AGENDA: Hazen made a motion to approve the agenda with additions; seconded by Sadlo. Ayes: Dehlerl Sadlo, Rieke, Loso, Hazen. Nayes: None. Motion carried. BILLS PAYABLE: Loso made a motion to approve the bills payable as presented; seconded by Rieke. Ayes: Dehlerl Sadlo, Riekel Loso1 Hazen. Nayes: None. Motion carried. · TREASURER'S REPORT: Sadlo made a motion to approve the March treasurer's report as presented; seconded by Loso. Ayes: Dehlerl Sadlol Riekel Loso, Hazen. Nayes: None. Motion carried. MINUTES: Loso made a motion to approve the minutes of the March 19 meeting; seconded by Rieke. Ayes: Dehler, Sadlo, Rieke, Loso, Hazen. Nayes: None. Motion carried. MAYOR REPORTS: 1) Schedule for the budget for 1993 has been established. 2 ) Mayor attended the legislative conference at the Capitol. A proposal to tax local governments purchases is being considered. 3) Tony Goddard discussed at the APO meeting 1 the hazards of the st. Augusta landfill. contaminants are leaching into the water. 4) The D.A.R.E. bus 1 sponsored by the MTC will be christened soon. COUNCIL REPORTS - RIEKE: There was not enough attendance to hold the meeting of the CORE Committee. HAZEN: The Planning Commission has a lengthy agenda. Ted Klein is wishing allowances to construct an additional unit to his duplex. SADLO: 2) Quotes have been received for cleaning well number two from Donabauer Well & Pump Co. at $1/565 and Traut Wells at $1/725. Sadlo made a motion to accept the quote of Donabauer Well & Pump Co. to clean well number two 1 for $11565; seconded by · Hazen. Ayes: Dehlerl Sadlol Riekel Hazenl Loso. Nayes: None. Motion carried. . Page 2048 April 2 ¡ 1992 J · 1) LOSO: Park Board met and recommended several projects. They are a) considering ways to create and maintain flower beds at Monument Park, b) recommended installing two picnic tables at Morningsidepark; c) discussed Rick Heid's involvement in Morningside Park. Mayor stated that Mr. Heid should pay the amount required by his development for park land and projects planned for Morningside Park will be bid. wetlands and flood control were also discussed. 2) Loso also requested that the city take the dogs which are picked up, to the humane society¡ if possible. 3) The new grass in the ball park should be protected. Loso made a motion to post keep off the grass signs, on the infield in Memorial Park, until May 1st; seconded by Hazen. Ayes: Dehler¡ Sadlo¡ Rieke¡ Hazen¡ Loso. Nayes: None. Motion carried. WOMEN OF TODAY: Judy Meyer¡ Linda Stangler and Janelle Von pinnon presented a proposal to install a system of can recycling¡ to raise funds for projects. After discussion with the Council¡ Sadlo made a motion to allow the recycling container to be placed by the sign in the parking lot by Linnemanns store. I t wi II be placed half on the parking lot and half of the city boulevard. The motion was seconded by Rieke¡ and he commended them for their · community interest. Ayes: Dehler, Sadlo¡ Rieke¡ Hazen¡ Loso. Nayes: None. Motion carried. OPEN TO THE PUBLIC: Mayor Dehler opened the floor to the public. No one responded. OUTDOOR LIQUOR PERMIT: Mark Zimmer presented an application for an outdoor liquor permit¡ for the LaPlayette, for May 3rd. Loso made a motion to approve his request; seconded by Hazen. Discussion - two off duty officers would be required¡ music end at 9:00 and all people off the outside premises by 10:00, cleanup within 24 hours¡ neighbors and the Convent will be notified. Ayes: Dehler, Sadlo¡ Rieke, Hazen¡ Loso. Nayes: None. Motion carried. SNOW PLOWING: El Paso has requested that the city remove the snow from their boulevard. Council discussed the past policy of all businesses paying a fee for snow removal. Loso made a motion to table the matter; seconded by Rieke. Ayes: Dehler¡ Sadlo¡ Rieke, Hazen, Loso. Nayes: None. Motion carried. The meeting was recessed at 8:15 p.m. The Mayor reconvened the meeting at 8:25 p.m. · ELECTION MACHINES: Council discussed the options for use of voting machines. Hazen felt that the City should rent the machines, because of the fast advancement of computer technology. Rieke concurred. - Page 2049 April 2 , 1992 . voting machines 1 at $6,550 each and a memory pack for each at $3151 as quoted by Business Records Corporation. The motion was seconded by Sadlo. Ayes: Dehler, Sadlo, Loso. Nayes: Hazen, Rieke. Motion carried. SIGNS: Council discussed the request to have signs "CAUTION CHILDREN PLAYING" installed in the alleys of the block between 1st Avenue SE and 2nd Avenue SE1 and Minnesota st. and Able St. Loso made a motion to have the signs installed in the alleys as requested; seconded by Rieke. Discussion - Sadlo questioned the need for them because there are stop signs at the center of the block. He stated that 1 although he supports safety measures, if they really will help ensure safety 1 signs are costlYI and many residents on alleys would like more signing in them. Mayor Dehler stated that existing signs 1 which are in alleys where children have grown up 1 could be relocated to this alley. Ayes: Dehler} Riekel Loso. Nayes: Sadlol Hazen. Motion carried. INVESTMENT OF FUNDS: Hazen