I also have the correspondence from 1993 which previously addressed this concern. My opinions have not changed since 1993. My only concerns revolve around the potential for environmental contamination at the . property sites. In 1993, Joe Bettendorf and I suggested a Phase I environmental audit before accepting title to the property. A Phase I audit usually consists of a review of the title and use history of the property and a visual inspection of the site seeking evidence of contamination. It is still my opinion that some type of environmental inspection or audit be conducted to address this potential concern. Otherwise, I do not see any problem with accepting title to the property as that would Frank J. Rajkowski .. put the City in a position to regulate its use and maintenance as the City deems Gordon H. These two outlots lie between Elm Street and the railroad tracks. Rather than simply make a few inquires, I believe that the more formal process of conducting a Phase I Environmental Audit should be undertaken before assuming ownership of these . properties. This is becoming more and more common with land transfers due to the tremendous liability and potential clean-up costs that could occur should an environmental problem be detected on the property. While we have people on staff in our St. Paul office who are trained and certified to conduct these analyses, I believe it would be more economical for the City to . - use local resources in this particular case. Both Huntington (Twin City Testing Corporation) and Braun Intertec have people available in St. Cloud to conduct the analysis, and I recommend that a quotation be solicited from each firm. I expect the cost to be approximately $1,500. With environmental concerns becoming such a large issue, we may want to consider requiring a Phase I Environmental Audit on all developments to protect the City and future home owners against a potential environmental problem. If the Phase I study shows that there is potential for cor:t...'lmin3.ticn, then the follmv-up studies would need to be completed 2.S necessa..ry. The cost would be born by the developer as part of the platting process. I am sending a copy of this letter to John Scherer, and ask him to advise us on this matter. Box 668 Saint Joseph, MN 56374 Dear Rachel: In reviewing my file on Northland Plat 3, I found I had not responded to John Scherer's letter of September 16, 1994 regarding review of the final plat and Subdivision Agreement. I have . reviewed the plat, Developer's Agreement, and legal descriptions for the plat, park, and storm sewer outfall and find all these documents to be in agreement with my records. I do, however, have one concern. I have been under the impression that the land south of Northland Plat 3 still belongs to the Rothfork family. If this is the case, the legal description set forth in Exhibit D is across land that is not owned by Lumber One. I believe it would be prudent to have this ownership checked by John to be sure we have clear title to the easement as described. As a final note, you will recall that the Lumber One and/or Dale Salo attempted to "give" Outlot A in Northland Plat Two to the City. The City, upon my recommendation, insisted on a Phase One Environmental Audit before accepting the land. We should probably check on the status of this issue to be sure that thi!1gs have beer. ~ettled ene 'Hay or another. My concern is that this area could become a dumping ground, weed problem, or playground for dirt bikes etc. We should know who is responsible for the land. Also, please check your records to see if we were given a drainage easement across Outlot A--my copy of the preliminary plat for Northland Plat Two shows the easement, but my copy of the final plat does not. Gaylen Cabe from Miller Properties has asked on several occa- sions if we were interested in the purchase of this parcel. They feel that the $49,000 they are asking is very fair and I think it's a possibility, but along with their asking price comes the al- most $18,000.00 assessment fee. The lots which would become one, will also become light commercial at best, needing just 1 - 6" sewer and water stub-in which is some what the same situation as I'm currently involved in with Blk 1, Lot 9 right next door. The lot sizes are approx. the same and paying only $8,922.79. I would even be willing to split the difference at $13,384.00 rather than the $17, 845.00 you are asking. They are as follows: '11)' Niedenfuer Mike Deutz - Hookup Fees: As you