8 . a) Wine & Beer license - John Scherer or someone from his
office will be at the meeting about 7:45 p.m. to counsel
on this lssue. iT: any of you have questions or comments,
please call him on Wednesday afternoon or Thursday

10. Also included in your packets is a tabulation of bids for
seal coating as opened by Joe Bettendorf. The low bid
. will be recommended for approval.
13. a) The City 1S required to provide, and the Police
Department has requested to be given the Hepatitis
immunizations. The County Health Department orders
vaccine about twice a year. They were just in the
process of ordering it, so I requested that they order
enough for our officers.. as the Chief had requested. The
cost lS $95 per person, or $475 total. Dr. Newton is
willing to give the shots at $8 per shot. Dr. Newton
stated that blood tests pr10r to the vaccine shots are
optional. Blood tests after are recommended, because
there is a 7% failure rate.
13. d) Please get any budget comments or requests, or changes
to me right a\.¡ay In order to include them in the budget
proposal.
13. e) The City Council is on the agenda of the Township
meeting for June 29 at 9:00 p.m. to discuss proposed
annexation of DBL Labs area.
13. f) Investments - Because of the state of the economy,
it is getting increasingly more difficult to invest our
funds 1n denominations larger that $100,000, which is
covered by FDIC insurance. All funds over that amount in
any . 1_ must be collateralized at 110% market value.

He had a $500,000 CD mature on June 11th. I put $150,000
ln the First State Bank of st. Joseph, to cover recent
bills (Baker & 7th construction, and bond payments) .
Quotes for the balance were received at rates of 4.3% to
4.45% for 12 months. Eighteen months was the same or
less. I checked on other terms for better rates.

There has been an optical scan users group formed for
Minnesota users. There will be a meeting of this group.. June
25th at Brooklyn Park City Hall.
. Recently I have been appointed to a committee to review and
update the City Clerk's Manual, which was compiled in 1976 as
a joint effort or the LMC and MCFOA and U of M. A meeting to
begin the process will be scheduled soon.

Dear Council Members,
I am pleased to advise you that this month I have no requests to
the council, nor can I think of anything that needs~coQ~òil'~appre¥a!~or
action upon.
As of the time I am writing this letter, I have not heard back from
. the Sheriff in reference to checking on St. Ben's past record relative
to their liquor license application. I hope to have made contact with
the sheriff before the council meeting and advise you.
I would also like to share some information to you in reference to
the enclosed directive the council sent to the police department. (enforcE
ment) In last years June incident report (may period) the police departmE
f/t'f,P - 26 tickets, 10 of which were for parking. This year the police department
issued nearly 100 tickets and charges for the same time frame, with 25 bej
for parking. This represents over 4 times the amount of tickets and char~
issued, and over twice the amount for parking issues. 16 vs. 66, & 10 vs.
Last week I was in contact with Jim Marthaler and delivered to him
approximately 20 property locations with long grass and or weeds. Jim knE
of most of the locations, and is working on them. He will be back in cant
with me for any that become a problem and will not cooperate.
In addition to this, the police department located approximately 20
other properties with junk cars located on them, and made contact with thE
owners to correct the problem.
The purpose of this letter is to inform you of what the police depart
ment has been doing in these areas, and to express my opinion that I beliE
we have been doing a fairly decent job at it.

