December 19, 1991 Pursuant to due call and notice thereof, the City Council for the City of st. Joseph met in regular session on Thursday, December 19, 1991 at 7:00 p.m. in the st. Joseph City Hall. MINUTES: Loso made a motion to approve the minutes of the December 5th City Council meeting as presented; seconded by Hazen. Ayes: Dehler, Sad10, Loso, Hazen. Nayes: None. Motion carried. MAYOR REPORTS: No report. COUNCIL REPORTS - SADLO: 1) The review of the Mobile Home park water meters situation, with the City Engineer will be done soon. 2) The water which was running in the vacant rental house, on College Avenue has been turned off. The City may need to certify this if we don't get payment for it. LOSO: The skating rinks are being flooded and will open on December 22. Attendants have been scheduled and briefed on their duties and responsibilities. The City may consider putting a window in the hockey warming house. HAZEN: Hazen asked for clarification on the Fire Department report. ST. JOSEPH BASEBALL TEAM, INC. : Jeff Hess, representing the st. Joseph .Basebal1 Team, -Inc. presented a summary of their upgrading projects, of the ball field in Memorial Park, along with financial status. He - asked the Council to pay Traut Wells for their costs in installing the sprinkler system, because the Baseball Team did not receive the grant ~ Page 2005 ~ . ~for which they had applied. Discussion of problems - water not IIr metered, and connection to fire hydrant needs to be corrected. Also the Baseball Team, Inc. will provide the City Council a report on their revenues and expenditures, costs and charges. Loso made a motion to pay the invoice of Traut Wells of $5,304~29, upon 1) written assurance that a city authorized water meter will be installed prior to use of the sprinkler, and 2) final asbuilts of the system presented to the City. The st. Joseph Baseball Team, Inc. will hold fund raisers to reimburse the City for the amount. The Council will address the reimbursement status, upon the Baseball Team's next presentation to Council for the next phase of improvement. The motion was seconded by Hazen. Discussion -water meter will not be able to be installed until spring,. and City policy is cost of meter is the responsibility of the property owner (City will pay for the meter.) Ayes: Sadlo, Loso, Dehler. Nayes: Hazen. Motion carried. POLICE CHIEF REPORTS: 1) Chief Lindgren presented the monthly incident report. 2) Judy Weyrens presented quotes received for computerization of the Police offices and upgrading of the Clerk/Administrator's office. The Council reviewed the three quotes and deferred consideration until later in the meeting. OPEN TO PUBLIC: Mary Layton stated that she thought the quotes for 'computer hardware were too high and the City should look further. She also stated that her experience with Marco has not been good. Sadlo made a motion to recess at 8:40 pm for ten minutes; seconded by Loso. Ayes: Sadlo, Loso, Hazen. Nayes: Dehler. Motion carried. ELECTION EQUIPEMENT: The Council reviewed information on opti-scan election equipment. They requested a letter from the Secretary of States office assuring that this type of equipment would be usable, for the life of the equipment. The Council requested that the Clerk/Administrator set up a special meeting so that the Council may view the operation of the equipment. GAMBLING LICENSE APPLICATION: Hazen made a motion to approve the application for exemption from lawful gambling license of the Sno-Joes, Inc, for a fund raiser, to be held at the LaPlayette on March 20, 1992. The motion was seconded by Sadlo. Ayes: Dehler, Sadlo, Loso, Hazen. Nayes: None. Motion carried. LICENSES: Loso made a motion to approve the following 1991 License Applications; seconded by Sadlo. . Ayes: Dehler, Sadlo, Loso, Hazen. Nayes: None. Motion carried. EMERGENCY SIREN INSTALLATION: Concerns of the neighborhood residents, of the proposed site for installation of the new emergency siren, for alerting residents of a potential or impending disaster, were discussed with the Council. The proposed sites are the all ey in block 2 of Loso's Fourth Addition, and the southwest corner of Baker Street and Second Avenue. Gladys Schneider questioned why a residential neighborhood was chosen for the site. Ken Twit suggested the Eastern Park lift station property. Residents discussed the possibility of the . equipment falling off the pole, and that it is not nice to look at. The Council and neighbors discussed the expected future growth areas of the City, and the negative aspects of the siren. Sadlo stated that our most precious possession is our children and that we should consider Page 2007 .. . . < ~this in establishing a site. He also stated that because of the large range of the siren, a few blocks one way or the other will not have much effect. It is a safety warning