are aware, Mike Deutz demolished the former Linneman House on the corner of Minnesota Street and 1st Avenue NW. Mike is applying for a building permit and disputes that he should have to pay additional hookup fees. I discussed this matter with both Joe Bettendorf and Ken Hiemenz. We all agree that Mike should get credit for the hookup that has already been paid. The question is whether or . not additional hookup fees are due. Based on the building permit, Mike should be charged a total of four hookup fees ($1,800 x 4 + $200). Allowing him the credit for the existing hookup he would owe the City for 3 additional hookups. Mike is claiming that the use has not changed and he is replacing what was existing. Therefore, he feels he does not owe any additional fees. In the past when a building has been demolished the hookup fees have been calculated on the new building. The proposed use of the new building is as follows: Upstairs: Rental with a maximum density of seven. Downstairs: Two separate Businesses. All three uses will be metered separately. Before the demolition, the house was used exclusively for student rental with one water meter. When the Building was originally assessed in 1986, the building was used for student rental upstairs and business on the lower level. The formula . needs to be revised to make provision for hotels and lodging houses. In addition, a provision needs to be included when land use changes, requiring additional services. This issue came ot light when Linnemann's Store was converted into a lodging house. Bettendorf stated that the revised proposal would charge a hookup fee based on the number of occupants. The following is the revised proposal: Single Family Residence One Unit Multiple Family Residence 1. The first four occupants One Unit 2. The next 15 occupants One unit per five occupants or fraction thereof 3. All occupants thereafter One unit per six occupants or fraction thereof Includes apartments, group homes, boarding houses, retirement complexes, dormitories, etc. The number of units is based on the number of potential occupants based upon a certificate of occupancy issued by the City. Commercial/Industrial One Unit for every 500 gallons . Per day or fraction thereof. An additional connection fee will be levied if the average annual flow increases more than 20 percent (but at least 500 gallons per day) over the initial flow. Additional flows in succeeding years are subject to additional connection fees. The fee amount will equal the established connection amount (less inspection charges) in effect on January 1 of the year that additional flow is generated. and shall be applied in accordance with the formula in effect on January 1 of the year that the additional flow is generated. JOSEPH CITY COUNCIL FROM: OFFICER JOEL BILL TOPIC~ 1998 ST. JOSEPH POLICE RESERVE PROGRAM THE ST. JOSEPH POLICE RESERVE PROGRAM~ AS YOU ARE ALL AWARE~ IS STRICTLY A VOLUNTEER ORGANIZATION. THERE ARE CURRENtLY FIVE ACTIVE MEMBERS IN THIS PROGRAM. DURING THIS PAST YEAR~ THE POLICE RESERVES HAVE CONTRIBUTED HUNDREDS OF HOURS TO OUR DEPARTMENT DURING CHAOTIC EVENTS. SOME OF THESE EVENTS WOULD INCLUDE THE 4TH OF JULY~ PINESTOCK AND DISORIENTATION TO NAME A FEW. THE DUTY OF THE POLICE RESERVES IS TO ESTABLISH OFFICER PRESENCE AND TO ASSIST THE POLICE DEPARTMENT AS NEEDED. . DURING MANY OF THE CITIES FESTIVALS~ THE POLICE DEPARTMENT WITH ITS THINLY STRETCHED MANPOWER IS UNABLE TO KEEP THE POLICE PRESENCE AS NEEDED TO HAVE A SAFE AND ENJOYABLE ATMOSPHERE. WITH THE ASSISTANCE OF THE RESERVES WE ARE ABLE TO HAVE ENOUGH UNIFORMS AROUND TO LET THE COMMUNITY KNOW WE ARE OUT THERE. WITHOUT THE HELP OF THIS PROGRAM OUR DEPARTMENT ALONE WOULD NOT BE ABLE TO MAKE THIS POSSIBLE. OVER THE ?AST YEAR~ OUR DEPARTMENT TOOK APPROXIMATELY 3,100 CALLS RANGING FROM ASSAULTS TO MOTORIST ASSISTS. DURING THIS PERIOD~ THE POLICE RESERVES WERE ABLE TO BE AN ACTIVE PART DURING THESE CALLS. FOR EXAMPLE~ AT BEST, DURING THE WEEKEND~ THERE ARE ONLY TWO FULL-TIME OFFICERS ON FROM 9~0Ø P.M TO 3~00 A.M IF NOBODY IS SICK, USED VACATION, COMP OR HOLIDAY TIME. WEEKENDS BRING HUNDREDS OF COLLEGE STUDENTS TO THE DOWNTOWN AREA WHICH ROAM THE STREETS MOST OF WHICH ARE UNDER THE INFLUENCE OF ALCOHOL. WHEN ALCOHOL IS ABUSED, UNPREDICTABLE EVENTS HAPPEN SUCH AS FIGHTING, CRIMINAL DAMAGE TO PROPERTY, THEFT AND THE LIST GOES ON. WHEN ONE FULL TIME OFFICER GETS OCCUPIED BY A CALL~ MAKES AN ARREST~ IS ENROUTE TO JAIL OR DETOX, OR FOR THIS MATTER, WHENEVER THERE IS ONLY ONE OFFICER AVAILABLE