The st. Cloud Area Planning Organization at their March 26,

Commissioner
Protecting the health of people consuming water from public water supplies is a
responsibility that the Minnesota Department of Health (MDH) assumes from the federal
government. In Minnesota, the MDH must enforce the requirements of the federal Safe
Drinking Water Act, and regulations developed by the U.S: Environmental Protection
Agency for providing safe drinking water. The federal government has determined that
the numbers of parameters monitored should increase from 23 to 83 parameters. During
the 1992 state legislative session, the MDH was authorized to assess a fee of $5.21 per
water service connection to cover the total state costs of the program. The fee is to
be paid by a public water supply owned or operated by a city, town or water user
district. (Laws of Minnesota 1992, Chapter 513, Article 6, Section 2.) .
This is to notify you of the following:
.. You must collect $5.21 annually from every service connection served by your water
supply ps of July 1 of that year.
2. You must pay the Department of Revenue one fourth of the total yearly fee each
calendar quarter. The first quarterly payment is due on or before
September 30, 1992. A water supply with fewer than 50 service connections may make
one payment annually starting no later than June 30, 1993.
3. If you do not submit payment within 30 days of the due date, you must pay an
additional late fee. The late fee is 5 percent of the actual amount of the fees
collected on service connections.
To assist with the payment of the fee, the MDH will soon be distributing coupon
booklets that will aid you in returning the fee amount to the Department of Revenue.
To inform the MDH of the number of service connections served by your water supply, we
request that you return the enclosed postcard by July 15, 1992. To inform your water
supply customers of the fee, we suggest a way to describe the fee is, ~Fee for safe
drinking water testing program mandated by federal law.~
We hope to make collection of this fee as simple as possible. Public water supply
staff are available to answer questions concerning the fee collection requirements at
612/627-5170. .
We would like to hear any suggestions you may have to ease this process. We are aware
of some confusion regarding the effective date of this legislation. After consulting
411tith the Attorney Generalis office we have concluded that the laws support collection
f this fee at this time. .
Thank you for your cooperation in this effort. We know you share our concern that safe
drinking water continue to be provided to the citizens of Minnesota.

As the cable television business changes, I'm pleased to inform
you that Mark Twain Cablevision will keep pace with the changes.
In the months of June and July you will see the installation of a
new satellite receiving antenna at our headends located throughout
the region. This new receiving antenna is necessitated by the
launch of a new satellite, Hughes Galaxy 5. A number of programming
services currently carried, such as WTBS - Atlanta, ESPN, and Cable
News Network (CNN) and the Family Channel will be moving to Galaxy 5
from their current locat ion, the Galaxy 1 satellite. However, other
serv ices, such as CMTV, TNT and Home Box Office (HBO) will remain on
Galaxy 1. In order to receive both satellites a new satellite
~ antenna is needed.
The launch of Galaxy 5 is the start of a number of new cable
television satellites to be put into orbit over the next eighteen
(18) months. We will do everything possible to keep with the
technological advances in the future.
With the new Galaxy 5 antenna, our capability to receive more
channels is increased. In future years, it make adding new channels
more possible.
The installation of this new satellite antenna represents a

I Division. Our intent was to use Charitable Gambling Funds to
assist in remodeling our meeting rooms and kitchen.
We have been informed by the state that we will be allowed to
use $39,300.00 of gambling funds to assist remodeling as
planned. IT WAS YOUR LETTER, and others like it, that made
it possible! THANK YOU! It is the cooperation between the
many groups in the area, working together, that makes things
like this possible.
The remodeling has begun, and will get in full gear
immediately after July 4th. We hope to have the job done by
mid to late August, with a grand opening in September.

SUBJECT: League of Minnesota Cities FY 92/93 Membership Dues
Last year, the membership considered a constitutional amendment granting the
League's board of directors authority to assess membership dues. When this
amendment failed, the most recently adopted dues schedule, FY 1990/91, went into
. affect. This schedule was used to assess dues for the 1990/91 budget year. At that
time the League raised dues by 4.9 percent. For FY 1991/92 there was no general
dues increase for member cities, but population figures used for calculating dues
- were adjusted using the 1990 census data.
The 1990/91 dues scheduled was adopted as a constitutional amendment in 1988,
which covered League dues for three years. Dues were set by the board during those
three years at less than the allowed maximum for each year. Therefore, because the
dues were not increased by the allowed maximum in 1990/91, it is possible for the
board to increase dues approximately three percent without a constitutional
amendment for the 1992/93 budget year.
The Budget Committee met on May 19 and discussed recommending to the board a
potential three percent dues increase. While the board will ultimately act on this
matter, it is important to give members advance notice of this possibility. The
proposed three percent dues increase would generate a total of $42,514 in revenue.
This represents less than 1 1/2 percent of the League's total budget.

