Pursuant to due call and notice thereof, the City Council for the
City of st. Joseph met in regular session, on Thursday, January
16, 1992 at 7:00 p.m. in City Hall.
MEMBERS PRESENT: Mayor Steven Dehler; Members of the Council Leo
Sadlo, Ross Rieke, Bob Loso, Stephanie Hazen. Clerk/Administrator
Rachel Stapleton.
OTHERS PRESENT: Stuart Goldschen, Bud Reber, Dan Nierengarten,
Brad Lindgren, Richard Taufen, Judy Weyrens.
AGENDA APPROVAL: Hazen made a motion to approve the agenda, with
additions; seconded by Sadlo.
Ayes: Dehler, Sadlo, Loso, Hazen.
Nayes: None. Motion carried.
Rieke arrived at 7:05 p.m.
BILLS PAYABLE: Loso made a motion to approve the bills payable as
presented; seconded by Sadlo.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
. MINUTES: Loso made a motion to approve the minutes of the January
2, 1992 City Council meeting with changes to the minutes on the
Mayor Reports - Hazen made the motion to table a letter of request
to increase rates; 2) under Loso's report, Morningside Park
appears to fall into the wetlands requirements. Sadlo seconded
the motion.

MAYOR REPORTS: The Mayor is getting information from the Engineer
for an agreement with st. Benedicts.
COUNCIL REPORTS - RIEKE: Kevin Schirmers called for information
on the rezoning of his property, to R-2, in 1987, by the Joint
Powers Board. Evidently minutes of the meeting cannot be found
and he needs documentation that the property was rezoned. This
has been noted in the City Council minutes of that time, and the
Township Clerk is gathering information from that meeting and
documenting the action from it, as was recommended by the Township
attorney.
HAZEN: The Planning Commission met, and 1 ) B ill Hanson and Fred
Sanda 1 , of APO, discussed the transportation plan with them and
affirmed that it is part of the comprehensive plan; 2)
reviewed the proposed fence ordinance and tabled it until the
February meeting; 3) recommended to include the subdivision
checklist as an appendix in the Code of Ordinances. Hazen made a
. motion to include the subdivision checklist as an appendix to the
Code of Ordinances; seconded by Loso. Discussion - Engineer and
Attorney should make recommendation to where the most advantageous

. filing would be. Hazen amended the motion to state that the
subdivision checklist is to be included in the most advantageous
place for the City, as the City Engineer and Attorney recommend;
seconded by Sadlo.

Nayes: None. Motion carried.
The Planning Commission recommended to periodically have joint
meetings with the Council, and recommended a meeting on January
28. Rieke made a motion to have a joint meeting on January 28, at
7:00 p.m. in city hall; seconded by Hazen.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
Chairman Klein was appointed to the APO Full Board, with Linda
Sniezek, as alternate, to attend any time he is unable to attend.
SADLO: 1) Hockey rink light is on early in the morning sometimes.
The attendants will be made aware to turn them off. 2) The APO
Christmas party was in st. Joseph this year. More Councilmen
should attend functions held in our City. 3) Growth and the
effect on sewer systems, was discussed at the Sewer District
meeting. The Council will need to address sewer system
capabilities, when considering future annexations and growth. It
appears that some growth areas will be served by sewer districts
in the future. 4) A new building is proposed for behind Gary's
. Pizza. Before a bui lding permit is allowed, all the problems of
the underground installations, (water and sewer lines, an
abandoned septic system), and fire access to existing buildings,
will have to be addressed, in full. 4) The 1991 annual water
report was well compiled by the Water Superintendent, total
gallons pumped in 1991 were 97,747,000. 5) With the investment
interest rate so low now, the Clerk should prepare to call any
bonds which are callable.
LOSO: Loso stated he had received complaints from citizens that
the Mayor has a trailer (mobile home) parked on his property, as
is prohibited by city ordinance. Mayor stated that this is a
recreational vehicle.
POLICE CHIEF REPORTS: The Chief 1) presented an annual incident
report of calls for 1991. 2) presented a resolution in support of
D.A.R.E. (Drug Abuse Resistance Education) and requested that
Officer Gustin be designated the D.A.R.E. Officer, trained and
certified. Total costs of instruction will be under $1,000 beyond
her salary. Sadlo made a motion to approve Virginia Gustin as
D.A.R.E. Officer and two weeks training for this position. The
motion was seconded by Hazen.