TO PATROL THE WHOLE COMMUNITY: THIS IS WHERE THE RESERVES ARE ALSO VERY BENEFICIAL. WHEN WE GET A CALL OF A FIGHT, NOISY PARTY~ OR OTHER DISTURBANCE~ HAVING THE PRESENCE OF ANOTHER OFFICER THERE REDUCES THE CHANCE OF . PEOPLE TRYING TO RETALIATE AGAINST THE OFFICER, VICTIM~ OR COMPLAINTANT, AND RISK THE CHANCE OF INJURY WHILE TRYING TO DEFUSE THE SITUATION. POLICE DEPARTMENT p.19 . BRADLEY J. WHILE THE FULL-TIME OFFICER CAN~T DISTANCE THEMSELVES TO FAR AWAY FROM THE SQUAD CAR, DO TO EMERGENCY SITUATIONS, A RESERVE OFFICER CAN WALK UP ONTO A LOT MORE ACTIVITY THAN WHAT WOULD BE SEEN IN THE SQUAD CAR. THIS HAS BEEN PROVEN TO BE VERY EFFECTIVE WITH PEOPLE DRINKING ON THE STREETS, PUBLIC URINATION, THEFT AND OTHER RELATED ACTIVITIES. WHILE SOME OF THE RESERVE EQUIPMENT IS NOT THE BEST DO TO INSUFFICIENT FUNDS, THEY NEVER COMPLAIN ABOUT IT. ALTHOUGH ONE THING WE ALL FLET WAS NEEDED WAS NEW RADIOS. KNOWING MONEY WOULD BE AN ISSUE THE RESERVES ASKED THE ST JOSEPH LIONS CLUB TO HELP DONATE MONEY FOR 2 NEW PORTABLE RADIO~S. KNOWING THAT RADIO COMMUNICATION IS CRITICAL IN SPLIT SECOND DECISION MAKING, THE LIONS CLUB DID IN FACT DONATE TO THE ST JOSEPH POLICE RESERVE PROGRAM 2 MOTOROLA . rORTABLE RADIOS WITH RADIO CHARGERS WORTH SEVERAL HUNDREDS OF DOLLARS TO HELP THE POLICE RESERVE PROGRAM. As you can see, it is the position of the bonding company that Thielen Construction has waived its claim against the bonding company by not asserting the claim in a timely manner. - I do not believe that Thielen Construction would have the basis to assert a direct - claim against the City of St. Joseph. Thielen Construction had no contractual relationship with the City of St. Joseph. Since the City of S1. Joseph has made payments to the general contractor, the City is not unjustly enriched. The law prohibits the filing of a mechanic's lien against a governmental entity. Therefore, it appears as though Thielen Construction may be limited to a claim directly against Mid-Minnesota Concrete & Excavating, and nothing more. Frank J. Rajkowski .. Gordon H. Stat. § 574.31, subd. 2(a), no action shall be maintained against a payment bond unless, within 120 days after the claimant's last delivery of labor and materials to the project, the claimant serves \VTiUen notice of its claim upon the surety and the contractor. However, Thielen Construction did not serve its notice of claim on the payment bond until October 14, 1998. Additionally, the notice of claim was only sent to TIG via United States mail instead of sent to both 1vfid- Minnesota Concrete & Excavating and TIG via personal service or certifIed mail as the statute requires. Further, the statute requires that any legal action to enforce a claim against the payment bond must be commenced within one year from the date of the claimant's last delivery of labor and materials to the project. See Minn. Stat. § 574.31, subd. 2( c). HO\vever, Thielen Construction did not aUempt to initiate its lawsuit until February 1, 1999. Accordingly, it is clear that this claim against the payment bond is time barred. Pursuant to the Minnesota General Rules of Practice 115.10, TIG requests that you immediately dismiss the bond claim in the above-referenced action. Pursuant to due call and notice thereof, the City Council for the City of St. Joseph met in regular session on Thursday, Apri11, 1999 at 7:00 p.m. in the St. Joseph City Hall. Motion Carried 4:0:0 Department Head Reports - Dick Taufen Water Tower Maintenance: Public Works Director Dick Taufen discussed with the Council the need to have routine maintenance completed on the water tower. Taufen stated in the past the City had contracted with Water Tower Paint and Repair of Clear Lake IA. The City Engineer has staff that can assist the City with the maintenance. The staff can complete the floatdown and determine if repairs are needed. Taufen - stated that the tower has some rust spots that need repair. The best time for routine maintenance is when - demand for water is low such as spring or early summer. If approved, Taufen will make the necessary arrangements with St. Ben's to supply water to the City during the repair and maintenance. Taufen also asked the Council if during the routine maintenance it is found that repairs are needed, will that require UNOFFICIAL MINUTES . further authorization from the City Council. The Council concurred that it would be cost prohibitive to wait for Council approval. Twit made a motion to authorize SEH to complete the float down and outside inspection