parcels, that are owned by the same OHners and the use of the

to reconsider the valuation on the decking around the pool,
which was installed for their handicapped daughter, and Hould
be removed and relocated, should they move to another

the City of St. Joseph reconvened as a Board of Review on
Thursday, May 7, 1992 at 8:15 p.m. in the City Hall to
complete t.he revieH process.

Mayor Dehler called the Board of Review to order at 8:15 p.m.
Sadlo made a motlon to approve the recommendations of City
Assessor Ollie Lesnick as rollows:
Parcel #84-53645-00 st. Joe Gas & Bait - Michael J. Deutz,
OHner. Reduce the Market Value of this property for the 1992
assessment from $169,600 to $148,000, as recommended by
reappraisal.
. Parcel #84-53779-00 James W. Bruemmer, owner. Reappraisal
reduced value from $52,300 to $50,600 because of poor
condition.
The following properties have no change of value.

MINUTES: Loso made a motion to approve the April 23 and April 30
minutes with the following changes:

Fourth page - under CAPITAL OUTLAY REQUEST: "Request is to
change from a 743 .John Deere at $7,800, to a 932 .John Deere at
$9,650 because it is lower profile and is safer on hills. "

Fourth page - MAINTENANCE WORKERS: "Loso made a motion to
hire two part time employees from ,June 1 through August 31st"
The motion was seconded by Rieke.

Rieke made a motion to approve the minutes of the April 22 meeting
as corrected as follows: COMPREHENSIVE STUDY: Includes Section .1
also; ~md ST. BENEDICTS ANNEXATION: but would like an assurance
that the City would preserve, implement and enforce the
Transportation Plan adopted by the Township of st. .Joseph.
The motion was seconded by Sadlo.

COUNCIL REPORTS - SADLO: 1) Well No. 2 has been cleaned.
2) Motion by Sadlo and seconded by Rieke, to purchase the
requested 932 John Deere tractor at $9,650.

Aft.er discussion of safet.y equipment., Sadlo made a motion t.n
purchase and install roll bars and seat. belt, on the 932 ,John
Deere at a cost. or about. $1,000. The motion was seconded by
Rieke.
Ayes: Dehler, Sadlo, Rieke.
Nayes: Loso. Mot.ion carried.
3) Sadlo discussed that there is a need to require cleanup of
rent.al propert.ies aft.er part.ies, and have the rental housing
inspect.or make t.he landlords aware of t.his when they get their
annual inspection.
4) The new emergency siren part.icipates in the monthly test.ing.
The public should be made aware of what it means when the siren
blows, and what different signals mean. The Emergency Services
Direct.or will take care of this matter.
LOSO: 1) Loso made a motion to have maintenance move the sign
at. the Northwest corner of Morningside Park and reinstall it t.o
4IÞ designate the entrance to t~e Park; seconded by Rieke.
Ayes: Dehler, Sadlo, Rleke, Loso.
Nayes: None. Motion carried.
2 ) The Park Board also wished to make the Council aware that they
would like the assistance of the Maintenance Department to pull
the parking lot poles out of the creek area in Millstream Park.
3) The Park Board requested three picnic tables for Morningside
Park. Sadlo made a motion to approve purchase and installation of
3 picnic t.ables for Morningside Park at approximately $300 each;
seconded by Rieke.
Ayes: Dehler, Sadlo, Rieke, Loso.
Nayes: None. Motion carried.
4) Loso request.ed preliminary approval to proceed with
installation of a parking lot. in Morningside Park. He stated he
has received one quote. The engineers estimate is $.5,400; with
class five, wit.h no curb. Council requested another quote, and
consider at next meeting.
5) Park Board would like the Maintenance Department to stake and
dig out. the area for the sand box, the City will pay for the
mat.erials.
RIEKE: Rieke presented and made a motion to approve a quote for a
Dictaphone, for t.he Police Department at $375: seconded by Sadlo.
Ayes: Dehler, Sadlo, Rieke.
. Nayes: Loso. Motion carried.
91ST AVENUE ANNEXATION: Arnie Lauer asked if cost.s of installing
sewer would be near the estimate. Usually they are quite close.
After annexation takes place; residents asked how long they would
have before they would be required to hook up to city sewer.
Existing obstructions within the proposed easement area; where the

