Pursuant to due call and notice thereof, the City Council for the City
of st. Joseph met in regular session on Thursday, March 19, 1992 at
7:00 p.m. in the st. Joseph City Hall.
Members Present: Mayor steve Dehler. Members of the Council Ross
Rieke, Bob Loso, Stephanie Hazen. Deputy Clerk Judy Weyrens.
Councilor Leo Sadlo absent due to vacationing in New Orleans.
Others Present: Eric Hansen, Norman Hansen, .Judy Meyer, Duane Sorenson,
Mark Lambert, Becky Thomas, Brett Johnson, Mark Sakry, Dave Borgert,
Gwen Breer, Geri Herges, Linda Stangler, Brad Lindgren, St.uart

Approve Agenda: Hazen made a motion tò approve the agenda with
additions; seconded by Rieke.

Approval of Minut.es: Loso made a motion to approve the minutes of the
March 2, 1992 and March 5, 1992 Council meetings as present.ed. The

Treasurer's Report: Hazen made a motion to approve the February

Mayor Reports: 1) The second meeting in April falls on Holy Thursday,
and since their are five (5) Thursdays in April, Dehler asked the
Council for their opinion on moving the April 16, 1992 meeting to April
23, 1992. Hazen made a motion to change the April 16 meeting to April
23, 1992. The motion was seconded by Loso.

2) The Government Training Service is conducting a seminar entitled
Transforming Public Service Delivery During Times of Scarce Resources.
The Seminar will be held in St.. Cloud at the Holiday Inn on April 10,
1992. Loso made a motion to approve the attendance pf the Mayor at the
above mentioned seminar. The motion was seconded by Hazen.

. At this time the Mayor introduced Judy Meyer of the Women of Today. In
an effort. to promote Civic Awareness, t.he Women of Today are serving
Coffee and Cookies to those present at this meeting. Mayor Dehler
commended t.he Women of Today for t.heir active role in t.he Community of
St. .Joseph.

Council Reports
Rieke: Dennis stueve stated that the Chamber of Commerce has been
working on a beautification plan for Minnesota street.. It is the
Chambers understanding that parts of Minnesota street will have to be
replaced due to new water lines to service the new tower. Depending on
which portions will have to be replaced, they felt it. might. be timely
to work on the beautification of Minnesota street. The Council was in
general agreement to have Mr. stueve present the beautification plans
to the City Engineer, so that the beautification plan can be
incorporat.ed into the plans for the restoration of Minnesota Street..

POLICE CHIEF REPORTS
1989 Chevy: Chief Lindgren discussed with the Council the equipment on
the '89 Chevy and whether or not they would consider selling the
equipment with the car, provided the car is sold to another
municipalit.y to be used as a patrol car. Lindgren received estimates
to replace the equipment, tot.aling $1,900. After discussion, Loso made
. a motion to place t.he 1989 Chevy squad on the City Surplus Auction,
(May 2, 1992) . If t.he car is purchased by a municipality, they will
have the option of purchasing the car equipped by adding $1,900 to the
bid price. If the car is sold to a private person; the equipment will
be placed in the new squad. The motion was seconded by Hazen.

Crime Prevention: The Minnesota Crime Prevention Officers Association
will be conducting a seminar on Crimes against Seniors. Chief Lindgren
is request.ing approval for one officer to attend the seminar. The
seminar will be held in Fridley on April 9, 1992. The officer t.hat
at.tends will conduct training to the local senior citizens. Rieke made
a motion to approve the participation of one Officer t.o attend the
Seminar on Crimes against Seniors. The motion was seconded by Hazen.

