As you know, there is a Joint Powers Board governing the regional human rights service and program. The Board is comprised of two elected officials from each member city. One of the Board's responsibilities is to create and appoint the Regional Human Rights Commission. Thus, the JPA outlines the appointment process, terms, and duties and responsibilities of the Commission. Unfortunately, the terms of the Commissioners all begin and terminate at the same time. This schedule can be disruptive to the routine of the Commission's work. The JPA Board recently met and recommend that the JPA be amended so that the terms of Commissioners are staggered. To implement the new terms, the Commissioners will be slotted into 2 1 -year terms, 3 2 -year terms, and 3 3- year terms. There is a two year term limit for Commissioners. During this implementation phase, the shortened terms will not be considered for the purposes of term limits. I have attached a resolution that can be used by your city to agree to the amendment. RESOLUTION AMENDING THE JOINT POWERS AGREEMENT FOR THE PROVISION OF HUMAN RIGHTS SERVICES THROUGH A REGIONAL HUMAN RIGHTS OFFICE WHEREAS, the cities of Sartell, Sauk Rapids, St. Cloud, and St. Joseph have entered into a Joint Powers Agreement (JPA) to organize and govern a community -based effort to provide human rights services and support a regional human rights office, and WHEREAS, the JPA establishes an eight member Regional Human Rights Commission (Commission) appointed by the JPA Governing Board, and WHEREAS, the JPA requires that all Commissioners have three year terms that expire at the same time, and WHEREAS, the JPA Board unanimously agreed to amend the JPA to stagger the terms of Commissioners as follows: Beginning in 2014, terms will be staggered. Two terms will expire on December 31, 2014; three terms will expire on December 31, 2015; and three terms will expire on December 31, 2016. A term of less than three years will not be considered a term for the purposes of limiting Commissioners to two consecutive terms. The Regional Human Rights Commission will make a recommendation to the JPA Board for the purposes of making appointments to the newly established terms. WHEREAS, Section 8. 1, Subd. 3. the JPA will be amended as follows: Subd. 3. Terms of Members, Vacancies, Participation. (WAppointment: Beginning in 2014 At * the time of the initial appal tment, members of the Commission will be appointed to two, one year- terms, three two -year terms, and three, three -year terms to establish staggered terms of three years_ The above - mentioned shortened terms will not be considered for the purposes of term limits. After 2014, appointments will be made to the three year, staggered terms. Any person appointed to fill an unexpired term will serve only until the expiration of that term. No person will serve more than two consecutive terms. THEREFORE, BE IT RESOLVED by the City Council of , Minnesota, that the Regional Human Rights Joint Powers Agreement be amended as presented commencing in March, 2014. Adopted this day of March, 2014.