made a motion to allow Shears on Lehman Brothers to invest city funds; seconded by Hazen. Ayes: Dehlerl Sadlol Rieke, Hazen, Loso. Nayes: None. Motion carried. . CITY ENGINEER JOE BETTENDORF: 1) WATER SYSTEM IMPROVEMENTS - Mr. Bettendorf presented the following proposed schedule for the 1992 Water System Improvements: Begin Survey Work, Plan & Specifications April 6, 1992 Present Funding Alternatives (Local Share) April 23, 1992 Finalize Design Concept April 23, 1992 Complete Construction Plans & Specifications June 26, 1992 Advertise for Bids June 26, 1992 Open Bids 11:00 a.m. July 171 1992 Consider Award July 231 1992 Begin Construction August 61 1992 Complete Watermain Construction October 151 1992 Complete Tower Foundation November 1, 1992 Complete all Construction June 301 1993 Council discussed the need to reconstruct Minnesota Streetl and replace water mains under it. Joe recommended to wait until next year to do Minnesota Streetl and to keep that project separate from the Water Improvement project. Loso made a motion to approve the time schedule and begin plans and specifications and replace only the roadway which will be removed in the installation of water mainsl in conjunction with the projectl and to add as alternate A and alternate BI water main extensions on Minnesota Streetl two blocks east, and on Minnesota Street to attach to Park Terrace water main. The motion was seconded by Sadlo. . Discussion - Only the area of Minnesota Street which is torn up in conjunction with the project will be replaced. It will be replaced to handle seven to nine ton loads. Stearns County wi II be contacted to see if there are funds to assist in improving y Page 2050 ! April 2, 1992 . DBL LABS: Council concurred that the proposal for DBL Labs is to be presented at a Joint Township Board - City Council meeting. PONDVIEW RIDGE ADDITION: John Scherer¡ City Attorney, reported that Rick Heid has been contracting with and bonding through Bauerly Brothers. Their bond is at 100% of engineers estimate of costs. Heid is providing 25% in letter of credit. Rieke made a motion to authorize Pondview Ridge Addition project with financial assurances as proposed with 100% bonding and 25% letter of credit, and the developer shall pay park land amount and will have opportunity to bid on any park improvement in conjunction with the development. The motion was seconded by Hazen. Ayes: Dehler, Sadlo, Rieke, Hazen, Loso. Nayes: None. Motion carried. Mayor Dehler extended the meeting 15 minutes at 10:00 p.m. FENCE ORDINANCE: Council was in general agreement to change the maximum height of residential fences to seven feet, in the proposed fence ordinance, and refer the proposal back to the . Planning Commission to hold a public hearing on the matter. The Council also generally agreed that steve Frank was in compliance in his fence construction proposal. CITY ATTORNEY JOHN SCHERER REPORTS: 1) Mr. Scherer reported that Ed Kacures is wi II ing to fence across the entire back of his property to screen the area, and he is also willing to move some of the stored materials orf the property, if the City is willing to drop the charge. Rieke made a motion to drop the charges against Mr. Kacures and provide a variance to construct a fence on an easement, according to st. Joseph Code of Ordinances, in return for Mr. Kacures performing the tasks above. The motion was seconded by Sadlo. Ayes: Dehler} Sadlo¡ Rieke, Hazen, Loso. Nayes: None. Motion carried. 2) Mark Lambert's request for financing apartments through bonding - The City should require written assurances that the City would have no duty to administer the bonds, the city would not be liable if the renters did not stay within income requirements} and city would be reimbursed for all expenses. When considering the matter the City should consider if there is a need for this type or housing in the City. Hazen made a motion that the City Attorney send a letter to Mr. Lambert addressing these issues; seconded by Loso. . Ayes: Dehler, Sadlo, Rieke, Hazen, Loso. Nayes: None. CAPITAL OUTLAY REQUEST: Rieke made a motion to approve the capital outlay request of the street department for an airless jackhammer at $210; seconded by Hazen. Box 668 St. Joseph, MN. 56374-0668 RE: WATER TOWER & STREET IMPROVEMENT PROJECT FINANCINGS Dear Rachel, Enclosed please find several financing scenarios related to the pending street improvement project and to the water tower project. The various examples are titled: St Imp Prj 10, St Imp PIj 15, St ImpPrj 10 B, St Imp Prj 15 B, Water Prj 10 and Water Prj 15. St Imp Pri 10 & St Imp Prj 15: These two examples assume no cash contribution by e. the City resulting in a $370,000 bond issue. As this issue will not be paid off from a 100% assessment, the City must pick up the balance due on debt retirement payments through annual tax levies. The 10 year bond issue has an average tax levy of about $34,000; the 15 year issue has an average annual tax levy of about $27,000. St ImD Prj 10 B & St ImD Prj 15 B: Each scenario assumes a cash contribution by the City of approximately $250,000, producing a $125,000 bond issue. As