The property in question is described as follows: Lots 004 and 005 Block 001 in Section 12 Twp 124 Range 029 in the St. Joseph Industrial Park. All interested persons are invited to attend. Ann Reischl Town Clerk St. Joseph Joint Planning Board IN RE: FINDINGS OF FACT Application of Tom Dullinger AND DECISION Conditional Use Permit, Transfer Station FINDINGS OF FACT On March 13, 2012 the St. Joseph Joint Planning Board conducted a public hearing to consider the application of Tom and Susan Dullinger to secure a Conditional Use Permit to allow the construction of a facility to operate a transfer station. The property is located at 8232 Delta Circle and the matter was duly published and notice was provided to property owners within 350 feet of the above referenced property. The St. Joseph Joint Planning Board acknowledged the following information in consideration of the request for Conditional Use to allow for the construction of a facility to operate a transfer station: 1. The subject property is currently zoned Industrial and located within the St. Joseph City/Township Orderly Annexation area. 2. The applicant currently owns and operates Reliable Rolloff which has been in business for 14 years. Reliable Rolloff provides ten (10) yard dumpsters for homebuilders, remodelers, and residential cleaning which is currently operated at the address stated above. 3. The property owner has a desire to promote and manage his business by recycling, reusing or donating useable items. The proposed facility would allow the dumpsters to be located inside a warehouse were the material can be filtered. 4. The proposed use is consistent with the Stearns County Comprehensive Plan an meets the goal of encouraging industrial development within existing communities, including redevelopment of existing sites and filling of industrial and business parks. 5. The proposed use will require the construction of 20' x 20' addition to the existing office and a 50' x 70' addition to the existing storage space. 6. The proposed expansion can and will meet all zoning setback and site regulations including impervious surfacing. DECISION AND CONCLUSION Based on the Finding of Fact, the St. Joseph Joint Planning Board approves the request Tom and Susan Dullinger to secure a Conditional Use Permit to allow the construction of a facility to operate a transfer station based on the following: 1. The property will conform to all the performance standards identified in Stearns Couty Ordinance #439 or successor Ordinances. 2. The impervious surface plan submitted with the application will be implement no later than August 1, 2012. The re- vegetation shall consist of working up the soil, adding a minimum of 4 inches tope soil and seeding. 3. A financial guarantee in the form of a letter of credit, cash or bond equal to 125% of the impervious plan cost must be submitted to Stearns County prior to issuance of a construction site permit. 4. If there will be running water within any part of the structure, a sub - surface sewage treatment system permit must be submitted no later than June 15, 2012 and installed within 10 months of the date of this resolution. 5. All required solid waste transfer station licenses /registrations shall be obtained from Stearns County and the Minnesota Pollution Control Agency. 6. Any material stored outside must be contained within dumpsters and no more than 1 0 dumpster shall be located outside at any given time. By Secretary Stearns County Environmental Services Board of Adjustment Staff Report Date: February 8, 2012 File: 12 -03 Name of Applicant: B & K Properties of St. Joseph, I:LC TWP: St. Joseph DBA: C & L Excavating Parcel #: 31.20801.0020 Relevant Facts: C & L Excavating built the existing structure in 1999 before the enactment of Stearns County Zoning Ordinance and related road setback requirements. The applicants applied for and received a construction site permit for a 48 foot by 84 foot addition to the work area in 2002 to accommodate growth. That addition was able to meet all setback requirements. The property is Zoned Industrial. The existing office area is 16ft x 24ft extension toward the road. C & L Excavating needs to expand the office area and is proposing to attach a 24 foot by 24 foot addition which would be located 59 feet, at the closest point, to the centerline of County Road 134 which is also known as Ridgewood Road. This section of County Road 134 is classified as a Minor Collector road. The expansion will consist of attaching a used 24 foot x 24 foot structure that can match up to the existing roof line. The structural setback requirement on a Minor Collector road is 100 from the centerline. The proposed expansion will be located outside of the road right -of -way. The proposed addition will also encroach into the Great River Energy electrical line easement, and Great River Energy has been notified of the encroachment (see attachment). Comments: 1. The proposed setback request is a 41 % deviation from current zoning requirements. One of the goals of the Comprehensive Plan is to assist businesses with expansion possibilities. 2. The applicants are proposing to use the property in a reasonable manner. 3. The need for the variance request arises in part due to the fact that the Zoning Ordinance was enacted after the existing office was already located 83 ft from the centerline of the road and it is due to growth of the business and the subsequent need to expand the office. 