Adjourn ~ aý-/ , · Pursuant to due call and notice thereof the City Council for the City of St Joseph met in regular session on Thursday, February 19, 1998 at 7:00 p.m. in City Hall. MEMBERS PRESENT: Mayor Kenneth J. Hiemenz; Councilors Bob Loso, Cory Ehlert, Mary Niedenfuer, Ken Twit. Clerk/Administrator Rachel Stapleton. OTHERS PRESENT: Judy Weyrens, Chad Carlson. Dave Theisen. Richard Taufen. Peter Omann, Jim Graeve. Mayor Hiemenz called the meeting to order at 7:00 p.m. with all Councilors present. AGENDA: Twit made a motion to approve the agenda; seconded by Loso. Ayes: Hiemenz. Loso, Ehlert, Niedenfuer, Twit. Nays: None. Motion carried. :MINUTES: Loso made a motion to approve the minutes of February 3, February 5, and February 10, 1998; seconded by Ehlert. Discussion - Niedenfuer stated the minutes of February 5, 1998, page 3276, second paragraph should reflect that Niedenfuer did not concur with elimination of the Mayor and Council reports, but recommended shortening them with presenting written information on as many matters as possible. The Council agreed with the correction and the motion is amended. · Ayes: Hiemenz. Loso, Ehlert, Niedenfuer, Twit. Nays: None. Motion carried. CONSENT AGENDA: The Council considered the consent agenda as follows: 1. 3rd Phase Development, Brian Klinefelter Memorial Park, Approve purchase of "Big Toy," $4,100. 2, Special Use Permit for Construction of an 84' x 50' Truck Storage Facility, Mike Kittridge. 3. Police Officer futoxilyzer Certification in St. Paul - Gustin. Meyer and Young, registration $40 each, 4. DNR Cooperative Forestry Assistance Reimbursement Agreement, $500, matching grant for pagers for Fire Department. 5. Fire Department Purchase 10 replacement pagers, estimated cost $400 each; two portable lights for ladder truck, estimated cost $110 each, 6. League of Minnesota Cities Legislative Conference February 26 - Approve attendance of 2 attendees. Discussion - Twit questioned reducing the front yard setback to 80 feet, for the Truck Storage Facility Special Use Permit request of Mike Kittridge. Mayor Hiemenz recommended no truck access from the front of the building be part of the Special Use. · Ehlert made a motion to approve the Consent Agenda items with the stipulation that Item Number 2. Special Use Permit for a truck storage facility provide no semi-truck access from the front of the building to Joseph Street. The motion was seconded by Loso. Ayes: Hiemenz, Loso, Ehlert, Niedenfuer, Twit. Nays: None. Motion carried, . BILLS PAYABLE: After short discussion Loso made a motion to approve the bills payable as presented check numbers 25106- 25151; seconded by Twit. Discussion - Council requested to have the new Police Officer introduced to them at the next meeting, Ayes: Hiemenz, Loso, EWert, Niedenfuer, Twit. Nays: None, Motion carried, Loso made a motion to approve the overtime and call outs with a typo correction; seconded by Twit. Discussion - Richard Taufen's vacation hours carryover at the end of the fiscal year exceeded the allowed carry over. Council requested a response if this matter has been addressed, Loso made a motion to allow office staff up to 20 hours overtime/comp time for audit preparation as requested; seconded by EWert. Ayes: Hiemenz, Loso, EWert, Niedenfuer, Twit. Nays: None. Motion carried, PUBLIC COMMENTS TO THE AGENDA: Fire Chief Dave Theisen stated a total of $1,750 in grants was received for funding assistance for the Fire Department pagers, EDA REPORT: EDA Director Chad Carlson reported on the summary of activities during the . year and discussed his annual report. After short discussion of various proj ects, Twit made a motion to accept the EDA Annual Report; seconded by Niedenfuer. Ayes: Hiemenz, Loso, EWert, Niedenfuer, Twit. Nays: None, Motion carried, CENTRAL MINNESOTA EVENTS CENTER: EWert presented and discussed a Resolution Requesting the Minnesota Legislature to Adopt Legislation enabling the City of St. of St. Joseph to Impose a Sales and Use Tax of up to one Percent, and an Additional Sales Tax on Lodging and Food and Beverage of up to One Percent to pay for all cost Associated with Developing the Central Minnesota Events Center. EWert stated the proposed legislation is intended to provide taxing allowances for the cities in the St. Cloud area. The proposal provides for excess revenue, beyond that needed to provide for debt service for the proposed Events Center, to be placed in a pool for the participating cities use for specific projects. He further stated any benefit the Events Center would have to St. Joseph cannot be measured until the location is identified. Twit stated he had contacted City Attorney as directed by the Mayor, concerning this resolution, Scherer advised the resolution does not obligate the City as it is written, Twit further discussed the costs of administration of the proposed ta.