The Building Official sent a notice and the property owner did not acknowledge the correspondence. On April 12 on the St. Joseph Officers hand delivered a notice to the property owner at 111 Ash St E informing him that he had a potential safety hazard and the building needed to be removed. The officer explained the situation and the property owner indicated that he some personnel issues that would prevent immediate action and requested an additional couple of weeks. The City has tried to contact the property owner without avail and the adjacent neighbors continue to experience debris flying around the area. Due to lack of response, the City is requested to move forward with formal action to demolish the building and assess the cost to the property owner. In discussing the matter with a local contract, the cost to remove the building will be about $ 1500. Minnesota Statute 463.17 gives the City authority to remove the building and provides the process for the same. The first step in the process is adopting a resolution to proceed under MN Statute 463.17 or abatement of a hazardous building at 111 Ash Street E. This page intentionally left blank CITY OF ST. JOSEPH COUNTY OF STEARNS STATE OF MINNESOTA RESOLUTION TO PROCEED UNDER MINN. STAT. §463.17 FOR ABATEMENT OF HAZARDOUS BUILDING AT 111 ASH STREET, ST. JOSEPH, MINNESOTA WHEREAS, the accessory building located at 111 Ash Street, St. Joseph, Minnesota has suffered damaged related to excessive snow fall this Spring. The property is legally described as follows: Lot 5, Block 2, LOSO'S 5TH ADDITION, according to the plat thereof on file and of record in the Office of the Stearns County Recorder. PID: 84.53697.0000 The record owner of the property is Karl L. Kosel, a single person. WHEREAS, as a result of the excessive snow fall, the roof of the accessory building has collapsed. The accessory building has been exposed to the elements for the past several months and has sustained structural damage; WHEREAS, the accessory building is in an unsafe condition for occupation; WHEREAS, the City Building Official has delivered two letters to the owner requesting immediate repair of the building and the condition of the building has not been abated; WHEREAS, the because of inadequate maintenance, dilapidation and physical damage, the accessory building constitutes a fire hazard and a hazard to public safety or health of the residents of St. Joseph; and WHEREAS, it is in the best interest of the public safety and health that an Order be served on the landowner and lien holders directing that the accessory building be repaired or razed; NOW, THEREFORE, BE IT RESOLVED that the Council of the City of St. Joseph declares the above - described residential dwelling to be hazardous in accordance with Minn. Stat. §463.17 and directs the City Attorney to draft an Order directing the owner to commence repairs within fourteen (14) days of service of the Order and to Complete said repairs or to raze or remove the accessory building within thirty (30) days of service of the Order. BE IT FURTHER RESOLVED that if said Order is not complied with, the City Council authorized the City Attorney to commence proceedings in District Court and move the Court for enforcement of the Order. PASSED AND ADOPTED by majority vote of the St. Joseph City Council this day of June, 2013.
