NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Joint Planning Board of the
St. Joseph Township - City of St. Joseph will hold a public hearing on
Monday, February 13, 2012 at 7:40 p.m. or as soon as possible thereafter in
the Town Hall to consider the petition of Rothfork Associates, Melrose MN
and St. Joe Sand and Gravel, St. Joseph, MN to plat "St. Joe Sand and
Gravel" in Section 3 and 4 of the St. Joseph Township.
All interested persons are invited to attend.

Lot Size and Density Requirements
The acreage within the plat is 27.91 acres. The property is zoned Urban Expansion (UE).
Property is not being platted as a residential lot so no equivalent land area is required. The
property is currently being used as an existing gravel pit and was registered in 2004 as a pre -
ordinance mining operation.
Soil Suitability
Septic system areas: No septic areas need to be identified since no sewage treatment will be
needed.
Building Site: No buildings are being proposed. All setbacks for existing buildings on the
residual parcel are met.
Wetlands
There are National Wetland Inventory wetlands within the plat. No wetland impact is allowed
without prior approval.
Feedlot Setbacks
Feedlot setbacks are met.
Zoning Standards for Placement of Structures
Not applicable.
Road Access
Property will have a deeded easement to County Road 2. This will be recorded with final plat.
Drinking Water Supply Management Area(DWSMA)
The property is located in the City of St. Joseph DWMA and City of St. Cloud Priority Area A.
No change in use is being proposed within the plat. Stearns County Soil and Water Conservation
District provided the following comments, "encourage St. Joe Sand and Gravel to practice good
housekeeping, meaning storage of gasoline and/or other potential contaminates are not exposed
to the elements and is placed off site, don't store equipment and vehicles in the gravel excavation
area."
Other
The residual parcel contains turkey barns and several driveways. The impervious lot coverage of
the residual parcel will be over the 25% lot coverage limit. The property owner is proposing to
vegetate several of the driving surfaces. In addition, the property owner will attach 5.45 acres
from the property to the north to the residual parcel to come into compliance with the impervious
lot coverage requirement. The property owner plans to complete the re- vegetating by June 1,
2012. This is further addressed in the proposed Subdivision Agreement/Developers Agreement
below. The attached plan shows the area to be re- vegetated and the 5.45 acres to be attached.
Comments
Suggested conditions to be required with the final plat submittal:
A
1. Require that a Subdivision Agreement/Developers Agreement be entered into with the
Joint Planning Board and the Developer and be recorded with the plat stating the
following:
a. That in order to avoid future impacts to wetlands within the plat of St. Joe Sand and
Gravel the developer agrees that the deminimus exemption found in Minnesota Rules
8420.0420 subpart 8; or successor rules, shall not be used for the purposes of draining
or filling wetlands located within said plat.
b. A drinking water well shall not be installed or used within the plat St. Joe Sand and
Gravel.
c. Property use shall be non - residential only.
2. An ingress /egress easement is required to provide Lot 1 Block 1 access to County Road 2.
This shall be submitted with the final plat.
3. A current title opinion or title commitment shall be submitted with final plat
4. Complete the re- vegetation as shown on the attached plan by June 1, 2012. The re-
vegetation shall consist of working up the soil, adding a minimum of 4 inches of top .soil
and seeding.
5. Consider requiring a financial guarantee (letter of credit, cash escrow or bond) to guarantee
the site is re- vegetated according to the plan submitted.
6. The administrative subdivision to attach 5.45 acres to the residual parcel shall be recorded
with the final plat.