-x as well as the costs to businesses in implementing it. Niedenfuer stated before St. Joseph considers funding a facility to benefit St. Cloud, consideration needs to be given if St. Joseph is willing to sacrifice its needs for a St. Cloud facility, . Mayor Hiemenz stated St. Joseph has many priorities, 2- . , , . Ehlert recommended delaying consideration of the resolution, as it may be significantly changed, St. Joseph's involvement is to have access to the potential future excess funding. SPACE NEEDS PROPOSAL: The Council received a proposal for the space needs update of Bradley E. F orbrook. SEll. There was considerable discussion of the role of Department Heads, costs, the need for public input, and need to plan for the future. Mayor Hiemenz stated the Council needs are great enough that Council chambers should be reserved for Council, rather than to also accommodate community use. Loso and Twit felt a facility should be planned, with departments sharing use of some areas and with possible future expansion capabilities. Chad Carlson discussed the implications of G. O. Bonds and Revenue Bonds as well as debt limits. He indicated he could send infonnation to several architects to prepare sketches of their perception of our needs. There was discussion of including a basement and possibly a second floor. After further discussion Twit made a motion to direct the Department Heads to compile and report their anticipated space needs to the EDA Office by Friday, February 27; seconded by Ehlert. . Ayes: Hiemenz, Loso, Ehlert, Niedenfuer, Twit. Nays: None. Motion carried. INSURANCE UPDATE, LIABILITY, COMPREHENSIVE, MUNICIPAL PROPERTY AND CASUALTY: Peter Omann, Insurance Agent, discussed the current claim for the damage due to the roof leaking. Mayor Hiemenz indicated the damage, due to the freezing and thawing, caused the patch on the roof to open up, Omann also presented and discussed the current insurance coverage. Buildings are covered with blanket coverage, with flood insurance now included. Inland marine items under $25,000 have blanket coverage, with over $25,000 items listed.. Coverage includes open meeting law (cost $500 annually). On auto and general liability the Council needs to decide if they wish to agree to a waiver of immunity, This waiver would increase general liability and auto coverage from $300,000 to $750,000 at an additional cost of $750 annually. Omann also presented an umbrella policy, which would increase coverage to one million dollars, at an additional premium with waiver of immunity - $5301, and without the waiver - $4,264. Loso made a motion to decline the umbrella coverage; seconded by Twit. Ayes: Hiemenz, Loso, Ehlert, Niedenfuer, Twit. Nays: None, Motion carried, Twit made a motion to accept the waiver of immunity, increasing general liability and auto . insurance coverage to $750,000 limit; seconded by Ehlert. Omann discussed the role of the Insurance Agent for employee health insurance, stating the City may elect any agent they so chose. He can give the same service with our current insurance company (Principal), as well as provide quotes from other carriers. He also requested to be the agent for Principal should the City stay with Principal. The Council generally agreed to entertain any proposals Omann may receive from his companies. PURCHASE REQUEST FOR ROTARY BROOM: Loso made a motion to approve the request to purchase a new rotary broom for the John Deere from Mies Equipment at $2,250; seconded by Twit.. (This equipment is used primarily for sweeping streets and snow removal from sidewalks and hockey rinks). Ayes: Hiemenz, Loso, EWert, Niedenfuer, Twit, Nays: None, Motion carried, DIRECTOR OF PUBLIC WORKS REPORTS: Richard Taufen reported 1) Wells number 3 and number 4 both need cleaning, estimated cost is $2,000 to $2,500 per well. Loso moved to approve the request to clean wells as presented; seconded by Twit. Ayes: Hiemenz, Loso, EWert, Niedenfuer, Twit. Nays: None, Motion carried, 2) Taufen also reported the meters at wells number 3 and number 4 need to be re-calibrated, . estimated cost is $300 to $500 per meter. Twit made a motion to approve the re-calibration as presented; seconded by Loso. Ayes: Hiemenz, Loso, Ehlert, Niedenfuer, Twit. Nays: None, Motion carried, 3) Taufen reported serious drainage problems again this year with Joseph Street. Also the roadway is breaking up badly, City Maintenance has hauled seven loads of gravel to it already. Loso stated the need is immediate with Joseph Street. A construction project for it should include stOrnl drainage and utilities along with construction of the roadway. Niedenfuer recommended consideration of drainage with something other than curb and gutter. 