Council Meeting-
Special Order of Business - Chief Will will be presenting a certificate of appreciation to Paul Zastrow, a
resident who assisted Officers Dave Windels ,and Paul Schley in an arrest a few weeks ago.
Consent Agenda - The bid for City Hall is also in. The bids were opened on Tuesday, July 25th at 3:00
PM. We received six bids, with Gopher State being the lowest bidder with a base bid of $245,840. The list
of bids is enclosed for your review.
7:00 Delinquent Utility Bill Hearing - We are not expecting anyone to be present for this item.
7:05 Noise Violation - 316 Old Hwy 52 - Randy Matthew, Manager and Bob McMannes, owner. Mr.
- McMannes has not requested an evidentiary hearing. Chief Will will be present to discuss this item.
- Department Head Reports - Judy Weyrens will be presenting the Treasurer's Report. Chief Will will be
looking for some direction from the Council on the computer system issue. (Please bring your information
from last packet). There is a possibility that the grant for the administrative assistant position may still be
active. If we have any new information regarding this, it will be presented at this meeting.
Dick Taufen will be present to discuss the sign request for Dale. He will also be looking for direction from
the Council on a permit for Northern Pipeline for Seren to get cable to St. Bens. They will be running three
two inch tubes underground until 16th avenue, where they will take the line above ground and to the
existing poles until 7 Ave NE. At 7th they will run the lines under one block and then back above ground
again to 2nd Ave NW and into the college. In the past the Council has been reluctant to allow lines to be
placed above ground. Ordinance 36 addresses this item in that it states the City must be agree to the
location of the wires (see page in packet). Dick will be seeking some direction from the Council on this
Issue.
Noise Violation - Evidentiary Hearing - The parties have requested an evidentiary hearing. John Scherer
will be present for this item.
Ordinance 55 - The Rental Committee recommended a number of changes to Ordinance 55. The changes
are denoted in italics in the copy in your packet. Steve Hagman, the llew rental inspector would like a
decision made on the changes prior to conducting any of the inspections for the 2000-2001 year. John
Scherer will be present to discuss the ordinance changes as well. (Please bring your information from the
last packet.)
MiscelIaneous-
The Fire Board will be meeting on Wednesdày, August 2nd at 8:00 PM. we have our first budget meeting
on Wednesday, August 9th at 4:30 PM. The Union stewards and representatives will be meeting every
Friday morning in August from 10:00 - 12:00 AM until an agreement is reached or the groups reach an .
impasse.
There were a few other items that were postponed from the last meeting (BFI, Seren and the joint trenching
issue). These items will be on the agenda for August l7Ù1.
At the last meeting, the Council asked whether or not street lighting was addressed in the Northland
Developers Agreement. Street lighting was NOT addressed in the agreement. I have contacted NSP and
they will be conducting a street lighting assessment of the area.
At the last meeting, a question was raised as to the outcome of Dan Hemminger's pole barn in Pondview. I
have enclosed the agreement that was drafted by John Scherer and signed by the Mayor. Gene Lange is
doing the excavation work and Palmer Lakes is doing the relocation of the structure. Building inspector
Ron Euteneur will be paying for half of the cost of this error. The total cost of this project is approximately
$4,200. The City will be paying for half of this amount. This type of structure will not be permitted in the
future, due to the changes to the ordinance suggested by the Planning Commission and approved by the
City Council.

ADMINISTRATOR This letter has been prepared to provide you with notice and information
Cari Schmidt regarding a proposed suspension or revocation of the rental license for the
above referenced property. This action is being taken because of an alleged
COUNCILORS violation of Ordinance No. 102 of the St. Joseph Code of Ordinances. This
Bob Loso violation is alleged to have arisen out of an incident on July 16, 2000 (copy
- J. Ehlert enclosed) .
_.Twit The St. Joseph City Council will review these allegations and consider
Mary Niedenfuer appropriate action, including a suspension or revocation of your rental license,
for up to a period of twelve months. The meeting will be conducted on
Thursday, August 3, 2000 at 7:00 p.m. in the St. Joseph City Hall, 25 - 151
Avenue Northwest.
At that time you are entitled to a hearing to be conducted in accordance wi.th
Minnesota Statutes 14.57 to 14.70. This hearing will be for the purpose of
determining whether or not the alleged violation did in fact occur. At that
hearing, you have the right to cross examine witnesses and present evidence
on your behalf. The proceedings will be video recorded. Based upon the
evidence presented, the Council will then make a determination as to whether or
not the alleged violation did in fact occur.
If you wish to have an evidentiary hearing of this type, you must contact the City
Clerk/Administrator in writing at least seven days prior to the scheduled Council
meeting. If a request for hearing is not received by the City Clerk/Administrator
at least seven days before the hearing, you will then be considered to have
waived your right to have an evidentiary hearing and no evidentiary hearing will
be scheduled. A waiver of this right to hearing will be equivalent to an
admission of the basic allegation (s) alleged herein and reported by the
complaining party.
If you waive your right to hearing, or if an evidentiary hearing is conducted and
the Council determines that a violation did occur, then and in those events, the
Council will proceed immediately to consider a disposition, which may include

revocation or suspension of your rental license. Prior to the determination of disposition, you
or your designated representative may address the City Council and at the time of
disposition.
In the event of a revocation or suspension of your rental license, the premises must be
vacated of all renters, within thirty days of the Council action. Any rental occupancy
occurring after that time may result in criminal charges.
You have the right to be represented at the time of this meeting during either the evidentiary
hearing, if requested, or the dispositional hearing. If you wish to have legal representation,
you must hire your own attorney. If you have any questions regarding the law or your rights,
I suggest that you contact an attorney to discuss this matter.
Your failure to appear at this meeting will be considered an admission of the allegation and a
~ waiver of your right to address the Council before the determination of a disposition. If you
fail to appear, the Council will take whatever action which is deemed appropriate and you will
- be notified of this action at a later time.

