Adjourn r; " . Apr i.1 22, 1992 Pursuant to due call and notice thereof, the City Council for the City of st. Joseph and the Town Board for the Township of st. Joseph met in special session on Monday, Apr i 1 22, 1992 at 8:30 p.m. in the St. Joseph City Hall. City Council Members Present: Mayor Steven Dehler. Members of the Counc i 1 Leo Sadlo, Ross Rieke, Stephanie Hazen. Clerk/Adm Rachel Stapleton. Town Board Members Present: Jerome Salzer and Joe Bechtold. Town Board Clerk Anna Reischl. , Others Present: Joe Bettendorf, Dick Taufen, Judy Weyrens. Mayor Dehler called the meeting to order at 8:30 p.m. and stated t.hat. the purpose of the meeting is to continue the discussion on future planning and t.o possibly develop a plan to provide a large area wit.h City Services. At the last meeting, .Joe Bettendorf, City Engineer, was asked to prepare a cost. estimate for preparing a study of sections 1 , 2, 11, 12, 13, 14, 15, Range 129, Section 10. Mayor Dehler turned . the floor over to City Engineer Joe Bettendorf to discuss the proposal. Joe Bettendorf presented each member with a copy an outline for the proposa 1 . The tasks to be included in the study are: 1) Assemble available layout, zoning, and USGS maps for background, Delineat.e areas of potent.ia1 development, establish population density equiva1ent.s, 2) Coordinat.e fut.ure roadways wit.h all involved, 3) Drainage issues. 4) Sanit.ary Sewer issues, and 5) Watermain issues. The final report wi 11 outline lssues and concerns regarding development. in the areas in question including maps and exhibits showing development. projections, and sewer, wat.er, and drainage trunk line 1ayout.s. The St.tJdy will t.ake approximat.ely sixty days to complete and wi 11 cost approximat.ely $24,000. Joe Bechtold quest.ioned whet.her all proposed sewer 1 i nes wou 1 d all flow back to St.. Joseph. Joe Bet.tendorf st.ated t.hat the City would make a second connection to St.. Cloud eliminating t.he f1~w coming back t.o St.. Joseph. The Boards questioned t.he cost and functioning of a new lift st.at.ion. Joe Bettendorf stated that a lift station cost approx. $.50,000 and would be similar to t.he lift stations currently serving St.. Joseph. The stations would be built in such a manner so that they could be checked easily. Leo Sad10 questioned the need to be cautious in ext.ending services to . the area, as t.he City purchased a limited amount of space from st. Cloud in the int.ercept.or, and it will be expensive t.o purchase additional space. Joe Bettendorf st.at.ed that the Cit.y purchased 600,000 gallons of flow and we are currently using approx. 250,000 gallons. At t.he current. Page 2051 '0 , . April 22, 1992 rate, the City could double the population before space would run short. Leo questioned whether ~r not the PCA could require the City to provide service to areas such as Pleasant Acres. Joe Bettendorf stated they could not. steve Dehler addressed the concerns with the loss of tax base for the Township. He recognizes the fact t.hat the Township does not want to lose the tax base of the industrial park and felt that a enterprise zone should be est.ablished. A legal document could be drawn which would transfer a portion of the tax collections from a designated area t.o st. Joseph Township for a specified period of time. The City and Township would then share in both the expenses and the revenues of these enterprise areas. Bot.h Boards entertained t.he ideas of merging the two, the Cit.y and the Township. Joe Bechtold while agreeing with the possibility of merging, stat.ed t.hat he did not know if it would be possible, as t.he City could not. and probably would not want to provide services t.o cert.ain areas. Ross Rieke briefly discussed zones that. could be established should t.he t.wo entit.ies merge. Merging would help define areas where development. . would be encouraged and at the same time prohibit development. in are;~ts where services could not be provided. Joe Bechtold stat.ed that the Township encompasses some natural obstacles such as 1-94 and the Sauk River. Both boards were in general agreement. to st.art t.he discussion of merging with the ent.ities legal counse 1 . St.eve Dehler st.at.ed that t.he Boards need t.Q work on t.wo goals: 1) Immediate needs 2) Long Range planning , DBL Labs Annexation: Joe Bett.endorf outlined the proposed service 1 i nes for sanitary sewer for DBL Labs. Because the City has an agreement with the City of st. Cloud requiring all resident.s on City Sewer to be annexed to the City, annexat.ion of cert.ain lands will be required to provide t.he service t.o DBL Labs. One opt.ion is t.o run the service 1 i ne down t.he road to service DBL and annex only t.hose parcel who wish to annex at t.he time (spot annex). The second opt.ion is to annex a large portion including t.he entire industrial park.. Joe Becht.old stat.ed t.hat he would oppose the first option (spot. zoning), as that is no way to plan. The only way he would favor the annexat.ion is to est.ablish a plan and annex the parcels that. lead to DBL Labs and i nc ltJd i ng the industrial park.. Comprehensive study: Hazen made a motion t.o authorize the expendit.ure of $12,000 to proceed with the Comprehensive Municipal Ut.ilit.y St.udy of . Sections 1 , 2 , 11,12, 13, 14, 15, T124N, R29W bet.ween t.he Cit.y of St.. Joseph and the Township of st. .Joseph. The mot.ion was seconded by Rieke. Ayes: Dehler, Sadlo, Rieke, Hazen. Nayes: None. Motion Carried 4:0 Pa!