4) The owner of Horizon RoofIng, the roofIng company that has been repairing the City Hall roof, recently came out to view the roof and repair it. He felt the leak was fIxed but stated the crack large. 5) The City has accumulated surplus items, and needs to dispose of them, Taufen recommended holding an auction at the end of April or early May. Taufen will check on consignment possibility with St. Cloud's next auction, also if area Cities would wish to join St. Joseph in an auction, 6) The Community Fire Hall will hold an open house on March 29 from 9 a.m, to 4 p.m. with a pancake breakfast and a ceremony in the afternoon, . 7) The property owner at 208 Fir Street E, in Northland Addition complained about a drainage problem in front of her driveway, Taufen stated this seems to be a yearly occurrence that 'I' , ~ . ) · remedies itself, with the water gone now. Council recommended the City Engineer review the matter next time he is in that area. ---- ---- PERSONNEL COMMITTEE REPORT: Twit reported the employee job description updates are nearly completed. Council will hold a special meeting on February 24 at 6:00 p.m. to consider changes needed to come into compliance with Pay Equity. Loso questioned how the City became "out of compliance" and recommended and Council concurred to request Consultant Kathleen Murphy (previously assisted the City with wage and pay equity issues) to assist the City in this matter. MAYOR'S REPORT: 1) Mayor Hiemenz received a letter from the City of St. Cloud requesting St. Joseph meet with them to discuss the compensation for their sewer system regarding sections 1, 12, and 13 of St. Joseph Township. These sections were included in the Orderly Annexation agreement, but were previously included in the St. Cloud sewer service area. 2) This year the Transportation Alliance is giving its support to the 3cd Street upgrade (in St. Cloud). The 3cd Street project is on the APO 1998 Transportation Plan as well. 3) Steams County is setting up cluster meetings through LESA (Land Evaluation Site · Assessment) to accommodate their land use plan controlling urban sprawl and preserving ag land. 4) Mayor Hiemenz discussed infonnation sent to the Council concerning a parcel of land adjacent to and west of the Roske property on Minnesota Street locally known as the Roth property. Twit felt the City should pursue consideration of purchasing that parcel as it would benefit the property owned jointly by the City and Township. Loso felt consideration should be given after the City's space needs are detennined, COUNCILORS REPORT TWIT: No report. EHLERT: No report. LOSO: 1) An estimate for fencing the area by the maintenance shop (due to a safety concern, to deter children sledding on the hill) will be brought to the Council at the next regular meeting. 2) The minutes of the last Fire Board minutes were received in the packet. NIEDENFUER: 1) The CORE Committee met recently. One of the community members expressed concern that the "Disorderly House Ordinance" is going to another committee, Linda Sniezek discussed some of the problems the Landlords have with the way parts of the document is written. . · Mayor Hiemenz extended the meeting at 10:00 p.rn. S- . , . 2) A student intern with the Minnesota Project is working on a project that will predict St. Joseph's future outlooks and growth using a program called Luf-net. He will be contacting community persons to assist in the project, CLERK/AD:MJNISTRATOR REPORTS: Because the City received the radio license for the SCADA system, John Scherer recommended payment to Bentec of $2,000. The City is retaining $4,000 for warranty. l\1ISCELLANEOUS OR ANNOUNCEMENT ITEMS: 1) Mayor Hiemenz reported he is getting a committee of Students, Landlords, Residents, and Councilors to consider, and make recommendation to the Council on the proposed Ordinances relating to rental housing (Disorderly House Ordinance). Board of Review meeting for the City has been set for 7:00 p,m., April 7, 1998, . Stapleton reported the City Office local government band radio no longer receives the emergency frequencies and therefore staff is unaware when Police and Fire are responding to emergency calls, This has caused City Office communication problems, Granite Electronics is able to program the radio system to scan the needed channels for reception in the City Office for about $100, Niedenfuer made a motion to approve the re-programming of the radio as requested; seconded by Ehlert, Ayes: Hiemenz, Loso, Ehlert, Niedenfuer, Twit. Nays: None, Motion carried. Mayor Hiemenz reported Mark Lambert called to check on the status of the request to install a light on the emergency siren pole to light his parking lot. The