Enclosed is a report comparing the present dues for each city to the proposed amount
for FY 92/93. The board will consider this matter when they adopt the FY 1992/93

A Joint Resolution as to Orderly Annexation
WHEREAS, the City of Big Lake and the Town of Big Lake, Sherburne County,
Minnesota, are in agreement as to the orderly annexation of certain lands
described herein for the purpose of orderly, plannned growth; and
WHEREAS, such annexation and growth is of benefit to the City of Big Lake and
the Town of Big Lake; and
WHEREAS, the parties hereto desire to set forth such terms of orderly
annexation by means of this resolution.
NOW, THEREFORE BE IT RESOLVED by the City of Big Lake and Town of Big Lake as
follows:
The following described area in Big Lake Township is properly subject to
orderly annexation under and pursuant to Minnesota Statute 414.0325,
. Subdivision 1, and the parties hereto do hereby designate th is area as in
need of orderly annexation as provided by statutes; this area consists of
approximately 376.75 acres. The area subject to orderly annexation is
divided into the following three tracts:
TRACT 1: This area consists of Remmele Engineering's property (Plants 30 and
40) and to be annexed immediately upon approval of this agreement
by the Minnesota Municipal Board. This a rea consists of
approximately 75.20 acres. See attached map and legal
descriptions.
TRACT 2: This area consists of the property from the City limits to Remmele
Engineering's Plant 30 and is subject to annexation by petÍlion of
the City and Town during the terms and conditions of this
agreement. This area is approximately 11.68 acres. See attached
map and legal descriptions.
TRACT 3: This area consists of the property east of Remmele Engineering's.
Plant 40 and to the intersection of Trunk Highway #10 and the
Burlington Northern Ra il road (overpass) and is subject to
annexation by pet it ion of the City and Town during the terms and
conditions of this agreement. This area is approximately 289.87
. acres. See attached map and legal descriptions.

CONDITIONS OF ANNEXATION FOR TRACT 1:
A. The Municipal Board may review and comment but shall, within thirty (30)
days, order the annexation of the described property in accordance wi th
the terms of the joint resolution. Annexation of Tract 1 shall take
effect immediately.
R. The parties acknowledge that the orderly annexation area is urban and
surburban in character, contiguous to the City of Big Lake, and that the
City is capable of providing municipal services, such as sanitary sewer
and water, to said area.
C. For all property annexed to the City pursuant to this resolution, the
property tax ra te (and only the property tax rate) for said area will
increase to the City I S tax rate immediately. Taxes will also be paid to
the City as soon as possible according to Minnesota Statutes. The taxes
sha 11 be shared equally between the City of Big Lake and the Town of Rig
Lake inperpetuity. The tax sharing shall be only between the City of Big
Lake and Town of Rig Lake.
D. The Town of Rig Lake does, upon passage of th is resolution and its
adoption by the Rig Lake City Council, confer jurisdict ion upon the .
Minnesota Municipal Board so as to accomplish said orderly annexation in
accordance with the terms and conditions of this resolution.
E. For the cost of extending sewer/water to Remmele Engineering, Inc., the
City of Big Lake and the Town of Big Lake sha 11 determine the costs
sewer/water for each party involved.
CONDITIONS OF ANNEXATION FOR TRACT 2:
A. These property owners will not be annexed and they wi 11 not be required
to connect to the municipal sewer/water system. If these property owners
do request sewer/ water services because of development or other
concerns, the property in question will be required to annex as outlined
in the City/Township orderly annexation area. After services and
annexation, the taxes shall be shared 50/50 between the Cjty of Big Lake
and Town of Rig Lake, inperpetuity. The property owner/developer would
be expected to pay normal user fees, the sewer access charge, water
access charge, and meter charge to connect to the municipal system; these
funds shall be paid only to the City of Big Lake. These property owners
will not be required to immediately pay the cost associated with the
sewer/water extension to Remmele Engineering, Inc.
B. The property owners/developers will be assessed for improvements payable
upon their request for connection to City sewer/water with no interest .
charged back to the property owner. This assessment sha 11 be based on a
front footage basis for each property owner and payment sha 11 be shared
equally between the City of Big Lake and Town of Big Lake.

