HomeMy WebLinkAbout[03] Public Hearing - Easement Release 3 Council Agenda Item MEETING DATE: January 5, 2015 AGENDA ITEM: Public Hearing – Easement Release Central MN Credit Union SUBMITTED BY: Administration BOARD/COMMISSION/COMMITTEE RECOMMENDATION: None required PREVIOUS COUNCIL ACTION: The City approved the St. Joseph Professional Plat in 2012 which provided four commercial shovel ready lots. BACKGROUND INFORMATION: The City received a request from the Central MN Credit Union to release the drainage and utility easement between lots 2 and 3 of the St. Joseph Professional Plat. The request for release is to allow the two lots to be combined so that they can construct a service center for the Credit Union. The proposed plan includes construction of a 13,900 square foot facility that will operate as a service center. The City Engineer and Public Works Director have reviewed the proposed request for easement release and have verified that the easement will not be needed based on the submitted plans. The Office staff mailed notice to all utility companies to see if the release of easement would have an impact (see chart below). Since the easement is recorded on the plat, it is considered public right of way and can only be released through a public hearing process. The Council must determine at the hearing that it is in the best interest of the City to release the easement. The matter came before the City Council pursuant to a petition submitted by the Central Minnesota Credit Union. Based upon the information presented at the time of hearing, the City Council for the City of St. Joseph hereby resolves that the above described easement is here by vacated effective immediately.