effect it may have on the radio communication has not yet been deteI111ined. The meeting was adjourned at 1 0: 15 p,m. with a motion by Loso; seconded by Twit. WI DRAFT Development Proposal February 27, 1998 As we came to the end of the 1997 construction season, concern arose regarding the current process for subdivision development in St. Joseph. While most recent development projects have been constructed satisfactorily, the process currently used needs improvement in terms of planning for the future, protecting the interests of established neighborhoods, and completing construction in a timely and cost effective manner. · Currently, the Developer hires a Surveyor and Engineer to prepare the preliminary and final plat, the site grading plan, and the construction plans and specifications. The Developer then hires one or more contractors to grade the site and construct the public improvements. The City Engineer reviews the plats and accompanying submittal documents, and reviews and approves the final construction plans and specifications. He then monitors project progress and places a technician on site to observe construction. Field information is conveyed to the Developer's Engineer for payments to the Contractor, and for the development of record drawings. The Developer pays for the City's legal and engineering costs based on preliminary estimates submitted by John Scherer and Joe Bettendorf. The City's interest is protected by requiring the Developer to place a cash escrow or letter of credit on file covering the projected costs. The Subdivision Agreement provides that any excess escrow is returned to the Developer, and that any overrun of these costs is covered by additional payment from the Developer. Problems have arisen with this process including the following: .. There is duplication of Engineering costs. The Developer pays to have the construction plans and specifications prepared by an independent Engineer, then pays again to have · the plans and specifications reviewed by the City Engineer. .. The Developer's Engineer is driven to minimize cost and to focus on improvements that serve the immediate development. Though the City Engineer reviews the plans, it is often , · difficult to force changes to a design "that works" but that doesn't incorporate a long range view or minimize future maintenance. An example of this is in Northland Addition where we have separate small storm sewer outfall lines for the first and second phases, when a single line designed to serve two or three phases would have been a better choice. ~ Potential costs are not always allocated to the entire development. In Northland, the first three phases were the easiest and least costly to develop. Last fall the Developer looked at proceeding with the fourth phase, but abandoned his plans because costs were so much greater for the remainder ofthe development. It is my understanding that a drainage pond and lift station added significant costs to the remaining lots. These extraordinary costs should have been spread over the entire development, not just the final phases. This cost issue could prevent additional development from taking place for some time seriously impacting our ability to get a second access road into the Northland area. ~ A similar situation to the above exists in Pond View Ridge where the first phase of development along East Baker Street was constructed with drainage going to the north via shallow ditches. Now that we're looking at developing the area north of Baker Street as a separate phase, the holding pond on East Minnesota Street will have to be enlarged to accommodate not only the runoff from the current phase, but also the runoff from the original first phase. Enlargement of the holding pond is consistent with the original plan · for the subdivision and with the work we just completed on East Minnesota Street. My concern is that the lots in the current phase will probably have to bear the entire cost of this expansion. Though we have eliminated the need for a lift station in this area, there was one in the original plan, and the current lots would have had to bear that entire cost as well. This practice of not analyzing costs for the entire development up front makes the last phases disproportionately expensive to complete. ~ When the Developer hires the Contractor, the City has no direct contractual relationship to fall back on. We must rely on our agreement with the Developer to get things done in a timely manner. Ifthe Developer chooses to have multiple contracts rather than one prime contract, we must deal with each Contractor separately with no one in charge of the overall project. This is extremely difficult to administer. Often times there is no specific completion date