4. The only option for office expansion would be to the east of the existing office and that proposal would be cost prohibitive because of the need to change the roofline. 5. The issuance of the variance will not change the essential character of the locality, as the area is Zoned Industrial, and the proposed expansion is outside of the road right -of —way. 6. While economics is a consideration of the proposal, cost of changing the structure, this is the only feasible location for an expansion of the office. Alternatives /Recommendations: 1. Staff recommends that a condition of the variance, if granted, is that the Encroachment Agreement with Great River Energy is executed and recorded prior to the issuance of the construction site permit. 2. As you know, I have been talking with Troy Freihammer and Kurt Hoffman from MPCA about starting a transfer station. Reliable Rolloff has been in business for 14 years setting 10 yard dumpsters for.Homebuilders, remodelers and residential cleanouts. I was General Manager for BFI St Cloud, BFI Rochester and Superior Services before starting on my own. It has always bothered me how much recyclables are thrown away in construction, remodeling and estate cleanouts. Because it is time consuming for a builder or someone doing an estate cleanout to take everything to the proper site to get rid of, would like to add on to my existing building so that I can recycle, reuse or donate those loads I haul which have a lot of recyclable material, and also to allow residents with small trailer loads to dump in my building, which I also would hand sort into appropriate containers. The things I will take out of a load will be aluminum, steel, cardboard, concrete, electrical wiring, wood and everything that can be donated (clothes, shoes, books, etc.) I will also take out partial full paint cans, chemicals, appliances etc. and take these to the appropriate disposal sites. I am currently in a 50'x 124' building. I would use 64' on the north side of building and extend an additional 70' to the north. The north wall would be taken out of existing building. The new addition would be 50'x 70' with 20' sidewalls. I would also build a 20'x 20' office attached to existing building. JOSEPH INDUSTRIAL PARK EAST PROTECTIVE COVENANTS 1/15/2004 The Protective Covenants originally recorded as document number 1086804 on October 24 2003 in the office of the Stearns County Recorder are being amended to change the set back requirements as outlined in paragraph one(1) of the Protective Covenants. The set back requirements are hereby amended so that all structures crec:ed on the property shall be set back a minimum of Thirty(30) feet from the t' property line and a minimum of twenty(20) feet from the side of each proper. y line. MGJR Development, LLC is the Developer and Owner (hereinafter called "Developer" and/or "Owner ") of certain real property located in Stearns County, Minnesota, and legally described in the attached Exhibit A (hereinafter the "property "). The owners of the property are developing the property as an industrial park an i want to insure the best use and most appropriate development and improvement of building sites within the property. Therefore, the real property describi'c in Exhibit A is subjected to the covenants, restrictions, conditions, resor•ations, liens, and charges hereby declared. Both induttrid and commercial uses are permitted, provided that such uses are in compliance with all zoning laws as defined by the St. Joseph Township and Stearns County, Minnesota. These covenants are to run with the land and shall be binding on all parties and all persons until 611.'2023. After that date, said covenants can be amended by a vote of the majority of the then owners of :lots' or tracts. A majority by both number of lots and area is necessary. Said amendment shall become,effective when an appropriate document is filed with the Stearns County Recorder. After 6/1/2023 these covenants will continue and renew annually. The owner or operator may he required to submit a financial guarantee to the County to ensure compliance with the permit and the closure requirements. No.one is allowed to enter this transfer except my own trucks and pickup trucks and cars with trailers. Since the roadway is built foe industrial traffic, I believe there would be no problems. B. Total of both lots is approximately 89,910 sq. ft. The building with addition and office is 10,100 sq. ft. C. The facility has a 50'x60' maintenance shop with heated floor (water boiler). I change oil in trucks, grease, repair tires etc. We also grind, weld and paint containers that need repair. I have engine oil in 55 gal. barrels (1 for used & 1 for new), and a parts washer. All fluids are disposed at an East Side Oil Company Collection site a mile away (Beeline Marine). 1 have a 500 gallon fuel tank supplied by Schwagel Distributing in the cold storage side of my building for fueling trucks. I have a satellite toilet that is maintained by Nelson toilet every Wednesday. Two security lights are on existing building for lighting. Hours of operation will be 8:OOam to 4:30pm Monday- Friday. 