HomeMy WebLinkAbout[06] Little Saints Council Agenda Item \[06\] MEETING DATE: December 4, 2014 AGENDA ITEM: ReZoning, PUD – Little Saints SUBMITTED BY: BOARD/COMMISSION/COMMITTEE RECOMMENDATION: The Planning Commission conducted the public hearing on December 1, 2014 and recommended the City Council approve the rezoning and PUD of Wise Owls LLC d/b/a Little Saints. PREVIOUS COUNCIL ACTION: BACKGROUND INFORMATION: During the public hearing the Planning Commission received one comment requesting the City not rezone the property as he owned WGohman Construction across the street from the proposed site and felt there was a conflict of users (heavy equipment versus child care). The Commission heard two other property owners/tenants request the Commission recommend approval. The final recommendation was requesting the Council approve the rezoning request, rezoning the former Metro Plumbing building from current industrial to B2, Highway Business. In addition, they recommended the Council conditionally approve the PUD Application that would allow a commercial development to include childcare, commercial kitchen and cold storage. The recommendation was conditional with the following:  Final Plans are submitted and compliant with the B2 Zoning District  Relief of curb and gutter only if drainage meets the requirements of the City Engineer  The storage area is limited to use by Little Saints and a change to the use would require an amendment to the PUD.  Execution of a development agreement.  Review the parking lot and circulation to provide for pedestrian safety. BUDGET/FISCAL IMPACT: ATTACHMENTS: Request for Council Action Planning Commission Meeting Material REQUESTED COUNCIL ACTION: Consider the action of the Planning Commission This page intentionally left blank 5 Planning Commission Agenda Item MEETING DATE: December 1, 2014 AGENDA ITEM: PUD/ReZoning Wise Owl \[Little Saints\] BACKGROUND INFORMATION: Little Saints has been an established business in St. Joseph providing childcare based on the concept that children benefit in all areas of learning by providing music and movement as a learning tool. They have been operating in the former Kennedy School and due to the needs of District 742 they will be losing their space. They are committed to staying in St. Joseph and have looked at different options, and finally found a site that would accommodate their needs today and in th the future. They are looking to occupy the former Metro Plumbing site on 8 Ave NE. The property is currently zoned industrial and they have requested to rezone the property to B2, Highway business. The property in this area is a growth area with commercial near. The comprehensive plan indicates this is a future area of growth and identifies commercial. The property across the street is Industrial, operating as a construction/excavating company with heavy equipment moving in and out. th The proposed daycare will have the outside activity are in the west and north, keeping it away from 8 Ave. The applicant is requesting a PUD as they are looking at combining the daycare with a commercial cooking area that can be used for catering and a storage facility. As can be seen from the exhibit the property currently has a storage component and they wish to continue. The facilities will be upgraded and the all of the exterior requirements will be met. The building will consist of a combination of white siding and red brick, playground equipment will be added and fenced and the site will be enhanced with landscaping. With regard to parking, the Ordinance does not include a provision for daycares, but looking at neighboring cities, 6 spaces for each child and one space for each employee on the maximum shift has been used. If the number of children is 125 is used (based on previous conversations) the parking would be 21 for the children portion and she will have approximately 14 staff on the maximum shift, requiring 35, with the site plan showing 40. The City has received one letter objecting to the use and is attached. Just as a reminder, zoning cannot be approved contingently. As an adjoining property owner this planned use as a day care facility looks to me to be a very unsafe and dangerous proposal. Parents dropping off little ones in the morning and picking them up later in the day is an accident waiting to happen. All three businesses located on this street have large vehicles coming and going regularly. Safety needs to be primary to everyone's concern. The best thing for this use is to find another location that is much safer for all concerned. Please use this e-mail as my opposition to this proposal. The approximate boundaries include:  Areas north of the Wobegon Trail  Areas south of the Northland developments  Areas within the current corporate limits Total Acres in District: This district contains 251 acres of land. Number of Acres Platted: 222 acres have been subdivided; 29 have not yet been subdivided. Number of Acres with Potential Development Considerations: Five Subdivided Ac.Non-Subd. Ac. acres contain potential considerations for development. Areas of Stability and Areas of Change: Areas of change and areas have been identified within this district. The majority of the district has been identified as an area of change meaning the city expects to direct resources (either new development or redevelopment, public and/or private resources) as available and/or requested. Land area not labeled as ‘change’ or ‘stability’ are not expected to be serviced by municipal utilities in the near term, however, conditions leading to utility extension and/or subdivision can change. Prominent Features Prominent features within Planning District Eleven include the Wobegon Trail, Elm Street, CR 133, CSAH 75, Buettner Business Park, Rennie Addition, Borgert Industrial Park, and Indian Hill subdivision. Existing Land Use Existing land uses in this district include vehicular oriented commercial, industrial, and multiple family housing. Proposed Future Land Use The majority of this district has been identified as an area of change with future investment likely over the duration of this plan. Areas of change are primarily centered on commercial parcels adjacent to CSAH 75 and Elm Street. Future development patterns will respect the mobility function of CSAH 75; therefore, commercial clusters at meaningful intersections are warranted. Clustering will provide for the development of cohesive commercial entities capable of creating and sustaining compatible design elements, shared parking, and shared storm water management facilities. 2008 City of St. Joseph Comprehensive PlanChapter 4, Page 41
