Pursuant to due call and notice thereof, the City Council for the
City of st. Joseph met in regular session, on Thursday, January 2,
1992 at 7:00 p.m. in City Hall.
The meeting was called to order by Mayor Dehler with the following
members present: Mayor steven Dehler; Members of the Council Leo
Sadlo, Ross Rieke, Bob Loso, Stephanie Hazen. Clerk/Administrator
Rachel Stapleton.
OTHERS PRESENT: Stuart Goldschen.
AGENDA APPROVAL: Hazen made a motion to approve the agenda;
seconded by Sadlo.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
BILLS PAYABLE: Counc i 1 requested that they receive partial lists
of the bills ear 1 i er , if possible, without duplicity of work by
staff. Hazen made a motion to approve the bills payable as
presented; seconded by Rieke.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
. MINUTES: Loso made a motion to approve the minutes of the
December 19, 1991 City Council meeting with changes to the minutes
on the emergency siren proposed sites, "south side of Baker street
between Second and Third Avenues SE, " and the computers " approve
Marco's quote, if the computer system quoted is IBM, but not PS2,
and remove the redundancy, ("on the condition that the quoted hard
drive is IBM, but not PS2, and affirm that the networking includes
installation charges"). The motion was seconded by Sadlo.
Ayes: Dehler, Sadlo, Loso, Hazen.
Nayes: None. Rieke abstained. Motion carried.
MAYOR REPORTS: 1) The Counc i 1 received a copy of a letter of
request to increase rates, from the City Attorney. Dehler made a
motion to table the matter until the first meeting in July, as the
attorney indicated, would be allowable, due to the city budgeting
schedule and current budgetary restraints. The motion was
seconded by Rieke.

Nayes: None. Motion carried.
2) The process of annexation of st. Ben's property which is
outside the city boundaries is nearing completion. It is intended
that the Council wi 1 ì consider a resolution to allow the
annexation, at the next Council meeting.
. 3) The Mayor discussed a proposed cost sharing agreement with
representatives of st. Benedicts, for improvement of East Baker
Street, and they indicated that they have no problem with it.
4) Dehler presented revised percentage amounts of the proposed
budgetary figures. He also requested that the Council receive a

report of percentage change from 1991 to 1992 adopted budget. The
Clerk is to get information on State Aids and formulas and the
effect of them on the city. 5) The Mayor thanked everyone for
working with him the past year, and Happy New Year.

LOSO: 1) Park Board discussed the report from the insurance
company on loss contro 1 , and recommended to the Council to fo 11 ow
the recommendations. 2) The Park Board also recommended reviewing

acreage, boundaries, and costs of obtaining I nd i an Hill for a
park. Sadlo stated that parks are costly and the city currently
is trying to develop Morningside Park. Also Indian Hill appears
to fa 11 into the wetlands requirements.
CLERK/ADMINISTRATOR REPORTS: 1) Presented a request from Dick
Taufen to allow him to extend 15 hours of vacation time from 1991,
to be used in the middle of February, for a family event. Loso
made a motion to allow the extension as requested; seconded by
Rieke.

2) Government Training Service is sponsoring seminars for elected
officials, on the art of public leadership and survival skills for
the elected officiai. Hazen made a motion to approve the actual
and necessary expenses and per diem for Members of the Council who
wish to attend this seminar at Bloomington on February 7 ; seconded
by Sadl0.

POLICE DEPARTMENT - COMPUTER TRAINING AND SECRETARY: 1) Counc i 1
discussed the request for training or the Police Officers on the
new computer system and software for their department. They
· requested a break down of the costs of traïning in the cities vs.
training here. The Council requested more information prior to
making a decision. 2) Loso made a motion to approve Jean Gustin
to work 20 hours per week as clerk (secretary) , at secretary wage
scale, in addition to her work as part time patrol officer;
seconded by Rieke.
Ayes: Dehler, Sadlo, Rieke, Hazen, Loso.
Nayes: None. Motion carried.
OLD BUSINESS - EMERGENCY SIREN - Loso discussed that the location
by the railroad tracks may not reach the southeast end of the
city. Sadlo stated that the people we are tying to protect are
the ones that don't want the siren.
Loso made a motion to recess for 15 minutes at 8: 15 p.m. ; seconded
by Sadlo.
Ayes: Dehler, Sadio, Rieke, Hazen, Loso.
Nayes: None. Motion carried.
Mayor Dehler reconvened the meeting at 8:30 p.m.
OLD BUSINESS - FENCE ORDINANCE NO. 56: The Council reviewed the
proposed fence ordinance at the January 2 , 1992 meeting and
proposed the following changes, and requested that the Pianning
Commission consider these, and any other changes, and make
· recommendations.
Section 56.2 b) To assure that fences and walls do not
unrea~onablv (spelling), diminish the use, enjoyment or value of
adjacent properties.