sewer main and stubs to houses, will be placed, were discussed.
Also restorB.tion, of the area, was a concern. ·Kevin Hochel eau
requested to keep at leas t. one row of trees on his property, and
requested a guarantee. City officials did not feel that would be
feasible. The installation and placement of the sewer main would
be according to the engineers plans and specifications.
Restoration of the easement area would be according to the plans
and specifications and city policy.
Sadlo made a motion to recess for five minutes at 9:25 p.m.;
seconded by Loso.
Ayes: Dehler; Sadlo; :Rieke; Loso.
Nayes: None. Motion carried.
The Mayor reconvened the meeting at. 9:30 p.m.
The location and width of the easement was discussed. It is
appropriate to place the easement on the property that it. serves.
Most present were in agreement that they did not want an alley.
Loso made a motion to approve the petitions to annex the property
on 9Ist Avenue which the Council has received petitions. The
motion was seconded by :Rieke. The property to be annexed is
bounded by 9Ist Avenue on the East; Pond View Ridge Addition on
.the West; the Southerly boundary of the property owned by Rodney
Ophoven; and the Northly boundary of the property owned by Kevin
Schirmers. The motion was seconded by Rieke.
Ayes: Dehler, Sadlo, Rieke; Loso.
Nayes: None. Motion carried.
Loso made a motion to direct the City Engineer to begin plans and
specifications to extend sewer mains to service the arei3. on 91st
Avenue which is being annexed; seconded by Rieke.
Ayes: Dehler, Sadlo; Loso, Rieke; Hazen.
Nayes: None. Motion carried.
REZONE AND VARIANCE REQUEST: Ted Klein appeared before the
Council to requ.est approval for a variance request and to rezone a
D;:¡rcp.l of property. Rieke stated that Old Highway .52 will be

improved in the future; and he proposed a buffer fence on the
sOlJ.th side of it; to separate the multiple family housing from the
single family housing zones. Neighbor problems and parking
problems were discussed. Mr. Klein stated that he has enough
parking, but t.he renters do not use t.he off st.reet parking.
At 10:00 p.m. the Mayor extended the meeting to 10:30 p.m.
10so stated that there are enough residents in that area now. The
Council discussed methods of discouraging the street parking.
Sadlo made a motion to table the rezoning and variance matter

VARIANCE REQUEST: Sadlo made a motion to approve the variance
request of Kay Lemke for a three foot side yard setback, as
recommended by the Planning Commission based on the finding that.

Kay Lemke's lot lS unique as the property has a shared driveway
with the property owner to the West and in orde'r to utilize the
driveway the garage needs to be placed two feet from the property
line. The motion seconded by Loso.

Nayes: None. Motion carried.
Variance of 32 feet. over t.he 800 sq. ¡:::~ as recommended by the

Planning Commission; was approved with a motion by Rieke; seconded
by Loso. Discussion - Dehler asked what was exceptional about
this lot. Loso stated that it. is a larger than normal lot; and
has a large backyard. Dehler stated that lots in st. ,Joseph are
platted at 198 x 66 feet which is 13;068 square feet, in the
original townsite, and the lot requesting a variance is approx.
21,244 square feet.

LOT SPLIT REQUEST: Council discussed a proposed lot split of the
Caroline Schriml property which would allow part of it to be
joined to the adjacent property. Minimu.m singl e family lot size

Loso requested t.o attend the Annual League Conference and made a
motion to approve the at.tendance of all city officials who wish t.o
go. Discussion - that. it. would be good if all could at.tend, but
because of budget constraints; the number of attending officials
was limited to three. The motion t.o allow a maximum of t.hree
officials; including the Deputy Clerk; was seconded by Rieke.