Jeff Younq: Mayor Dehler questioned Chief Lindgren on his thoughts as
to re-hiring Jeff Young. Chief Lindgren stated that he has no problem
wi th .Jeff, he is actively performing his job, and he would have no·
problems or reservations with re-hiring Jeff. Councilor Loso opposed
the idea, stating that it not proper for the Council to reverse the
decision made last. summer. Before making any comments, Councilor Rieke
would like to have input from the Cit.y Attorney. However, in response
. t.o Councilor Loso, Rieke felt that it is not. unreasonable t.o re-
evaluat.e an employee after a year. The Mayor instructed the City
Clerk's Office to contact the City Att.orney to discuss the proper
procedure for discussing this matter, and alternatives available.
Transcription Machine: With the recent case loads of the Police

Depart.ment, Chief Lindgren is requesting authorization to purchase a
transcription machine. The machine they are currently renting can be
purchased for $200.00. Councilor Hazen requested that Brad receive one
more price and bring it back to the Council for approval.
Roller Bladinq: At. the March CORE meeting, they discussed
rollerblading, and the hazards associated with skating. It was their
recommendation to enact an Ordinance to prohibit rollerblading on
Minnesota street, College Avenue and Second Ave NW. Chief Lindgren
stated that the Ordinance could pert.ain to any act.ivity that impedes
the movement of vehicular traffic. The Council instructed t.he Police
Chief to discuss the matter with the City Attorney and make a
recommendation to t.he Council.
Police Department Traininq: To bring all the Officers into compliance
with requirements for first. aid training, Chief Lindgren is requesting
authorization to set up on-site training for first aid t.o re-certify
all the officers, at a cost of approx. $65.00 per officer. Mayor
Dehler indicated that t.he Fire Department is training with the st.
Benedicts Security Officers, and he should talk to Dick Taufen, Fire
Chief, about training with t.he Fire Department.
Police Department Manual: Mayor Dehler asked Chief Lindgren to update
. and work on t.he current Police Manual.
Service on Patrol Cars: Some Council members have received complaints
that the police department is not. rotating the service work on t.he
patrol car with the local businesses. Chief Lindgren st.ated that there
has been very lit.t.le work done on the patrol cars, and he will rotate
the repairs when possible.
st. Joseph Lions Gamblinq: Duane Sorenson, President of t.he st. .Joseph
Lions Club, presented two (2) applications to conduct lawful gambling.
The locations are as follows: EI Paso Club, 200 - NW 2nd Avenue, and
the Main street Pub - 21 Minnesota Street West. Loso made a motion to
approve t.he gambling applications as presented; seconded by Hazen.
Ayes: Dehler, Rieke, Loso, Hazen.

Recess: Mayor Dehler recessed the meeting at 8:10 p.m.

Boys & Girls Club ~ Summer Recreation: Gwen Breer, Boys & Girls Club
supervisor - Kennedy Site, introduced herself and the management team
from the Kennedy Site, (Brett .Johnson, Geri Herges). They have put
. together a summer recreation program similar to t.he years past, and axe
requesting approval of the program, and participation costs of the City
of st. .Joseph. Dave Borgert, board member of the Boys and Girls Club,
discussed the philosophy of the Boys and Girls Club and how they are
funded. After discussion, Loso made a motion to approve participation
in the 1992 Summer Recreation Program, wit.h the Boys and Girls Club

Truth in Taxation Costs: The City has received a bill from the stearns
County Auditor for the costs of preparing and mailing the t.ruth-in-
taxation costs. Dehler made a motion to authorize payment to the
County Auditor in the amount of $130.00. The motion was seconded by
Rieke.

Election Judge Training: Loso made a motion to approve Adeline
Gillitzer, Dorothy Sadlo, and Doris Johnson as election judges for t.he
president.ial primary on April 6, 1992. The motion was seconded by
Hazen.

Engineering statement: The statement for SEH, (formerly Pauly,Olsen);
came in late. Loso made a motion to authorize payment of SEH for
engineering cost incurred in t.he amount of $ 2,074.25. The motion was

