PREVIOUS COUNCIL ACTION: The City Council on February 6, 2014 discussed the potential extension
of utilities to the property adjacent to and south of MN St. W, west to CR 2. The City has already
constructed water services along MN St. W, constructed a trail along the new CR 2, and are in the
process of seeing funding for phase 3 of the trail to CR 51. Since the City is expending funds in this area,
annexation should be considered. The Council agreed to bring the annexation resolution back as a
consent agenda item.
BACKGROUND INFORMATION: The proposed annexation is in an expired zone and the criteria
for annexation can be met. In addition, the Township was approached and they did not have objection

Annexing Property Pursuant to Orderly Annexation Agreement
Pursuant to MN Statute §414.0325
(Annexation of 31.21159.0601, 31.21159.0602, 31.20867.0000, 31.20696.0000, 31.20692.0000, 31.20687.0000)
WHEREAS, the City and Township of St. Joseph entered into an Orderly Annexation Agreement
approved by the Municipal Board on February 6, 1998 which identifies the terms and conditions for
orderly annexation; and
WHEREAS, in 2006 the City and Township of St. Joseph amended the original agreement, now referred
to as OA -1283, to include criteria for annexation which requires that either 100% of the affected property
owners petition for annexation or the hearing process for annexation has been completed; and the
property is contiguous to the City limits; and the City has the ability to immediately provide water /sewer
services and the petitioner has the good faith intent to plat the property following annexation.
WHEREAS, the City and Township have identified time zones for annexation to assist with the orderly
annexation process; and
WHEREAS, in 2010 the City and Township of St. Joseph clarified the process for annexation which
allows property to be annexed to the City of St. Joseph by simple resolution of the St. Joseph City
Council of the property being considered for annexation meet the criteria for annexation as identified in
section 9(c) of OA -1283 (See Exhibit 1).
WHEREAS, the City agrees to reimburse the Township pursuant to Minnesota Statutes 414.036 and
Section 8 of OA -1283, for the taxes to be collected on this property according to said schedule.
NOW THEREFORE BE IT RESOLVED:
1. The City of St. Joseph is annexing the property on its own behalf permitted in section 9 of OA-
1283. (See Exhibit 1).
2. (Property). That the following described land is subject to orderly annexation pursuant to
Minnesota Statutes §414.0325, and that the City hereby requests that the land be immediately
annexed:
OUTLOT E and OUTLOT F, BENEDICT, according to the recorded plat thereof, Stearns
County, Minnesota.
ALSO
That part of the Northeast Quarter of the Northwest Quarter of Section 16, Township 124 North,
Range 29 West, Stearns County Minnesota, lying easterly of the easterly right of way line oflnterstate
Trunk Highway No. 94.
ALSO
That part of the Northwest Quarter of the Northwest Quarter of Section 16, Township 124 North,
Range 29 West, Stearns County Minnesota, lying easterly of the easterly right of way line oflnterstate
Trunk Highway No. 94.
ALSO
That part of the Southwest Quarter of the Southwest Quarter of Section 9, Township 124 North,
Range 29 West, Stearns County Minnesota, lying southeasterly of the centerline of C.S.AHNo. 2, and
easterly of the easterly right of way line of Interstate Trunk Highway No. 94.
ALSO
That part of the Southeast Quarter of the Southwest Quarter of Section 9, Township 124 North,
Range 29 West, Stearns County, Minnesota, lying easterly of the centerline of C.S.A.H. No. 2, and
lying southerly of a line drawn parallel with, distant 150.00 feet southerly of the northerly right of way
of Minnesota Street and it's westerly extension to the centerline of C.S.A.H. No. 2.
The tract of land herein described contains 91.80 acres, more or less.
3. (Acreage /Population/Usage). That the orderly annexation area consists of approximately 11.29
acres, more or less, the population in the area is 2, and that the land use type is B3- Highway
Business.
4. (Jurisdiction). That OA -1283 confers jurisdiction upon the Chief Administrative Law Judge so as
to accomplish said annexation in accordance with the terms of this resolutions and the Orderly
Annexation Agreement with the Township. (See Exhibit 1).
5. (Municipal Reimbursement). Based on the 2013 Stearns County Tax data (see Exhibit 2), the
Township will be reimbursed taxes as identified in Exhibit 2.
6. (Review and Comment). Pursuant to the Annexation Agreement, the Chief Administrative Law
Judge may review and comment, but shall within thirty (30) days, order the annexation in
accordance with the terms of the resolution.
(Tax Rate). The undeveloped land shall keep the tax rate of St. Joseph Township until a plat has
been recorded at the Stearns County Recorder's Office.