SUBJECT: MONTHLY REPORTS
Dear Council Members.
First of all, thank you for attending the D.A.R.E. graduation, I
believe it went over very well, and I received many good comments from
the public. Secondly, get ready for this, I made a mistake! On last
months months citation (tickets) summary report, I listed parking tickets
as 1. This is incorrect, it was 55, and for this months reports it is
18, both are enclosed.
. One item I would like to mention is that these reports are for the
period of April 1st to the 30th, and do not reflect Pinestock, or the
other "May Incidents", May's reports will be completed and submitted

, ': '" Also enclosed, are, a - couple of more thank you' s I received last month,
for your review.
The police department should receive approximately $560.00 back form
the sale of the drug forfeiture car. This money, by law is to be used
as a supplement to the agency's operating fund. I would very much like
to purchase a car phone with this money, and ask for your approval. The
phone would cost $499.00. Cellular One seems to have the best government
rate plan. It is $9.95 a month and each month you get a ~ hour of air time
free. Then it is 19¢ & 10¢ (equals $11.40 & $6.00 an hour) for peak and
off peak air time. r wouldn't think our bills would go over $20-$30 a
month. In addition to the drug forfeiture money, from time to time, the
city attorney has people pay money to the pOlice department in plea bargàin-
ing cases. (people who have been very difficult with-in the system) This
money is put in a supplental fund and we have $75.00 in it. Together with
the extra drug forfeiture money, this amounts to $135.00. Divide this by
6 months left in the year, gives us approximately $23.00 per month towards
phone bills. r would then know about how much the bills are running, and
budget the amount for 1993's budget. A car phone would greatly increase
our service to the public, and the efficiency of our department. Thank

FOR IMMEDIATE RELEASE
sixty-nine law enforcement officers were killed
feloniously in the line of duty ,during 1991, according to
preliminary national figures released today by FBI Director
William S. Sessions. The total is 4 higher than the 1990 annual
count of 65.
Firearms continued to be the weapon most used in the
slaying of officers. During 1991, handguns were used in 48 of
. the murders, rifles in 14, and shotguns in 4. . One officer was
killed by a bomb explosion, one was beaten with a flashlight, and
one was intentionally struck by a vehicle. Twenty-three officers
were wearing body armor at the time of their deaths, and 9 were
killed with their own weapons.
Geographically, 29 officers were slain in the Southern
states, 20 in the Midwestern states, and 7 each in the
Northeastern and Western states. Five officers were killed in
Puerto Rico, and 1 was killed in the U.S. Virgin Islands.
Sixteen officers were answering disturbance calls when
killed, and 15 officers were slain during arrest situations.
Among the 15, 4 were attempting to prevent robberies or apprehend
robbery suspects; 3 were attempting to apprehend burglary
. suspects; 3 were involved in drug-related situations; and 5 were

· attempting arrests for other crimes. Thirteen officers were
slain while enforcing traffic laws; 10 were killed in ambush
situations; 9 were slain while investigating suspicious persons
or circumstances; and 6 were killed while handling prisoners.
Law enforcement agencies have cleared 65 of the 69
slayings.
An additional 49 pfficers lost their lives due to
accidents occurring during the performance of their duties.

AMENDMENT TO GARBAGE PICKUP AGREEMENT
This amendment is to a Garbage Pickup Agreement entered
into the 31st day of October, 1991 for the period of January
1, 1992 through December 31, 1994, between Browning-Ferris
Ind. of MN, Inc. , d/b/a/ Park Refuse Service and the City of
st. Joseph.
That part of Part 2. Section (a) which alloHs the bag system
is expanded to include an allowance for fifteen gallon bags,
for the residents Hho chose to be on the bag system. Those
residents shall have a choice of fifteen (15) gallon bags at
$1.78 per bag, plus tax, or thirty (30) gallon bags at $3.30
per bag, plus tax. The bags will be available to the
I residents to purchase from the supplier.
All other parts of the original agreement shall remain
unchanged.

Dear City Council,
I'm writing in regards to Contract]]I, Pond and Overflow
Pipe Improvements. Item No. 10, 24" R.C. pipe sewer Class II,
. 738' lin. ft. I made a mistake on the bid form and didn't
catch it until just before the bid letting. I wanted to pull
it out but that sheet had to be signed. If I would have pulled
it out Contract I would have been void. I told the engineer
about it but he didn't understand what I was trying to tell
him at the time. Our total price on item 10 was $7,380.00,
where it should have been $13,680.00 A difference of $6300.00
Because of this error the pipe will cost me $4.00 per ft. more
than what my bid was. I still would be low bidder with $6300.00
more I'm asking you to consider giving $6,300.00 more so I
won't lose so much on this job. Thank you for your time.