Section 56.2 d) Omit.
section 56.3 Include the following from Section 56.8 "The
app 1 icant sha 11 provide proof that the property lines have been
recently determined by a registered surveyor, and that stakes,
pins or other màrkers have been placed to indicate the location of
the property line. " The Council recommended that this portion
also includes language which would allow the Building Inspector
some latitude in which pins or stakes could be used for property
1 i ne location, if s/he is confident of the noted location of the
lot line. Otherwise a certified surveyor would be required to
find the lot line.
Section 56.4 Fence Height - No fence or wa ì ì located within a
residential area sha i 1 exceed the height of seven feet. No fence
or wa 11 located in a commercial area sha 11 exceed the height of
eiqht feet. A fence or wa ì ì in an industriai area sha 11 not
exceed ten feet. If two different zones abut, the zoning
requirements of the of the property owner constructing the fence,
sha1i prevail.

NOTES: 1. A total of at leaSt 438 Verbal warnings were given last year.
2. Our total initial complaint reports (LC.R. IS) for 1991 were
1,771 compared to 1,595 in 1990, and 1,491 in 1989.
3. There are two items that I need your approval on for this 1st.
month of 1992, DARE and approval to order a new squad. First,
. DARE. I believe you all know what DARE is. I'havè'beenin
contact with the lab school and they very much want this progra
I have signed agreements with them,to start the program. It
will be for the 6th grade classes. ,Kennedy only goes to 4th
grade, and they will get DARE in 5th or 6th grade in Discovery
School so all the kids from our area will get DARE training.

The program is for a uniformed police officer teaching in the schaal
. for a 1 hour class 1 time a week for 1 quarter of the school year. Jean
Gustin has been selected from our department and been approved by the B.C.]
for the two week training course starting Feb. 3. I need your approval to
send her to this course. She will be working in uniform in the office 4
hours a day 8:00am to 12:00pm, and then 1 day a week she will work an extrë
hour teaching DARE. .
The two week training session is $350.00 for room and board, she has
to stay at the facilities. r am applying for two grants for DARE costs.
1 grant I will get for sure, this will pay 75% of the $350.00, and is a
federal grant. The other grant I am applying for will be for around $3,00C
for other costs associated with DARE. According to the grant criteria, we
are in a good position to receive this grant also. In addition to this, tr
St. Joseph Women of Today~have offered help and a·$100.00 towards this pro-
gram.
The second item, I need your approval for is to order the new squad
car. Ford got the state bid this year at $12,968. The only problem is
they have not started to make the cars yet. They are telling me around
June of 92 they should have them in. This scares me, and I can see a
problem of when June of 92 comes and they say, will within the next two
months we should have it for you. r checked around, and the county can
get.Chev. this years Chev. squads for last years state bid price. I con-
tacted the dealer and he says we can too. The price is $12,924, (enclosed
with Ford bid.) Chev. has squads in stock, but if they would have to ordel
one for us, it would be in within 60 days from our order date.
I would recommend we order the Chev. squad car. I would also recommer
we get the extra $200.00 add on of inoperative rear doors, windows, etc.
. The main reasoning I recommend the Chev. now is our Chev. has 130,000 mile1:
on it and is used as a'spare and second car. The Ford has 40,000 on it.
We need to get a new car and rotate the use of each so we use the new squac
for 4 years and round it off to around 100,000 miles each by the end of 4
years. This will a~so help us to keep the'cars under warranty longer. If
I ord.~r_.the Chev. nq,w, we will park the Ford and use the old Chev. until
. the new one arrives, and save the warranty/miles on the Ford.
One other item RE: squads, is thåt Chev. has an extended warranty of
85,000 and 100,000 miles, and 4 years with no deductable. The 4 year 85,OC
mile. warranty is around $800.00. The 4 year 100,000 mile warranty is arour
$1,000.00. I would suggest we get the 4 year 100,000 mi~e extended warrant
with no deductable. Thank you.

shown for Survey Crew are from Regan Land Surveying. As in the
past, there will be no additional charge for overtime hours
(primary impact would be construction inspection), nor will there