Loso made a motion to approve the following resolution; seconded
by Hazen.

. RESOLUTION 92-1
A RESOLUTION OF SUPPORT OF THE D.A.R.E. PROGRAM
WHEREAS, drug and alcohol abuse places a negative impact on
the society and the citizenship of st Joseph; AND
WHEREAS, the children are our most precious resource, and
there is an inherent need to protect them from the adverse
elements of society; AND
WHEREAS, children are directly impacted by the abuse of drugs
and a 1 coho 1 ; AND
WHEREAS, the Drug Abuse Resistance Education (D.A.R.E.)
Program is a recognized, and proven preventative curriculum,
which is structured to educate youth of the dangers of alcohol and
drug abuse.
NOW, THEREFORE BE IT RESOLVED THAT, the City Council for the
City of st Joseph supports the concept and methodology of the
D.A.R.E. program, and approve the implementation of the D.A.R.E.
program in the City of st. Joseph.
BE IT FURTHER RESOLVED, that the City Council for the City of
. st. Joseph will continue to support the use of D.A.R.E. as an
avenue of drug and alcohol education as long as the need exists in
our community.
Adopted by the City Council for the City of st. Joseph this
16th day of January, 1992.

PATROL VEHICLE: Chief presented quotes of state bid for patrol
vehicles. Sadlo made a motion to purchase a Caprice Chevrolet
police car, through the state bid at a cost of $13,145; seconded
by Rieke.
Ayes: Dehler, Sadlo, Rieke, Hazen.
Nayes: Loso. Motion carried.
Counc i 1 discussed a maintenance agreement for the car and deferred
action on it.
OPEN TO PUBLIC: No comments or questions were received from the
public. Mayor Dehler asked Bud Reber if a building could be built
over a septic tank. Reber stated that Roger Steichen discussed
his proposal for construction with the Planning Commission, and
that he is not planning to build yet.
. ENGINEERING RATE REQUEST: Loso made a motion to approve the
engineering rate schedule for 1992, of SEH (Pauly, Olsen,
Bettendorf, Eastwood & Assoc.) as proposed by City Engineer Joe
Bettendorf; seconded by Rieke.

CLERK/ADMINISTRATOR REPORTS: 1) Demonstration of opti-scan
election equipment was set for January 20 at 8:00 p.m. The st.
Joseph Township Board intends to come to it.
2) Loso made a motion to repair the toilet stool in the clerk's
office; seconded by Rieke.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
3) Dale Salo has filed in conciliation court for return of
inspection fees of $2,000 plus f i 1 i ng fee. Council genera 11 y
agreed that the Engineer and Attorney should assist the
Clerk/Administrator in defending the City in this wrongful claim.
4) The City received a sanitary sewer extension permit for Pond
View Ridge from Minnesota Pollution Control Agency.
5) The City will be receiving an insurance risk survey this year
from ISO Risk Services which will review the fire rating and re-
rate our city.
6) Loso made a motion to approve Rachel Stapleton , s attendance at
the annual Clerk's Conference, March 17-20, in st. Cloud; seconded
by Hazen.

7) Sadlo made a motion to approve word processing software for
networks, for the Police Department - PFS Professional Write LAN
(file server) at $250; seconded by Rieke.

