural west of the current city limits. Within the city limits existing land uses include: single family residential, multiple family residential, and public parks. Proposed Future Land Use Portions of the eastern half of this district have been identified as 'areas of change'. Future investment, public and private, is expected within this district during the scope of this plan. Portions of the western half of this district have been identified as 'areas of stability' wherein our primary land use efforts focus on retaining the integrity of previously established neighborhoods. This district is truly the focus of transition, from existing to potential development and from residential neighborhoods to commercial and /or industrial uses in Planning District Two. Future uses within this district will reflect the transitional nature of the district. Areas in the vicinity of existing residential units are guided toward continued residential uses with density gradually increasing as they approach future commercial areas adjacent to the new CSAH 2 corridor. Light industrial business park clusters will be allowed in the CSAH 75 corridor.
