JOSEPH 25 College Avenue North PO Box 668 St. Joseph, MN 56374 -0668 SUBJECT: NORTH CORRIDOR AND CSAH 2 REALIGNMENT STUDY CONTRACT AMENDMENT No. 2 Dear Ms. Weyrens: The purpose of this letter is to document Amendment No. 2 to our original Professional Services Agreement for the North Corridor and CSAH 2 Realignment Project. The original contract was executed October 31, 2005 between the City of St. Joseph and SRF Consulting Group, Inc. BACKGROUND The original contract was previously revised on October 30, 2008 by Amendment No. 1, which modified the type of environmental documentation to be completed for the study. Amendment No. 1 documented that three separate environmental documents would be completed for discrete segments of the study area: 1) an EAW for the CSAH 2 realignment 2) an EIS Scoping Document and Scoping Decision Document for the CSAH 3 to CSAH 133 segment of the North Corridor and 3) an EA/EAW for the CSAH 133 to Rolling Ridge Road segment of the North Corridor. In accordance with Amendment No. 1, SRF completed the EAW, the draft Scoping and Scoping Decision Document, and the draft EA/EAW by March 2009. The EAW was subsequently approved by MnDOT. The other two documents were forwarded to MnDOT and FHWA for comment, however, no action was taken by either agency per a new interpretation of federal National Environmental Policy Act (NEPA) policy. FEDERAL POLICY Amendment No. 2 is prompted by this unforeseen Federal Highway Administration (FHWA) policy decision regarding the agency's approval of EAs and Scoping Documents. Based on this policy FHWA's Minnesota Division staff has determined that a project must identify financial commitments for future project phases, and these commitments must be included within a regional or statewide plan before a NEPA document can be approved. www.sr fconsulting.com One Carlson Parkway North, Suite 150 1 Minneapolis, MN 55447 -4443 1 763.475.0010 Fax: 763.475.2429 An Equal Opportunity Employer Ms. Judy Weyrens - 2 - April 23, 2012 City of St. Joseph According to the FHWA policy: "All project phases (i.e., preliminary engineering, final design, right -of -way acquisition, utility relocation, construction, and /or construction phasing) planned within the life of the transportation plan must be included in the fiscally constrained Metropolitan Transportation Plan (MTP) in order for FHWA to sign the Record of Decision (ROD), Finding of No Significant Impact (FONSI) or approve the Categorical Exclusion (CE)...The Metropolitan Transportation Plan must demonstrate that revenues are reasonably expected to be available and sufficient to cover the costs of the entire project (all phases) (i.e., preliminary engineering, final design, right -of -way acquisition, utility relocation, construction, and/or construction phasing) that are included in the plan." Thus, FHWA's policy required that a financial commitment for a phase of the North Corridor Project be made and documented in approved APO and MnDOT's programming documents (TIP /STIP) before FHWA would review /approve of NEPA environmental document for the project. Over the past months, the City and APO staff have worked diligently to make the necessary financial arrangements to meet the FHWA policy requirements. As a result, the federal requirements can now be met. However, over this period the three year life of the environmental documentation has lapsed, and must be updated. AMENDMENT NO. 2 SUMMARY Amendment No. 2, cooperatively developed by the City, APO and SRF, accommodates the new situation. Amendment No. 2 includes: 1. Updating only the draft 2009 EA/EAW for the eastern North Corridor Alignment (from CSAH 133 to Rolling Ridge Road) to reflect new data, new state /federal requirements, new future traffic forecasts generated by the APO's latest travel demand model; and reinitiating the state /federal coordination and review process, which was previously placed on hold due to the federal fiscal constraint requirements. 2. Deleting the original official mapping task for the North Corridor because it will no longer be needed; as ROW for thisncor�icbae purchased using federal segment CSAH 133 to of Rolling Ridge Road) will p the EA/EAW. 3. Deleting further work on the EIS Scoping Study and Decision Document, for the western North Corridor alignment (CSAH 3 to CSAH 133); and instead adding a small task to the revised contract that will provide by technical memo a construction cost estimate (current 2012 value) for the eastern North Corridor Alignment. The attached Scope of Work which encompasses these contract modifications is provided as Exhibit A. SRF will perform these services in accordance with the rates of compensation presented in Exhibit A. Ms. Judy Weyrens - 3 - April 23, 2012 City of St. Joseph BUDGET According to the billings incurred to date in connection to the North Corridor and CSAH 2 Realignment Professional Services Agreement between SRF and the City there is approximately $41,400.00 remaining budget. SRF agrees to perform tasks and services set forth in Exhibit A. Based on these estimates, the Scope of Services can be completed for $37,059.19 which is less than the remaining contract funds available under the North Corridor and CSAH 2 project. Thus, while no additional contributions by the City or APO will be needed, there will be a small amount of contract funds remaining, in case unanticipated costs arise or some minor additional services are desired. None -the -less, SRF will only bill for work performed and this could leave an amount of unexpended funds in the contract. COUNCIL APPROVAL Upon City Council approval of this amendment, SRF will prepare a new contract for the services and budget included in Exhibit A and this letter. We will begin work upon authorization from the City and will complete the project within the mutually agreed upon time schedule.