Resolution 92-3 ~ Authorizing Enaineer and Preparation of Plans
WHEREAS, the City Council for the City of st. Joseph has received
approval of a Small Cities Development Grant for the construction of a
water storage facility; and
WHEREAS, t.he City Council has considered this project for several
years; and
WHEREAS, the engineering firm of Pauly Olson Bettendorf Eastwood &
Assoc; Lt.d. now SEH have st.udied the feasibilit.y of the project and
have indepth knowledge of the needs and status of the needs of t.he Cit.y
of st. .Joseph; and
WHEREAS, plans and specifications need to be drawn for the water
storage facility project.
NOW, THEREFORE BE IT RESOLVED THAT BY THE COUNCIL FOR THE CITY OF
ST. JOSEPH, MINNESOTA:
That t.he firm of Short Elliot Hendrickson, commonly known as SEH,
with Joe Bettendorf as principal engineer, is appoint.ed as engineer for
this improvement. He shall prepare plans and specifications for the
making of such improvement.

being the lead agency, and with City participation of $3,860. Cost. of
the program to participants will be $25.00 with each participant
receiving a T-shirt. The motion was seconded by Hazen.

Since a number of the participants in the Summer Recreation Program are
from st. Wendel Township and St.. ,Joseph Township I the Council
recommended the Boys and Girls Club approach them for Township
participation.
Mark Lambert: Mark Lambert appeared before the Council to discuss
funding alternatives for his proposed apartment. complex development.
The proposed site is adjacent. to the railroad t.racks on the Northern
edge of st. .Joseph. Because of the economy, he has been having a
difficult t.ime securing financing. Mr. Lambert is exploring t.he
possibility of using Multi Family Revenue Bonds to fund the project.
As part of the process, the City must approve the Revenue Bonds. To
the best of his knowledge; the City will incur no liability or have no
obligation t.o pay the bonds should the project not. be a success. The
only involvement by the City would be approving the bonds and
conducting a public hearing. Multi Family Revenue Bonds are low income
. based and a percentage of the units in the proposed complex must be
reserved for low income. Twenty percent of the occupants must have
incomes below fift.y percent of the median income of st.. ,Joseph, or
forty percent of the occupants income must be below sixty percent of
the median income of st. ,Joseph. For the income level, st.udents are
not considered low income. The bonds are sold tax exempt. and the
income is tax free, thus they have a lower interest rate. The Council
questioned whether or not the property will be taxed at a different
rat.e. The Council was in general agreement that they are willing t.o
consider this type of financing, but would like input from t.he City
Att.orney. If the Attorney feels it would be in the best interest of
the Cit.y, a public hearing would be scheduled.
CLERK/ADMINISTRATOR REPORTS
Gamblinq Application: Hazen made a motion to approve the following
gambling applicat.ions as presented; seconded by Rieke.

Surplus Auction: The Clerk's office is requesting the Council to
. consider placing the current refrigerator in t.he Clerk' Office either
on the auct.ion or in the Maintenance Department. Hazen made a motion
t.o authorize the Clerk's Office to receive estimates for replacing the
refrigerator in the Clerk's Office and to place the current
refrigerator in the Maintenance Department. The motion was seconded by
Rieke.

SUPERINTENDENT OF PUBLIC WORKS REPORT
Park Tractor: The Simplicity Lawn Tractor needs to have the steering
and the mower repaired. The tractor is Seventeen years old and the
estimates of repair are $1,148.00. With the age of the tractor it. is
uncertain as to the condition of the engine or the hydrostatic system.
After discussion, Loso made a motion to approve the purchase of a John
Deere tractor for $7,800.00, and place the Simplicity tractor on
surplus auction on May 2, 1992. The motion was seconded by Hazen.
Ayes: Dehler, Rieke, Loso, Hazen.
Nayes: None. Motion Carried 4:0:0
Compost Area: Residents are questioning whether or not the compost area
will be open again this year, and if it is when it will be opening.
Both John Galama and Don Schneider have agreed t.o be attendants again
this year. Rieke made a motion to open the compost area for Cit.y
Residents only, on April 3, 1992, whether permitting; the motion was
seconded by Hazen.

