PREVIOUS PLANNING COMMISSION ACTION: The Planning Commission and City approved a
development plan for the construction of McDonalds at the intersection of CR 133 and CR 75. The
development plan included an advertising sign that was within the Ordinance provisions.
BACKGROUND INFORMATION: McDonalds has requested a variance to construct a pylon sign,
which is currently prohibited by the Ordinance. In granting a variance the Planning Commission must
develop findings of act and must make an affirmative finding on all the criteria established by MN
Statute. In the packet is a variance worksheet which identifies the criteria so that when you review the
material you can determine whether or not the request meets the Statute.
For your convenience attached are the applicable Ordinances, included the Corridor Overlay as this
property is located within the district.

Sign Variance
Administrator The St.Joseph Planning Commission will be conducting a public hearing on Monday October 7,
�udy Weyrens 2013 at 7:05 PM in the St.Joseph City Hall,25 College Avenue N to consider a fifteen foot
variance on the maximum height of a sign and to allow a pylon sign. St.Joseph Code of 52.32
subd. 11(b)(5]states: The maximum height of a Business Sign shall be feet 15 feet in height;
Mayor and section 52.32 Subd. (d)states:Advertising or pylon signs shall not be permitted. The
R�ck Sch�lcz variance is being requested to allow the construction of a sign 30 feet in height. The property
for which variance is sought is located at 1180 Elm St E; legally described as Lot 001 Block 001

Planning Commission—Variance
Findings of Fact—Supporting/Denying a Variance
A variance may be granted only when it is in harmony with the general purposes and intent of the official control
and consistent with the comprehensive plan and where the strict enforcement of the City Zoning controls will result
in practical difficulty. A determination that a"practical difficulty"exists is based upon the following criteria as
defined by MN Statutes, Section 394.27.
1. The proposed use is allowed in the zoning districts in which the subject property is located? YES or NO
2. The variance will be in harmony with the general purposes and intent of the official control(s) YES or NO
3. The variance wi11 be consistent with the Comprehensive Plan? YES or NO
4. The variance may be granted if there are Practical Difficulties in complying with the official control(s):
a. The property owner proposes to use the property in a reasonable manner? YES or NO
b. The plight of the landowner is due to the circumstances unique to the property owner,not created by the
land owner? YES NO
c. The variance, if granted,will not alter the essential character of the locality? YES or NO
d. The need for variance involves more that economic considerations? YES or NO
The Planning Commissinn should consider each of the elements listed above. If any one element is voted"NO"
by the majority, then the criteria for granting a variance,per MN Statutes,Section 394.27,has NOT been
meet and the variance as requested shou[d be denied.