· LIQUOR ORDiNANCE: Loso requested that the Council have a meeting
with the bar owners and attorney to update the liquor ordinance.
After suggestions of smaller group meetings, or individual contact
with bar owners, the Council requested that the City Attorney

review.
ANNEXATION: Council reviewed a proposed annexation resolution for
the part of the College which is not in the City and part of
adjacent property of the Sisters of the Order of st. Benedict.

if Roman Meyer should be excluded.
SPECiAL MEETINGS: Mayor Dehler recommended that the Counci 1 limit

CONFJNEDSPACE ENTRY/PERMiT AND CHECKLIST: Dick Taufen, Public
Works Superintendent presented confined space forms for the

by Sadlo. Discussion -how does this affect weekend checks? Dick

WATER TOWER POLICY: Dick Taufen presented a proposed po 1 icy as
recommended by the insurance Loss Control Consultant, which
requires the fol!owing: The City prohibits City employees from

service work must be done, the City does agree to contract all

the City has constructed a new water tower, provided it is
constructed with the necessary safety equipment, and approved by

Mayor Dehler called the first quarterly joint meeting of the City
Council and the Planning Commission of the City of st. Joseph, to
order at 7:00 p.m. . Sadlo commended the Planning Commission

The group discussed the issues of the Council overturning a
recommendation of the Planning Commission in official matters such
as variances and special use permits. The Planning Commission
felt that the Council did not give adequate weight to the Planning
Commission , s decisions. Discussion of methods restricting the
. appeal process were discussed. The following process was agreed
on:
A request to consider a matter wi 11 not be placed on the
agenda until all the needed information is submitted and
requirements are met.
An applicant, who is requesting a variance or special use
permit or other allowances which require consideration by the
Planning Commission; will be sent a notice of approval or denial,
by the Planning Commission. If it is a den i a 1 , the reasons for
the denial, and the options available, along with a form for
appeal process will be sent. If the applicant wishes to appeal
the Planning Commission will consider it at the next regular
Planning Commission meeting, and then the matter may be considered
by the Counc i 1 .
The appeal will be made in writing.
The Council wi 1 1 act on the appea 1 , only after the Planning
Commission has reviewed it and makes recommendations to the
Counc i 1 on the appea 1 .
The Council will get more information from the Planning
Commission prior to making a decision.
The Council liaison to the Planning Commission is reporting well
to the Council.
. The group discussed wetlands issues, proposed fence ordinance, and
annexation issues affecting st. Joseph. Sadlo stated that
wastewater facility, for st. Joseph, is limited to 6,000

. population. The st. Cloud plant is now at 80 percent capacity.
DBL Labs and portions of Whispering Pines are requesting
annexation soon. Consolidation with the Township may need to be
looked at.
Mayor Dehler proposed that the group meet quarterly on the
following dates: Apr i 1 28, July 28, and October 27. The group
agreed to meet on these nights in the City Hall at 7:00 p.m.

. St. Joseph Fund
of the
Stearns County Historical Society
Definition: A restricted fund for use by the St. Joseph community to record and preserve the history of the
St. Joseph area as recommended by the city and township governing bodies.
Policy: The Stearns County Historical Society shall maintain a restricted fund, known as the St. Joseph
Fund, dedicated to the preservation of St. Joseph's history. Request for fund use shall be
presented to the Society board of directors by the governing body of the City of St. Joseph or
St. Joseph Township. No request for funds should be for more than 50% of the existing fund
balance.
Procedures: 1. Investment. The Society will attempt to invest funds in St. Joseph area. Separate and
distinct records will be maintained showing fund activity. Short-term investment media will be
considered (certificates of deposit & money market funds).
2. Fees. Management and accounting fees shall be charged to the account.
3. Annual Report. The Society shall issue an annual activity report identifying
contributions, net gains and losses, interest & dividends, management fees, and
distributions.
The activity report shall be sent to city and township governing bodies.
. 4. Request for Funds. Requests for expenditures of funds shall be submitted through
both the City of St. Joseph and/or St. Joseph Township governing bodies to the
Stearns County Historical Society executive director. Final approval of fund use and
distribution is vested in the board of directors of the Society.
Requests shall be in writing providing the minimum of the following information:
a. Needs assessment (reason for request)
b. Project objectives (measurable outcomes)
c. Methods (describes steps to achieve desired results)
d. Budget (estimate of total project costs)
e. Project summary
In the case of one governing body requesting funds the other shall be afforded the
opportunity to comment on the request to the Society.
5. Distribution of funds. Following board of director resolution authorizing
distribution of funds the Society will issue a check to the governing body who made the
request. Since funds may be invested in term deposits with penalty for early
withdrawal, there may be a delay in transfering funds.