to detennine what if any repairs are needed. This motion also approves making necessary repairs to the tower. Motion Carried 4:0:0 Well Cleaning: Taufen discussed the need to clean Well #5 which has been in operation for three years. (Wells are typically cleaned every three years.) Taufen stated it is his plan to rotate cleaning of all City wells with one being cleaned each year. Loso made a motion authorizing Taufen to make the necessary arrangements to have Well #5 cleaned. Motion Carried 4:0:0 Holding Pond Maintenance: Taufen presented a proposal :trom Nature's Acre to conduct management bums at the St. Joseph holding ponds. It is recommended the ponds be burned every three years. Taufen stated that he and his department are not familiar with prairie grass and maintenance and recommends the City Council contract with Nature's Acre using Maintenance Staff for additional labor. Assisting Nature's Acre would serve as training for the Maintenance Staff and in the future the controlled bums could be completed by the Maintenance Department. Twit made a motion accepting the recommendation of Taufen and contracting with Nature's Acre for Maintenance bums on the three existing prairies (holding ponds). The City Maintenance Staff will assist with the burning process. The motion was seconded by Loso. Ayes: Hiemenz, Loso, Twit, Ehlert. . Nays: None. Brimever Executive Search Committee: Jim Brimeyer presented the first draft of the position profile for the position of Clerk/Administrator. The Council spent considerable time reviewing and proof reading the proposed draft. Due to the numerous changes, Brimeyer will fax a revised copy to the City Council and requests and additional revisions be forwarded to his office no later than April 5, 1999. Brimeyer proposed the following timetable to the City Council: May 17, 1999 Deadline for applications June 10, 1999 Present list of candidates to the City Council June 29 & June 30 Interview and select candidate (Candidates will arrive the evening of June 29, 1999 with a small reception. June 30 the candidates will meet with the City staff in the morning and tour the City. Interview will begin sometime after 1:00 p.m.) July 1999 Start Date The proposed salary range based on the existing market for the Clerk/Administrator is $ 45,000 to $ 55,000. Twit questioned if the salary range could be adjusted to $45,000 to $ 50,000. Brimeyer will review the salary range. Old Business - - Council and Board Meeting Fee: The Council discussed an opinion letter :trom the City Attorney regarding increasing the meeting fee for the City Council. The City Attorney concurs with the League of Minnesota Cities whereby the meeting fees for the City Council cannot be increased until after a general UNOFFICIAL MINUTES . election. However, the Council may increase the meeting fees for subsidiary committees. Hiemenz stated that he is not comfortable increasing the meeting fee for subsidiary boards to the same level as the City Council. Ehlert stated that he does not feel his time is more valuable than that of a subsidiary board member and encourages the Council to increase the meeting fee for subsidiary boards $ 5.00 per meeting. Loso made a motion to increase the meeting fee for subsidiary boards to $ 20.00; seconded by Ehlert. Discussion: The Council clarified that Chairpersons of subsidiary boards will continue to be paid $ 20.00 per meeting. Councilor Ehlert stated he will discuss this matter with Chairpersons and report back to the Council. Ayes: Loso, Twit, Ehlert Nays: Hiemenz Motion Carried 3:1:0 Housing Study Update: Weyrens reported that EDA Director Chad Carlson discussed the Housing Study with Admark and the study should be available shortly. The Council requested Weyrens review the contract between the City and Admark to determine if a penalty clause was included in the contract. New Business Outlots. Northland Addition: Hiemenz reported that he received a request from Terry Schmid of Avon Lumber One for the City to assume ownership of Out10ts A & B in Northland. Since information was not available for the meeting, this matter is tabled to Apri115, 1999. Y2K Update: Hiemenz reported on the recent Y2K meeting held with the Department Heads. The planning stages are going well. The Police Department and Administration have completed the inventory . stage and will be working on testing equipment. A major issue that needs to be resolved is the water system. The company whom the City purchased the equipment from has since gone out of