JOSEPH Council Agenda Item 6 (a -c) MEETING DATE: November 17, 2011 AGENDA ITEM: Planning Commission Matters SUBMITTED BY: Administration BOARD /COMMISSION /COMMITTEE RECOMMENDATION: Business Districts — The Planning Commission conducted a public hearing to relieve the requirement of a special use permit for drive thru business. The Planning Commission indicated that in a time when people are looking for convenience a drive thru is necessary. The only reason a special use permit was required was to insure that motor and pedestrian traffic and circulation is considered in site plans. The Planning Commission indicated that staff provides this review and a property owner should not be required a special process for consideration. Therefore they unanimously recommended the Council adopt the amended Ordinance. R1 Rental — The City has received requests to allow military personnel to rent their homes while deployed or serving on active duty. Since the legislature created a niche for homesteading based on military classification, the City can follow and allow an Interim Use Permit for rental purposes. The proposed amendment includes a time limit on the rental and required submittal to verify they qualify. T Parking Pads —The Council has asked that this matter be reviewed again. The Planning Commission has twice considered an amendment recommending approval both times, only to have the Council deny the amendment. The Planning Commission agreed to review again. PREVIOUS COUNCIL ACTION: Denied the recommendation to amend the parking ordinance. BACKGROUND INFORMATION: The Planning Commission conducted a public hearing on the R1 Rental provision as well and a number of realtors spoke requesting the City considering amending the Ordinance lifting the rental limitations. The Planning Commission agreed to consider the matter that was published and at a future meeting discuss the general provision. BUDGET /FISCAL IMPACT: ATTACHMENTS: Request for Council Action Ordinance Amendment — Business District Ordinance Amendment — R1 Single Family Previous Parking Pad Ordinance REQUESTED COUNCIL ACTION: The adoption of the business district and R1 provision will require two separate actions, one approving the amendment and one approving the summary publication.