\.<]inter Recreation Program: John cancelled the program two weeks ago. Laurie
will have to negotiate her salary with Rachel (City Clerk).
Future winter program - Events run by volunteers.
Recomnendation on Indian Hill: Mayor Steve Dehler informed John the city would
sned him information regarding Incian Hill. To date John has not received the
information. A recomnendation from the Park Board to have the city purchase land,
for a part on Indian Hill will be discussed at a later meeting.
Earthday committee project: John attended the ST. Cloud Chamber meeting regarding
Earthday. The events dates are from April 8th - May 22.

Spring Informational meeting: Set up meeting for March 23rd. Invite our city
Service groups. Put notice in our local paper.
Ask Janelle to put our monthly meetings in the paper each month now that they meet
every 4th Monday. If there is a change in t:i1I1e and location the secretary will
send Janelle a notice.
Pondview Developer: JOhn will invite Rich Heid, Pondview developer to our next
. meeting to find out where we/they stand in regard to this park.

Pursuant to due call and notice thereof, the Plannine Commission for
the City of St, Joseph met 1n reeular session on Monday, February .3 ,
1992 at 7:.30 p.m. 1n the St, Joseph City Hall.
Members Present: Chair Hub Klein. Members of the Commission Linda
Sneizek, S. Kathleen Kalinowski, Ken Hiemenz, Dan Nierenearten, Kurt
Schneider, Donald "Bud" Reber. Seeretary of the Board, Judy Weyrens,
Others Present: Council Liaison Stephanie Hazen, John Hazen, Roeer
Steichen.
Rop;er Steichen - Buildinp; Permit: Roeer Steichen appeared before the

Commission for approval of a buildine permit to construet a buildine on
the lot located between Gary , Pizza and Bo Diddley , The proposed

buildine would be 30 x 46 and be constructed of decorative block,
Commissioner Klein questioned whether or not the plans included a
basement and if he 1S aware that their are septic tanks buried
undereround on the lot. Steichen at this time does not intend to have
a basement and intends to die out the undereround tanks. Commissioner
~eber sueeested that Steiehen have soil borines done to test the soil.
e also reiterated that the tanks must be removed for his safety, If
the tanks were left 1n they could cause a shift 1n the buildine, as
well as other problems, Mr, Steiehen was made aware that the City
Ordinanee does not allow water and sewer conneetions 1Jntil after May 1.
When asked whether or not their were any easements on the property, Mr.
Steichen responded that their 1S an eieht (8) foot utility easement
runnine alone the entire back side of the property, The proposed plans
include a thirty one (.31) foot area for parkine, which would
accommodate approximately four to five ca rs ,
Heimenz made a motion to approve the site plan as presented by Mr.
Steichen. Mr. Steichen 1S exempted from providine off street parkine;
as clarified 1n Section 52.1.3 subd 4 of the St. Joseph Code of
Ordinances.
The amount of required off-street parkine space for new uses or
buildines, additions thereto and additions to existine; buildine;s
as specified previously, shall be determined 1n accordance with
the followine; table, and the space so required and shall be
irrevocably reserved for such use, except these requirements shall
not apply to the Central Business District of St. Joseph.
The buildine; permit 1S also contineent upon the approval of the plans
by the Buildine Inspector, Fire Chief, and Public Works Director,

Fence Ordinance: The Commission discussed the proposed fence Ordinance
as requested by the Council. Commissioner Heimenz drafted a proposed
Ordinance based on the Orieinal Ordinance as written by the City
Attorney and the recommendations of the City Council. Amone discussion
items were allowable materials for fences, location of fences and
maX1mum heiehts of fences. After discussion, Nierenearten recommended
Council Approval of the revised Fence Ordinance (see attached). The
motion was seconded by Kalinowski.

