BACKGROUND INFORMATION: As part of this project,Graceview Estates was assessed, impacting the outlots or future development areas. There were two separate outlots labeled outlot A,both owned by Pond View Ridge LLP. The property owners were notified of the assessment and they opted to have the assessments placed on the property. Shortly after the property was assessed, the economy turned and development has slowed, leaving the lots undeveloped. While Pond View Ridge LLP is on entity, there were two partners with each partner having interest in a different outlot. When the tax statements came out Bob Herges contacted the City Offices discussing if the assessments were correct, which was an annual discussion. The assessments were moved a couple of different times after the conversations with the property owner(See August 7, 2012 Letter). Sometime after the August 7, 20121etter,Bob Herges bought out the interest in the outlot,PID 84-53533- 0161 and when the assessment search was completed it did not show an assessment. Bob is requesting that the City waive the interest and penalties that were assessed as he indicated he did not know that he owed assessments. The matter has been reviewed by the City Attorney and the assessment amount cannot be changed as the time period for contesting an assessment is long past. The City completed all the required notifications and processes required. The City could consider absorbing the delinquent charges in the amuunt of$ 10,245.17. BUDGET/FISCAL IMPACT: $ 10,245.17 ATTACHMENTS: Request far Council Action August 7,2012 Correspondence REQUESTED COUNCIL ACTION: Discussion as to whether to relieve the property owner the delinquent charges. The parcel# should have been#84-53533-0106. The remaining assessments on parcel#84-53533-0107 was reallocated to parcel #84- 53533-0106 in November 2410; however, the assessments prior to the 2010 reallocation remained delinquent to parcel #84-53533-0107(2007-2010 settlements). T'he delinquent assessments along with the remaining assessments due should all have been moved to parcel#84-53533-0106, Graceview Estates Outlot A. In 2010 the City also requested the remaining assessments on parcel #84-53533- 0161 ($50,193.45)be moved to parcel#84-53533-0106. This was in enor. Assessments for parcel #84-53533-0161, Graceview Estates 2 Outlot B, should have remained under parcel#84-53533-0161. Please put the delinquent and . remaining assessments from the$50,193.45 (Nov. 2010 remaining balance)to parcel #84-53533-0161. The assessments plus penalties and interest for 2011 and 2012 should be applied to parcel #84-53533-016]. I prepared a spreadsheet to show the assessments paid/unpaid each year. I tried to split out the payments from each parcel paid with a tie back to the parcel the payment belonged to. You will notice the assessments paid are in green and the unpaid assessments are in pink. Penalties and interest were paid in 2010 for the second half assessments due in 2008 for parcel #84-53533-0161. I do not show i any other payments of penalties and interest for the delinquent assessments. ZS College Avenue North • PO Box 668 • Saint oseph, Minnesota 56374 Phone ;zo.363.7zo Fax 3ao.363.o34z Please let me know if you need further clarification of these assessments.