device, wh i ch wi 1 1 alert to tornados or other hazards like a chemical spi 11, and can be used as a loud speaker. Loso stated that the possibility of the equipment falling off the pole is minimal. Bud Reber stated that it would make more sense to put it on the future water tower site, rather in a residential zone. Counc i 1 discussed further the range of the siren and the adversity of the neighborhood residents to it being placed at any site in their neighborhood. sadlo made a motion to establish the site for the emergency siren as Block 25 of Peter Loso Addition, the property owned by the City for a future water tower site. The motion was seconded by Dehler. Ayes: Sadlo, Dehler, Loso. Nayes: None. Abstained: Hazen. Motion carried. Loso made a motion to pay Front Line Plus Fire and Rescue 95% ($25,222.50) of the approved quote of $26,550, and retain $1,327.50; seconded by Hazen. Ayes: Sadlo, Dehler, Loso, Hazen. Nayes: None. Motion carried. RESOLUTION TO APPROVE UPDATED ORDINANCE CODE: Loso made a motion to approve a resolution approving the update to the code of ordinances, known as the 1992 Edition of the st. Joseph Code of Ordinances, with ~the effective date being January 1, 1992. The motion was seconded by Hazen. Ayes: Sadlo, Dehler, Loso, Hazen. Nayes: None. Motion carried. COMPUTERS: The Council further discussed computer quotes for the Police Department and to upgrade the Clerk's office. Quotes were received from Marco, Simplified, and Sunset Computers, for 386 Processors, with 100 and 200 minimum MB hard drive, networking, and a printer. Hazen made a motion to approve Marco's quote if the hard drive is IBM, but not PS2, and affirm that the networking includes installation charges. The approved quote is $4,997, for three 386/25 MHz Personal Computer work stations with 100 MB hard drive, and one 386/25 MHz personal computer work station with 200 MB hard drive, quote of $2,099, and a printer from Simplified Software for $430, on the condition that the quoted hard drive is IBM, but not PS2, and affirm that the networking incluàes installation charges. JOSEPH, MINNESOTA 56374 (612) 363-8250 EMERGENCY 911 DATE: Jan 2, 1991 TO: St. Joseph City Council FROM: Chief Lindgren SUBJECT: TRAINING/SECRETARY Dear Council Members, I have been advised that the training on our computers will take 2 to 3 days, and is free in the cities, or $200.00 a day and they will train up here. I would like to train in the cities. I would like your permission to stay over night in the cities vs. driving back and forth each day. I would sent two groups~ one of 3 and one of two, so we still . have our regular police coverage here in town. They are open as to the dates we can train, so we will be able to get everyone trained within two weeks. I would also like permission to start scheduling Jean Gustin at the 20 hours a week after she is trained on the computers. I have spoke to her about this and she wants to do this, and I have indicated that there would be a different pay scale for the clerk vs. police work, and this is fine with her. I have also told her not to quit her security job until we get approval for the clerk position from the council. Today 12/31/91 I have learned that Jeans last day at Finger Hut is 1/5/92. She has applied for and been approved as our D.A.R.E. Officer with the B.C.A. and is sch- eduled for two weeks of training (free, and with council's approval) in Feb. In addition to this, and with working our other open shifts, it is too time consuming with her full time job, so she quit that and is going to dedicate herself to only police matters. This ordinance shall apply to the construction and maintenance of all walls or fences within the City. This Ordinance shall be applied in conjunction with Ordinance 52.13 subd. 14, and be interpreted consistant therewith. Section 56.2: PURPOSE. This Ordinance was enacted for the following purposes: a) To generally regulate fence or wall construction. b) To assure that fences and walls do not unreasonable diminish the use, enjoyment or value of adjacent properties. c) To assure that fences and walls are constructed within the property of the party who will maintain the wall or fence. ~ d) To assure that fences or walls do not restrict light or air to adjacent properties. e) To assure a reasonable degree of consistancy in the location of residential fences or walls. £) To require walls and fences be constructed of a low maintenance material so as to avoid deterioration. When exercising any discretionary powers, the City shall be guided by the expressed purpose of this Ordinance. \ Section 56.3: PERMIT. Prior to constructing or reconstructing a fence or wall within the City, the person or entity owning the property in which the wall or fence is to be constructed or reconstructed shall fIrst secure a fence permit from the City. An application fee, in