plumbing and mechanical inspections. As you may
recall, prior to that meeting I undertook a general
review of recent changes in Minnesota law as well as a

statutes. The local building lnspector with whom I

I took a closer look at these various regulations and statutes.
The regulatory scene is a maze of various codes which cross
reference each other. Minnesota Statute 65B.62 subd. 1 provides
that all municipalities shall adopt and enforce the State
Building Code with regard to any new construction (which includes
remodeling) . There are some exceptions, but they are not
applicable here.
The Code, as defined by the State Regulations, includes the
Mechanical System Code and the Plumbing Code. Minnesota has
adopted the Uniform Mechanical Code with some modification which
is set out within the Minnesota Code of Regulations.
The general administrative provisions of the State Building Code
contain a contradiction which I have been unable to resolve.
Those regulations contain virtually identical provisions dealing
with enforcement and administration, found only several pages
from each other. One provision provides that those portions of
the Building Code which must be administered by the
municipalities include mechanical and plumbing provisions. An
· almost identical provision provides for administration by
municipalities of only plumbing, with mechanical specifically
omitted. Therefore, under the Building Code it is unclear
whether or not the municipalities is mandated to enforce the
Mechanical Code.
The Mechanical Code provides that permit fees must be established
by the local authority. The only limitation is to the maximum
fee. There is no minimum fee. Section 301 of the Uniform
Mechanical Building Code provides that there should be no
installation unless there has been the issuance of a separate
mechanical permit. Section 305 then goes on to state that the
mechanical system for which a permit is required shall be subject
to inspection by the building inspector. I do not read this
provision as mandating inspection. If the City wishes to
undertake inspection, inspection must be allowed by the builder.
Although a permit fee is required, I think that the actual
inspection is discretionary based upon the type of mechanical
system involved in the construction. In some cases inspection
may be warranted. In other cases it may be waived.
The State Plumbing Code provides that plumbing sys~ems shall be
inspected by the proper administrative authority to insure
compliance. The proper administrative authority would be the
City. This provision does not provide that there must be a
separate permit or permit fee. There need not be a separate
· plumbing inspection.

In summary, some type of plumbing inspection appears to be
required. A separate mechanical inspection is probably not
required.
I suggest that the City impose a permit fee for mechanical and
authorize some type of limited plumbing inspection. I would
suggest that the Building Inspector's position be advertised for
bids bi-annually to assure that fees are competitive with other
municipalities. I would suggest that the call for bids require
each bidder to list all mandatory inspections and the fee for
each mandatory inspection. The bid should also list any
discretionary inspections and the charges for discretionary
inspections. The bid should also set forth what would be
involved in each mandatory and discretionary inspection. In this
way, the City can implement an inspection program which will meet
the requirements of the State Building Code and discretionary
inspections which the City Council wishes to pursue.
Rachel, I am sending a copy of this letter to Steve as well. Why
don't you and Steve let me know how you wish to proceed; should I
· personally address the City Council on this issue or do you
simply wish to present a copy of this letter to the City Council
for adoption of the appropriate resolution. I would recommend
that they either accept the proposal of Ron Euteneuer, re-
negotiate some of the terms of that proposal, or advertise for
bids as suggested above. For now, I would suggest negotiating
with Ron to establish a fee schedule and plan on letting the
position for bids later this year.

I Items of information:
1) Election equipment - We need two units, for our two
precincts.
Proposal #1 - Authorize purchase of two units - Cost per
unit $6",550, plus dup 1 i cate data memory pack at $315.
This includes support for one year.
Proposal #2 - Rent machines. Cost $1,500, per machine,
per election. Includes programing and maintenance.
2) I received a request for signs "CAUTION CHILDREN PLAYING"
to be installed in the alleys of the block between 1st
Avenue SE and 2nd Avenue SE, and Minnesota st. and Able
st. Wendy Doyle requested this because she feels vehicles
using the all eys need to be alerted that there are sma 1 1
children playing in her block.
3) Also in your packets is information from Shearson Lehman
Bros. on investments. Several of the area cities use th i's
firm for long term investments and I would-recommend that
you authorize me to make investments through them. They
are we 11 versed on statute requirements and are able to
seek out the higher percentage points of interest.

I have enclosed two brochures on Shearson Lehman Brothers

tificate of Deposit Program posts new rates each Tuesday
morning which are effective through the following Monday, or
until the program is sold, if earlier.