Schneider,

Minutes: Nierenearten made a motion to approve the Minutes of the
January 6, 1992 Plannine Commission meetine as presented. The motion

_etlands Seminar: Heimenz reported on the Wetlands Seminar that he
attended on-January 31, 1992 1n St. Cloud. The sem1nar discussed the
rules and permits of wetlands, the 1991 Wetland Conservation Act,
wetlands and approvine plats, and how to determine wetlands. A six ( 6 )
paee packet 1S in the proeess of beine formed to inform applicants of
what they need to be aware of. Heimenz stated the sem1nar was very
informative and received a wealth of information.

FENCE ORDINANCE
Section 56.1: APPLICATION. This ordinance shall apply to the
construction and maintenance of all walls or fences, to include
living fences, within the City. This Ordinance shall be applied in
conjunction with Ordinance 52.13, Subd. 14, and be interpreted
consistent therewith,
Section 56.2: PURPOSE, This Ordinance was enacted for the
following purposes:
a) To generally regulate fence or wall construction.
b) To assure that fences and walls do not unreasonably
diminish the use, enjoyment or value of adjacent
properties,
c· ) To assure that fences and walls are constructed on the
property line or within the property of the party who
. will maintain the wall or fence.
d) To assure that fences or walls do not excessively
restrict light or air to adjacent properties.
e) To assure a reasonable degree of consistency 1.n the
location of residential fences or walls.
f) To reqU1.re walls and fences be constructed of a low
maintenance material so as to avoid deterioration,
g) To require walls or fences to be constructed of non-toxic
materials.
When exercising any discretionary powers, the City shall be guided
by the expressed purposes of this Ordinance,
Section 56..3: PERMIT. Prior to constructing or reconstructing a
fence or wall within the City, the person or entity owning the property
1.n which the wall or fence 1.S to be constructed or reconstructed shall
first secure a fence permit from the City, An application fee, 1.n an
amount set by the City Couneil, shall be paid at the time the
applieation 1.S made. The application shall be on a form prepared by
the City Clerk and shall contain a legal deseription of the property on
which the fence or wall 1.S to be eons t r1J c t ed or reconstructed, a sketch
showing the location of the fenee or wall, a description of the
~aterials to be used in the construction of the fence or wall, a
description or sketch of the design of the fence or wall, to include
the provisions of section 5 6 , 9 : Property Line Location. The
application will be referred to the City Building Inspeetor for reV1ew
and the 1.ssuance of a permit upon a determinatión that the proposal
complies with this Ordinanee. The fenee or wall shall be inspeeted by
the Building Inspector upon completion of construction or

reconstruction, and shall be modified by owner as required by the
Building Inspector if not in conformance with this Ordinanee.
Section 56.4: FENCE HEIGHT. No fenee or wall located within a
residential area shall exceed the height of six feet, except for fences
from the street abutting the property to the rear of the residential
structure that are not chain link shall not exceed four feet, No fenee
or wall located ~n a eommercial area shall exceed the height of eight
feet. A fence or wall ~n an industrial area shall not exeeed eight
feet unless a higher fenee or wall ~s approved as part of the special
use permit allowing the industrial use, If two different zones abut,
the zoning requirements of the property owner constructing the fence
shall prevail,
Section 56.5: FENCE MATERIALS. Fenees may be constructed out of
trees and shrubs, wood or chain link materials, Walls may be
constructed out of stone or brick not less than four inches nor more
than twenty-four inches ~n width and shall be set on a firm foundation
half aga~n as wide at the base as the wall and rested below the frost
line. Dry wall eonstruction need not comply with foundation below
frost line. All wood fences, other than those constructed out of
redwood or cedar, shall be stained or painted upon completion of
4IÞconstruction or reconstruetion. All ehain link fences shall be made
out of a non-rust material. Barbed wire and eleetrical fenees are
strictly prohibited except as allowed ~n an industrial area, barbed
w~re may be located on that portion of fence whieh 1S minimum of Sl.X
(6) feet above grade of both sides of fence pursuant to a special use
permit. Fences may be constructed out of trees and shrubs, wood, chain
link, stone, brick or a combination thereof so long as a harmonious
eombination or handsome setting ~s used. Use of creosoted lumber or
railroad ties are strictly prohibited. Other materials which are not
specifically allowed by this Section, nor specifically prohibited, may
be permitted only by varJ.ance granted pursuant to Section 52.10 herein.
Section 56.6: LIVING FENCES. Trees and shr1Jbs used as fencing
within a residential area are not restricted J.n height except from the
street abutting the property to the rear of a residential structure
which shall not exeeed four feet. Trees and shrubs used as fencing
within an industrial area are not restricted ~n height,
Section 56.7: FENCE LOCATION. No tI privacy fence tI be