COMPLAINANT: Sue Pitzen
OFFENSE: Noise Complaint
At approximately 0310 hours, Sunday, July 16,2000, I was dispatched to
Old Highway 52, St. Joseph, MN 56374, Steams County, for a complaint of
loud music. Steams dispatch said that the complainant, Sue Pitzen, said that
there was a truck in the back yard playing music loudly, and they have a
camp fire. She described the location as between 314 to 318 Old Hwy 52.
I was westbound on West Birch St. and turned onto Old Hwy 52. I had my
vehicle windows open, and when I was in front of the 8-plex I could here the
music clearly. I stopped in front of314 Old Hwy 52 and as I exited the
. squad I could hear that the music was very loud. I walked to the back of the
building and saw a black truck parked there with all the doors open. There
was a male at the driver door leaning in and he must have turned the volume
of the music up because it became louder than before. There were two other
people in the back yard sitting by the camp fire. I approached the male and
asked him to turn down the music. I told him there was a complaint about
the noise. I asked him for his I.D. and he said it was in the apartment. I
asked him ifhe lived here and he said he lived in 314. He said the other
people were in 316. I asked him what he meant and he said the party is in
316 but he lives in 314. I asked him to get his I.D. I then asked the female
sitting at the fire if she is a renter, and she said she is. I asked her if there are
any other renters here at this time and she said no. I told her of the noise
complaint, that it is a violation, and I would be notifying her landlord. I
asked her for her I.D. and she gave it to me. I asked her how many people
are at the party, and she said only ten people. She said that they would stay
in the residence.
Her Minnesota driver license identified her as Kelly Christine Knewtson, 03-
05-79. I issued her a citation for violating the St. Joseph noise ordinance
#102. A court date is set for 0830 hours, Tuesday, August 29,2000 at the
Steams County Courthouse.

. While I was at the squad car with Knewtson, the male finally came with his
I.D., n identified him as Nathan Eric Kirschner 11-02-78. I issued him a
citation for violating the noise ordinance also with the same court date.
They became quite argumentive when I issued them citations. They said I
could not do that, and said that they were broke college students and
couldn't afford the fines. I advised them again that I would be notifying
their landlord.
At approximately 0350 hours this date, I telephoned Randy Mathews at 656-
1845. An answering machine picked up and I lèft a message advising him of
the noise violation at his property.

Re: City Hall Bids
The City received six bids for the City Hall project. The bid form asked for a base bid price with four
alternates. The lowest base bidder with the alternates was Gopher State Contractors at $245,840. The
alternates total is $9,160, for a grand total of$255,000. They will complete the project in 100
calendar days.
The alternates are as follows:
G-l:Rern.ove the curb, platform/equipment under drive-up and cap the remaining hole
. G-2: Provide wood frame sidelight at doors 100 and 101
G-3: Ix 8 oak soffit and fInish to match existing
G-4: Plastic laminate and wood veneer council table
Staff Recommendation: A ward the bid for the City Hall project to the lowest bidder Gopher State
Contractors.

. Subd. 10. City Action on Default. If the company is in default in the performance of the
work authorized by the permit, the City may, after the above notice to the company and failure of
the company to cure the default, take such action as may be reasonably necessary to abate the
condition caused by the default. The company must reimburse the City for the City's reasonable
costs, including costs of collection and attorney fees incurred as a result of the company default.
The security posted under Section 2, Subdivision 5, will be applied by the City first toward
payment for such reimbursement.
Subd. 11. Use of Public Ground. Facilities must be located, constructed, installed,
maintained or relocated so as not to endanger or unnecessarily interfere with the usual and
customary traffic, travel, and use of public ground. The facilities are subject to additional
conditions of the permit as established by the director including but not limited to (i) the right of
inspection by the City at reasonable times and places; (ii) the obligation to relocate the facilities
pursuant to Section 3, Subdivisions 3 and 4; and (iii) compliance with all applicable regulations
imposed by the Minnesota Public Utilities Commission and other state and federal law, including
prompt compliance with the requirements of the Gopher State One Call program, Minnesota
Statutes Chapter 216D.
Subd. 12. Location. The facilities must be placed in a location agreed to by the City. The
company shall give the City forty-five (45) days advanced written notice of the company's
proposed location of facilities within the public ground. No later than forty-five (45) days after
. the City's receipt of the company's written notice, the City will notify the company in writing of
the City's acceptance or rejection of the proposed location. If the City rejects the company's
proposed location, the City shall propose alternative locations. The City does not waive or forfeit
its right to reject the location of facilities by failure to respond within the forty-five (45) days.
Subd. 13. Emergency Work. A company may open and disturb the surface of public
ground without a permit where an emergency exists requiring the immediate repair of its facilities.
In such event, the company must request a permit not later than the second working day
thereafter and comply with the applicable conditions of the permit. In no event, may the company
undertake such an activity which will result in the closing of a street or alley without prior
notification to the Chy.
Subd. 14. Street Improvements, Paving and Resurfacing. The City will give the company
written notice of plans for street improvements where permanent paving or resurfacing is
involved. The notice must contain (i) the nature and character of the improvements; (ii) the
streets upon which the improvements are to be made; (iii) the extent of the improvements, the
time when the City will start the work; and, (iv) if more than one street is involved, the sequence
in which the work is to proceed.
Subd. 15. Company Protection of Facilities. The company must take reasonable
measures to prevent the facilities from causing damage to persons or property. The company
must take reasonable measures to protect its facilities from damage that could be inflicted on the
facilities by persons, property, or the elements. The company must take specific protective
measures when the City performs work near the facilities.