=1e 205 2 - '- April 22, 1992 . st. Benedict Annexation: st. Joseph Township presented the City with a 'resolutiori~tatin9 that they do not oppose the annexation of st. Benedict, but would like an assurance that the Cit.y would preserve, implement and enforce the transport?ltion adopted by the Township of st. Joseph (see attached). Hazen made a motion to accept the resolution of st. Joseph Township and include the preservation of the future corridor as terms of the annexation. The motion was seconded by Rieke. The designation of the area on the enclosed map where . such a road may be developed is not to be understood as consent for the develpment of an arterial road across the property. Rather, it is an identification of an area where the Sisters of the Order of St. Benedict and the College of St. Benedict agree not to construct any buildings. If and when there is any funding for the development of an arterial road in the area, ..... is our understanding that the normal legal. processes 1.... will be followed at that ti~e. We would like to again state that we are opposed to th0 development of the road and that we do not have any projections to sell the land to the west and south of the Convent and College campuses for development or to develop it ourselves. BAKER STREET AND SEVENTH AVENUE IMPROVEMENTS: City Engineer Joe Bettendorf presented the bid tabulations for the 1992 East Baker Street & 7th Ave SE Improvements I as opened on April 101 1992 at 11:00 a.m. The low bid was submitted by Randy Kramer Excavating . of Watkins at $192/581.061 for contract 1. Hazen made a motion to award the project and approve the bid of Randy Kramer Excavating of $192/581.06; seconded by Sadlo. Ayes: Dehlerl Sadlol Riekel Loso/'Hazen. Nayes: None. Motion carried. CLOVERDALE DRAINAGE PROJECT: City Engineer Joe Bettendorf presented the bid tabulation of bids opened on April 101 1992 at 11:00 a .m. I for Contract I I I 1992 Pond & Overflow Pipe Improvements. The low bid was submitted by Donald Tretter Excavating of Pierz in the amount of $20/818. My reason for this proposal is to allow construction of the new unit to stay align with existing two units and to allow the existing property to stay align with the rest of property along the street. Rezoning would allow both parcels to be combined and have one legal description. It also allows enough square footage to build a new unit. I feel the location of this property is best suitable for student rental. I feel I will be helping the city of st. Joseph to keep students in R3 zoning instead of spot zoning. I would like to move the parking lot to the west side of the new · constructed building and provide a parking lot of at least ten or more stalls to alleviate off street parking problems which are occurring at this time. The parking lot with designated stripes would accommodate all three units. I would also like to run a hedge or some kind of buffer to avoid parking in front of the units. I feel that the property is an ideal location for student housing because it is buffered on all sides. North side - County Road 75, West and East side -R3, multiple families, and South side - Old Hwy 52 and apartment buildings. I feel that the property will be an asset to the neighborhood by eliminating the garage (party room) . The apartment building would be constructed where the existing garage is. By removing the garage and adding apartments will enhance the looks of the building along with final landscaping to make the apartment look more appropriate for the neighborhood. I also feel that my property is maintained/managed very well compared to other units in the area. If I'm allowed to build this unit, I feel the city of st. Joseph could use my property as an example for others to fix and clean up their property units. The body of this report outlines specific and potentially hazardous conditions noted during the survey and my recommendations for their abatement. I CITY GARAGE During today's survey, I noted that the Keller power hacksaw was not guarded correctly. The oscillating disk, which operates the cutting arm itself, needs to be protected. As this disk rotates, the pinch point is exposed. Also, the V-belt pulley assembly should be guarded with a guard having opening no larger than one- half inch or its equivalent. WASTE WATER PLANT The generator's exhaust manifold and stack should be guarded to a point of seven feet from the floor. This will help prevent anyone from coming into contact with the hot portions of the manifold and turbo-charger located on this diesel generator. You should install protective posts around the gas pump area to help prevent damage to the gas pump by motor vehicles. These posts should be substantial steel or wood posts permanently anchored into the ground. In addition to the protective posts, I also suggest that you place a "No Smoking" sign in the immediate vicinity of the gas pump and that you hang a permanent fire extinguisher within 75 feet of the gas pump area. If this fire extinguisher is located within a nearby building, you should place a sign by the gas pump indicating where the closest fire extinguisher is located. Also, I there should be a sign by the pump to indicate where the emergency "Shut Off" switch is located. Attention to recommendations is important and we urge your prompt action. It must not be assumed that every unsafe condition or procedure has been covered in our survey. It contains a wealth of info. re: our services rendered. The Center had a total of 411 victim contacts during this quarter. 