Section 56.8. BORDER FENCE OR WALL, Any fence or wall which
parallels a property line shall be constructed at least two feet from
off the property line, unless the adjacent property owner consents .1n
writinB to the construction and maintenance of the fence or wall
directly on the property lines. This consent shall be provided to the
City at the time application 1S made for permit, With respect to any
fence or wall located on or within six feet of a property line, that
side of the fence which appears as the most finished, or which does not
have exposed posts, shall be the side which shall face the adjacent
property,
Section 56.9, PROPERTY LINE LOCATION, The permit application for
any border fence or wall shall also include a statement siBned by the
applicant and adjaeent landowner(s) verifyin~ that the property line
separatin~ the adjacent properties has been determined to the
satisfaction of the parties si~nin~ the statement and verifyin~ that no
~roperty line dispute exists, In lieu of such a statement, the
applicant shall provide proof that the lines have been recently
determined by a reBistered surveyor, and that stakes, p.1ns or other
markers have been placed to indicate the location of the property line,
Section 56.10, VARIANCE, Any prOV1S.10nS of this ordinance may be
varied upon application and after consideration and hearinB by the
PlanninB Commission with their recommendation to the City Council. In
Brantin~ a var.1ance, the City must make a findin~ that the proposed
variance .1S J.n compliance with "Subd, 2 : VARIANCE" and will not be
offensive or objectionable to the owners of any adjaeent properties,
will be eonsistent with the lon~ term development of the property, and

SUBJECT: WATER METER FOR BASEBALL PARK SPRINKLER SYSTEM
CCUNCIL MEMBERS:
I discuss the meter problem with Bob Sanford from Trauts.
He stated that the meter was not included in the bid price.
He would help install the meter in spring if the City would
purchase the meter. The size of meter needed for that
operation is a inch and half. The system needs sixty gallons
. per minute at sixty five PSI. The cost of the meter is appox
three hundred dollars. Should I go head and order it or what
are the Councils wishes.

SUBJECT: USED OIL FILTERS
COUNCIL MEMBERS:
By PCA standards it is illegal for the City to dispose of
there used oil filters into the garbage. Vasko Refuse Service
is offering a recycling program for this. They bring out a
sealable bðrrel to put the filters into and when it is full
. they pick it up (appox 30 filters) at this point the City
signs off that Vasko picked them up and they are responsible
for disposing of them. We are all clear. This program would
cost about seventy-five dollars. To the best of my knowledge
A.F.I. doesn't offer this program. i would highly recommend
that the City go with this program. Do we want to offer this
to the residences also?

SUBJECT: REGULATORY & PARKING SIGNS
Dear Members:
Approximately two years to three years ago the City of St
Joseph participated with Stearns on sign replacement program.
Most of the regulatory signs were replaced. We do have a few
Stop signs right now that need replacement. Also with
Northland and Pond View Additions coming in we will need to
purchase some new signs. The City Council should establish a
standard stop sign size. (Sizes 24 -24.30 -30 36 -36 etc.) I
would recommend a 30 - 30 high density (Reflective) as a
· standard for our streets in St. Joseph. I requesting to order
twelve new signs at a cost of 30.00 to 35.00 dollars per
sign. (est) I would also ask the City Council to look at
replacing or removing the Parking signs on Minn St. and
College Ave. The condition of these signs doesn't improve the
appearance of the town. If the signs are replaced . I would
hope that the ordnance is enforced.