1. Call to Order. Pursuant to due call and notice thereof, the City Council for the City of St.
Joseph met on Thursday, July 20, 2000 at 7:00 p.m. in the St. Joseph City Hall.
Members Present: Cory Ehlert, Ken Twit, Mary Niedenfuer, Bob Loso, Clerk-Administrator
Cari Schmidt and Deputy Clerk Judy Weyrens. Members absent: Mayor Kenneth Hiemenz.
Others Present :Police Chief Gary Will, Diane Schneider, Randy Matthews.
2. Approve Agenda -Acting Mayor Twit stated that due to a family emergency, Mayor Hiemenz
is absent from the meeting. In light of that, the agenda has been shortened. Items 4b,a, 9,
10, 11 and 13 have all been removed and will be rescheduled for a later meeting. There are
also two additions to the agenda: the re-approval of Ollie Lesnick as the City Assessor for the
year 2001, and the re-approval of a zero deductible for the City's workers compensation
coverage. Ehlert made a motion to approve the agenda, seconded by Niedenfuer. The
motion passed unanimously.
3. Approve Consent Agenda -
a. Approval of Ollie Lesnick as the City Assessor for the year 2001
b. Approval of zerQ deductible for the City's worker's compensation
coverage
Loso made a motion to approve the consent agenda, seconded by Niedenfuer. The motion
passed unanimously.
4. Department Head Reports - Chief Will reported that the Council directed the Police
. Department to propose violations/penalty sanctions for liquor license violations. Will
generated a graph with violations and recommendations for actions. Will stated that it is his
recommendation that they send it to the alcohol compliance committee for their review and
recommendations. Will stated that this committee will be made up of Dave Windels, the
compliance officer, Mark Zimmer, Mark Loso, Mary Niedenfuer, Cory Ehlert and
representatives from the colleges. Loso made a motion to send the administrative penalty
matrix to the alcohol compliance committee for review, seconded by Ehlert. The motion
passed unanimously.
5. Approve Minutes - Ehlert made a motion to table the minutes of July ffh until the next
meeting, seconded by Niedenfuer. The motion passed unanimously with Loso abstaining as
he was not present at the July ffh meeting.
6. Bills Payable and Overtime/Callouts - Loso made a motion to approve the bills payable.
Ehlert seconded the motion and it passed unanimously. Twit asked what the expenditure for
Gene Lange was for. Schmidt stated that it was to move the pole barn on Mr. Hemminger's
property. Ehlert asked whatever happened with that. He gets calls about it all the time.
Schmidt stated that the City issued a building permit to Mr. Hemminger in error and are now
paying for it to be moved to his rear yard. The City will be paying for half and the Building
Inspector will be paying for the other half. Ehlert asked when this was approved. Schmidt
stated that the Council approved it a few months ago.
Loso made a motion to approve the cal/outs, seconded by Ehlert. The motion passed
unanimously.
7. Public Comments on the Agenda - There were no public comments to the agenda.

