Ehlert stated it is his opinion that it is prudent to request bids . period~callyand review the services received. The Council was in general agreement to bid the refuse servic· in fall 1999. Deferred Assessment: Weyrens presented a request by the Pond View Ridge Developers to extend the payment of the deferred assessment to April 30, 1999. The Developer's Agreement required the assessment be paid in fulll20 days from commencement of the Plan B Improvements. Bettendorf clarified that the assessments in question have been deferred without interest since 1994 as part of the East MN Street Utility Improvement project. The assessments were deferred until the property was developed. As the assessments have been deferred in the past, Ehlert made a motion to defer payment of the assessment as stated in the Pond View Ridge IV Developer's Agreement until June 30, 1999. The motion was seconded by Niedenfuer. Discussion: Twit clarified that if the assessment is not paid by June 30, 1999 interest will be charged. Ayes: Hiemenz, Ehlert, Twit, Niedenfuer Nays: None. Motion Carried 4:0:0 City Engineering Services: Hiemenz reported that Amy Schaefer of SEH will be working with Joe Bettendorf. The employ of a second engineer will increase communication and resolve problems more efficiently. OLD BUSINESS Appoint two Members of the Council to the Alcohol Compliance Check Committee: As discussed at the January 21, 1999 Council meeting, two Council Members needto be appointed to the Alcohol Compliance Committee. This Committee will work with Officer Dahl to implement a program aimed at the decrease of minor consumption. Mayor Hiemenz stated that he would be interested in serving on the . Committee as well as Niedenfuer and Ehlert. Twit stated he also has interest in serving onthe Committee but would withdraw. Twit made a motion appointing Niedenfuer and Ehlert to the Alcohol Compliance Check Committee with Hiemenz as an alternate. The motion was seconded by Hiemenz. Discussion: Twit questioned if Loso has an interest in working on the Committee, Hiemenz agreed to withdraw from the Committee as an alternate ifLoso is interested in serving on the committee. The cqst breakd()wn is as follows and excludes overtime and holiday payoff: r Wages: $2~,078.40 Benefits $ 7,676.48 I Hieme z stated that is was h~s understanding that the purpose of the FASTCOP program was to provide . additio al police officer coverage. W.I.S.E.R. Program- Julie Peters & Les Green: Les Green andJulie Peters appeared before the Council to seek support and participation in the W.I.8.E.R. program started by 8t. Cloud Mayor Larry Meyer. The purpose of the program is to provide community wide diversity education to community leaders. City Councils, County Board and School Board members are being requested to participate. As presented by Peters and Green, the following is a summary of the W.I.8.E.R. program. · The program qualifies for Continuing Education Credits · W.l.S,E.R. is an effective communication tool · The program is a twelve week course and requires a commitment of approximately one hour per week. To help accommodate schedules, meetings will be established at various times. · W.I.S.E.R. is also in the form of a workbook which can be completed in 90 days. · The project is cost is $ 55.00 per registrant · If community leaders subscribe to the program it will make a statement about our comminuty and leadership. · The St. Cloud area is the first to try the program Ehlert made a motion to support and participate in the W.I.8.E.R program as a City Council and authorize the expenditure of$55.00 per Council Member. The motion was seconded by Twit. Discussion: Niedenfuer strongly urged the entire Council to participate, sending a message to the Community. Motion Carried 4:0:0 Property split Borgert and Buettner: The Council reviewed correspondence from 8hayLaw Office requesting a Certificate of Compliance to split 3.395 acres of the Buettner Property, parcel number 84- 53432-067. The split being requested will be part of the Final Plat presented by Leo Buettner which has been approved by the Planning Commission. Motion Carried 4:0:0 Insurance coverage for Elected Officials: Twit stated that in the past he was opposed to providing injury insurance to elected and appointed officials, but due to the growth of the City and a need for regional planning it may be reasonable to add the insurance. The Council discussed the rate proposed and what additional costs would be incurred if all Boards and Commissions were included. Weyrens will contact the insurance agent and report back at the next meeting. Ehlert made a motion to table the insurance coverage to the February 18, 1999 meeting; seconded by Niedenfuer. Ehlert clarified rhat the original motion of the City Council required all rental property with three 9r fewer units to participate in the City refuse contract. The objective of the motion was to assure that altlandlords provide refuse service. Twit was of the opinion that landlords not wishing to partici ~te in the, City refuse ¡system sho~ld appe~r be~ore the Council. The Council discussed waiving the reqU1rement If a landowner can provIde the CIty wIth an executed refuse contract for the length of the licensø period. . Further, if a rental unit is not part of the City contract they would not be eligible to . partici ate in the spring and fall cleanup. This matter will be referred to the February 18, 1999 meeting. The Sustainability Committee is also in the process of forming a Friendly Neighbor Program which would assist in developing neighborhood relationships. The existing railroad crossing should be labeled as a private crossing. I would like to see a tie to the crossing and a reference to the railroad milepost number. If this street is to be platted as a pUbÙc street, we should have a public crossing at the tracks, This may not be possible, given I the