business. At this time the City Engineer and Public Works Director have requested authorization for the City to hire a professional to evaluate the water system. The cost of an evaluation can range between $ 5,000 and $ 10,000. Loso made a motion authorizing the expenditure up to $ 11,000 to analyze the water panels and system for Y2K readiness. Motion Carried 4:0:0 Hiemenz requested the Council restrict vacation of City employees between December 15 and January 1, 2000. Hiemenz requested the Emergency Services Director Bob Loso contact the company whom the City purchased the new siren from to check how long the siren can operate on battery power. Hiemenz also requested Loso to seek costs for adding public address capabilities to the new siren. Recreation Association Promissory Note: Weyrens presented the Council with a first draft of a promissory note between the City of St. Joseph and the St. Joseph Recreation Association. The City has agreed to underwrite the costs of the concession stand for Millstream Park. The Recreation Association has agreed to re-pay the City twice yearly from gambling proceeds for a term not to exceed three years. The draft promissory note affirms the conditions of underwriting. Since the Recreation Association has not reviewed the promissory note, Ehlert agreed to discuss the matter with them and report back to the City Council. - Mayor Reports - Meetings Attended: 0 Weed Inspector meeting UNOFFICIAL MINUTES . 0 Area Legislators meeting - Main topic of discussion was transportation, Sales Tax for Local Government and MNDOT Building. Miscellaneous Matters: 0 The St. Joe - Cold Spring Vet Clinic will be sponsoring a dog licensing day in conjunction with the City. 0 The developers of Pond View Ridge will be approaching the City with the final plat for Phase 6 D Residents along 90th and 91 st have been sent a construction update by the City Engineer. The Newsletter did not include the City Hookup fees so a second mailing will take place. D Forwarded a letter of support to the Central MN Initiative Fund for the Healthy Community Grant. D Construction on County Road 133 is scheduled to begin mid summer. Councilor Reports KEN TWIT Investment Committee: Twit stated he was contacted by Rich Knowlton of Smith Barney regarding the City investments and monies available for re-investment. The investment committee will be meeting soon to discuss the investment ladder and how funds can be invested to maximize return. Mailbox Sub Committee: Twit stated that he and Taufen will be meeting to review the placement of mailboxes within the City. . CORY EHLERT Central MN Events Center: The task force on the Central MN Events Center has been working on the design details of the facility. Ehlert reminded the Council of the upcoming Five City Council meeting. The meeting is scheduled for April 7, 1999 at 7:00 p.m. at the St. Cloud Civic Center. Healthy Communities Program: Ehlert reported on the behalf of Councilor Niedenfuer. He stated the Central MN Initiative Fund has requested the City appoint a second Council Member to the Committee and request their attendance to the two day training seminar. Niedenfuer has requested that Councilor Ehlert be part of the Healthy Community Program. April 13, 1999 Page -2- Mr. Duetz would be provided credit for any hookup charges previously paid with regard to that property. It is my understanding that there would be a credit for one unit. The fact that a hookup charge was paid previously does not allow subsequent uses of the property which significantly increases sewer and water use without additional compensation to the City. I also want to note that I concur with your conclusion that a hookup charge should be recalculated based upon the use of the new structure. I also wish to note that the policy setting hookup charges for multiple residential and commercial properties was adopted in 1993, about seven years after the charges were assessed to this property. The City has not required a reassessment of a commercial properties in response to the policy. Rather, the City has decided to review water and sewer use of individual properties only when the use changes or is significantly expanded, an event normally triggering a building permit. Ehlert stated the ordinance requirements for lot size were met in 1984 when this matter was originally considered and further stated the City Attorney advised the Planning Commission in their consideration and findings. He further stated although it is not typical to have a