CONDITIONS OF ANNEXATION FOR TRACT 3:
A. These property owners will not be required to connect to the sewer/water
system unt il such a time when development occurs that requires sewer/
water. When this does occur, the property will be annexed as outlined in
"H" and "L" herein. If these property owners do request sewer/water
services, the same provisions stated in Tract 2 , Conditions A and B,
shall apply with the exception of those owners possibly paying to extend
sewer/water to their property.
OTHER CONDITIONS OF THE ORDERLY ANNEXATION AREA:
A. Street improvements in the orderly annexation area, such as a frontage
road concept, shall be shared on a 50/50 cost sharing basis after state
aid money has been deducted, when available. All other new roads sha 11
be built to an engineer's plans and specifications at the property
owner/developer's expense or City and Township expense. The City Counc il
and Town Board must approve the improvement of the roads as well as
sharing the costs of the roads.
. B. Maintenance of said streets that may be constructed will be completed by
the City of Big Lake's Pub lic Works Department. The Town of lEg Lake
will reimburse the City of Big Lake for such maintenance costs on a 50/50
basis after proof of labor, equipment, and materials have been submit ted
to the Town Clerk for audit ing purposes. Maintenance will include, but
is not limited to, street sweeping, snow remova I, seal coating, crack
filling, etc. Township roads shall be maintained and paid for by the
Town of Big Lake.
C. Maintenance of the utility lines are to be completed and paid for by the
City of Big Lake.
D. Future building permits shall be issued by the City of Big Lake's
Building Inspector within the annexed area only.
E. The zoning and subdivision controls shall follow under Minnesota Statute
414.0325, Subdivision 5 and provide for the establishment of a board to
exercise planning and land use control authority, prescribed by Minnesota
Statutes 1976, Section 471.59, Subdivisions 2 to 8, inclusive.
1. Board shall have authority to adopt and enforce the Uniform Fire
Code.
2. Joint planning and land use controls shall apply to any and all parts
. of the orderly annexation area, with the exception of Tract 3 which
planning/controls sha 11 be utilized when utilities and annexation
take place.

3. The ordinances and subdivision controls sha 11 be the City of Big
Lake's.
4. The Board shall consist of the City Council and Town Board.
S. Public hearings, etc. sha 11 be held as prescribed by law and to be
held at Big Lake City Hall or the Big Lake Town Hall.
6. The City of Big Lake Planning Commission and Town of Big Lake
Planning Commission will not be utilized in this annexation area.
F. It is the intent that the entire area proposed in this Special Orderly
Annexation District be zoned "industrial" type development, with no
provisions that future residential development will be considered.
Existing residential areas may continue to exist and be sold for
residential purposes.
G. The Big Lake City Council and Big Lake Town Board, as part of this
proposal, desire continued discussions on other possible orderly
annexation areas.
H. Annexation of Tract 2 and Tract 3 sha 11 be initiated by resolutions of ·
the City Council and Town Board and the same conditions of the Tract 1
annexation shall apply.
I. Expenses and costs incurred by this project, such as consultants and
construction, shall be negotiated and paid at a later date by the City of
Big Lake and Town of Big Lake.
J. Other costs associated with this project, such as Municipal Board fees,
etc., sha 11 be shared equally between the City of Big Lake and Town of
Big Lake.
K. It is understood by the City of Big Lake and Town of Big Lake that the
municipal utility system (sewer and water) is owned and operated by the
City of Big Lake under its ordinances, policies, and regulations.
L. Any development that occurs within Tract 2 and Tract 3 must connect to
the municipal sewer/water system, if available, and have the property
annexed as outlined in "H" above of this orderly annexation agreement.
If sewer/water services are not available, the property can be developed
according to the ordinances and policies of the Town of Big Lake and
Sherburne County.
M. This original agreement may be amended from time to time by the City
Council and Town Board.

