JOSN:YH �� Council Agenda Item 8(c) MEETING DATE: June 7, 2012 AGENDA ITEM: Ordinance Amendment — Off Street Parking SUBMITTED BY: Administration BOARD /COMMISSION /COMMITTEE RECOMMENDATION: The Planning Commission conducted a public hearing on the amendment to the Off Street Parking Ordinance defining where parking pads can be located and how they are to be constructed. No one was present at the public hearing for this amendment and the motion to recommend was unanimous. PREVIOUS COUNCIL ACTION: BACKGROUND INFORMATION: Since this is an Ordinance Amendment, it will need to be approved and published before implementation and will require two separate actions. The first action is approving the Ordinance Amendment and the second is approving the summary publication. ATTACHMENTS: Request for Council Action Draft Ordinance Ordinance Amendment Summary Publication — Resolution 2012 -011 REQUESTED COUNCIL ACTION: Authorize the Mayor and Administrator to execute Resolution 2012 -011 and and cause the same to be published. THIS PAGE INTENTIONALLY LEFT BLANK • AMENDMENT TO ORDINANCE 52.10 OFF STREET PARKING The City Council for the City of St. Joseph hereby ordains that the sections of Ordinance 52.10 below have been amended as follows: Subd. 7: Parking pads for Residential Units in All Zoning Districts a) Any off- street parking facilities to residential uses shall feature improved surfaces as defined in section 52.10 subd 3(n) of this Ordinance and shall be made part of or adjacent to the existing driveway and/or located in the side yard. For the purpose of this section a driveway shall be defined as a private way for vehicles leading from a public right -of -way to an off - street parking facility_ b) Off- street parking facilities located in the side yard as defined in Section 52.04 Subd. 116 of this code shall be improved to provide a durable and dust -free surface consisting of concrete, asphalt, pavers or similar materials. Class 5 material is not an accepted material. Off - street parking shall not be permitted in easements areas. c) Existing driveways not currently improved to a durable and dust free surface are not required to be upgraded unless it is determined that the current driveway surface materials are washing into the public street causing a nuisance. Any expansion to an existing gravel driveway shall be improved to a hard surface roadway and must be constructed of a hard surface consisting of concrete, bituminous, or pavers which could be designed to drain and to dispose of surface water d) In no circumstance shall the site coverage exceed the maximum impervious surface for each specific zoning district. For R1 single family zoning districts the impervious surface shall not exceed the limits identified in Section 52.27 subd 9(c). This amendment is adopted the day of , 2012, and shall be effective upon publication. CITY OF ST. JOSEPH BY Rick Schultz, Mayor BY Judy Weyrens, Administrator These amendments were published on , 2012 RESOLUTION 2012 -011 RESOLUTION AUTHORIZING SUMMARY PUBLICATION OF AMENDMENT TO ORDINANCE 52.10 (Off Street Parking) RECITALS: WHEREAS, on June 7, 2012, the City Council for the City of St. Joseph amended Ordinance 52.10, entitled "Off Street Parking "; and WHEREAS, the City of St. Joseph desires to publish the Ordinance by Summary Publication; and WHEREAS, the proposed amended prescribes the location and material for parking pads on front and side yards. THEREFORE, IT IS HEREBY RESOLVED: 1. The City Council has reviewed the proposed Summary Publication and finds that the summary of the Ordinance clearly informs the public of the intent and effect of the Ordinance. 2. The City of St. Joseph directs the City Administrator to publish the Ordinance by Summary Publication. Adopted this day of , 2012, by a vote of in favor and opposed. CITY OF ST.
