HomeMy WebLinkAbout[05] Ordinance Codification 5 Council Agenda Item MEETING DATE: May 4, 2015 AGENDA ITEM: Ordinance Codification BOARD/COMMISSION/COMMITTEE RECOMMENDATION: PREVIOUS COUNCIL ACTION: BACKGROUND INFORMATION: The City has run out of numbers to add Ordinances and the only manner in which some sections could have ordinances added would be to either hyphenate the Ordinance, which would seem confusing or renumber the entire book using a three digit system. The entire book has been renumbered using the new numbers by changing Ordinance 10 to 100. The hearing does not include any additional ordinances, only changes numbers. The process to do so requires the Council conduct a public hearing and then publish the final summary. BUDGET/FISCAL IMPACT: ATTACHMENTS: Request for Council action Hearing Notice Resolution 2015-016, Adopting the 2015 Code of Ordinances REQUESTED COUNCIL ACTION: Authorize the Mayor and Administrator to execute and publish Resolution 2015-016 adopting the 2015 Code of Ordinances. THIS PAGE INTENTIONALLY LEFT BLANK NOTICE OF HEARING ON THE ADOPTION OF A CODE OF ORDINANCES FOR THE CITY OF SAINT JOSEPH, COUNTY OF STEARNS, MINNESOTA TO WHOM IT MAY CONCERN: Minnesota Statutes Sections 415.02 and 415.021 authorize the city to codify its ordinances and print them in a book. Notice is hereby given that the council of the City of St. Joseph, Minnesota, will meet at 6:00 PM. on May 4, 2015 at the St. Joseph City Hall, located at 25 College Avenue North, to consider, and possibly adopt, a city code consisting of the general ordinances of the city as amended, restated, revised, updated, codified, and compiled in book form, including penalties for the violations of various provisions thereof, which shall constitute the “Code of Ordinances of the City of St. Joseph.” This Code of Ordinances will also adopt by reference certain statutes and administrative rules of the state of Minnesota as named in the Code of Ordinances. The proposed Code of Ordinances shall consist of the following titles: Chapter 1: General Provisions \[Ordinances 100-105\] Chapter 2: Operation, Administration & Organization \[Ordinances 201-209\] Chapter 3: Public Property & Improvements \[Ordinances 301-308\] Chapter 4: Water & Sewer \[Ordinances 401-407\] Chapter 5: Building, Land Use & Regulations \[Ordinances 501-508\] Chapter 6: General Regulations \[Ordinance 601-609\] Chapter 7: Liquor, Beer & Wine \[Ordinance 701-705\] Chapter 8&9: Traffic & Motor Vehicles \[Ordinance 801-809, 900\] Chapter 10: Nuisances & Offenses \[Ordinances 1001-1012, 1020-1021\] All prior ordinances, pertaining to the subjects treated in the Code of Ordinances, shall be deemed repealed from and after the effective date of the ordinance adopting the Code of Ordinances, except as they are included and re-ordained in whole or in part in the Code of Ordinances. This repeal shall not affect any offense committed or penalty incurred, or any right established prior to the effective date of this ordinance, nor shall this repeal affect the provisions of ordinances levying taxes; appropriating money; annexing or detaching territory; establishing franchises; granting special rights to certain persons; authorizing public improvements; authorizing the issuance of bonds or borrowing of money; authorizing the purchase or sale of real or personal property; granting or accepting easements, plat or dedication of land to public use; or vacating or setting the boundaries of streets or other public places; nor shall this repeal affect any other ordinance of a temporary or special nature or pertaining to subjects not contained in or covered by the Code of Ordinances. The official copy of this Code of Ordinances shall be marked and be kept in the office of the city clerk and shall be named 2015 St. Joseph Code of Ordinances. The Code of Ordinances will be declared to be prima facie evidence of the law of the city, and will be received in evidence as provided by Minnesota Statutes by the courts of the State of Minnesota. The ordinance adopting the Code of Ordinances, and the Code of Ordinances itself, shall take effect upon publication of the ordinance adopting the Code of Ordinances in the city’s official newspaper. Judy Weyrens Administrator Publish: April 17, 2015 Resolution 2015-016 Revoking and Approving Ordinance 100 Adopting Code and Repealing Prior Ordinance The City Council of the City of St. Joseph hereby ordains: That Ordinance 10 is hereby revoked in its entirety and the following language is enacted in its place: ORDINANCE 100 ADOPTING CODE AND REPEALING PRIOR ORDINANCE An ordinance enacting a code of ordinances for the City of Saint Joseph, Minnesota, amending, restating, revising, updating, codifying, and compiling certain ordinances of the City dealing with the subjects embraced in the code of ordinances, and providing penalties for the violation of the code of ordinances. WHEREAS Minnesota Statutes §§ 415.02 and 415.021 authorize the city to cause its ordinances to be codified and printed in a book, NOW THEREFORE the City Council of the City of St. Joseph, Minnesota, ordains: Section 1. The general ordinances of the city as amended, restated, revised, updated, codified, and compiled in book form, including penalties for the violations of various provisions thereof, are adopted and shall constitute the Code of Ordinances of the City of St. Joseph. This Code of Ordinances also adopts, by reference, certain statutes and administrative rules of the State of Minnesota as named in the Code of Ordinances. Section 2. The Code of Ordinances as adopted in Section 1 shall consist of the following titles: Chapter 1: General Provisions Chapter 2: Operation, Administration & Organization Chapter 3: Public Property & Improvements Chapter 4: Water & Sewer Chapter 5: Building, Land Use & Regulations Chapter 6: General Regulations Chapter 7: Liquor, Beer & Wine Chapter 8&9: Traffic & Motor Vehicles Chapter 10: Nuisances & Offenses Section 3. All fees established in prior ordinances shall remain in effect unless amended in this Code of Ordinances, or until an ordinance adopting a fee schedule is adopted or amended. Section 4. This ordinance adopting the Code of Ordinances shall be a sufficient publication of any ordinance included in it and not previously published in the city’s official newspaper. The city clerk shall cause a substantial quantity of the Code of Ordinances to be printed for general distribution to the public at actual cost, and shall furnish a copy of the Code of Ordinances to the County Law Library or its designated depository. The official copy of this Code of Ordinances shall be marked and be kept in the office of the city clerk and shall be named 2015 St. Joseph Code of Ordinances. Section 5. The Code of Ordinances is declared to be prima facie evidence of the law of the city and shall be received in evidence as provided by Minnesota Statutes by the courts of the State of Minnesota. Section 6. This ordinance adopting the Code of Ordinances, and the Code of Ordinances itself, shall take effect upon publication of this ordinance in the city’s official newspaper. th Passed by the City Council of the City of St. Joseph, Minnesota this 4 day of May 2015.