219 were from Stearns Co. We documented 223 hours of services toward victims services. This does not include hours spent during ~ucation presentations. Residents from St. Joseph continue to attend our support groups. We also continue to have people from the St. Joseph area work as volunteers for our Center. The Center completed 30 presentations with 726 participants during this past quarter in Stearns Co. Liaison Report: Engineer is still working on Parking lot. We received $5400 from Pond View Addition. Need more specifics for picnic tables. Let maintenance know they should install the water fountain. Archery Target: Joe made up som rules for the use of the target and it will be printed in the News leader . A deposit fee of $25.00 was suggested. There is also a need for a stand at the target range. Community Clean-up: It went quite well according to Joe Braun. Jaycees paid for the lunch. CSB/SJU students cleaned up in the main street area. Sandboxes: Jaycees checked the sandbox that was built and they will do the work but would like the City maintenance to stake it out and dig the area out. They may order spring jumping toys and they will be installed in the corners of the sandboxes. They will also build a new volleyball I court in Centennial park. The city maintenance should dig the holes and they will put borders around the Big Toy, slides and swing areas in the parks. Spring Development Morningside: 50' x 200' parking lot and it was suggested to have it done in C-class. Also stake out where picnic tables and bridges should be installed by Rich and Darwin. Monument area: Marge checked on shrubs, flower beds to see where they should be located. Bob Loso said he has bids on the tuck-pointing. I Ms. Rachel Stapleton May 6, 1992 Page -2- These increased burdens to the City should be consídered against the increased revenue generated by annexed properties and to what extent capital improvements servicing the annexed properties will be paid for by the property owners, developers, or regional economic development organizations. With regard to the DBL Lab property, as a starting point the City may want to consider the following: 1. The City immediately annex the DBL property, a strip of land from the City boundary to the DBL property through which the utilities will run, and any properties adjacent to the DBL property or this strip of land which also wish to seek annexation at the present time. This annexation would be accomplished by joint resolution of the City and Township. 2 . An agreement be entered with the owners of the properties to be annexed for the cost of the improvements to be provided. The property owner should absorb the cost of the improvements to serve their I properties. Any oversizing incorporated into the project to serve future connections is a cost which the City could absorb and then pass onto other properties as they are annexed and connected. 3. The annexed properties would be taxed at the City rate beginning with the levy in the fall of 1992. 4. Tax revenues from the annexed properties shall be shared between the City and Township under the following schedule: DATES CITY TOWNSHIP 1993 50% 50% 1994 60% 40% 1995 70% 30% 1996 80% 20% 1997 90% 10% I 1998 and 100% thereafter W . . I Ms. Rachel Stapleton May 6, 1992 Page -3- With regard to other future annexations, I would recommend that the City and the Township designate a new orderly annexation area which would consist of sections 1, 2, 3, 9, 10, 11, 12, 13, 14, 15, 16, the southern half of section 4 and that portion of section 16 lying to the northeast of Interstate 94. The City will not initiate any annexation within this area for a designated period of years unless the property becomes so surrounded by City property that 75% or more of its boundary abuts City property. The Township would not oppose any request for annexation initiated by a property owner within the area of orderly annexation. Further terms to apply to annexations occurring within the area of orderly annexation could be the following: 1. Property subject to annexation would be designated as either "voluntarily" or "involuntarily" annexed property. Voluntarily annexed property would be where the owner petitions for annexation. Involuntarily annexed property would be where there was not a request for annexation, but the property becomes so surrounded by City property I that 75% or more of its border abuts City property. The Township would not oppose annexation under either of these circumstances. 2. Any single family or agricultural property which is annexed shall have 100% of its tax revenues immediately designated toward the City. Multi- family residential, commercial or industrial property which is annexed shall have tax revenues shared between the City and Township on the same schedule and ratio as suggested for the DBL Labs annexation outlined above. 