HomeMy WebLinkAbout2014 [06] Jun 30 June 30, 2014 Page 1 of 2 Pursuant to due call and notice thereof the Joint Planning Board for the Township and City of St. Joseph met in special session on Monday, June 30, 2014 at 7:00 PM in the St. Joseph Township Hall. Members Present: Chair Jeff Janssen. Members Rick Schultz, Ralph Eiynck, Renee Symanietz, Hal Undersander, Mike Koltes, Ross Rieke. Others Present: Brenda Stanger, Jerome Salzer, Ann Reischl, Duane Pfannenstein, Lisa Pfannenstein, Jeff Karnik, Mike Deutz. Approve Minutes: Schultz made a motion to approve the minutes of June 9, 2014; seconded by Eiynck and passed unanimously by those present. Public Hearing, Interim Use, St. Joseph Sand and Gravel: Chair Janssen called the hearing to order to which Weyrens stated the purpose of the hearing is to consider an interim use permit to allow a temporary asphalt plant for four(4) years. The request for interim use is in accordance with Sections 4.18, 6.15 and 9.15.7A of Stearns County Land Use and Zoning Ordinance#439 to operate a temporary asphalt plant for four(4)years. The property under consideration is Lot 1 Block 1 St. Joe Sand and Gravel and part of the NE1/4 SE1/4, Section 4 and part of the NW1/4 SW1/4 Section 4, lying westerly of County Road 2, St. Joseph Township (124/29). The request for interim use has been submitted by St. Joseph Sand and Gravel, St. Joseph MN. Weyrens clarified that the request before the Board is similar to the interim use permit issued in 2010, so the matter before the Board is similar to a renewal. The County Zoning Ordinance limits the interim use permit to four years. Weyrens stated that she is unware of any complaints from the previous permit. Chair Janssen opened the public hearing. Jeff Karnik, 31086 CR 2, questioned the notification process. Karnik questioned if residents were notified of the public hearing as he lives near the subject property and he did not receive a notice. He stated that he talked to some of his neighbors and they as well did not receive notice. Weyrens stated that she verified with City Office staff that the notices were mailed and published. Janssen stated that the hearing notice was published in the St. Cloud Times. Being no one further to wishing to speak, the public hearing was closed. Applicant Michael Deutz stated that he has reviewed the recommendations provided to the Board and they are similar to the expiring permit and does not oppose them. He has once concern however, the removal of the excess recycled asphalt. He stated that the material was on the property when he purchased the tract and it is a large amount of material. Deutz stated that they did not use the asphalt plant in the past but have the opportunity to do so at this time. Schultz made a motion authorizing the Board Chair and Secretary to execute the Findings of Fact issuing an Interim Use Permit to St. Joseph Sand and Gravel to operate a temporary asphalt plant for four(4)years with the following contingencies;the motion was seconded by Schultz and passed unanimously. 1. Hours Operation: Monday— Friday: 6 AM to 8 PM Saturdays: 8 AM to 2 PM Sundays and Holidays: Operation not allowed 2. Expiration of IUP: The IUP will expire on December 31, 2018. 3. Excess Material: All recycled asphalt pavement (RAP) and/or excess material shall be removed upon completion of operation. June 30, 2014 Page 2 of 2 4. Financial Guarantee: The applicant shall submit a financial guarantee in the amount of $ 5,000, to ensure that the temporary equipment and RAP be removed upon termination of the IUP. 5. Signage: a. Truck Hauling signs are required during times of hauling. b. Signs shall be placed at the entrance showing the name and telephone number of the property owner, site operator and hauling contractor. 6. No more than one asphalt plant shall be located on the property at any given time. 7. Required Permits: The applicant is responsible for obtaining all required permits and provide a copy of the same to Stearns County Environmental Services. The following permits shall be required: Air Emission Permit (MPCA); Spill Response Plan; NPDES Permit (MPCA) 8. Dust shall be controlled. Other Matters: None.