JOINT FIRE PROTECTION AGREEMENT
BETWEEN THE TOWN OF BIG LAKE AND THE CITY OF BIG LAKE

)\r This joint contract is entered into as of of
\I\rc-~ , 1988, between the TOWN OF BIG LAKE, MINNESOTA
("Town"), an urban town organized and existing under the authority of
the Minnesota Statutes, and the CITY OF BIG LAKE ("City"), a Minnesota
municipal corporation, organized and existing under the authority of
the Minnesota Statutes.
WHEREAS, it is in the mutual interests of the residents and
property owners of both the Town and City that said governmental
subdivisions enter into this Joint Contract.
NOW, THEREFORE, in consideration of the mutual promises
herein contained and other valuable consideration, the receipt and
sufficiency of which are hereby acknowledged, the City and Town agree
as follows:
1. DEFINITIONS
City: shall mean the City of Big Lake, a municipal
corporation.
. Town: shall mean the Town of Big Lake, a duly authori zed
subdivision of the State of Minnesota.
Contract: shall refer to the agreement between the City of
Big Lake and the Town of Big Lake as herein defined.
Capital Equipment: sha 11 refer to all items whose purchase
requires bidding pursuant to Minnesota Statutes.
Equipment: shall refer to all items which may be purchased
without the necessity of bidding.
Joint Equipment: sha 11 refer to such equipment which is
purchased jointly and whose operations are shared.
Trustee: shall refer to the authorized party charged wi th
primary use and maintenance of joint equipment.
Fire Department: shall be the Big Lake Volunteer Fire
Department.
2. GENERAL EXPENSES
A. Equipment Purchases. Equipment shall be purchased on an
. equal funding basis with the City and the Town each contributing
one-half. Each party shall own an undivided one-half interest in said
equipment.
B. Equipment Maintenance. The City and Town sha 11 share
equally the cost of maintaining the equipment.

C. Building Maintenance. The City and Town sha 11 share
equally the cost for the general maintenance of the building in which
the present fi re department is located. .
D. General Operations. The City and Town sha 11 share
equally the cost associated with routine operations.
3. CAPITAL EQUIPMENT
A. The City and Town shall from time to time meet and
determine a long range capital replacement and improvement program.
B. The City and Town shall adopt by resolution authorization
to purchase capital equipment. Said resolution sha 11 designate an
authorized representative to facilitate said purchase.
C. Minnesota law shall govern the procedures utilized to
purchase said capital equipment. Nothing herein shall be construed to
allow for a mutual capital equipment expenditure without the mutual
consent of both parties in writing.
4. SPECIAL PROVISIONS
A. The City does hereby agree to provide and carry at all
times adequate and proper liability and workmen's compensation
insurance on all of the equipment and fire-fighters for which it acts
as trustee, to which the Township agrees to pay one-half of the cost .
of such insurance coverage.
B. In as much as the costs associated with the operation of
th is fire contract are being borne equally between the City of Big
Lake and the Town of Big Lake, the City sha 11 also bear only 5010 of
all costs associated with contracts other than between the parties of
this agreement. The City shall bill 5010 0 f these expenses to the Town
of Big Lake. The City shall forward 5010 of the associated revenues
derived from th(\se outside contracts.
5. TRUSTEE
The Town hereby appoints the City of Big Lake as trustee f (\r
the care, control and maintenance of all the equipment of the Fire
Department. The City shall maintain suE f ic ient insurance coverage to
assure prompt repair or replacement on said equipment. The Fire
Department shall be governed by ordinances of the City of Big Lake
Minnesota Statutes 412.221, Subdivision 17.