and construction drags out. This causes problems with the neighboring properties and usually results in Engineering costs exceeding preliminary estimates. ~ The Developer's Engineer takes no ownership of the construction process since the City Engineer is doing the construction observation portion of the work. This creates problems if changes need to be made on the job site. If a change is needed, we must attempt to work through the Developer's Engineer, who usually asks us to take care of it since we're on the site. Issues of responsibility arise, especially if the change is going to cause the Developer's cost to increase. · Last fall, the St. Joseph City Council moved to have all subdivision development designed and administered by the City Engineer, and directed me to prepare a plan by which this can be accomplished. I propose the following procedure: . · 1. The Developer hires a Surveyor to prepare a sketch plan for the development and submits the plan to the City for review and approval. The City Engineer reviews the sketch plan and prepares a cost estimate to do the preliminary engineering including site grading plan, street grades, drainage, sanitary sewer, water main, and estimate of probable construction cost. The Developer deposits a cash escrow with the City in the amount of 125% of the Engineer's estimate. The escrow is placed in an interest bearing account with all accumulated interest going to the Developer. ' 2. The City Engineer completes the preliminary engineering work to accompany the Developer's preliminary and final plat submittal. The City Engineer attends the Planning Commission and Council meetings as required to field questions regarding the design and to make required changes. 3. The City Engineer prepares a cost estimate to complete construction plans and specifications, and to perform construction administration and resident construction observation. The estimate is to include costs for soil borings, agency review fees, and advertising costs. The Developer deposits a cash escrow with the City in the amount of 125% of the Engineer's estimate. The escrow is placed in an interest bearing account with all accumulated interest going to the Developer. · 4. The project is bid by the City of St. Joseph as a City project. If the City and the Developer find the low bid acceptable, the Developer deposits a cash escrow with the City in the amount of 110% of the low bid plus 125% of projected engineering. legal, and administrative fees. The escrow is placed in an interest bearing account with all accumulated interest going to the Developer. 5. Construction is completed, and any residual escrow funds are returned to the Developer. An unconditional letter of credit on a form prepared by John Scherer can be substituted for a cash escrow if the Developer wishes. Some Developer's may want the City to bond for the project and assess the cost of the improvements back to the development. I didn't pursue the project since the property owners entered a resounding no with regard to sewer and water. Sanitary sewer is in the street up to DBL Labs, and would have to be in the street if extended further north. Water will not be available until it is brought into the industrial park. Apparently there have been complaints again recently regarding the condition of the street. I believe that if we consider going ahead with the project, sanitary sewer extension is mandatory. We can . handle water main later if the property owners will give us easements to install the main behind the curb line. In the event of such a cancellation, GRANTEE shall be entitled to payment, determined on a pro rate basis, for work or services satisfactorily performed. The STATE may cancel this Agreement immediately if the STATE finds that there has been a failure to comply with the provisions of this Agreement and that reasonable progress has not been made, or that the purposes for which the funds were granted have not been or will not be fulfilled. The STATE may take action to protect the interests of the State of Minnesota, including the refusal to disburse additional funds and requiring the return of all or part of the funds already disbursed. GRANTEE shall indemnify, save, and hold the STATE, its representatives and employees harmless from any and all claims or causes of action, including all attorney's fees incurred by the STATE, arising from the performance of this Agreement by GRANTEE or GRANTEE'S agents or employees. This clause shall not be construed to bar any legal remedies GRANTEE may have for the STATE'S failure to fulfill its obligations pursuant to this Agreement. X. ACCOUNTING, AUDIT AND RETENTION OF RECORDS. A. GRANTEE will establish an interest bearing account to deposit program funds in accordance