CONFINED SPACE ENTRY POLICY
(Effective )
I . PURPOSE
The purpose of the Confined Space Entry Policy is to comply with OSHA
regulation 5205.1000 - 5205.0300 and to establish guidelines for
employees safety while working in confined spaces. All employees have
a responsibility to follow this policy. Management and supervisory
employees shall be responsible for employee training and compliance
with this policy.
Failure to comply fully with this policy may result in injury or death.
I I . DEFINITIONS
~onfined Space - A confined space is any area which by design has
limited opening for entry and exit and/or unfavorable natural
ventilation. The space may contain or produce an atmosphere which may
be hazardous to life, and is not designed for normal occupancy by
people.
The types of confined spaces that may be encountered in the water and
wastewater industry include, but are not necessarily limited to,
manholes, sewer lines, vaults, pumping stations, wet wells and storage
facilities.
Work - Includes repair or maintenance procedures requiring entrance
and/or occupation of a confined space. The atmospheric conditions of
the space may deteriorate because of, or during, the work being
performed.
Inspections - Entry and/or occupation of a confined space for the
purpose of observing the condition/operability of the equipment within
the facility.
I I I . TYPES OF HAZARDS
A. Oxygen
1 . Low oxygen deficiency content is considered dangerous to 1 i fe
and health.
. 2. High oxygen content is explosive when an ignition source is
present.
B, Toxic Gases (Including but not limited to)
1 . Hydrogen Sulfide (H2S) has the distinctive odor of rotten eggs.

H2 S is extremely toxic at low concentrations and explosive at
high concentrations.
2. Sulfur Dioxide (502) is nonexplosive but highly toxic.
3. Carbon Dioxide (C02) will not support life at higher
concentrations over a long period of exposure.
4. Carbon Monoxide (CO) is very toxic and ordorless.
5. Chlorine (CL2) is extremely toxic, irritating and threatening.
C. Explosive Gases (Including but not 1 imi ted to )
1 . Methane - Explosive at lower concentrations.
2. Certain petroleum products - Gasoline and other fuel oils.
3. Hydrogen Sulfide - H2S is explosive at high concentrations.
4. Natural Gas (NSP, Minnegasco or other natural gas uti 1 ity).
IV CONFINED SPACE CLASSIFICATIONS
A. Class I - Minimum Potential Hazard
Confined spaces where an atmosphere with a dangerous air
contamination, oxygen deficiency or oxygen enrichment is unlikely
to develop.
1 . Entry procedures are:
. a. Class IA - Annual permit authorizing entry is required.
This permit is ~o be used as a checklist.
b. Class IA and Class 16 - All areas of the space must be
ventilated with clean air at a rate of six (6) or more air
changes per hour, or as specified under OSHA regulation
5205.1040 A3a and 64
c. Class 16 - Test atmosphere before entry and continuously
monitor atmosphere during entire time of occupancy of
space.
B. Class I I - Dangerous but not immediately life threatening
Confined spaces where an atmosphere free of dangerous air
contamination, oxygen deficiency or oxygen enrichment has been
verified.
1. At least one person shall stand by outside of the space
prepared to give assistance in case of emergency.
2. Visual, voice or signal line communications shall be maintained
between the individuals in the space and the stand-by person.
3. An approved safety belt or harness with an attached 1 i ne sha 11
be used where practical and feasible. The 1 i ne sha 11 be at
lest 2000 pound test and secured outside the entry opening.
4. The Stand by person shall not enter the confined space without
alerting an emergency response team or other trained rescue
. workers of the intent to enter the confined space. Stand-by
persons shall not enter the space unless the stand-by person is
protected by wearing a self-contained breathing apparatus
(SCBA)
5. Mechanical ventilation shall be initiated prior to entry into
the space and shall continue during the entire occupancy of the
.
space.
6. Continuous atmospheric monitoring shall be performed prior to
entry into the space and during the entire time of occupancy of
the space.
7. Hot work is prohibited of the flammability level is 10% of
lower explosive level (LEL) or greater.
8. A confined space entry permit ~ required prior to entry.
C. Class III - Immediately dangerous to li fe and hea 1 th
Confined spaces where an atmosphere free of dangerous air
contamination, oxygen deficiency or oxygen enrichment cannot be
verified or prevented. Entry will not be permitted without proper
authorization.
1. Approved respiratory protectiv~ equipment (SCBA) must be worn
by occupants of the space.
2. An approved safety belt or harness with an attached 1 ine must
be worn by all occupants of the confined space. The 1 i ne sha 11
be secured outside the space and shall be at least 2000 pound
test.
. 3. At least one person shall stand by outside the confined space
ready to give assistance incase of emergency.
a. The stand-by person shall have approved respiratory
equipment (SCBA 15 min air pac) available for immediate
use.
b. The stand-by person may enter the space only after
notifying an emergency response team, having a stand-by
person available and only after donning the required
personal protective equipment (SCBA).
c. Visual, voice or signal line communications shall be
maintained between individuals within the confined space
and the stand-by persons(s).
4. When an entry must be made through a top opening the following
requirements will apply:
a. The safety harness shall be of the type that suspends a
person in the upriQht position.
b. An approved hoisting device or other effective means must
be used to lift workers out of the space.
c. A confined space entry permit is required prior to entry.
5. Hot work is prohibited if the flammability level is 10% of
lower explosive level (LEL) or greater.
6. At least one person trained in first aid and cardiopulmonary
resuscitation (C.P.R.) sha 11 be immediately available whenever
1. respiratory equipment is required.
TRAINING
Employees are expected to become and remain familiar with the terms
of this policy. To assist employees in becoming familiar with the
policy the employer will do the following:

A. Annual training will be given to employees regarding confined
space entry.
1 . Provide copes of the "Confined Space Entry Checklist" to
all affected employees.
2. A copy of the policy will be issued to each employee
regarding confined space entry.
B. Periodically the supervisor will conduct work-site inspections to
assist employees in complying with the policy.

-.r RESOLUTION FOR ORDERLY ANNEXATION
BETWEEN THE TOWNSHIP OF ST. JOSEPH, MINNESOTA
AND THE CITY OF ST. JOSEPH, MINNESOTA
The Township of st. Joseph and the City of st. Joseph hereby
jointly agree that the area designated for orderly annexation in Joint
Resolution Between the Township of st. Joseph and the City of st.
Joseph Designating an Area for Orderly Annexation dated october 10,
1975 be amended to include the following:
Both the Township and the City agree that no alteration of the
stated boundaries of this agreement is appropriate. Furthermore,
both parties agree that no consideration by the Board is
necessary. Upon receipt of this resolution, the Municipal Board
may review and comment, but shall, within 30 days, order the
annexation of the following-described property in accordance with
the terms of the Joint Resolution.
The territory to be annexed consists entirely of lands which are
owned and operated by the Sisters of the Order of st. Benedict and by
the College of st. Benedict, for ecclesiastical and educational
purposes. The property to be annexed encompasses all of the property
'belonging to the College of st. Benedict lying outside of the City of
st. Joseph and also includes a portion of the property belonging to
the Sisters of the Order of st. Benedict. This description of this
property is as follows:
That part of the Northwest Quarter of the Northwest Quarter in
Section 15, and that part of the North Half of the Northeast Quarter
in Section 16, and that part of the South Half of the southeast
Quarter in Section 9, and that part of the Southwest Quarter of the
Southwest Quarter, in Section 10, all in Township 124, Range 29,
stearns County, Minnesota, lying South of the existing corporate
limits of the City of st. Joseph, lying West of College Avenue and
lying North and East of the following described line: Commencing at
an iron monument at the Northwest corner of said Section 15; thence
along the North line on an assumed bearing of East, 661.35 feet;
thence South 00 degrees 10 minutes West a distance of 1207 feet;
thence bearing East 660 feet, more or less, to a point on the East
line of the Northwest Quarter of the Northwest Quarter, in said
Section 15, said point being the point of beginning of the line to be
described; thence bearing West along the previously described East-
West line and its Westerly extension, a distance of 3300 feet, more
or less, to a point lying due South of the Southwest corner on Lot 5,
in Auditor's Subdivision No.4, according to the recorded plat
thereof, Stearns County, Minnesota; thence due North to the Southwest
corner of said Lot 5 and there terminating.
. NOTE: This description begins at a point on the center line of
College Avenue and proceeds West along the North line of the Church
of st. Joseph Cemetery and continues West to a point due South of the
Southwest corner of the existing corporate limits. The description
.
. then proceeds North to the point of intersection with the southwest
corner of the existing corporate limits, which corner is also the
Southwest corner of Lot 5, Auditor's subdivision No. 4.
The territory described above abuts upon the City limits at the
southern boundary thereof, and is ecclesiastical and educational in
character. The territory abuts the City limits on one side, and is
being served by city sewer through an agreement. The property owners
maintain their own water system for the population of the College and
Convent.
The undersigned jointly resolve that the above described property
is in need of orderly annexation, and resolve that the property be
annexed pursuant to the Joint Resolution for Orderly Annexation
Agreement.
