The City has previously
executed a lease agreement and amendment #1 with Verizon Wireless to locate antennas on the water
tower. The monthly lease agreement includes a monthly payment in the amount of $ 1,434.06.
PREVIOUS COUNCIL ACTION:
BACKGROUND INFORMATION:
Both Verizon and Sprint have submitted requests to modify their
equipment on the water tower. The City required the vendors to move their equipment off the tower so
that the City could complete necessary repairs. Verizon navigated through the design and review process
and are back on the water tower. The current lease agreement with Verizon affords the City the ability to
capture revenue for expanded antennas or equipment. Verizon has agreed to compensate the City an
additional $ 250 per month for the new technology.
BUDGET/FISCAL IMPACT:
$ 250 increase in revenue, escalated each year based on the
original agreement.

VerizonWay,MailStop4AW100,BaskingRidge,NewJersey07920(telephonenumber866-
862-4404),isanamendmentthatisherebymadeapartofandincorporatedintothat
CommunicationsSiteLeaseAgreement(Tower)datedFebruary2,1999,asamendedbythe
AmendmentNo.1toCommunicationsSiteLeaseAgreementdatedJune9,2009(collectively,
the“Agreement”).
A.TheAgreementisamendedtoallowawatertowerinstallationconsistentwith
ExhibitB-2
,whichisattachedheretoandmadeaparthereof.
B.Asconsiderationfortherightsgrantedherein,commencingonthefirstdayofthe
monthfollowingthestartofinstallationofthemodified/additionalequipment,themonthlyrent
shallbeincreasedbyTwoHundredFiftyandNo/100Dollars($250.00).Theincreasedrental
amountshallescalatepursuanttotheAgreement(bythreepercent(3%)onFebruary1ofeach
year).LessorandLesseeagreethattheyshallacknowledgeinwritingthedatethatinstallation
started.LessorandLesseeacknowledgeandagreethattheincreasedrentalpayment(s)maynot
actuallybesentbyLesseeuntilthirty(30)daysafterthewrittenacknowledgementconfirming
thedateofinstallation.
C.Exceptasexpresslysetforthherein,allothertermsandconditionsoftheAgreement
shallremainunmodifiedandinfullforceandeffect,andthepartiesherebyconfirmandratify
suchtermsandconditionsandagreetoperformandcomplywiththesame.
