PREVIOUS COUNCIL ACTION: In 2011 the City Council conducted a public hearing on the proposed
improvement for the Park Terrace area. At that time the feasibility report was prepared and updated
and the City Engineer presented alternatives for the project which included sewer lining or sewer
replace and/or relocation. The Council conducted a separate public input session on the impact to the
tax levy if less than 20% of the project were assessed. Based on the input received, the Council decided
to delay the project.
BACKGROUND INFORMATION: In July the Council authorized the City Engineer to update the
feasibility report from 2011 for potential hearing and construction in 2014. On September 23, 2013 the
City Council accepted the amendment to the 2011 Feasibility Report and on October 3, 2013 the City
Council authorized the public improvement hearing for the proposed improvements.
The public hearing process is regulated through the 429 process which includes a series of resolutions
that must be adopted by the Council. The City Council has already completed the first resolution by
accepting the feasibility report calling for a public hearing.
Part of the public hearing is to provide a reasonable estimate as to the cost of the project and impact to
residents. Included in the information for the packet is a preliminary assessment roll. The purpose of
this hearing is not to focus on the assessment; rather the merits of the project. At this time the project
is not designed and the numbers are merely an estimate. Residents will have an opportunity at a later
time to discuss the assessments when final numbers are available.
The Council has had considerable discussion on the portion that should be assessed. The Council at the
September 23 meeting discussed financing the project through a GO Special Assessment Bond, assessing
60% of the project costs. Based on estimates approximately 43% of the total project will be assessed.
Costs that are not paid through assessments will be paid through a general tax levy over a 15 year
period.

Street W (CSAH 2) and Birch Street W, along 5th Avenue NW between 41h Avenue NW and a point
200 feet north of Birch Street W, along Ash Street W between 5th Avenue NW and 2nd Ave NW,
and along Old Highway 52 between Birch Street W and a point 200 feet northwest of Birch
Street W by constructing sanitary sewer, water main, storm drain, grading, bituminous street
with concrete curb and gutter, and surface restoration improvements pursuant to MN Statute §
429.011 to 429.111.
The estimated cost of the improvement is $ 2,100,000.00. A reasonable estimated cost of the
impact of the assessments will be available at the hearing. Such persons, as desire to be heard
will be heard with reference to the proposed improvement.

AND WHEREAS, ten days’ mailed notice and two weeks’ published notice of the hearing was given, and

were given an opportunity to be heard thereon,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH, MINNESOTA:
1. Such improvement is necessary, cost-effective, and feasible as detailed in the feasibility report.

2. Such improvement is hereby ordered as proposed in the council resolution adopted the 2165 day
of October, 2013.
3. SEH is here by designated as the engineer for this improvement. The engineer shall prepare plans
and specifications for the making of such improvement.
4. The city council declares its official intent to reimburse itself for the costs of the improvement
from the proceeds of the tax exempt bond.
