HomeMy WebLinkAbout2014 [06] Jun 09 June 09, 2014 Page 1 of 2 Pursuant to due call and notice thereof the Joint Planning Board for the Township and City of St. Joseph met in special session on Monday, June 30, 2014 at 7:00 PM in the St. Joseph Township Hall. Members Present: Chair Jeff Janssen. Members Rick Schultz, Ralph Eiynck, Renee Symanietz, Hal Undersander, Mike Koltes, Ross Rieke. Commissioner Mark Brommenschenkl. Others Present: Brenda Stanger, Jerome Salzer, Ann Reischl, Chris Hensel, Sarah Hensel, Mike Deutz, Cory Ehlert. Approve Minutes: Symanietz made a motion to approve the minutes of April 14, 2014; seconded by Rieke and passed unanimously by those present. Public Hearing, Interim Use, Chris and Sarah Hensel: Chair Janssen called the hearing to order to which Weyrens stated the purpose of the hearing is to consider issuance of an interim use permit to allow the construction of an accessory building before the construction of a principal structure on a residential lot. . The request for interim use is in accordance with the terms of the Joint Orderly Annexation Agreement, recorded document#A1338765, Attachment 2[a]2, whereby an accessory building cannot be constructed prior to the location of a principal structure. The property under consideration is located at 31820 Cedar Ridge Road, St. Joseph MN, legally described as Lot 010, Block 001 Sunset Ridge. The request for interim use has been submitted by Christopher and Sarah Hensel, 1023 13th Ave NE, St. Joseph. Weyrens clarified that the original hearing notice that was published and mailed stated that the Board would be considering a variance, and since that time it is more appropriate to consider an interim use permit as a sunset can be placed on the approval; whereas a variance it cannot. Both an interim use permit and variance required the same process; therefore the publication and notice requirement are not affected. Jerome Salzer stated that in the past the Township has allowed the construction of the garage before the home provided the property owner applied for a building permit for the home and accessory building and paid for the same. In addition, the home had to be constructed within twelve months. Weyrens clarified that the Orderly Annexation Agreement includes a provision that prohibits the building of an accessory building without a principal structure; therefore property owners have to apply for an interim use permit at which time conditions can be applied. The use of an interim use permit would not require the property owner to secure a building permit for the house. Chris Hensel stated that he is requesting the interim use permit as he will be constructing the home himself and needs a place to store material. He intends to place his existing home on the market and start construction the new home in fall. Hensel stated that at this time he does not have the house designed and is not in a position to apply for a building permit for the home; however he does have the plan to secure a permit for the accessory building. With no one further wishing to speak, the public hearing was closed at 7:11 PM The Board discussed the site plan submitted by Hensel and reaffirmed that the zoning regulations require that residential accessory buildings shall meet the road setbacks and in no case shall they be located closer to the road than the residential dwelling. Based on the concept plan it appears that the accessory building will be closer to the street than the accessory building. Hensel stated that they will meet all the zoning requirements and the plan is concept only at this time. The Board also clarified that living in an accessory building is not permitted and that the accessory building must compliment the principal structure. Hensel stated that he will meet this requirement as well. Salzer again stated that in the past the Township Board has required the property owner to secure the building permit for the home at the same time as the accessory building to assure that the home would be constructed. Hensel reiterated that he does not have the home designed at this time and would like to June 09, 2014 Page 2 of 2 move forward with the accessory building. Janssen stated that the interim use permit process provides the same assurance as securing the building permit. Rieke made a motion to issue an interim use permit to Christopher and Sarah Hensel to construct a residential accessory building before a principal structure on the aforementioned lot with the following conditions: 1. The approval is based on a residential accessory building and should the use be changed to home occupation or extended home occupation a special use permit, as required in the Orderly Annexation Agreement must be secured. 2. Construction of the principal structure must begin no later than September 1, 2015 with completion by September 1, 2016. 3. Approval of the Interim Use Permit is separate an independent from the building/lot requirements. The residential accessory building must meet all the land use requirements as identified and required by Stearns County Environmental Services and the Building Inspector for St. Joseph Township The motion was seconded Schultz and passed unanimously. Other Matters: Jerome Salzer stated that he was approached by Mike Deutz regarding the expiration of his interim use permit to operate an asphalt plant. Salzer stated he recommended Deutz come to the Joint Planning Board meeting. Deutz stated in 2010 he needed a recommendation from the Joint Planning Board and not sure what process he needs to follow. Weyrens stated that in 2010 the Joint Planning Board was advisory to Stearns County, since that time the process has changed whereby the Joint Planning Board has final authority and conducts all public hearings. She stated his first steps would be to contact Stearns County Environmental Services and they would process the request. Deutz stated that he already talked to them and questioned if he would have to pay the $200 fee. Weyrens responded that he would have to pay a total of$ 750 for the hearing process. The Board agreed to meet specially on June 30 if the application is submitted to Stearns County and can be processed to meet publication deadline.