8. Variance Request - EDA Director, Chad Carlson, submitted a report that explained that Paul
Sullivan, owner of Paul Mar, Inc., presented a proposal to establish a Chester Fired Chicken
. restaurant franchise to replace the existing Stardust Video business next to Taco Johns.
Taco Johns is also owned by Mr. Sullivan. The current businesses of Stardust Video and
Taco Johns have enough parking spaces as required by Ordinance. However, Mr. Sullivan
states in his cover letter that the site plan is short three parking spaces necessary for the
Taco Johns and the new Chester Fried Chicken business. Mr. Sullivan presented his
variance for three parking spaces to the Planning Commission on July 10th. After a
considerable amount of discussion centering around the traffic congestion that currently
exists at the site, the Planning Commission felt that the restaurant would increase the traffic
on the site and adversely impact the parking offered by adjacent businesses. In addition, the
Planning Commission felt that the owner was creating the hardship by considering a business
that would increase traffic levels and the need for additional parking spaces. Therefore, the
Planning Commission is recommending denial of the variance request. After the public
hearing had concluded, the Planning Commission suggested that Mr. Sullivan acquire the
necessary space for the three parking spots needed for the business. The Planning
Commission felt that the business would be a good addition to the community of St. Joseph.
Loso stated that he thinks that the parking situation would have worked and would like to see
this business in St. Joseph. Ehlert stated that the Planning Commission was in favor of the
business, but felt that the parking situation was a problem. They felt that the businesses
would complement one another very well. Loso stated that since Mr. Sullivan was not
present to argue his case, he would move to accept the Planning Commissions
recommendation to deny the variance of the three parking stalls at this time. Niedenfuer
seconded the motion and it passed unanimously. Ehlert stated that Mr. Sullivan is working
with Chad Carlson to try and figure out some other options to make it work.
9. Mayor and Council Reports - Hiemenz was absent from the meeting. Ehlert asked about
. the progress on the slow children signs on Dale. Schmidt stated that Public Works Director
Dick Taufen will be looking at them. He is, however, on vacation thi~ week. Twit had no
report. Loso asked that NSP do a street lighting study of Norhtland to determine the lighting
needs in the area. Ehlert stated that he thought this was addressed in the developers
agreement. Loso stated that it wasn't covered in this agreement. Schmidt stated that she
would look into it and if the development agreement did not address street lighting, that she
would have NSP conduct a study. Niedenfuer reported that the Healthy Community Partners
will be having two meetings in August, one for a fun activity and one for work. They are also
coordinating a city-wide survey in conjunction with a town meeting sometime in the fall. Loso
reported that he and Schmidt met with the Union and the City stewards today. The two sides
agreed to meet every Friday morning from 10:00 am - 12:00 am starting August 4th until they
either settle the contract or reach an impasse. Ehlert asked about the outside negotiator.
Schmidt stated that she was requested by aCouncil member to contact an outside negotiator
that might be willing to help the City with the negotiations. Schmidt stated that she contacted
Cy Smythe, from Labor Relations Associates. He would charge the City his basic
subscription rate of $80 per hour. Loso suggested that the City try to do it on their own first,
before hiring someone from the outside to do it.
Twit asked Chief Will if he had heard anything about the Administrative Assistant grant for the
Police Departmènt. Will stated that they have 30 days to respond and it looks like they will be
using their full 30 days to decide. He will update the Council as soon as he hears something.
Niedenfuer asked that the Council bring the items that weren't discussed to the next meeting
so that they don't have to be recopied for the next packet. The Council agreed.
10. Clerk/ Administrator Report - Schmidt reported on a few upcoming meetings.
11. Adjourn - Loso made a motion to adjourn at 7:45, seconded by Ehlert. The motion passed

PRELIMINARY PARAGRAPH:
0 On 06/25/00 at approximately 0310 hours Officer Jean Gustin and I were dispatched to a loud
noise complaint at 121 E Ash St and found the residence in violation of city ordinance.
OFFICER OBSERV A TION/ ACTION:
0 Dispatch advised us that they did get the name of the complainant, however they wished to
remain anonymous.
0 After being dispatched to the call, Officer Gustin responded to the north side (back) of the
residence and as I came in on 3rd Ave NE trom Minnesota Ave.
0 As I turned on to 3 rd Ave NE trom Minnesota I heard someone yell trom the area we we,re
. responding to.
0 As I was pulling up to the residence I noted that there were still lights on inside the house.
0 This allowed me to see several people inside the residence.

OFFICER OBSERV A TIONI ACTION: .
a I noticed that some of the individuals inside the residence were holding plastic beer cups
filled with a brown/tan liquid.
a I also noticed several people on the eastside of the residence standing on the steps.
a These individuals were also holding plastic beer cups.
a As I was standing on Ash St in front of the residence I could hear the people standing on the
east steps talking very loudly and yelling at times.
a I estimate the total number of people present at the residence to be from 15-20.
a As I then walked through the front yard the front door of the residence opened.
a When the door was open, I could hear a loud music coming from living room area.
a I then walked to the eastside of the residence and met with Officer Gustin who had walked
from the back.
a Officer Gustin told me that she could also hear the loud voices well off the property.
a I then asked the group standing on the steps to get someone who rents the house.
a Two males came forward and stated they were staying at the house.
a I identified the two by drivers license as Christopher Cyril Ducharme OS/22/78 and
Anthony David Zimney 06/19/78.
a I infonned the two that they were in violation of the city's noise ordinance and that they
would have to clear the party out.
a As Officer Gustin and I were talking to Duchanne and Zimney, I noticed that most of the
people present at the party went into the house and shut off the lights.
a After speaking with Zimney and Duchanne it was unclear to me if they actually currently
lived at the residence because they advised me that they were on the lease but not currently
living at the house. .
a I then told them to get any other people out of the house that currently lived there.
a Two more males claimed to be living at the house but not on the lease.
a They were Andrew Paul Lien 08/28/78 and Michael Anthony Jennings 06/19/75.
a I also advised them that the house was found in violation of the noise ordinance.
a I did also identify Kevin Michael Sullivan 06/07/78 who was standing with the others.
a We then cleared the area.
a I attempted to notify both the owner of the house as well as the manager of the house.
a I left messages advising of the violation with both parties and finally did contact Tim
Borresch.
a Upon asking him for a current list of tenants he stated that they did not have one.
a I have not received a current list as of the time of this report.
a Several days later I did speak with the complainant regarding this violation.
a She stated that she called the complaint in because the individuals were both talking loudly
and she could hear their stereo inside her residence.
a She also noted that it was 3 :00 a.m. and she had kids trying to sleep.