6. JOINT OWNERSHIP OF CURRENT PROPERTY
The City and Town hereby agree that both the City and Town
. shall have an undivided fifty (SO':O percent ownership interest i ) and
to the personal property ut i lized by the Big Lake Volunteer Fire
Department. The City hereby grants, bargains, sells, and conveys to
the Town an undivided fifty (50%) percent ownership in and to said
personal property to which the City currently has title. The Town
hereby grants, bargains, sells, and conveys to the City an undivided
fifty ( 5070) percent ownership interest in and to said personal
property to which the Town currently has title. However, the current
Big Lake Volunteer Fire Department fire station structure and the land
upon which said structure is currently situated, is specifically
excluded from the provisions of this paragraph. Said fire station
structure and the surrounding premises shall remain fully the property
of the City.
7. JOINT OWNERSHIP OF FUTURE PROPERTY
The City and Town hereby agree that both the City and Town
shall hold an undivided fifty ( 50%) ownership interest in and to all
. personal and real property hereinafter acquired by the City or Town
for use by the Big Lake Volunteer Fire Department, or purchased by the
Fire Department itself.
8. JOINT CONTRIBUTION TO EXPENSES
The City and Town hereby agree each to contribute fifty (50%)
percent of the expenses of the Big Lake Volunteer Fire Department.
The budget for the fire department will be prepared by the Chief of
the Big Lake Volunteer Fire Department, who sha 11 prepare a
preliminary budget for review by the City and Town before July 1 of
each year, and which shall be reviewed by the Fire Chief with the City
and Town by August 1 of each year. Said budget shall be considered by
the City and Town at the respective meetings of the City Council and
Town Board in August of each year, and the final fire budget shall be
adopted by the City and Town at the respective meetings of the City
Council and Town Board in September of each year. If any disputes
arise between the City and Town concerning the fire department budget,
they shall be resolved through a joint meeting or series of joint
. meetings of the City Counc i 1 and Town Board in September and October
of each year. In the event the City and Town are unable to resolve
the dispute following said meeting(s), the parties agree to submit the
dispute to arbitration pursuant to the rules and procedures of the
American Arbitration Association (AAA).

In the event the AAA fails to rule on the dispute prior to the
commencement of the succeeding calendar year, the City and Town agree
that the proposed budget of the City shall become effective at the
commencement of the calendar year, once the dispute is resolved ·
through arbitration in accordance with this paragraph.
9. FORFEITURE OF INTEREST
In the eve n t e it he r the City or Town reduces its percentage
of the contribution to the costs and expenses of the Big Lake
Volunteer Fire Department as provided above, the fifty ( SO'}'o) percent
undivided property interest to the fire department personal property
that is vested in the party that reduces such contribution, sha 11
revert entirely to the other party to this agreement.
10. MUTUAL HOLD HARMLESS
It is agreed that the City and the Town shall hold each other
harmless for injuries or damages incurred by the non-ava i labil ity or
inability of the Big Lake Volunteer Fire Department firefighters to
respond to a fire call due to, but not limi ted to, extremely poor
weather, poor road conditions, or other acts of God which sha 11 make
the rendering of fire protection or other emergency services
effectively impossible. ·
11. EFFECTIVE DATE
This Joint Contract is hereby deemed to be in effect for a
period of ten years from and after approval and signature by the City
and the Town; and said Contract may be renewed after said ten year
period for another period not to exceed ten years or such other length
of time that is permitted by law, by mutual agreement of the parties
hereto.
12. TERMINATION
Either party may terminate this Joint Contract upon written
notice given at least one (1) year prior to the effective date of the
cancellation, or upon the mutual consent and resolution of both the
City and the Town. The party that gives notice of termination sha 11
forfe it its entire ownership interest and investment in the Big Lake
Volunteer Fire Department, upon the effective date of such
termination, unless such termination is mutually agreed by the parties
hereto. If mutually agreed to terminate, the assets of the department
sha 11 be owned on a 50/50 basis between the City and the Township. ·
The only exception to this statement is the property owned by the City
as stated in paragraph six (6) .

13. MISCELLANEOUS PROVISION
. The Contract for joint ownership shall be effective when both
the City and Town mutual agree to terminate the December 15, 1986
Contract and mutually agree to sign this new Contract. If both City
and Town do not agree to do both of these actions then the December
15, 1986 Contract shall still be in effect.
IN WITNESS WHEREOF, the parties hereto have set their hands
as of the day and year first above written.
