HomeMy WebLinkAbout2015 [03] Mar 19 March 19, 2015 Page 1 of 3 Pursuant to due call and notice thereof the Joint Planning Board for the Township and City of St.Joseph met in special session on Thursday, March 19, 2015 at 7:30 PM in the St.Joseph City Hall. City Representatives Present: Mayor Rick Schultz. Council Members Dale Wick, Renee Symanietz, Bob Loso, Matt Killam. Planning Commission Members Steve Olson, Chad Hausman, Ross Rieke. City Administrator Judy Weyrens. Township Representatives Present: Township Board Chair Jeff Janssen. Board Members Brenda Stanger, Jerome Selzer. Planning Commission Members Ralph Eiynck, Michael Koltes, Hal Undersander. Township Attorney Boa Piras. Others Present: Duane Pfannenstein, Justin Honer, Mike Deutz, Stearns County Commissioner Mark Bromenschenkel Public Hearing,Consideration of amendment to OAA: Weyrens stated the purpose of the hearing is to amend the OAA agreement, modifying the management of the OAA to include administrative responsibilities and board composition.Additionally, within the OAA,the MOU is proposed to be modified adding contractor yards as a permitted use by issuance of a conditional use permit. Schultz opened the public hearing. Boe Piras, Willenbring Law Office: Piras approached the board as the legal representation for the township. Piras stated there are additional corrections that were not redlined to the MOU agreement he would like to make note of. Some of the changes are typos, others are more substantial.The changes are as follows: • Typo in paragraph 3 of MOU • Paragraph 10 should read as: "County to administer the applications in the orderly annexation area for items involving platting, rezoning,variance/administrative appeals, conditional and interim use permits, and administrative subdivisions." • Paragraph 10:Attachment 1 should be corrected to Attachment 2 • Paragraph 11: • Paragraph 16.1: "The land use controls for the OA Area shall be the Stearns County Urban Expansion District." • Attachment 2(a3): "Any manufactured home to be used as a residential dwelling unit and located within the Urban Expansion Zone shall be no less than...." • Attachment 2(a3): "Residential dwelling units shall be no less than 24 feet in width." • Attachment 2(b2): "The County will administer the applications in the OA area for items involving platting, rezoning,variance/administrative appeals, conditional and interim use permits, and administrative subdivisions. The county will review applications for compliance, collect application fees, develop required legal notices,send notification labels to the township and will provide recommendations to the Joint Planning Board for consideration." • Attachment 2(b3): "The City will set the public hearing for the Joint Planning Board by sending out property owner notifications on joint City/Township letterhead." • Attachment 2(b8): Paragraph to include"Administrative Subdivisions." • Attachment 2(b16):The County is still listed for responsibility of liability coverage.The removal of the County should be considered. As no one else present wished to speak, Schultz closed the public hearing. Janssen asked who will be responsible for publishing the legal publication and where.Weyrens stated that the agreement states'as designated' because different items can be published differently. Loso made a motion recommending the Joint City Council/Township board approve the amendments to the OAA and modifications to the MOU in addition to the existing language.The motion was seconded by March 19, 2015 Page 2 of 3 Discussion: Janssen stated in addition to the amendments to the OAA and modifications to the MOU, the corrections made by Piras need to be taken into consideration as well. As no further matters were on the agenda,Schultz adjourned the Joint Planning Board meeting at 7:43. Schultz called to order the Joint City Council Township Board meeting of Thursday, March 19, 2015. Consideration of amendment to OAA and recommendation of Joint Planning Board: Janssen asked for questions from the Township Board on the recommendation to approve the OAA amendment.There were no questions. Janssen made a motion to approve the amendments to the OAA,and modifications to the MOU as presented.The motion was seconded by Stanger and passed unanimously. Symanietz made a motion approving the amendments to the OAA and modifications to the MOU as presented.The motion was seconded by Wick and passed unanimously. Schultz adjourned the Joint City Council/Township Board meeting at 7:46 PM. Schultz called to order the Joint Planning Board meeting of Thursday, March 19, 2015. Approval of Minutes: Loso made a motion approving the minutes of January 5,2015 with the removal of Hal Undersander from the list of others present.The motion was seconded by Undersander and passed unanimously. Public Hearing—CUP, Honer Excavating,St.Joe Sand and Gravel:Weyrens stated the purpose of the hearing is to consider a conditional use permit to allow for a contractor yard in the Urban Expansion area. The property under consideration is Lot 1 Block 1 St. Joe Sand and Gravel, and was submitted by Honer Excavating Inc. Schultz opened the public hearing.As no one present wished to speak, Schultz closed the public hearing. Weyrens stated two actions are to be taken tonight by the board. The first is to amend the subdivision agreement to allow for well and septic. The subdivision agreement which governs St. Joe Sand and Gravel prohibits the connection to water and sewer; therefore if the CUP is to be approved the agreement must be amended.The second action required is consideration of a CUP to allow the operation of a contractor yard at the aforementioned property. Loso made a motion to approve the amendment to the subdivision agreement between the City of St.Joseph and St.Joe Sand and Gravel to allow for a well and septic system.The motion was seconded by Hausmann and passed unanimously by those present. Weyrens stated the second matter is the draft findings of fact which have taken into account the recommendations of Stearns County. The findings were also shown to the applicant and no issues were found. Janssen asked if the maximum of twenty commercially licensed motorized vehicles includes stored vehicles as he has concerns that they might go over the maximum. Weyrens stated she is unsure how the County interprets the requirement, but assumes it is just the vehicles owned by the company. Adam Ripple, Rinke Noonan:Ripple approached the board stating his interpretation is that the maximum twenty vehicles apply only to those owned by the applicant. Janssen stated he would like to see additional clarification in the findings limiting it to those of the applicant. March 19,2015 Page 3 of 3 Mike Deutz, St. Joe Sand and Gravel: Duetz approached the board to clarify that there is an asphalt plant in addition to the contractors yard. However, the number of vehicles and the operations associated with the asphalt plant does not apply to this conditional use permit. Loso made a motion to execute the Findings of Fact approving the CUP for Honer Excavating as requested based on the following conclusions and contingencies.The motion was seconded by Hausmann and motion passed unanimously by those present. 1. Hours Operation: Monday—Friday:6 AM to 8 PM Saturdays:7 AM to 8 PM Sundays and Holidays:Operation not allowed 2. Signage: The CUP docs not include provisions for signage and if at some point in the future,signage be requested,the property owner will be required to go the planning process. 3. Screening: The property owner has indicated that the storage of material will be kept on the floor of the gravel pit,so additional screening is not required. If at some point in the future the property owners changes the located of the outdoor material the property owner shall meet with the Joint Planning Board to determine if additional screening is required. 4. Equipment: A maximum of twenty(20)commercially licensed motorized vehicles associated with the contractor's yard(including trucks and trailers)are allowed. 5. Accessibility Code: Prior to receiving a certificate of occupancy,the property owner shall provide Stearns County Environmental Services with documentation from a Licensed Building Official that the shop was constructed to meet the State Accessibility Code. 6. Storm Water: If the total new impervious service exceeds one(1)acre, a storm water management plan according to Section 7.25 of the Stearns County Land Use and Zoning Ordinance 14439 shall be required. 7. Required Permits: The applicant is responsible for obtaining all required permits and provide a copy of the same to Stearns County Environmental Services.