NOISE VIOLATION HEARING -121 ASH STREET EAST: Mayor Hiemenz called the
hearing to order at 7:14 p.m. William Tallman. property owner, had not requested an evidentiary hearing
and represented himself. He told the Council of his expectations of his renters and to make them aware of
the concerns of the neighbors. Two of the renters were in attendance and stated they were not aware of
the volume of noise emanating from their residence.
Mayor Hiemenz asked the renters to address the statement from the police report "Don't open the door,
they can't do anything." The renters in attendance stated the person that said that was not in attendance.
. Loso stated there is a history of complaints on this rental unit Tallman responded that he believed there
were two violations in the 94-95 year with the last violation being May 1995.

Niedenfuer questioned if the renters were aware of the noise ordinance, to which they responded they
were.
Tallman questioned the orange notification sign placed on the door discussing a second violation may
result in license suspension or revocation. He was told the policy has been changed since the signs were
printed although the signs get noticed as is the intent. Currently a first violation may result in a fine or
license suspension or revocation.
Ehlert discussed the lack of maintenance on the property, resulting in the City mowing the lawn. He
stated that awareness of the need for property maintenance was raised during prior years. Studen~ renters
have been encouraged to be good responsible neighbors by helping their neighbors.
Twit questioned the Police Officers if the fact that the door was not answered when theY first knocked was
a concern. officer Meyer stated it was a concern, but no tickets were issued He stated the noise was not
extremely bad
Ehlert made a motion to consider this violation a warning with an acknowledgment to the renters that any
similar incident within one year will be dealt with more severely. Further, the property owner shall be
required to reimburse tlie City for the adminimative, police and legal costsincurred due to the complaint.
The motion was seconded by Loso.
Ayes: Hiemenz, Loso,Ehlert.. Niedenfuer, Twit.

Mayor Hiemenz closed the hearing at 7:32 p.m.

CONSIDERATION OF WEST-METRO ENVIRONMENTAL IMPACT STATEMENT (EIS)
COST SHARING PROPOSALS: - - - ~ - L '-- - _?
Mr. Hansen reported the West Metro Corridor Steering
Committee, made up of the seven effected jurisdictions (the cities
of st. Cloud, st. Joseph, sartell and Waite Park, the Townships of
LeSauk and st. Joseph, and the County of Stearns), is recommending
three possible formulas for funding the EIS. They are asking the
Executive Board to make a recommendation to the APO Policy Board on
which formula should be used. It is anticipated that the EIS could
take two to three years to complete and once completed could be one
of the Metro Area projects that special federal earmarked funding
could be pursued for.
I Mr. Ellenbecker indicated that he has difficulty in supporting
any of the proposed formulas, as the primary benefactor of this
corridor isn't paying a significant enough portion.
Discussion fo~rowed on how the needs for this corridôr study
is not only for the origination of these trips, (the City of
Sartell) but also where the trips destinations are (the cities of
st. Cloud and waite Park) . Other issues discussed included the
current congestion across the 8th street North Bridge, and how at
one time a corridor was included within st. Cloud Township's
Transportation Plan but has since been lost to development.
Mr. D. Mareck stated that as a member of the Steering
Committee many formulas were reviewed and none were found to be
magic, the three presented were considered the best of those
available.
Several Board members indicated that they were not comfortable
making a recommendation on funding formulas that did not involve
their individual jurisdiction.
Mr. Hansen asked if the Board would prefer directing this item
directly to the effected jurisdictions without an APO Policy Board
recommendation.
Some discussion took place on the possibility of Stearns
County paying for the entire EIS, as the corridor will more than
likely be a County Road. Mr. Haws stated he did not believe the
County would be willing tò make such a commitment.
Ms. Schaefer moved, Mr. Grandy seconded, to direct all three
possible funding formulas directly to the affected jurisdictions
with no recommendation from the APO Policy Board. Motion carried
unanimously.
Mayor Miller suggested that a meeting of the affected
jurisdictions be held one hour prior to the regular APO Policy
Board meeting on July 27th.

market. It was indicated that the Housing and Redevelopment
Authority (HRA) has a market study conducted each year and makes
range adjustments according to the current market. Mr. Hansen
stated that with only six positions and with the uniqueness of
these positions, that type of study may not be beneficial.

CONSIDERATION OF THE 2001 BUDGET AMENDMENT:

Mr. Hansen stated the 2001 budget amendment incorporates the ';
staff re-structuring presented this evening and a continuation to ~
reserve some of the federal funds in case Mankato is designated a .:
Metropolitan Planning Organization (MFO) with the 2000 Census.
Ms. Schaefer moved, Mr. Weisbr ich seconded, to recommend to
the APO Policy Board approval of the amended budget.
Mr. D. Mareck questioned the reduced Office Supplies budget
line item and did the Computer line item include another laptop
computer for use by the Secretary. It was explained that the 2000
Office Supply line item included some furniture purchases that were
made in 1999. That is why this line item remained the same. Mr.
Hansen indicated, 1999, that with the staff re-structuring, a
request for additional computer equipment and some training will be
corning to the Board for their consideration. )
The motion to recommend approval of the budget carried \)