3. Any voluntarily annexed property shall be taxed at the City rate upon annexation. Any involuntarily annexed property shall have the City rate of taxation phased in over a period of five years, or sooner if the property owner requests connection to City's sewer and water services. 4. The City will provide sewer and water services to annexed property upon request and as available. Voluntarily annexed property shall be required to connect to services immediately upon annexation where services are available. Upon connection, I the property owner will pay the proportionate costs of the services plus applicable hook-up charges. For involuntarily annexed property, the property owner shall not be required to connect to T . . I Ms. Rachel Stapleton May 6, 1992 Page -4- City sewer and water until the property owner so chooses, but such connection must be made within at least 10 years from the date of annexation. At the end of 10 years, the City may require connection to the City sewer and water services. Upon connection, the property owner shall pay the cost of the services based upon the cost as of the date of connection, plus any applicable hook-up charges. The City shall agree to extend services to any property which is annexed and which is adjacent to property currently being served by services. If property is annexed which is not adjacent to property currently being serviced, extension of services shall be subject to negotiation between the City and property owner to arrive at a reasonable cost sharing arrangement. S. Any property not in need of annexation but lying adjacent to property which is being annexed may join in the annexation and be provided with phased in tax rates available for property involuntarily I annexed. 6. The City shall create an lIurban service district II and a II rural service districtll for tax purposes. The urban service district shall consist of platted property, property provided with sewer and water or property of less than S acres. The rural service district shall consist of unplatted property of greater than S acres with no service connections. Agricultural property connected to City services shall be able to claim the house and the adjacent S acres for taxation as a urban service district while the remainder of the agricultural property may be treated as a rural service district. 7. Upon creation of urban and rural service districts, the Council may consider a revision of various ordinances to allow for lesser restrictions in areas designated as rural service districts, such as a less strict dog ordinance, or some modification of the zoning ordinance. As far as long term options available, the City and the Township may want to start to consider the following: I 1. Continue with orderly annexation and co-existence of the City and Township. This arrangement has worked well and could continue to work through the T ~þ .; I Ms. Rachel Stapleton May 6, 1992 Page -6- I believe that the Township and City should_continue to strive toward a working relationship which would allow the city to continue to grow, allow developed property to become part of the City and secure needed essential services, to allow the Township to maintain a tax base to provide services to their remaining residents at a cost efficient basis, while avoiding unnecessary duplication of government which would be an unwise use of taxpayers money for both the City and Township. Merger of the City and Township with the creation of urban and rural service districts, phased in taxation and a limited availability of sewer and water service. 3. A merger of the City with a portion of the Township, such as that portion of the Township lying northeast of Interstate 94 and northwest of the Sauk River, with the remainder of the Township following one of these options: a. Remaining an independent Township. b. Merging with Rockville and/or Collegeville Townships. c. Eventually incorporating as a new City. I d. Providing for that portion of the Township lying southeast of the Sauk River and northeast of 94 to merge with Waite Park. Rachel, I present these proposals as food for thought. At this point, the immediate issue has to do with the DBL Lab's property. I will start discussing some proposals with Kirby Dahl as soon as he is back in town and contacts me. Any direction which the City Council can provide prior to that time will be welcomed. I think we can also start negotiating a new orderly annexation agreement to control that area of the Township subject to the engineering study which has been undertaken, and those areas of the Township immediately north and west of the City. Realistically, I believe that these areas can be designated as areas eventually to be served by City sewer and water services. Those negotiations can proceed with an eye toward reaching a resolution sometime late this year or early next year. Finally, a long term plan for the future of the Township can enter the discussion stage but I do not anticipate an answer being reached for a period of 5 years or so. What I am proposing in this letter is very preliminary. I would insist on close review and input from the City Engineer as well as the Area Planning Organization. Admittedly, there are a lot of "kinks" to be worked out.
