Ordinance Amendments

PREVIOUS COUNCIL ACTION: The Council has been discussing amending the Keg Ordinance to require
permits for all kegs within the City and to create two new ordinances one entitled Social Host and the other
Disruptive Intoxication. The Ordinances are tools for the police department in managing alcohol related incidents.
The Council requested that a public hearing be conducted on January 17 to solicit public input. The hearing notice
was advertised in the St. Joseph Newsleader and placed as a newsflash on the City Website.
BACKGROUND INFORMATION: Each of the Ordinances require two separate actions, one approving the
Ordinance or Amendment and the second approving the summary publication. The Social Host Ordinance
indicates that it becomes effective upon 30 days of adoption and publication. The other two ordinances can
become effective upon publication. For simplicity it is suggested that any of the Ordinances that are adopted
become effective on March 1, 2013. If the keg permitting is approved this would provide ample time to order
permits.
If the Keg Permit amendment is adopted the Council should establish the permit fee for which staff recommends $
5.00.

REQUESTED COUNCIL ACTION: Conduct the public hearing and if appropriate authorize execution of the
resolutions and establish the keg permit fee at $ 5.00 if adopted.
