HomeMy WebLinkAbout[02b] School District Agreement Council Agenda Item 2b MEETING DATE: January 5, 2015 AGENDA ITEM: School District Agreement – Requested Action: Authorize execution of a Memorandum of Understanding between the City of St. Joseph and ISD 742 memorializing the requirement for release of the building permit for the expansion of Kennedy SUBMITTED BY: Administration BOARD/COMMISSION/COMMITTEE RECOMMENDATION: PREVIOUS COUNCIL ACTION: The City issued a building permit in 2007 for the construction of Kennedy Community School. BACKGROUND INFORMATION: The City received a building permit application for the expansion of Kennedy Community School. The expansion included additional classrooms allowing for an additional 143 students. When building permits are issued for commercial type projects Ordinance review is part of the process. The City has been made aware of traffic congestion that occurs each morning during drop off. The congestion is a result of car stacking along Jade Road to CR 121 as cars wait to enter and exit the district property. The City and School have identified incremental measures that would help alleviate the problems. The MOU address the mitigation measures and timeframe for implementation. In addition, the agreement allows the WAC/SAC fee to be paid in two installments. This page intentionally left blank MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding is entered into this day of ,2014, by and between the City of St.Joseph,a Minnesota municipal corporation(hereinafter the"City"),and Independent School District 742,a public corporation under the laws of Minnesota,hereinafter called the "District". Recitals: 1. On August 22,2014,representatives from the District met with representatives from the City to discuss the application of a building permit for an expansion to Kennedy Community School. 2. On October 8,2014,the City issued a footings and foundation permit,building permit 2014- 00239 for the proposed expansion knowing that there were outstanding site improvements that could be addressed before the release of the full building permit. 3. On December 2,2014,representatives of the City and District meet to discuss the problem of traffic congestion during drop-off time in the morning and alternative solutions. Traffic congestion was identified as cars stacking along Jade Road and CR 121,waiting to enter the school site to drop off their children. The stacking is a result of congestion within the District property. 4. On December 29,2014,representatives of the City and District met to continue the discussion on traffic congestion and agreed to the terms identified below. Upon execution of the agreement the City would release the full building permit and allow the water and sewer access fee to be paid in two installments. The first installment shall be payable by December 31,2014 and the second payment shall be due December 1,2015. NOW,THERFORE,in consideration of the mutual covenants expressed herein,IT IS HEREBY AGREED AS FOLLOW: 1. Effective upon execution of this agreement the District will expand the student drop off area adding approximately eight(8)more spaces for student drop off. The drop off area will extend along the east/west side of the entrance road beginning across from the entrance of the parking lot. 2. Effective upon execution of this agreement,the District will continue to educate parents of the stop,drop and go initiative,whereby parents drop children off without getting out of their cars. The district will provide staff outside to assist with traffic control during drop off and pickup of children. 3. Effective upon execution of this agreement the first row of parking in the parking lot nearest the school will be designated for drop off whereby parents may opt to park, get out of their vehicles,and escort students to the door. The parking lot restriction will apply during drop off and pickup times. 4. The District agrees to widen the parking lot entrance to improve circulation during drop off and pick times. The improvement must be completed before the certificate of occupancy is issued and ready for the 2015/2016 school year. 5. The District agrees to evaluate the entrance to Jade Road and expand the entrance as approved by the City Engineer. The improvement must be completed before the certificate of occupancy is issued and ready for the 2015/2016 school year. 6. In the event that the measures outlined above(1 —5)do not relieve congestion on Jade Road and CR 121,the District agrees to construct an additional paved area,which will consist of the loop around the proposed parking lot,or similar configuration,as illustrated on Exhibit 1 of this agreement. For the purposes of this provision,the City will require the additional paved area if cars continue to stack on Jade Road to CR 121 creating on site congestion. The additional area will be constructed so that it is ready for use with the beginning of the 2016/2017 school year.