nearly 100% of this issue will paid off from special assessments, very few, if any, tax levy dollars will be required to assist in the retirement of the debt. Water Pri 10 & Water Prj 15: With a cash contribution of $200,000, a $415,000 bond issue will be required for the water tower project. The 10 year financing will cash flow very nicely if at least 75 new homes will be hooked up to the water system over the next 3 - 4 years. The 15 year example has a very positive cash flow based upon at least 50 new hook-ups over)he next 2 - 3 years. Apr i 1 1 6 1992 Dear Members of the Council: I would like to request the City Council to consider hiring one (1) fu 11 time maintenance worker and two (2) part time workers for the summer. On May 2, 1977, Jim Marthaler was hired by the City of st. Joseph as our fourth (4th) maintenance worker. About two (2) to three (3) years later, John Kierzek retired as a fu 11 time employee. In addition to having a maintenance department of four (4) fu 11 time employees, we also employed four (4) part time workers during the summer. Today, the Maintenance Department consists of three (3) fu 11 time workers and three (3) part time summer workers. Since 1977, the City of st. Joseph has grown substantially. Eastern Park was in the process of being built out and Cloverdale Estates was being extended. In addition, Cl inton Vi llage, Cloverdale 3,4, and 5, Northland, and Pond View Ridge were annexed and platted. All of which require City services. During this same period, two parks were also added, Millstream and Morningside. . While the work load for the Maintenance Department has almost doubled Slnce 1977, the staff has been cut back by almost one-fourth. It appears to me that the Maintenance Department is moving backwards rather then forwards. I don't know how much longer we can continue to try and meet the needs and demands of the residents and City. This summer we have not only added two ( 2) new housing additions, but we will be doing construction on at least two (2 ) maJor projects. Even though the City contracts out these services, they st i 11 add a stress to the work force and require Maintenance Department support. Last year while preparing my budget, I did include the addition of one (1) additional maintenance worker. After the budget was cut, the maintenance worker was st i 11 provided for in the budget, but only to begin sometime in May. With this in mind, I would like to recommend the Council consider hiring one (1) fu 11 time Maintenance Worker and two (2) part time Maintenance Workers for the summer. The addition to the Maintenance Department would not el iminate the overtime as Weekend work, snow removal and emergency breaks wi 11 always happen. . Thank you for your consideration on this matter. Paul Fries purchased this property about six month ago. To the best of . my knowledge he was suppose to connect to City Sewer Service. Presently the house is on Spetic System. I have discussed this with Ollie Lesnick (Park Reality) they sold the house and he informed me that the agreement was as long as the Septic System works he can use it, if that System fails he must hookup to City Sewer. Mr Fries reasons for not hooking up are, his Wife is expecting, she needs four operations, and no work. I have no problem with this except that we do have No. Two Well in this area, plus this is a family of four to five people. Prior to this nobody lived there and before that one to two elderly people. The housing needs of the City and data demonstrating those needs. 2. The proposed method to meet identified housing needs and the specific methods to carry out the plan. 3 . Target areas, if any, of the City. 4. General description of the program or programs to be implemented to meet the housing needs identified in the plan. 5 . Methods of monitoring the implementation by participants to insure that the programs will be consistent with the plan and its objectives. 6. The administrative capacity of the City to monitor and · supervise housing finance programs. Additionally, each program within a plan shall set forth the following: 1. A general description of the program. 2 . A designation of the geographic location to which each program will be limited. 3 . The estimated amounts and timing of the sale of revenue bonds required to finance the program, including the funding of appropriate reserves and paying the cost of issuance. 4. Methods of monitoring the implementation to insure that the program will be consistent with the plan and its objectives. 