HomeMy WebLinkAbout[04d] St. Cloud Area Response Initiative Council Agenda Item 4d MEETING DATE: 12/17/2014 AGENDA ITEM: St. Cloud Area Response Initiative: Requested Action: Authorize Chief Klein to enter into a Memorandum of Agreement with the Central MN Mental Health Center SUBMITTED BY: Police Department BOARD/COMMISSION/COMMITTEE RECOMMENDATION: PREVIOUS COUNCIL ACTION: BACKGROUND INFORMATION: The St. Joseph Police Department along with the other Metro Departments of the St. Cloud area recognize that we deal with many traumatic events. We also realize that many children are traumatized because of these events and often their needs go overlooked. Within the last year, an initiative called the St. Cloud Area Child Response Initiative (CRI) has been developed and funded for 2 years by private donations. This program gives local law enforcement a tool to provide children with the emotional help they need during traumatic events. The program, which is run by the Central Minnesota Health Center, has a Trauma informed advocate that is full time staffed and co-located at the St. Cloud Police Department. At any time we can make referrals to them as we see fit for the situations we have. There is no cost to our department and this is another tool we can use to help those in need. CLOUD AREA CHILD RESPONSE INITIATIVE(CRI) ST.IOSEPH, MINNESOTA MEMORANDUM OF AGREEMENT WITNESSETH: WHEREAS the St.Cloud Area Child Response Initiative is a program coordinated by the Central Minnesota Mental Health Center and the St.Joseph Police Department,for implementation in the community;and, WHEREAS the Central Minnesota Mental Health Center will employ a Trauma Informed Advocate to be co-located at the St.Cloud Police Department to service referrals from St.Joseph area police officers when a child is exposed to a traumatic event;and WHEREAS it will be necessary for the Trauma Informed Advocate to have protected access to limited law enforcement data for purposes of receiving and processing referrals related to the program;and WHEREAS the Central Minnesota Mental Health Center and the St. Joseph Police Department are committed to protecting any and all confidential information developed and maintained as part of the St. Cloud Area Child Response Initiative; and WHEREAS the St. Cloud Area Child Response Initiative has also partnered with a network of qualified trauma assessment and treatment providers to provide services to children exposed to violence and trauma and their families in order to reduce law enforcement involvement and increase treatment engagement;and, WHEREAS, the St. Cloud Area Child Response Initiative project team and the trauma provider network representatives have concluded that each would like to collaborate to address the needs of children exposed to violence and trauma and their families; and WHEREAS the St. Cloud Area Child Response Initiative project team and the trauma network representatives are committed to maintaining confidentiality and providing ongoing general service updates to the trauma provider network by hosting regular trauma provider network meetings. WHEREAS the St. Cloud Area Child Response Initiative will require ongoing collaboration between the signing members from February 24, 2014, to February 24, 2015, and will be reviewed and renewed annually. NOW THEREFORE the signee(s)of this MOA agree to: 1. The Central Minnesota Mental Health Center and the St.Joseph Police Department agree that information shared related to health care, social service reports and law enforcement data shall be held confidential and subject to the protections accorded by HIPAA and the Government Data Practices Act, except as otherwise required by law. Information which identifies any juvenile will be held confidential and not disclosed to any parties outside of this 1 agreement except pursuant to the Minnesota Government Data Practices Act or a valid court order. All requests pursuant to the Government Data Practices Act will be processed by the government agency that maintains the data. 2. The Central Minnesota Mental Health Center and the St.Joseph Police Department agree that from time to time it may be necessary for the Trauma Informed Advocate to "ride- along" with law enforcement officers. The Central Minnesota Mental Health Center's / Trauma Informed Advocate's waiver of liability is attached to this agreement and shall apply for the length of this agreement. 3. Trauma provider network members of the Child Response Initiative agree to meet regularly as scheduled by the Central Minnesota Mental Health Center and commit to sending an agency representative to each meeting. 4. Trauma provider network members agree to information sharing in the form of client name, assigned therapist, appointment time,and appointment attendance upon verbal approval of the client (but no other contextual information about the client's situation or what is discussed during therapy). Provider agencies are encouraged to also obtain a general release of information from clients. � 5. Trauma provider network members agree to collaborate with all CRI staff, specifically the Central Minnesota Mental Health Center and the Trauma Informed Advocate,to ensure data collection and evaluation information elements,including date offirst service,type ofservice, total number of sessions, and date of treatment completion or termination. 6. Trauma provider network members agree to commif to, whenever possible and where it makes sense, referring within the trauma network, and if a referral outside of the network is most appropriate, inform CRI of where the client has been referred for CRI follow up. 7. Trauma provider network members agree to update CRI if capacity changes arise such as addition or termination of different types of services offered or contact information changes. This agreement shall be reviewed in no less than one year. It shall remain until modified or terminated as set forth herein and terminated by either party upon thirty(30)days written notice to the other party. 2 IN TESTIMONY WHEREOF,the agencies listed have executed this Memorandum of Agreement as set forth below.