8:OOam to 12:OOpm on Saturday. D. I don't expect more than 10 cars or pickups a day, so there won't be a traffic problem. Everything else is moved sooner. If something was dumped that would stink it would be a small amount and would be removed immediately. Access to the building, unloading area and leaving will be done on asphalt so dust management will be controlled. Sound and vibration will be from a'skid steer used for sorting and loading containers. Most of the work will be done in building and most of the sorting will be done by hand. I will dump about 3 loads on average a day from my trucks and about 3 small vehicles a day will dump their loads during daylight hours. P. CONDITIONAL USE PERMIT REQUEST Solid Waste Transfer Station Application Date: January 25, 2012 File No: 12 -02 Parcel No.: 31.21403.0003 31.21403.0004 Applicant /Owner: Tom Dullinger PO Box 848 St. Joseph, MN 56374 Description of proposal: The applicants are requesting to start a solid waste transfer station. They plan to construct 2 additions to their existing building, a 20'x20' office and a 50'x70' sort area. The property is zoned Industrial (I) and the request is reviewed for compliance with Sections 6.52.2 and 9.11.5 • R of Stearns County Land Use and Zoning Ordinance #439. Location of Property: The property under consideration is Lots 4 and 5 St. Joseph Industrial Park East, Tying westerly of Delta Circle in Section 12, St. Joseph Township (124/29). The property address is 8232 Delta Circle, St. Joseph MN. County Zoning: Industrial District Lot Size: The entire property is 2.01 acres. Topography: The property is relatively flat. Access Management: Access will be from Delta Circle. Building Placement and Coverage: See attached site plan for proposed structure placement. All setbacks will be met. The applicant will need to vegetate a portion of the property in order to stay at or below 60% impervious lot coverage. See the enclosed impervious plan. Stormwater Management: A stormwater management plan is not required since there will not be 1 acre of new impervious surface created. Wetlands: There are no National Wetland Inventory wetlands or hydric soils on the property. Septic system: Currently there is no septic system on the property. The applicant uses a satellite toilet serviced weekly by Nelson's Toilet. If there is running water in the current building or in the proposed additions, a septic system is required to be installed. Drinking Water Supply Management Areas: The property is located within the City of St. Cloud Drinking Water Supply Management Area. Notification of the request was sent to the City of St. Cloud and the Soil and Water Conservation District. If any comments are received, they will be forwarded to the Joint Planning Board. Performance Standards: See enclosures which address the performance standards from Section 6.52.2 of Ordinance #439. Consistency with Comprehensive Plan: This proposal is consistent with the County the Comprehensive Plan. Chapter 7 Economic Development Plan Goal 1. Maintain and strengthen economic diversity. Objective 2. Encourage industrial development within existing communities, including redevelopment of existing sites and filling of industrial and business parks. Future Land Use Map: Urban Expansion The Urban Expansion category is described as: "Areas anticipated to be annexed and provided With municipal services during the time frame of this plan. Also includes areas under Orderly Annexation Agreements. Variety of land uses to be determined through joint city- township planning. Residential uses remain restricted until annexation occurs. Limited commercial /industrial uses may be considered." Policy Area: The Metropolitan Area: The multi- county St. Cloud Metropolitan area will continue to attract a substantial portion of the region's jobs and population growth. It will also be the location for most major transportation projects, as planned and programmed by the St. Cloud Area Planning Organization (APO). This policy area generally encompasses the boundaries established by the 2000 St. Cloud Area Joint Planning District plan, with some adjustments to the "ultimate service area" for wastewater treatment. Policies: 1. Support and update the policies of the Joint Planning District plan regarding regional coordination of services. 2. Support extension of coordinated, centralized wastewater treatment to the ultimate service area. 3. Protect the ultimate service area from premature subdivision by limiting large - lot residential development. 4. Support transit improvements, including the Northstar Commuter Rail extension. Recommended Action: The Department recommends the Joint Planning Board consider the following conditions: 1) All performance standards in Stearns County Ordinance #439 or successor ordinance shall be followed. 2) The approved impervious plan shall be implemented by August 1, 2012. The re- vegetation shall consist of working up the soil, adding a minimum of 4 inches of top soil and seeding. 3) A financial guarantee in the form of a letter of credit, cash deposit or bond equal to 125% of the impervious plan costs shall be submitted to the Township or City prior to issuance of a construction site permit. 4) If there will be running water within any part of the structure, a sub- surface sewage treatment system permit shall be applied for by June 15, 2012 and installed within 10 months of final approval of the conditional use permit. 5) All required solid waste transfer station licenses /registrations shall be obtained from Stearns County and the Minnesota Pollution Control Agency.