house on an alley, in some ways it could be beneficial to the resident. Loso stated that the ordinance prohibiting building on an alley has been enforced since its adoption. Mayor Hiemenz clarified one of the problems associated with structures fronting on alleys is that assessment formulas do not provide for fairly assessing such properties. Twit recommended referring the matter back to the Planning Commission for clarification on the ordinance reference in relation to this matter. Pfannenstein indicated her husband had requested this matter be addressed when it was brought to the Council previously. On the request of Mayor Hiemenz for a substitute motion, Twit made a motion to refer the matter back to the Planning Commission for consideration at their next meeting. A recommendation for clarification on a reference to the S1. Joseph Code of Ordinances 54.7 subd 4(e) requiring "frontage on a public dedicated street other than an alley" is requested with the lot only having alley frontage and recommendation of the treatment of future public improvement assessments to the property. Ehlert seconded the motion. Discussion -In order to expedite the matter the Council agreed to consider the Planning Commission's recommendations at the next Council meeting with Planning Commission's recommendations disbursed to the Council in a second agenda packet. SPECIAL USE PERMIT FOR R-3 IN A BUSINESS ZONE & PARKING PLAN: Michael Deutz appeared before the Council to request the Council accept the Planning Commission's recommendations for property located at 33 Minnesota Street West, to allow R-3 use in a Business Zone and consider the development parking plans. Deutz discussed his parking plans. The original plans needed to be changed due to the parking needs for the Sal's Bar business. His alternate parking plans are on the property adjacent to the alley west of Sal's Bar & Grill. Deutz discussed a meeting where he had discussed his plans with Chad Carlson, Cory Ehlert and Mary Niedenfuer as well as plans to enhance the appearance of the proposed building. Niedenfuer stated the Comprehensive Plan allows for preservation of historic sections of the City. She further offered to take photos of historic buildings and discussed methods to foster preservation of such structures, such as waiving certain fees. Deutz showed his elevation plans along with his building plans indicating he would use the same type of bricks as the Meat Market or Gary's Pizza buildings. Niedenfuer recommended he make an attempt to give the building an historic ambiance. Deutz further discussed parking indicating the owner of Papa Guseppi's has parking with the next door building in relation to her other business located in that building. Twit indicated that parking is the biggest issue with this proposal. Deutz requested to allow his attorney to work with the City Attorney to draw up an agreement to secure the needed additional four parking stalls to be located on Dale Schneider's rental property (next to Sal's Bar). The Planning Commission discussed in depth the number of parking stalls to be required for this proposal. After further discussion Loso made a motion to accept the Planning Commission's recommendations after holding a hearing, and approve a Special Use Permit to allow R-3 In a . Business Zone and approve the parking plans, contingent upon his securing four off site parking spaces with a fully executed document, approved by the City Attorney. Ehlert seconded the motion. "' .- -- -- Page 3353 July 16,1998 The Planning Commission's recommendations to approve the Special Use Permit as . requested, included the following contingencies: 1. Deutz will provide six (6) parking spaces on the same property where the proposed development will occur. The parking spaces portrayed in the street boulevard may not be one of the six required spaces. Further, Deutz will provide four (4) parking spaces within 300 feet of his property. Deutz will require the employees of lower level to use the off site parking. A long-term lease (10 years) will be signed by the property owner of the off site parking which will be reviewed and approved by the City Attorney. If the off site parking Is lost and not immediately replaced, the conditional use permit allowing residential rental is lost. 2. The following maximum densities apply for the rental unit: Student Rental: 7 occupants Family Rental: One family per unit as allowed by the housing code 3. Deutz will provide a refuse dumpster which shall be properly screened