an amount set by the City Council, shall be paid at the time the application is made. The application shall be on a form prepared by the City Clerk and shall contain a legal description of the property on which the fence or wall is to be constructed or reconstructed, a sketch showing the location of the fence or wall, a description of the materials to be used in the construction of the fence or wall, and a description or sketch of the design of the fence or wall. The application will be referred to the City building inspector for review and the issuance of a permit upon a determination that the proposal complies with this Ordinance. The fence or wall shall be subject to inspection by the building inspector upon completion of construction or reconstruction, and shall be modifIed by the owner as required by the building inspector if not in conformance with .,: this Ordinance. 181 . . . . ~ Section 56.4: FENCE HEIGHT. No fence or wall located within a residential area shall exceed the height of six feet. No fence or wall located in a commercial area shall exceed the height of 8 feet, A fence or wall in an industrial area shall not exceed 8 feet unless a higher fence or wall is approved as part of the special use permit allowing the industrial use. Section 56.5: FENCE MATERIALS. Fences may be constructed out of wood or chain link material. Walls may be constructed out of stone or brick. All wood fences, other than those constructed out of redwood or cedar, shall be stained or painted upon completion of construction or reconstruction. All chain link fences shall be made out of a non-rust material. Barb-wire and electrical fences are strictly prohibited except as allowed in an industrial area pursuant to a special used permit. Other materials which are not specifically allowed by this Section, nor specifically prohibited, may be permitted only by variance granted pursuant to Section 52.9 herein. Section 56.6: FENCE LOCATION. No "privacy fence" may be constructed or maintained on residential zoned proprety fróm the street abutting the front of the property to the rear of the residential structure located on the lot. A "privacy fence" shall be considered a fence which obstructs vision through 50% or more of the fence area. A "non-privacy fence" shall not be constructed in a residential zoned property from the street abutting the front of the property to the front of the residential structure located on the lot. A wall shall not be constructed or maintained within any area where a privacy fence is prohibited. Section 56.7: BORDER FENCE OR WALL. Any fence or wall which parallels a ~ property line shall be constructed or reconstructed at least one foot from off the property line, unless the adjacent property owner consents in writing to the construction and maintenance of the fence or wall directly on the property lines. This consent shall be provided to the City at the time application is made for permit. With respect to any fence or wall located on or within 6 feet of a property line, that side of the fence which appears as the most finsished, or which does not have exposed posts, shall be the side which shall face the adjacent property. Section 56.8: PROPERTY LINE LOCATION: The permit application for any border fence or wall shall also include a statement signed by the applicant and adjacent landowner( s) verifying that the property line separating the adjacent properties has been determined to the satisfaction fo the parties signing the statement and verifying that no property line dispute exists. In lieu of such a statement, the applicant shall provide proof that the property lines have been recently determined by a registered surveyor, and that stakes, pins or other markers have been placed to indicate the location of the property line. Section 56.9: VARIANCE. Any provisions of this ordinance may be varied upon application and after consideration and hearing by the Planning Commission with their recommendation to the City Council. In granting a variance, the City must make a finding that the proposed variance will not be offensive or objectionable to the owners of any adjacent properties, will be consistent with the long term development of the property, and will comply with the stated purposes of this ordinance. Section 56.10: PREEXISTING FENCES. This Ordinance shall apply only to fences and walls constructed or reconstructed after December 1, 1991. Any wall or fence which is more .; than 25% destroyed so as to require reconstruction shall be subject to the Ordinance. 182 > . . , ~ Section 56.11: PENALTIES/REMEDIES. Violation of this ordinance shall constitute a misdemeanor as herein defined. The City of St. Joseph may also seek civil remedies, including but not limited to injunctive relief prohibiting construction or maintenance of a fence in violation of this ordinance. ~ .) 183 . .
