Council Agenda Item 10(a) MEETING DATE: May 17, 2012 AGENDA ITEM: Lot Split Request Central MN Credit Union SUBMITTED BY: Administration BOARD /COMMISSION /COMMITTEE RECOMMENDATION: PREVIOUS COUNCIL ACTION: The St. Joseph Professional Plat was recently platted with three parcels. At the time of platting the developer anticipated the fast food company purchasing the entire tract that abuts CR 133. BACKGROUND INFORMATION: Approval of the lot split does not convey development rights or site plan approval. The fast food company needs to close on the property before the site plan can move forward. Attached to this packet is the site plan for the company; however, it has not been reviewed for Ordinance compliance. The staff is in the process of completing that task. The Ordinances allow a onetime minor subdivision so the request before the Council is consistent and allowable by Ordinance. BUDGET /FISCAL IMPACT: The lot split will allow the development of the front parcel in summer 2012, increasing the tax base. This page intentionally left blank Certificate of Compliance To: Stearns County Auditor's Office The undersigned Administrator for the City of St. Joseph does hereby certify that the City Council reviewed and approved at its regular meeting on the 17 clay of May 2012, a lot split dividing the north 248.99 feet from Lot 1 Block 1, St. Joseph Professional Plat creating two separate parcels. The lot split has created the following two legal descriptions: Tract A That part of Lot 1, Block 1, ST. JOSEPH PROFESSIONAL PLAT, according to the recorded plat thereof, Stearns County, Minnesota, lying northerly of the following described line: Commencing at the northeast corner of said Lot 1; thence South 00 degrees 05 minutes 30 seconds East, record bearing, along the east line of said Lot 1, a distance of 248.99 feet, to the point of beginning of the line to be described; thence South 89 degrees 54 minutes 30 seconds West, 181.78 feet, to the west line of said Lot 1 and said line there terminating. Tract B That part of Lot 1, Block 1, ST. JOSEPH PROFESSIONAL PLAT, according to the recorded plat thereof, Stearns County, Minnesota, Tying southerly of the following described line: Commencing at the northeast corner of said Lot 1; thence South 00 degrees 05 minutes 30 seconds East, record bearing, along the east line of said Lot 1, a distance of 248.99 feet, to the point of beginning of the line to be described; thence South 89 degrees 54 minutes 30 seconds West, 181.78 feet, to the west line of said Lot 1 and said line there terminating. The attached survey described and illustrates the lot split requested. The transfer is in compliance with the Zoning Ordinance and Subdivision regulations of the City of St. Joseph.
