PREVIOUS COUNCIL ACTION:
The City Council conducted a public improvement hearing on
February 18, 2015 to consider the proposed improvements in Clinton Village and Northland. At the same
meeting the improvement was ordered.
The City Council opened bids on April 9, 2015 for the proposed Street Improvement.
BACKGROUND INFORMATION:
The Assessments have been prepared using the Benefit Analysis
report prepared by Bill Waytas. The amount of assessment was capped at 60% for those property where
the assessment exceeded 60%. When the preliminary assessment roll is prepared the Engineer estimates
the cost of the projects and 60% of the costs are then allocated based on the square footage of each
individual property. Once the Council orders the improvement the City has prepared a benefit analysis
which indicates the range of benefit for the area. The amount in this report is used as the maximum that
any one property can be assessed; however, they are assessed less if 60% of the assessment is less then
the benefit report.
The final assessment notice sent to each individual property owner is based on the actual improvement
cost, using the caps as stated above. If a property owner wishes to contest the assessment they must do so
in writing before the assessment hearing is closed and they must file in district court within 30 days of
adoption of the assessment roll.
If the assessment roll is adopted, residents will receive notice of final assessment. At this point the
assessment is due and payable and residents have the option of paying some, none or all of the assessment
without interest. After 30 days the assessment is certified and interest is applied.
One the assessment roll is adopted, the Council can consider the bids and award to the lowest responsible
bidder, Knife River Corporation in the amount of $ 516,767.15.

Two separate actions are needed: 1) Authorize the Mayor and
Administrator to execute Resolution 2015-017 Adopting Final Assessment Roll for the 2015 Street
Improvement project; and 2) 2015-018 Awarding Contract to Knife River for the 2015 Street
Improvement Project.

Notice is hereby given that the council will meet at 6:30 p.m. on May 4, 2015, at the St. Joseph City Hall,
25 College Avenue North to consider, and possibly adopt, the proposed assessment for the 2015
Bituminous Street Improvements which affects the following areas:

Adoption by the council of the proposed assessment may occur at the hearing. The area listed above is
proposed to be assessed. The proposed assessment is proposed to be payable in equal annual installments
extending over a period of 10 years, the first of the installments to be payable on or before the first
Monday in January 2016, and will bear interest at the rate of 5.5 percent per annum from the date of the
adoption of the assessment resolution. To the first installment shall be added interest on the entire
assessment from the date of the assessment resolution until December 31, 2015. To each subsequent
installment when due shall be added interest for one year on all unpaid installments.
You may at any time prior to certification of the assessment to the county auditor, pay the entire
assessment on such property, with interest accrued to the date of payment, to the City of St. Joseph. No
interest shall be charged if the entire assessment is paid within 30 days from the adoption of this
assessment. You may at any time thereafter, pay to the City of St. Joseph the entire amount of the
assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is
made. Such payment must be made before November 15 or interest will be charged through December 31
of the succeeding year. If you decide not to prepay the assessment before the date given above the rate of
interest that will apply is 5.5 percent per year. You have the right to partially prepay the assessment with
any balance being certified to the County Auditor for collection under the terms described above.
The proposed assessment roll is on file for public inspection at the city clerk’s office. The total amount of
the proposed assessment is $369,149.21. Written or oral objections will be considered at the meeting. No
appeal to district court may be taken as to the amount of an assessment unless a written objection signed
by the affected property owner is filed with the municipal clerk prior to the assessment hearing or
presented to the presiding officer at the hearing. The council may upon such notice consider any objection
to the amount of a proposed individual assessment at an adjourned meeting upon such further notice to
the affected property owners as it deems advisable.
Under Minn. Stat. §§ 435.193 to 435.195 and city Ordinance No. 38, the council may, in its discretion,
defer the payment of this special assessment for any homestead property owned by a person 65 years of
age or older or retired by virtue of a permanent and total disability for whom it would be a hardship to
make the payments. When deferment of the special assessment has been granted and is terminated for any
reason provided in that law and Ordinance (Resolution), all amounts accumulated plus applicable interest
become due. Any assessed property owner meeting the requirements of this law and Ordinance No. 38,
may, within 30 days of the confirmation of the assessment, apply to the city clerk for the prescribed form
for such deferral of payment of this special assessment on his/her property.
An owner may appeal an assessment to district court pursuant to Minn. Stat. § 429.081 by serving notice
of the appeal upon the mayor or clerk of the city within 30 days after the adoption of the assessment and
filing such notice with the district court within ten days after service upon the mayor or clerk.

WHEREAS, pursuant to proper notice duly given as required by law, the council has met and heard and
passed upon all objections to the proposed assessment for the 2015 Bituminous Street Improvements
which affects the following areas:

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH, MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby
accepted and shall constitute the special assessment against the lands named therein, and each tract of
land therein included is hereby found to be benefited by the proposed improvement in the amount of
the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending over a period of 10 years, the
first of the installments to be payable on or before the first Monday in January 2016, and shall bear an
interest rate of 5.5 percent per annum from the date of the adoption of this assessment resolution. To
the first installment shall be added interest on the entire assessment amount from the date of this
resolution until December 31, 2015. To each subsequent installment when due shall be added interest
for one year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certification of the assessment to the
county auditor, pay the whole of the assessment on such property, with interest accrued to the date of
payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid
within 30 days from the adoption of this resolution; and the property owner may at any time
thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid, with
interest accrued to December 31 of the year in which such payment is made. Such payment must be
made before November 15 or interest will be charged through December 31 of the succeeding year.
4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county auditor to be
extended on the property tax lists of the county. Such assessments shall be collected and paid over in
the same manner as other municipal taxes.

Bids were received, opened and tabulated according to law, and the following bids were
received complying with the advertisement:

Knife River Corporation 516,767.15
Tri-City Paving, Inc. 526,666.00
AND WHEREAS, it appears that Knife River Corporation of Sauk Rapids, MN is the
lowest responsible bidder.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH,
MINNESOTA:
The Mayor and City Administrator are hereby authorized and directed to enter into the
attached contract with Knife River Corporation of Sauk Rapids, MN in the name of the
City of St. Joseph for the 2015 Bituminous Street Improvements as described above
according to the plans and specifications therefore approved by the City Council and on
file in the office of the City Administrator.
The City Administrator is hereby authorized and directed to return forthwith to all bidders
the deposits made with their bids, except that the deposits of the successful bidder and the
next lowers bidder shall be retained until a contract has been signed.
Adopted by the Council this 4th day of May, 2015.