with applicable federal regulation for P.L. 104-134. The trust account must be able to account for the Federal award amount, local match amount and interest earned. Only allowable program expenses can be paid from this account in accordance with the Office of Management and Budget (OMB) Circular A-87, Cost Principles for State and local Governments; the Office of the Comptroller Financial Guide; and llEBG program requirements. B. In accordance with the current edition of OMB Circular A-128, recipients, who receive $ 1 00,000 or more of Federal funds during their fiscal year, are required to submit an organization-wide financial and compliance audit report. Recipients, who receive $25,000 to $ 1 00,000 of Federal funds, are required to submit a program or organization-wide audit report as directed by the granting agency. Recipients, who receive less than $25,000 of Federal funds, are not required to submit a program or organization-wide financial and compliance audit report. A copy of this audit shall be submitted to the DEPARTMENT. The CFDA number for this grant is 16.592. C. GRANTEE's and any subcontractor's books, records, documents and accounting procedures and practices relevant to this project are subject to examination by the STATE's authorized agent and by the STATE and/or legislative auditor. Fiscal records shall be sufficient to reflect all costs incurred in performance of this agreement and shall be retained for a period of three years following the submission of the final report. ~ XI. OWNERSHIP OF MATERIALS AND INTEllECTUAL PROPERTY RIGHTS. A. The STATE shall own all rights, title and interest in all of the materials conceived or created by the GRANTEE, or - its employees or subcontractor, either individually or jointly with others and which arise out of the performance of this Agreement, including any inventions, reports, studies, designs, drawings, specifications, notes, documents, 2 soft"ware and documentation, computer based training modules, electronically, magnetically or digitally recorded . material, and other work in whatever form ("MATERIALS"). . The GRANTEE hereby assigns to the STATE all rights, title and interest to the MATERIALS. GRANTEE shall be responsible for payment of any and all such claims, demands, obligations, liabilities, costs, and damages including, but not limited to, reasonable attorney fees arising out of this Agreement, amendments and supplements thereto, which are attributable to such claims or actions. If such a claim or action arises, or in GRANTEE'S or the STATE'S opinion is likely to arise, GRANTEE shall at the STATE'S discretion either procure for the STATE the right or license to continue using the MATERIALS at issue or replace or modify the allegedly infringing MATERIALS. This remedy shall be in addition to and shall not be exclusive to other remedies provided by law. XII. DA T A PRACTICES ACT. The GRANTEE shall comply with the Minnesota Data Practices Act as it applies to all data provided by the STATE in accordance with this grant agreement and as it applies to all data created, gathered, generated or acquired in accordance with this grant agreement. XIII. IDENTIFICATION AND SOURCE OF FUNDING. The GRANTEE agrees that any publication (written, visual, or sound, but excluding press releases, newsletters and issue analyses) issued by the GRANTEE or any subcontractor which describes . projects funded under P.L. 104-134 shall contain the following statement: "This project was supported by Grant #96-LB- VX-0330 awarded by the Bureau of Justice Assistance, Office of Justice Programs, U.S. Department of Justice. This Agreement, and amendments and supplements thereto, shall be governed by the laws of the State of Minnesota. Venue for all legal proceedings arising out of this Agreement, or breach thereof, shall be in the state or federal court with competent jurisdiction in Ramsey County, Minnesota. XX. OTHER PROVISIONS. A. The GRANTEE assures that Federal funds made available under this formula grant will not be used to supplant state or local funds but will be used to increase the amounts of such funds that would, in the absence of Federal funds, be made available for law enforcement activities. B. The GRANTEE assures that matching funds required to pay the non-Federal portion of the cost of each program and project, for which grant funds are made available, shall be in addition to funds that would otherwise be made available for law enforcement by the recipients of the grant funds. C. The GRANTEE assures that a legally binding commitment appropriating the cash match required by the Act has been made by the appropriate authorities. D. GRANTEE agrees to complete and keep on file, as appropriate, the Immigration and Naturalization Service .