5. An analysis of how the program will meet the needs of low and moderate income families. The statute provides that the apartments must be designed for families having an adjusted gross income not in excess of 110% of the median family income for the area or 100% of the income limit set by the Minnesota Housing Finance Agency for the City. At · least 20% of the units must be held for occupancy by families or individuals with adjusted gross income not in excess of 80% of the median family income for the area unless they are rented primarily to the elderly or handicapped. The specific program W " ~ · Ms. Rachel Stapleton April 3, 1992 Page -3- for multi-family unit must establish the need, describe the method of financing, designate who will be served and set forth the income limits of the occupants. Minnesota Statute 462C.07 provides that the City must issue and sell revenue bonds payable exclusively from program revenue. This provision appears to indicate that the City may not guarantee payment of the bonds with the full faith and credit of the City. The City is not subject to the limitations of Minnesota Statue Chapter 475 with regard to the sale of these bonds. The benefit to the developer lies in a lower interest rate with a use of the municipal bonds as opposed to conventional financing. Federal Tax Code provides that municipal bonds may be non-taxable if they are issued for qualified residential units. The qualifications established by the IRS seem to be more restrictive than those established by the State. To be qualified for non- taxable status, at least 20% of the occupants must fall below the 50% median income level, or 40% of the occupants must fall below · the 60% income level. The units must continue to meet these requirements for a stated period of time for the bonds to maintain their tax exempt status. Against this background, several questions arise: 1. What is the risk to the City? Probably little risk. It appears as though the bonds would be paid solely from the revenue from the development. Without actually seeing the bonds and language contained within the offering, I would reserve any final opinion. Before going forward with this proposal, there should be a clear statement that the City would have no liability whatsoever, either primary or secondary, with regard to the payment of principal or interest. 2. Will these bonds affect the City's debt limitations? I don't believe so, but would recommend that Mr. Lambert's provide an opinion of counsel letter verifying that fact. 3 . will this property be taxed at the same rate as if the developer had used conventional financing? · This issue is also not clear. I have spoke with the County Assessor who was unable to give me a clear answer without more detail. At this time, it appears W " , · Ms. Rachel Stapleton April 3, 1992 Page -4- as though there is certainly a possibility that the property would be assessed for taxation at a lower rate than would conventionally financed property. 4. What is the benefit to the City? There is probably little direct benefit to the City. This program was enacted to assist Cities in fostering the construction of housing for the handicapped, elderly and low income families. It is also to assist the City in rehabilitating target areas of a municipality. The City of St. Joseph does not have a real, identifiable need for this type of development. Presumably, the development will primarily serve as student housing. On the plus side, the involvement of the City may assist a developer in constructing a complex which will be a welcome addition to the City and help foster the overall growth and orderly development in designated areas of the City. This is particularly true if the development could not go forward without City involvement. Under that scenario, · the land would remain vacant until another developer is willing to proceed with the project by using conventional financing. The City should also be aware of the fact that the steps for the adoption of the plan and program may involve administrative time for the City and presumably review of documentation by the City attorney. The City should give consideration to the direct and hidden costs involved with the implementation of the procedure as required by statute. Before proceeding further, I would recommend that the City secure a letter from the developer's bond counsel which addresses the following issues: 1. A statement assuring the City that under no circumstances will the City have any liability in the event of default in the payment of principal or interest of the bonds. 2 . A statement verifying that the issuance of these bonds will have no impact upon the City's borrowing limits or will in no other way affect the City's ability to issue other bonds for other purposes. · 3 . That the property will be subject to the same property tax rates as it had been developed with use of conventional financing. T , 0> · Ms. Rachel Stapleton April 3, 1992 Page -5- 4. That the City will have no liability to bond holders in the event the tax exempt status of the bonds is lost due to failure to comply with the Internal Revenue " requirements. 5. That the developer will reimburse the City for all costs incurred, including administrative costs and out of pocket expenses relating to the adoption of the plan and program, attorney's fees incurred for review and counsel, and any other miscellaneous expenses which can be directly traced to the proposal. 6. That the proposal qualifies for adoption pursuant to Chapter 462C of the Minnesota Statutes. Therefore, I would recommend that the City adopt a resolution requesting a letter addressing these points before any commitment is made with regard to this request. Thank you.
