PREVIOUS PLANNING COMMISSION ACTION:
The Planning Commission conducted a public
hearing in October to consider a variance to allow a pylon sign and to allow a sign 30 feet in height. The
matter was tabled as the Planning Commission requested the petitioner submit a revised sign that was not
pylon.
The Planning Commission was scheduled to continue the discussion of the variance for McDonalds on
November 4; however, the property owner decided to submit a new application to allow a 40 foot sign.
BACKGROUND INFORMATION:
Representatives from McDonalds provided administration with
correspondence that they (McDonalds) conducted a flag test to verify visibility of the sign and they
indicated that the sign did not extend over the tree line, so visibility is still diminished. It is for this
reason that they are seeking a 20 foot variance allow a 40 foot sign.
Granting of a variance is controlled by MN Statutes and certain criteria must be meet before a variance
can be considered. The criteria is as follows:
1. The proposed land use is allowed in the Zoning District in which the subject property is
located.
2. The variance must be in harmony with the general purposes and intent of the official controls.
3. The variance must be consistent with the Comprehensive Plan.
4. The variance may be granted if there are practical difficulties in complying with the official
controls:
a. The property owner proposed to use the property in a reasonable manner
b. The plight of the landowner is due to circumstances unique to the property and
created by the landowner.
c. The variance, if granted, will not alter the essential character of the locality.
d. The need for variance involves more than economic considerations.