and located on the northeast section of his property. Discussion - Deutz's attorney may contact the City Attorney with a proposed draft of such document as necessary to secure adequate parking for the property. Niedenfuer felt the downtown area needs to look busy, and felt people will walk a short distance to businesses in the downtown area. Twit indicated sorne of the businesses would disagree. . Ehlert concurred there is a need to provide off street parking. Deutz also felt the area behind City Hall (where the old water tower was located) could be striped to provide more parking in the area. He stated he would like to negotiate with the City for use of such parking spaces. Ayes: Hiemenz, Loso, Ehlert, Niedenfuer, Twit. Nays: None. Motion carried. CITY ENGINEER REPORTS PROPOSED UTILITY EXPANSION - 91sT AVENUE AND WHISPERING PINES: City Engineer Joe Bettendorf discussed the results of a sUlvey sent to residents on 91st Avenue and Whispering Pines area. The sUlYey results show about 50% of the property owners were interested in being selYiced by water or sewer. Mayor Hiemenz stated 60% of the property owners in the area to be annexed, need to support annexation according to the Orderly Annexation Agreement. He further indicated a desire to maintain the City boundaries in straight lines to alleviate jurisdictional problems. If water and sewer lines are installed adjacent to properties that are not annexed, those properties will be required to pay up front the cost of the assessments as a utility extension charge in addition to hookup fees. Bettendorf stated the sewer main would be extended from the north on 91 st Avenue with the west side of 91 st Avenue already being selYed by sanitary sewer. Water main could be installed on either side of 91 st Avenue, with sewer main installation on the east side to selYice those properties. -- On 90th Avenue the utilities would have to be installed in the roadway, which would require road construction in the project. Ayes: Hiemenz, Loso, Ehlert, Niedenfuer, Twit. Nays: None. Motion carried. TREASURER'S REPORT: Weyrens presented and discussed the third quarter Treasurer's Report. She stated a construction and bond fund will need to be established for the 90th and 915t Utility Project. Ehlert questioned the amount the St. Joseph Recreational Association has donated toward the proposed concession building for Millstream Park~ Weyrens will verify the balances and report back. On Ehlert's asking about the Wobegon Trail Fund balance, Weyrens stated this was a funding strategy. Ehlert stated he would like to see funds available to have a welcome center constructed in St. Joseph when the trail in constructed through our city. Loso stated the other communities had fundraisers for such purposes. Niedenfuer recommended pursuing the trail construction through St. Joseph. Mayor Hiemenz stated the railroad is still in control of the railroad property in our area. Loso felt the deficit balance for the Klinefelter Park fund should be less than shown. Weyrens stated funds with negative fund balances incur interest expense, whiçh will increase the negative balance. Loso made a motion to accept the report; seconded by Ehlert. Ayes: Hiemenz, Loso, Ehlert, Niedenfuer, Twit. Nays: None. Motion carried. PUBLIC COMMENTS TO THE AGENDA: There were no public comments to the agenda. . WETLAND ORDINANCE PROPOSAL: Ellen Wahlstrom appeared before the Council to discuss a proposed Wetland Ordinance. She stated she is encouraging adoption by both St. Joseph City and Township. The Township has included the language in their Comprehensive Plan. She encouraged the City to proceed with the public hearing process in adoption of the ordinance. Ehlert stated this proposal could be included in public hearing the Planning Commission will be holding on ordinance changes after they are approved by the Council. Wahlstrom reported she would like the Comprehensive Plan to drive the Ordinance and requested the following language included in the Ordinance: "This Ordinance creates a process through which the City can comply with the Comprehensive Plan's pledge to support orderly growth and development while protecting environmentally sensitive resources within the City of Sf. Joseph. 