MN 56374 Re: Hinnenkamp Easement Our F'tlc No. 19655 Dear Canie: I have prþpared this letter to supplement my letter of August 18, 1999 regarding the request tø specify the easement across the City property serving the Hinnenkamp . property! After looking at the survey when we recently met, I have some question as to whether or not the area described as the easement will result in encroachment by City buildings. It appears as though the buUdings may fall within the area of the easement. Tbe City should not grant a specific easement then have the property owner require us to remove our buildings because of an encroachment. I have had ~n opportunity to review some documents sent to. me by attorney Paul Ampe seeking a c~arification, of an easement across the City property serving property currently owned by Selina Hinnenkamp. I I When the <City acquired the property, the party that then owned Hinnenkamp's property , reserved(ìrl access easement of 50 feet across the east edge of the City property. Ayear later, the l¿cation of the easement was shifted to "a location which will give proper access Frank J. Rajkowski .. to the tracts owned by 1 st parties lying N'ly of this tract." In other words, there was no specific legal description. Arguably, any portion of the City's property could be used for Gordon H. Hansmeler access so lbng as it does not unreasonably interfere with the City's use of the property. Before <loing so, I would fuggest that the survey be reviewed to make sure that the road, as described by this new agreeJent, will not interfer~ with any of the City's activities on the property. In other word, I think je should contino tha¡the roa<l, as <lescribed in this agreement, is basically where the current access road is located. Iftheitychooses to act 01 this matter at Thursday's Council's meeting, I woul<l suggest that approval to enter the agreement be conditioned upon verification of the location of the road by the Cit Engineer or memb¿rsofthemaintenance department if they were present when the road was su eyed. Hinnenkamp has entered into a Purchase Agreement to sell this tract to Mark La I bert. The City of St~ Joseph owns a tract of real estate which is burdened by a 50 foo access easement in [,avor of the tract owned by Mrs. Hinnenkamp. The title ins rance has raised an objection regarding the location of the easement which is not . pre ently defined. I havb drafted a proposed Agreement which will resolve this title pro lemandremove thd "blanket easement" from the City's property. This Agreement wil benefit boththe CitY and my client.