Study Background
Over the past year, the West Metro Corridor Scoping Study has evaluated road and bridge improvement
alternatives to address forecasted congestion within the West St. Cloud Metropolitan Area, specifically focusing
on the 8th Street bridge corridor. Four alternatives were selected from this Scoping Study as feasible options for
addressing road and bridge improvement needs in this area. The next step in the process is to secure the
necessary funds for an EIS to evaluate in detail the social, economic, environmental and transportation aspects
of each alternative. This analysis will ultimately help local officials in selecting a preferred alternative that will
be constructed in phases over a period of years.
EIS Cost Estimate and Funding Options
The cost to complete the West Metro EIS has been estimated at approximately $300,000. Staff have been
unable to identify a State funêling source for this Study. There are, however, two potêntial federal sources
available; these sources include High Priority Project funds and Surface Transportation Program (STP) funds.
Either of these federal sources would provide eighty-percent (or $240,000) of the Study cost, leaving twenty-
percent (or $60,000) to divide among local jurisdictions. If neither of these federal sources can be secured in a
timely fashion, consideration will have to be given to dividing the entire $300,000 Study cost among local
jurisdictions. '.
EIS Cost-Sharing Formulas
Over the past two months, the West Metro Corridor Steering Committee has discussed formula options for
distributing the $60,000 or $300,000 local cost for the EIS. Based on these discussions, the Committee
recommended to the APO Executive Board on July 13th that one of the following formulas be used. Specific
costs per jurisdiction for each formula are attached to this memorandum.
Formula 1: assumes a one-third (1/3) weight on equal participation, a one-third (1/3) weight on existing
community characteristics, and a one-third (1/3) weight on community growth characteristics.
Formula 2: assumes a fifty (50%) default to Steams County, and pro-rates the remaining cost to other local
jurisdictions based on Formula 1.
Formula 3: assumes a fifty (50%) default to Steams County, and pro-rates the remaining cost to other local
jurisdictions based on a one-fourth (1/4) weight on total trip generation (1995-2025), a one-fourth (1/4) weight
on total population (1995-2025), a one-fourth (1/4) weight on existing market value, and a one-fourth (1/4)
weight on existing tax capacity.
APO Executive Board Action
After discussing the formulas, the Executive Board reached a consensus decision that only elected officials
representing jurisdictions involved in the West Metro Corridor Study should be involved in selecting a local .
cost-share formula for the EIS. Accordingly, a meeting of APO elected officials representing jurisdictions in
the West Metro Corridor Study has been scheduled in an attempt to resolve the EIS funding issue.

Over the past several months' two questions have been raised relative to APO
operating procedures. The Executive Board has discussed these questions and is
proposing By-Law amendments to address them.
. The first relates to Policy Board acceptance of Executive Board minutes without
access to materials the Executive Board discussed. Of primary concern, was the
acceptance of APO monthly expenditures without a listing of the bills. Since the By-
Laws expressly provide the Executive Board with authority to receive and disburse
monies within the approved budget as well as numerous other duties, it is
recommended that acceptance of Executive Board minutes by the General Membership
be deleted from the By-Laws. Listed below is the recommended amendment to Article
V. Executive Board, Section 5. Minutes:
The Secretary of the APO shall record a roll of members, minutes of
proceedings, a record of votes, and shall keep a permanent file for
such purposes. Minutes of the Executive Board shall be approved, as
a separate order of business, by a majority vote of the Executive Board
members present, at the next regular meeting of the APO.
Subsequent acceptance of these minutes, but the General
Membership shall constitute approval of the Executive Board.
The second question related to APO regular meeting attendance requirements.
While review of the attendance records revealed only one violation of current
attendance requirements, it was apparent that several members were missing a large
percentage of duly called regular meetings. Accordingly, the Executive Board is
. recommending a 50 percent attendance requirement. Listed below is the
recommended amendment to Article II. Membership and Dues, Section 5. Attendance:
A Voluntary Association That is Committed to Coordinated Long-Range Planning
Through Constant, Cooperative, Intergovernmental Commun!cation
Appointed representatives shall be required to attend at least fifty .
percent of all reqular meetinqs duly called by the APO durinq their term
of appointment. Attendance records will be kept and annually reported
to member units. Should a representative fail to attend at least fifty
percent of all Reqular Meetinqs or if # a representative misses three
consecutive meetings without prior notification, that representative will
be considered to have resigned, subject to re-appointment. Prior to
final action on this implied resignation, the APO Executive Director will
notify the principal elected official of the affected member unit, in
writing, and request a written statement concerning the status of this
representative. One month will be allowed for the written reply. The
APO's Executive Board will have final authority in this matter.
The By-Laws of the APO may be amended only upon a sixty-six percent (66%)
vote of the total representatives present at a duly called meeting noticed for such

Dear Mr. Skudlarek:
In response to your question regarding my comments at the drainage meeting for Pond View Ridge
Fifth Addition last May, I have tried to reconstruct the conversation with my staff Engineer, Amy
Schaffer, who was also there.
As we recall, the residents had asked how this could happen (improperly grading the lots so that
. water would pond in the back yards). Amy stated that the building pads had been checked after the
developer graded the overall site, and were found to be in compliance. We did not check the lot
lines at that time, and can only assume they were properly constructed since the other grading in the
area checked out. I stated to the group that the builder or his landscape subcontractor usually does
the final lot grading after the house has been constructed. It simply depends on what the homeowner
contracted for when he or she hired the builder.
After much discussion, there was no clear-cut way to determine who was at fault, and the consensus
was that the homeowners and builder should simply split the cost and get the work done as soon as
possible. When we left the site, my understanding was that an agreement to this effect had been
reached and the builder would proceed to have the work done.

