Rezoning, Cory Ehlert

The following packet includes information for the land use request of Cory Ehlert. Two land use
applications were received, one for rezoning and one for concept plan approval. The Joint Planning
Board has final authority over all matters with the exception of rezoning. Therefore, the matter before
the Board will require separate actions with the request for concept plan considered at a future
meeting.
Zoning Considerations -
As you may recall, the decision of the Board must be based on Findings of Fact and typically a shell of
the findings will be provided for consideration. In considering the zoning the Board should consider the
following items:
• Is it consistent with the intent of the Orderly Annexation Agreement
• Is it consistent with the Comprehensive Plans of the County and City. How does the
proposed zoning relate the projected future land use for the City?
• Does the proposed zoning provide for efficient and cost effective utility extensions in
the future?
• Is the proposed zoning considered spot zoning?
Concept Plan -
Action on the concept plan should not occur at the meeting on Monday night as the Zoning will have to
occur first. Findings of Fact will have to prepared for this matter as well and the shell will be prepared
after the Zoning matter is resolved.