difficulty we had obtaining new public crossings for the future extension of4t~Avenue NE and the realignment of County Road 133. ! ¡ b. Do we want to fealign this street to the east so it can connect with 304th Street on the Batzer and Bauefly plats? Recently, Mayor Hiemenz, Chad Carlson, and I met with the APO and lookedl at the possibility of extending Elm Street east from the Business Park across the north~rn edge of this plat where it would continue east to a future collector , street shown on ~he current APO Transportation Plan; this could eliminate the need for a frontage road along the tracks (304th Street). ! Before final plat approval, it is necessary to reach an agreement with the developer as to how improvements shown in the Plat will be constructed (See Section 54.8). Typically, the City enters q developer's agreement which sets forth the party responsible for contracting for the installation of improvements, the method of payment fo~ improvements, security for payment, etc. . I would recommend that these issues be discussed during preliminary plat review so that. the appropriate· developer's agreement can be negotiated prior to final plat approval. - - 0.- . 7. Section 54.9 requires park dedication. For industrial property, the park dëdication is set at two percent. Obviously, the City would be requesting cash in lieu of park contno.ution. Prior to submittal. of the Final Plat, the developer should be asked to provide information regarding property value for review by the City, and the. appropriate amount for park contnöutions should be established. 8. The minimum width for lots in an industrial area is 100 feet. These lots meet the width requirement of the zoning ordinance. The minimum setback requirements for an industrial area are 40 feet for a front yard setback, 15 feet for side yard and 20 feet for rear yard. There are currently buildings located on the properties. I would confirm that the subdivision of the property as propose.d would not cause any of the buildings to violate the setback requirements, In particular, I would check on the setback for the building located in Lot 1 of Block 1 if the Plat . is approved as drawn. M.S. 176.011, subd. 9, (5), provides that "municipal officers elected or appointed for a regµlar term of office" are considered to be "employees" for workers compensation purposes only if the city has passed an ordinance or resolution to that effect. An elected or appointed official injured while performing his or her duties would not be eligible for workers compensation benefits unless the city had passed that ordinance or resolution. Whom does this affect? Thi$ provision clearly applies to mayors and council members. In some cities the clerk and treasurer are elected positions, and are therefor covered by this provision as well. It seems likely that members of other administrative boards that the city creates pursuant to . statute such as planning commissions, utilities commissions, park boards, hospital or nursing , ' home boards, etc. would fall under this provision as well. It's not clear though whether a member of a purely advisory committee or commission that the city creates would be considered to be an "officer" or "official" for purposes of this statute. Some charters may provide specific terms for certain appointed positions such as the assessor, engineer, police chief, etc. Under a strict reading of the work comp statute, these individuals would not be covered by workers compensation unless the city has passed an ordinance or resolution to add coverage - assuming that these individuals would be considered "officers" rather than merely "employees." If we want to add coverage, how should the ordinance or resolution be worded? The resolution or ordinance should specifically list the positions the city intends to cover. If the city wishes to extend coverage only to the mayor and council, the ordinance or resolution should refer specifically and only to elected officials. An ordinance to extend coverage to members of other boards and commissions, could be worded this way: "Pursuant to Minnesota Statutes 176.011, subd. 9, clause 6, elected officials and members of the following boards, commissions, and committees are included in . the coverage of the workers compensation act: planning commission, park board, utilities commission..." AN EQUAL OPPORTUNITY/AFFIRMATIVE ACTION EMPLOYER 4' ~ ;;J . \ I f any of the city's appointed positions such as police chief or assessor have a specific term, these . positions should be listed as well. It's not completely clear whether the city can distinguish among its elected and appointed officials, by providing workers compensation to some officials but not to others. The statute perhaps could be read to mean that the city's only options are either to cover all elected and appointed officials or none at all. If so, an ordinance or resolution extending coverage, regardless of how it is worded, might be interpreted to mean that all "officials" are covered. Then the question of whether, say, planning commission members are covered would depend not on whether they are listed in the ordinance or resolution but rather on whether they are "officials" or "officers;" Such an interpretation seems unlikely, but cities should at least be aware of the possibility. Is there any reason to use an ordinance rather than a resolution? If the city wishes to provide workers compensation coverage for elected officials, it is preferable to use an ordinance rather than a resolution, Resolutions are often recorded only in the council minutes; years later it can be very difficult and time-consuming to track down a resolution. We've seen a number of cases where a city has been paying premiums for workers compensation coverage for elected officials for years, but now can't find any ordinance or resolution specifying that elected officials are covered. An ordinance