Dear Mayor Hiemenz:
The Minnesota Legislature and Governor Ventura have approved the most significant increase in state transportation
funding in more than a decade. The Invest2000 Coalition would like to thank you and your city council for your interest
in this issue throughout the 2000 legislative session.
We ofter special thanks and congratulations to those· cities that approved resolutions urging the Legislature and the
governor to support increased transportation funding this year. Through your expressed support, the Legislature and the
governor clearly received the message that transportation funding is a high priority for local governments and the citizens
they represent.
The 2000 transportation funding bill contains several significant short-term funding measures:
Expenditures (est.)
. * $177 million for inter-regional trunk highway corridors in Greater Minnesota;
* $177 million for metro-area trunk highway and interstate bottlenecks;
* $100 million for other trunk highway priorities as established by MnfDOT;
* $39 million for local bridge replacement and rehabilitation;
* $23.8 million for the County State Aid system;
* $6.2 million for the Municipal State Aid system;
* $26 million for mass transit projects; (Another $44 million in transit funding was included in the state bonding bill.)
* $26 million for trunk highway facilities;
* $5 million for the Rail Service Improvement Program;
* $2 million for the Port Development Assistance Program;
* $15 million for the Transportation Revolving Loan Fund;

* $404 million in one-Lime appropriation from the state General Fund;
* $100 million in state trunk highway bonds;
* $91 million from the state trunk highway fund.
Funding Crisis Persists
Despite its benefits, the 2000 transportation funding bill is merely a short-term measure that does not address the long-
term transportation funding crisis facing Minnesota. It is estimated that Minnesota has more than $8 BILLION in unmet
transportation funding needs over the next 10 years. In signing the 2000 funding bill, Governor V entura wro~
( "w"ile I have signed the bill into law, I am tremendously disappointed in ils content. The Legislature
~ has missed a major opportunity to enact a long-term financing package that would provide permanent ~
/ \ funding increases for highway and transit infrastructure that is critical to Minnesota's future sustainable ,
. ~onomic development....At best, this will accelerate a few already-planned highway projects, and it
largely ignores needed new investment in transit. JI

Another problematic issue emerging from the 2000 session is the manner in which the state reduced motor
vehicle license fees, which are constitutionally dedicated to the state's Highway User Tax Distribution Fund
(HUTDF). To replace revenues lost to the HUTDF as a result of the license fee reduction, the Legislature
approved a statutory dedication of a portion of motor vehicle excise tax revenues -- a general fund revenue -- to
the HUTDF. Of great concern to Invest2000 and local units of government is the precedent of replacing
constitutionally-dedicated funds with less reliable and less predictable statutory funds.
As Minnesota's transportation community looks forward to the 2000 elections and the 2001 legislative session,
we must work hard to encourage the Legislature and Governor Ventura to continue to make transportation
funding a top priority. Legislative candidates throughout the state should be asked to support, at a minimum,
the following transportation funding initiatives:

As we discussed earlier this week, I have determined there is an error in my original handouts for
the County 121 Project in St. Joseph. The typical assessment for each of your 8-unit apartments is
projected to be $42,000, rather than $52,000 as originally shown. A revised copy of the handout is
enclosed for your records.
. As I stated earlier, each of your 8-unit apartment buildings is projected to be assessed as four
equivalent residential units based on a formula adopted by the city. Though the city council has not
formally determined the basis of assessment for this project, I will be recommending that the unit
basis be used. Typically, these assessments are spread over 15 years at approximately 7 percent; the
duration and interest rate are estimates which will be determined by the council at the assessment
hearing.

street. This incident did not come before the Council as it wasn't derived from a noise
complaint. I thought it was important for the Council to see this letter as it shows some
direct action by a landlord regarding the noise issues.

In regards to your security deposit for 29 East Minnesota Street, St. Joseph, MN, we have
elected to exercise our option under the Rental Addendum #1 and #2 as a second violation
of a party and noise violation that you will forfeit your entire security deposit. As it states
in the contract, all renters are responsible. .
As it states in the police report there was an opportunity to avoid this situation, Mr.
Thielman decided to ignore that opportunity. Each party pled guilty and paid a fine. We
have the responsibility to the City of St. Joseph to insure that the students we rent to will
be responsible adults and that we will enforce our rental contract. As for those that didn't
get cited, we are sure you were at the house and could have helped prevent this situation.
We are sorry that this had to end in this manner as we thought we had an understanding
after the first situation.

Introductions were made. The group welcomed the following new members: Kathy
Parsons and Bonnie Vornbreck from Resurrection Lutheran Church, St. Joseph. Arthur
Corrections to the minutes of the June 5, 2000 meeting. Jim Graeve did not attend
the meeting.