11 Niedenfuer felt the preface would give more teeth to the ordinance, as Wahlstrom felt enforcement of the Ordinance may be difficult. Niedenfuer further stated that wetlands define our boundaries. Loso made a motion to forward the proposal to the City attorney for a redraft in ordinance format, to include the preface as Wahlstrom requested; Niedenfuer seconded. Discussion - Twit felt all the ordinances should have the same format. Carlson stated if a wetland actually exists the wording should be changed to "shall be referred to the Steams County Environmental Services" rather than "may be" since the City has no expertise in wetland areas. Ehlert clarified the stated that Stearns County does not wish to have all development site plans referred to them. There was further discussion on terminology including "dwelling" and "envelopes". - Ayes: Hiemenz, Loso, Ehlert, Niedenfuer, Twit. - Nays: None. Motion carried. J DEVELOPMENT PROPOSAL - 33 MINNESOTA STREET WEST: Mike Deutz appeared on h1å own behalf, to discuss his parking plans with the Council. He had br~ught the request for a . Page 3417 October 15, 1998 revised parking plan to the Planning Commission on October 5, 1998 with that Commission . providing a recommendation to the City Council. After discussion Ehlert made a motion to accept the Planning Commission's recommendations as follow; seconded by Loso. Discussion - * Discussed the items that must be required in the contract as outlined in Chad Carlson's letter of September 14, 1998 to Mr. Deutz. Ehlert stated there is as need to assist development in the downtown area. Deutz stated the type of businesses he will have in the building will have quite a bit of walk in business and will not require parking spaces. Mayor Hiemenz stated if we ignore parking requirements it may require the City to provide parking in the future as well as push the parking on to other businesses that have provided parking and negatively impact their businesses. Ehlert felt the City is not in a position to analyze the future success of a business based on parking. He further stated in the future the City potentially could provide parking on City property when the green office building is razed. Mayor Hiemenz stated in fairness to Deutz he understands Twit asked how he would delineate his parking stalls from the adjacent parking stalls. Deutz stated his parking must be paved and striped. He will also label the stalls for each tenant or apartment. Twit asked if Deutz sees future potential for parking problems with the owner of the adjacent parking lot. Deutz stated he does not see it being a problem per se, partly due to the parking habits of the business owners and potential business activities. Deutz stated he tried to discuss the parking issue with that property owner, but felt there was another person who should have been involved in the negotiation that was not there. Motion to accept the parking recommendation of the Planning Commission to allow the . development to proceed with six (6) parking spaces to be provided. Twit stated that this in no way is setting precedence for any future requirements, but based on a situation where Deutz has exhausted all other possibilities. Ehlert stated that the City may deal with future parking needs as well, and could potentially provide this business some future parking when the office building is razed. Mayor Hiemenz stated that at that time the City may address the parking in the area, as the location could benefit several businesses in the vicinity. Ayes: Hiemenz, Loso, Ehlert, Niedenfuer, Twit. Nays: None. Motion carried. MEETING FOR ORDINANCE CHANGES: Ehlert stated the Planning Commission is prepared to have the Council set a meeting to review the ordinance changes. The Council was in general agreement to set that meeting for November 11 with an altemate date of November 16 at 7:00 P.M. PROPOSED BOND SALE: Monte Eastvold, representative of Juran & Moody, discussed with the Council methods of bonding. The City is proposing to bond for financing the 1998 Street Improvement project and the 90th & 91 st Utility project together. Eastvold discussed the two methods of bonding, public sale and negotiated sale. It is cost effective to hold a negotiated sale, although for large issues it is recommended to hold a public sale. After discussion Loso made a motion to hold a negotiated sale on November 5th; seconded by Ehlert. Discussion- Eastvold discussed that a negotiated sale saves the financial advisory fee, and is timelier. The maximum amount a City may bond for by negotiated sale is $1.2 million per twelve months. He further stated the City has used Dorsey & Whitney as bond counsel in the past. Which bond counsel to use is the City's choice, although the Council did not request to change bond counsel.