will generally be easier to keep track of . permanently, since it is recorded in the city's ordinance book as well as in the council minutes. Do we need to do anything special if we. don't want to cover elected officials for workers compensation? If the city does not wish to cover its elected officials for workers compensation, it might be wise to pass on ordinance to that effect as well unless you are absolutely certain that the city has never passed a resolution to provide coverage. That resolution could have been passed as long ago as 1967., when the law was first amended to permit cities to opt for coverage. The following language could be used for the ordinance: "The officers of the City of _ elected or appointed for a regular term of office shall not be included in the coverage of the Minnesota Workers Compensation Act, pursuant to Minnesota Statute 176.011, subdivision 9, clause 6." Obviously, there are many "borderline" situations where it might be debatable whether a council member is "conducting official coundl business on behalf and at the request of the council." For example, a mayor or council member might be asked individually to attend a meeting of the Chamber of Commerce or a service club to discuss and explain city policies or proposals the council is considering. Cities might want to consider adopting a resolution specifying whether the city considers such activities to be within the scope of duties that the city expects its elected officials to perform. Carlson stated the back ound of the developnient and issues raised as to the 30Sth Street easement as identified on the Preli~inary Plat Bettendo~f elaborated on the industrial park plans in relation to road construction in the area o¡fthe plat to includear~as east and west of the plat. Bettendorf expressed concerns for an east-west connection from the industzial park to the eastern boundary of the Township. Bettendorf suggested that the southern propez;y line of LOn ,BUq be brought south to the middle of the easement of30Sth Street as platted on Borgert Industrial Park Plat 4'. In addition,· if Borgert's develop their property to the west, it was sugges ed that 30Sth Street de~d-end and have a cul-de-sac constructed with a dedicated easement. Tom ! Chair Klein closed the hearing at 7.25 p.m. USWest Special Use Permit - Placement of Antenna: Chair Klein opened the hearing at 7:35 p.m.. and stated the purpose of the hearing is to consider a Special Use Permit to allow the placement of â wireless telt(communication antenna on the St. Joseph Water Tower. S1. Joseph Code of Ordinances 58.3. The Construction and maintenance of a commercial tower shall be permitted within the following zoning classifications, pursuant to a conditional use permit granted in accordance with the Zoning Ordinance. Subd. 4. General Business. Building mounted antennas, exempted dishes and antennas not attached to a tower. S1. Joseph Code of Ordinances 58.11 states the placement of a wireless telecommunication antennas on . roofs or walls of existing buildings or structures shall be approved by the City as a conditional use proved that the antennas meet the requirements ofthis Ordinance. The request is being submitted by US West Wireless LLC, 426 N.Fairview, S1. Paul MN 55104. Kenneth Nielsen presented background information on the proposed placement of antennas on the City Water Tower. The City Council approved a lease agreement with USWest to place the antennas on the City Water Tower. However, during negotiations the City Council decided that the Planning Commission should approve the placement with a Special Use Permitas required by the St. Joseph Code of Ordinances Nos. 58.3 and 58.11. The antennas will be placed 109 feet above the ground on the side of the water tower and a base station will be located on the ground. All necessary screening and landscaping will be completed as required by the City. Graeve questioned ifUSWest has exclusive rights to the City Water Tower. Nielsen stated that the lease agreement states that if any other proposed antenna would interfere with the transmission of the USWest antennas, the interference would need to be fixed or the antennas would be removed. Graeve disbursed copies of an article in Orion Afield- Autumn 1998 regarding health concerns associated with similar antennas. According to the article, communication antennas should not be placed with 1,500 feet of residents, nursing homes, schools and hospitals, Commissioners continued to discuss potential health risks and if the City should consider delaying the Special Use Permit until research can be conducted. Graeve suggested that Planning Commission and City.Council delay the approval of the Special Use Permit until.more research on health concerns can be conducted at the local level. . Nielsen stated that the FCC has conducted extensive studies in regard to health issues associated with communication antennas. .The FCC study concluded that there is no evidence thatthése antennas promote canc.er .or any other type of disease or illness. In fact, USWest has antennas located on the top of schools I ....: ~ ... 'I 1 and t~wers in communities Jllover the state. Nielsen further stated that Congress has determined that the FCC tudy on health issues rreempts all state or local efforts. . comlissioners brieflydiscJssed the terms of the lease agreement between the City and USWest. Carlson inforJed the Planning Commission that discussing the lease agreement at this time is inappropriate, ComJissioners are welcome to approach the City Council with any questions regarding the terms of the lease 19reement. I Niedrer expressed concern that if the City allows USWest to place these anteonas on the tower, reside ts living in the area ~ay be adversely impacted. Niedenfuer further stated that in her opinion, the City ¡s a responsibility to protect its residents from potential health risks.