Dear Rachel,
I appreciate the time you spent with me Monday discussing
your City's investments and related policies. I hope this
will be the beginning of a long and rewarding relationship
for both of us.
. Our view at Shearson going back at least two years was that
interest rates were going to drop significantly, and accord-
ingly we encouraged the Cities we worked with to lock in some
of the attractive longer term rates, while still available,
with their excess reserve or "cushion" funds.
Now that rates have dropped significantly, our view going
forward is that they will average throughout the 1990's de-
cade at much lower levels than the 1980's. Accordingly, we
still think there is opportunity available to those investing
their "cushion" money longer term in laddered Certificate of
Deposit (CD) programs and picking up the 2% plus that 3 to 5
year Certificates offer over short term CD's. This is the
type of laddering program we have been doing for many years
with a number of your neighbors and we continue to do, be-
cause five year rates at 7% versus 4% short term are still
very attractive.
Based on our discussions, your City has approximately
$2,500,000 currently invested in short-term Certificates of
Deposit, all less than nine months. Additionally, a portion
of these funds could well be invested out longer-term, as
they are not necessary for current operating expenses.

Assuming that you have $1,000,000 in "cushion" funds, for in-
vesting longer-term, I have attached a proposal which stag-
gers maturities every year stretched out five (5) years. I
would like to highlight the following points:
1) This portfolio would average approximately 6% versus
your short term investments which are currently under
4%.
2) From an administrative standpoint you would be han-
dling these reinvestments only once a year rather than
monthly.
3) $200,000 in funds would mature every year, and accord-
ingly are continually available for other uses, if
need be, otherwise they would be reinvested out five
(5) years, to continue the investment " ladder" .
4) Once this "ladder" is established and each Cer-
tificate has matured and been reinvested at least
once, the program will average what five (5 ) year
rates average, as opposed to your current portfolio,
which averages much shorter.
. 5) Our Certificates are each Federally Insured to
$100,000 and we would spread your investments among
10 different institutions, thus providing full in-
surance on the $1,000,000.
6) Our Program provides a "Best Efforts" secondary
market for you to sell your Certificates to another
investor, should the need arise for you to get out
early.
Your goal with this pool of money should be to pick up the 2%
plus that longer term investments generally offer, regardless
of whether rates go up or down.

Meeting was called to order by John Anderson, Chairper~on at 6: 33 pm.
Members present were Joe Braun, John Anderson, Darwin Erickson and Liaison
Bob Loso, and.::Claudette Klein, and Fay Gretsch.
Members absent were Marge LEsnick and Rich Schultz.
Minutes were aproved by Joe Braun and seconded by Dar.vin Erickson.
Liaison Report - No report. Someone asked about accident on hill and Bob
siad it was not that crucial.
Old Business
Indian Rill - We will not be making a reconmendation until we have more
information as to cost, acreage, etc.
Earth Day projects - WJON is sponsoring this program. John attended several
. of their meetings. We would like to have wood chips pùt in Morningside,
install fence posts, move the sign from 'Þth Ave. to 9th Ave. Tree plawing
in Millstream and Monument Parks. Also have flowers planted in Monument
Park. There will be a River clean-up this surmner to be done by. the Scout
troops. April 25 will be the City-wide clean up day.
Spring meeting - March 23 will be the date for groups in town to attend our
spring meeting. Letters will be sent to all groups.
Rick Reid from Pond View Ridge attended our meeting. We wondered what he had
planed for Morningside Park. We want to work with that addition to enhance that
park. ...
A recomnendation was made to have Morningside Park surveyed and to have contact
with the engineer of the City.
A reconmendation was made for equipment for Tot.Lots.
Winter Recreation - Laurie received her salary for the work done.
S~~r Recreation - Laurie will not be doing the Recreation program. John will
write a recorrmendation to have her return to the program and will also ask
the City Clerk to write a recOIImendation for her as she has done a terrific job
for this program the last few years. Each letter will be sent to the Boys(~
and Girls Club.