Reports
Sister Miriam reported on the survey meeting. . Ernie, Donna, S. Miriam & Tom
I Wicks from Kid Stop (for Glenn Deutz) met Monday, June 26 at the meeting grounds.
They reviewed surveys and decided on one, which S. Miriam distributed. This was a
first draft, which was discussed and approved. It was decided that it would go out with
the St. Joseph Newsleader to save postage. There would be drop off spots for those
people who do not wish to mail it back. The target date for the survey to be out will be
2 weeks prior to the town meeting (late Sept.lOct.)
A copy of the first draft will be sent out to all those members who did not attend
this meeting. We are to bring this copy with comments back.to the next meeting.
Jim Meyer reported on the Grand Opening Event of the Farmer's Market. There
were 600 buyers in attendance, 12 growers, many dignitaries such as Rose Arnold,
County Commissioner, and a variety of media --KSFM, local cable commission, the
Newsleader and their sister newspaper in Alexander. Members of the faith community
provided a blessing for the market. There were representatives from St. Ben's,
Catholic and Lutheran churches of St. Joseph and Avon. A raving success!1!

- The USDA has waived the one year waiting period for using WIC coupons at
the market. The only remaining problem seems to be that all the produce is sold by
5:00 p.m. They now will have a new full time market manager, Wynette Feia.
S. Miriam complemented Jim's spearheading of the project and the other board .
members for their superb efforts.
Cari Schmidt reported that one of the glitches, for achieving non-profit status for
this group, is that our name is the same as another, afready approved, group. We
need to change or adapt our name in some way.
Arthur Mehrhoff, St. Cloud State University and a member of the design team,
commented on the creativity of the committee's survey. He talked about a generic
survey which could be used in any community. He explained that these survey's were
used to gather data and measure success of the indicators or bench marks, we would
determine, Some web sites, from communities which have set such indicators, will be
given to the secretary. This process of setting bench marks could occur after our town
meeting. Ellen Wahlstrom commented that the town meeting would coalesce goals,
and that would be a wise step, before setting bench marks.
Mary Niedenfuer asked to be replaced as secretary. Donna J, Malum
volunteered to do the job for one year. A motion was made by Jim Graeve that Donna
Malum be accepted as the secretary for the group. Doris Deml seconded. Motion
passed,
Ellen Wahlstrom announced that there would be a fun meeting for. the group at .
Sammy's Pizza, St. Cloud, August 14. 2000 5:30 p. m. The survey will be discussed,
so bring your copy. An agenda will follow for the regular meeting of this group will be
AU9ust 28. 20005:30 p.m at the Fire Hall Everyone should bring a copy of the survey
for changes and to approve.

am, I do not know the intent of the Planning Commission and City Council when adopting this
provision. I do not know ifit was presumed that doors and windows would not be included in
computing the exterior finW1 requirement. As the ordinance is drafted, I believe that they would
have to be included, even if that was not the intent of those who drafted and approved tlús
proviaion.
It is my recommertdation that the building pennit be Í88Ued for the building as currently proposed.
I do DOt believe that it is worth the City's time and expense to fight tlús battle. I believe that the
City would most likely lose on this issue.
I believe that the better course would be to amend the applicable section by inscning the language
excluding exterior doors and windows when computing the 50% coverage requirement. Please
let me know if you have any other questions regarding this issue.

Lonnie talked to Mike from City Maintenance to arrange the location and
installation of the volleyball court in Northland.
Cory was going to look into the signs;.. we'll hear from him another time.
Park rules need to be posted in all parks. This could be a priority item for next
year's budget.
Marge sent "thank yous" to Channel 3 and AmCon for the work and donations
to Klinefelter Park.
- New Business: Park features for the cable commission need to be submitted to Bruce.

Resurfacing the parking area by the new concession stand is a bigger project
than we had realized. lighting needs to be looked at, and the entire project
needs to be assessed for costs and feasibility. .
: Marge spoke to Bob, who doesn't seem to need anything for the soccer field.
We tabled this discussion, however, until the next meeting, when we hope that
he can attend.
Other: Summer recreation is going well. The participants seem to be learning and·
having fun. The workers seem enthusiastic, and the kids are busy. Attendance
is strong.
Marge will bring copies of the budget for our next meeting.

. OVERVIEW
SO far in 2000, the overall crime rate in the City of St. Joseph is down by 2% and our
overall calls for services are also down by 8% when compared to the same period of time
in 1999.
There have been some areas that have seen significant statistical changes between this
year and last year. It should be noted though that these changes are actually small
numbers, but because of the change appear to be better or worse than they actually are.
Major crime, Sexual assaults, assaults, burglary and theft are down with the exception of
reported sex crimes. This is not because there are more sex crimes occurring but in
reality victims are reporting these crimes now.
Some examples of other crime categories and their changes are:
Underage consumption cases are up 40% from 145 to 204.
Noise complaint cases are up 58% from 31 to 49.
Dog cases are up 53% from 13 to 20.
In the area of traffic, citations are up 30% from last year. Traffic crashes are also up by
21 %. Specific areas are:
. Stop sign violations are up 1,333% from 3 in 1999 to 40 so far in 2000.
Speeding violations are up 285% from 118 to 337.
Underage consuming and operating is down 360% from 18 to 5 cases.
Stop ann violations are down 600% from 12 to only 2 so far this year.
This is only basic data for the time frames being compared. Because of the problems
with our records system, not everything has been fully analyzed for any changes or
patterns. Our system does not track data by sections of the community. It should also be
noted that arrests do not always equal crimes as more than one person can be charged
with one crime and one person can be charged with several crimes.
CRIME
Crime happens every day of the week and at all hours of the day or night. For the first .'--.-
six months of 2000 only, here is the break down of when crime occurred:
