Joseph met in regular session on Thursday, December 5, 2002 at 7:00 PM in the S1. Joseph City Hall. Members Present: Mayor Larry Hosch. Councilors Bob Loso, Cory Ehlert, Kyle Schneider, AI Rassier. Administrator Judy Weyrens. City Representatives Present: City Engineers Joe, Bettendorf and Shannon Smith. Others Present: Dave Then, Ross Rieke, Dale Wick, Approve Aqenda: Loso made a motion to approve the agenda as presented; seconded by Rassier and passed unanimously. Approve Consent Aqenda: Rassier made a motion to approve the Consent Agenda as follows: a. Bills Payable - Approved check numbers 32125 - 32170 b. Minutes - Approved Nov. 7 and Nov. 21, 2002 c. Declaration of Surplus Property - Declared the portable JVC camera and accessories as surplus, advertising for sealed bids with a minimum bid of $2;500 as requested by the Cable Commission. d. Assessment Abatement Agreement - Authorize the Mayor and Administrator to execute the Assessment Abatement Agreement between the City of Sf. Joseph and Róhert Gamades. e. Application for Payment No.2 - Authorize the Mayor to execute Pay Application NO.2 for · the SE Utility Improvement and authorize payment to Kuechle Underground in the amount of $232,349.26. f. Discussion: Loso questioned if a retainage is being withheld from the pay application for the East Baker Street Lift Station due to the recent sewer claim. Weyrens reported that the insurance companies are processing the claim and a retainage is not needed at this time. The motion was seconded by Schneider and passed unanimously. Public Comments to the Aqenda - No one wished to speak Fire Chief Report. Six-Month Activity: Fire Chief Dave Theisen appeared before the Council to present the six month activity report for the S1. Joseph Volunteer Fire Department. Theisen presented the following information: Fire Calls June 1, 2002 - November 30, 2002 City Calls 63 67 · S1. Joseph Township Calls 60 42 S1. Fire Calls December 1, 2001 - November 30, 2002 Medical Calls 213 183 Fire Calls 70 67 Weather Warnings 1 0 284 250 Hosch stated that while reviewing the six month activity report he noticed that while the emergency calls have decreased the amount for training increased. Hosch questioned why training has increased. Theisen stated that the Fire Department has recently added four (4) new firefighters requiring additional first responder and fire training. The total training hours for 2001 was approximately 785 hours while in 2002 it increased to 1101 hours. Loso made a motion to accept the six month fire report, authorizing the expenditure of $ 17,510 for the payroll for June 1 2002 through November 30, 2002. The motion was seconded by Schneider and passed unanimously. Dave Then, St. Cloud APO - Transportation Study: Dave Then of the St. Cloud Area Planning Organization appeared before the Council to present a traffic study for the intersection of Minnesota Street and College Avenue. Then stated that the APO was requested to complete a traffic study for the intersection stated above based on the projected housing developments of Graceview Estates (394 units) and Arkon Development (950 units). Then stated it was his understanding that the Council was concerned if the intersection in question would be capable of handing traffic in the future. Then presented the following information: . Y' The projected traffic from the new housing developments when completed is anticipated to generate 15, 000 vehicle trips per day. Y' Of the 15, 000 vehicle trips, 19% of the traffic is anticipated to use the in!ersection of College Avenue and Minnesota Street, with the remainin~ 81 % using the southerly access to St. Cloud or the easterly access that will eventually connect to 88 Avenue (Field Street). Y' When completing the study the Highway Capacity Software was used to determine traffic at peak hours. Intersections are graded from A to D and based on the current and proposed housing, the intersection was rated a C. The rating indicates that the current intersection should continue to move traffic effectively and Then does not recommend changes to traffic control at this time. Y' The traffic study did not include analysis of other intersections and streets in St. Joseph. City Engineer Reports 2002 Street Improvement. Chanqe Order NO.4: City Engineer Joe Bettendorf presented the Council with Change Order NO.4 for the 2002 Interior Street Improvement. The change order adds select granular borrow and subgrade excavation due to poor material found under Ash Street West. The change order will increase the contract by $ 3,384.00. When questioned the status of the contingency fund for the projects, Bettendorf responded that he will prepare a statement showing all the change orders and status of the contracts. Bettendorf stated the contingency is sufficient to absorb the additional cost as stated above. Rassier made a motion authorizing the Mayor to execute Change Order No.4 for the 2002 Street Improvement, increasing the contract with R.L. Larson by $ 3,384.00 as recommended by the City Engineer. The motion was seconded by Loso and passed unanimously. NPDES II MS4 General Permit: Bettendorf stated that the City of St. Joseph is one of about 150 cities in . Minnesota that is being required by the Minnesota Pollution Control Agency (MPCA) to comply with the proposed National Pollutant Discharge Elimination System Phase II (NPDES II) general permit requirement. The permit addresses storm water management in a five year pland called a Storm Water Pollution Prevention Program (SWPPP). The permit deadline is March 10, 2003. Bettendorf turned the floor over to SEH Engineer Shannon Smith who will assist the City of St. Joseph with the permitting process if approved by the City Council. December 5, 2002 Draft . Page 3 of..5 Smith stated that the City of St. Joseph is being required to complete the permit application for Storm Water Pollution as are all the major cities in the area. St. Joseph has been tied into S1. Cloud as part of , the Urban Area, which brings St. Joseph into the mandatory compliance by March 10, 2003. Implementation of NPDES included the following two phases: Phase I: Became effective in 1992 with populations exceeding 100,000 people. Phase II: Any Municipally over a population of 10,000 people or part of an Urban Area, such as St. Joseph, must comply within the stated deadline. The regulations also affects townships, counties, universities, MN DOT, hospitals, and prisons. Smith stated that when completing the application permit the following is required: 1. NPDES II will have a General Permit Application that includes several components. Each affected City must develop a Storm Water Pollution Prevention Program (SWPPP). The SWPPP will be a working document that will be designed and managed to allow St. Joseph to reduce the discharge of pollutants from the storm sewer system, protect water quality, and identify and manage Best Management Practices (BMPs) that will support the program. 2. The SWPPP is a 5-year plan for the work that each affected City must implement over the 5 year general permit lifetime. St. Joseph will not have to have any of the BMP and education components of the plan implement by March of 2003, but the SWPPP must be written and submitted. . 3. The SWPPP must cover all six Minimum Control Measures. For each Control Measure St. Joseph must identify and implement BMPs' that promote the Control Measure. Goals, timelines, and responsible departments must also be identified. The six Minimum Control Measures area as follows: Public Education and Outreach; Public Participation and Involvement; Illicit Discharge Detectioñ and Elimination; Construction Site Storm Water Runoff Control; Post Construction Storm Wc~ter Management in New Developments and Redevelopments; Pollution Prevention and Good Housekeeping for municipal operations. Smith presented the Council with a proposal to assist the City of St. Joseph with the unfunded State Mandate. The proposal indicated an expense of $ 16,950 of which $ 5,000 is optional software for tracking the requirements. Smith stated that she is not familiar with the software that is recommended and the tracking requires using a data base program. The Council was in general agreement to postpone purchasing the software until it is determined that it is effective and necessary. Loso made a motion to accept the proposal of SEH in the amount of $ 11,950 for the implementation of the required NPDES II Permit. The motion was seconded by Rassier and passed unanimously. Other Matters: Loso questioned Bettendorf on the status of the parking lots from the previous meeting. Bettendorf replied stating he has nothing at this time. Loso requested this matter be finalized at the December 17, 2002 Council meeting. Rick Poplinski, Madison Park: Rick Poplinski of Viking Development appeared before the Council to request annexation of approximately 34 acres of property abutting and south of Lynx Road. The property was previously owned by K & L Properties. Poplinski stated that he will be approaching the Planning Commission with a Preliminary Plat to develop the property with mixed density including single family and multiple family dwelling units. Weyrens stated that St. Joseph Township has considered the matter and . unanimously approved detaching the property as requested. Loso made a motion to accept Resolution 2002-_ approving the annexation of the following described property: The motion was seconded by Ehlert and passed unanimously. December Sf 2002 Draft Page 40fé5 Public Financing - Poplinski questioned if the Council would consider issuing municipal bonds for the · utility and street improvements. He stated that he was presented with the requirements of the City for consideration and is also aware that all bond payments must be guaranteed. Weyrens clarified the public financing would consist of a five (5) year bond that is secured by the developer both personally and by their business. If the bond payment cannot be met by the assessments, the developer is required to pay the shortfall. Mayor Hosch stated that it is his understanding that the City would be utilizing the bonding leverage of the City and this bond would not create any financial obligations on part of the City. By consensus, the Council authorized Poplinski to move forward with the application for public financing. Deferred Development Fee - Weyrens stated that when the SE Utility Project was financed, the assessment for the property being discussed at this time was deferred. The agreement required that when the property was sold or annexed the assessment would become due and payable. Poplinski is requesting that the deferred change be carried over time. The Council was in agreement that the agreement was established at the time the improvements were installed and it is important for the Council to be consistent in decision making. Therefore, the Council denied the request of Poplinski to defer the utility charges. Mayor Reports Affordable Housinq Committee: Hosch reported the Affordable Housing Committee will be interviewing service providers for the administration of the GAP financing. Interviews will be conducted on December 6, 2002 and the successful provider will be awarded the contract on December 12, 2002. Ehlert stated that a sub committee of the Affordable Housing Task Force has been meeting to discuss the market values of the homes. As of this time they have not reached consensus. EDA Announcements: LME Trucking (Lakeville Motor Express Trucking) will not be locating in the · Business Center as they have purchased a site with an existing building that meets their needs. However, it is his understanding that a second company is interested in purchasing the lot LME had an option on. Council Reports SCHNEIDER Park Board: Schneider reported that Park Board has funds remaining and they will be presenting the Council with a list of projects to expend the allocated funds. Ehlert clarified that the Park Board Funds are capital funds that are allowed to roll forward into the current year. Therefore there is not a need to spend the funds in December. Schneider would like the City to send out a thank you card to Bill Wasner who has donated his trailer for the storing of all the skateboard equipment through the winter. The Council was in general agreement. EHLERT SE Utility Improvement: Ehlert questioned if the Township has been approached regarding a possible contribution for the repairs to Lynx Road as the road was in dire need of repair at the time of annexation. Weyrens stated that she and Hosch attended a recent St. Joseph Township meeting and requested participation for the repairs to Lynx Road. The Board acknowledged that Lynx Road was in need of repair and they will consider a contribution in Spring of 2003. Each year in March the Board reviews all the Streets in the Township. During this review they will consider Lynx road. RASSIER Planninq Commission Matters: Rassier reported the Public Hearing for the Comprehensive Plan is · scheduled for December 10,2002 at 7:00 PM. Weyrens reminded the Council that the public hearing is a joint hearing of the City Council and Planning Commission. December 5, 2002 Draft . Page 5 of a 5 Rassier stated that he is in receipt of the letter from the Police Chief requesting the Council to reconsider the site plan approval of the Army requiring landscaping around the building. The letter indicates that planting trees will impede security of the site. Rassier stated that after reviewing the site plan he does not believe the trees will be an issue. LOSO Amendment to Ordinance 71 - Bistro: Loso stated that he has discussed the proposed amendment to Ordinance 71 with some of the residents and is requesting the Council allow Bistro's to operate between May 1 and November 1, not September 1 and increase the time frame from 9:00 PM to 11 :00 PM. Loso stated that October and November have the potential of warm weather, therefore creating an atmosphere for outside food and alcohol. Loso made a motion to amend Ordinance 71 to allow alcohol to be consumed outside in conjunction with food from May 1 to November 1 and to extend the time to 11 :00 PM. The motion was seconded by Ehlert. Discussion: Ehlert stated that he would agree to extend the time period but would like the opinion of the Police Chief before implementing changes to the amendment. Hosch stated that he also supports the motion, but has concerns with extending the time frame to 11:00 PM. Ehlert recommended the Council consider allowing outside alcohol consumption unti/1 0:00 PM, being consistent with Park rules. The Council was in general agreement that this matter should be reviewed with the Police Chief before amendment. . Ehlert made a motion to table amendment to Ordinance 71 to December 17, 2002 so that the Police Chief can review the recommendations of Loso. If the Chief is acceptable to the amendment the matter should be placed on the consent agenda for the December 17, 2002 meeting for approval. The motion was seconded by Hosch and passed unanimously. (Note: A motion to table takes precedence therefore the original motion of Loso is not acted upon.) Administrator Reports Public Information Meetinq: Weyrens reported that Bettendorf is requesting the Council consider conducing an open house to discuss the proposed street alignment of Field Street and Callaway Street. The City will be competing for federal funds for the transportation study and conducting an information meeting before submitting the application would be a benefit in the application process. The Council agreed to schedule a public information/open house for January 8, 2003 to discuss the transportation links on the SE side of the City. Area City Meetinq with Developers: Weyrens reported that the area City Administrators conducted a meeting with representatives of the CMBA to discuss items of mutual concern. A large part of the discussion focused on development issues such as drainage and erosion. The agenda for the meeting was divided into two parts: 1) City concerns; 2) CMBA concerns. The Committee will be meeting again on January 9,2003 to continue discussion of items of concern. Adjourn: Loso made a motion to adjourn at 9:10 PM; seconded by Ehlert and passed unanimously. . JOSEPH COMPREHENSIVE PLAN, A COMPILATION OF POLICY STATEMENTS, GOALS, STANDARDS AND MAPS FOR GUIDING THE PHYSICAL, SOCIAL AND ECONOMIC DEVELOPMENT OF THE MUNICIPALITY AND ITS ENVIRONS. WHEREAS, Pursuant to Minnesota Statute 462.355, Subd. 2; The St. Joseph Planning Commission may, recommend to the City Council the adoption and amendment from time to time of a comprehensive municipal plan. WHEREAS, The City Council of the City of St. Joseph with its Planning Agency, the St. Joseph Planning Commission, authorized the updating of its Comprehensive Plan in 2002; and, WHEREAS, The proposed Comprehensive Plan is based on local and regional historical facts, trends, and governmental planning standards; and, WHEREAS, The proposed City of St. Joseph Comprehensive Plan is a dynamic planning tool intended to guide the future growth and development of the city; and, WHEREAS, The attached document (Exhibit A) presents the Comprehensive Plan for St. Joseph, Minnesota; reflective of a community planning process conducted in the year 2002 and involving elected officials, appointed officials, city staff, community organizations, the public at large"St. Joseph Township representatives, Stearns County representatives and others; and, . WHEREAS, Before adopting the comprehensive municipal plan or any section or amendment of the plan, the planning agency shall hold at least one public hearing thereon; and, WHEREAS, A notice of the time, place and purpose of a hearing on the proposed Comprehensive Plan was published once in the official newspaper of the municipality at least ten days before the day of the hearing with a copy of the notice posted for public viewing; and, WHEREAS, A copy of the proposed Comprehensive Plan is on display at the City Offices for public review; and, WHEREAS, A joint public hearing by the St. Joseph Planning Commission and the St. Joseph City Council was held in the manner described in the public notice; and, WHEREAS, The proposed comprehensive plan may hot be acted upon by the City Council until it has received the recommendation of the Planning Commission; and, - WHEREAS, The Planning Commission has adopted a Resolution recommending to the City Council the approval of the Comprehensive Plan; and, NOW THEREFORE BE IT RESOLVED the City Council of the City of St. Joseph, Minnesota hereby repeals the 1997 Comprehensive Plan and replaces it with the 2002 Comprehensive Plan. . Attached are the revised Chpt 4 and Chpt 12 (Land Use and Implementation Chapters) . In chapter 4 pages 29, 32 and 36 have items highlighted with the text strikethrough. In chapter 12 page 3 has #5 highlighted and illustrated with a strikethrough. Chapter 4 changes include earlier references to allowing limited industry/assembly in the new commercial district and the references to the new district for large lots. Chapter 12 simply removes #5 referencing the creation of a new district for large lots. Since the city's subdivision and zoning ordinances 80 not include maximum lot sizes and the city may issue variances for hardships (cases where utilities could not be extended, etc.) the city should · be able to annex in and allow larger lots with private systems if the annexation criteria is met, without the creation of new zoning standards. Other predominant features in this district include the South Fork of the Watab River and large areas of wetlands east of CSAH 3 and north of the railroad/Wobegon Trail corridor near the river. Soil studies indicate soil types may pose moderate to severe limitations to development. Recommendations 1. Recommended future land uses within District Twelve include: a. Single-family residential development within areas contiguous to existing urban locations. b. Park/open space. c. Tiered higher intensity uses such as commercial (new commercial zoning district) and high density residential adjacent to CSAH 2 and the roadway connecting CSAH 2 & CSAH 3. Subd. 6: Temporary Outside Liquor Permit. a) Notwithstanding the provisions of Section 11, Subd.'s 2, 3 and 4 herein, a licensee shall be allowed to sell intoxicating liquor and may allow persons to possess and consume said intoxicating liquor outside of the building of an "on-sale" business, pursuant to a special permit from the City. Each permit issued by the City shall be applicable for a single designated period not to exceed 48 hours. The permit shall designate whether it is an "event permit" or a "seasonal permit." An event permit shall be applicable for a single designated period not to exceed 48 hours. A seasonal permit shall be valid ftom May 1 through November 1, or a designated portion thereof. Application for permit must be made to the City Clerk at least thirty days prior to the date for which the permit is to apply. Application · shall be on a form prescribed by the City Council. Application shall be made in the name of licensee, and the licensee assumes full responsibility for any violation of the terms of the permit, this Ordinance or other law resulting frQm acts or conduct occuning on the licensed premises at the time the permit is in effect. Application for a permit shall be accompanied by a permit fee established and amended ftom time to time by Council resolution. The fee is non-refundable. b) Upon receipt, the Clerk shall forward the application to the Chief of Police for review, comment and recommendation. Upon completion of police review, the application shall be considered by the Council at a public meeting. Prior to meeting, the applicant shall notify the owners of property adjacent to the location of the proposed outside liquor of the pending application. c) At the meeting, the Council may either deny or grant the permit and establish reasonable conditions and regulations controlling the permitted activities. When considering a permit request, the Council shall consider the following factors: 1) Protection of the peace and repose of the residents of the City. 2) The safety of City residents and their property. 3) The reasonable concerns of City residents within the vicinity of the proposed activity. · 4) The nature of the activity proposed and the manner in which the licensee intends on controlling the activity. 5) The general land use of the surrounding neighborhood. e 6) Past experience with events of a similar nature and events held by the applicant. 7) Recommendations of the Police Department relative to public safety, law enforcement and the creation of disturbance. 8) Whether the event is one of general community interest or is in the nature of a civic event. d) In granting a permit for temporary outside liquor, the Council shall establish reasonable conditions to protect public health, safety, repose and property. The conditions established by the Council may include, but are not limited to, the following: 1) Limitation of the time of outside activities. 2) Limitation of the specific activities permitted. 3) Require measures to limit or regulate noise. 4) Limit the number of participants. 5) Require the licensee to provide special security. 6) Make special provisions for additional parking. . 7) Dictate cleanup of area. e) In addition to those stated in the permit, all temporary outside liquor event permits shall be subject to the following terms and conditions: 1) Outside liquor shall only be allowed in an area adjacent to the licensed premises. 2) Ingress and egress to and rrom the area in which liquor is served, consumed or possessed must be effectively controlled by a fence, tent wall, building or other structure. 3) The licensee, his/her agents or employees shall supervise the activities or persons within the outside liquor area for the purpose of enforcing the state and local liquor laws, and controlling ingress and egress to the area. 4) No live or recorded music may be played within the outside liquor area after 9:30 p.m., unless the source of the music and all speakers or amplifiers are enclosed within a tent having walls and a roof. 5) The permitted outside liquor area shall not cause an obstruction of a public street, alley or sidewalk, unless specifically permitted by the Council. 6) The licensee shall repair any damage to public property directly resulting from the . activities, including damage to pavement caused by tent stakes and supports. . f) In addition to those stated in the permit, all seasonal permits shall be subject to the following terms and conditions: 1) Notwithstanding Subd. 5, outside liquor shall only be allowed in a sidewalk area directly in front of and adjacent to the licensed premises. 2) Persons may be served and may consume liquor only while seated at tables in the sidewalk area. 3) . He said that he would let us know if anything changes but at this time, he said the governor has not backed away from he earlier statements about "letting the legislature solve its budget problem." He said that they have not heard anything from the Pawlenty transition team about their desire to have the Ventura administration cut or delay the December aid payments. We have also talked to a key staff member at the Department of Revenue and he indicated that there is a rumor floating around that the Pawlenty transition team may ask Ventura to withhold a portion of the December aid payment. We have not confirmed any such rumor and in fact, that may be the same rumor that was circulating before the budget forecast was released. We will be talking to the Commissioner of Finance-designate, Dan McElroy, this afternoon (Thursday) and we will send along any additional information we receive at that time. · In any event, the budget crisis is very real and we'll have to watch closely to see if anything develops over the next couple of weeks. Without a doubt, next year's aid payments will be under the gun as the legislature struggles to balance the state's budget. - We will update you as additional information becomes available. Grading and Drainage Problem: Site grading is being changed from the original grading plan approved in the platting process. Drainage improvements are made for one or more building sites that create drainage problems, (usually ponding on private property) for other building sites in the same or adjacent subdivision. Proposed Solution: Require construction plans to include a site plan with elevations that are compatible with the grading plan approved as part of the platting process. . Furthermore, at the time building permit is issued, require the builder to sign a memo acknowledging the approved grading plan and the site plan with elevations. 2. Erosion Control Problem: Soil is eroding òff the construction site causing environmental degradation, dirty streets, and clogging of storm drains Proposed Solution: Follow erosion control practices as required by the MPCA. If practices are not followed, the city will request the MPCA to assist the builder. 3. Premature Occupancy of Residents Problem: . Occupancy of building before all necessary approvals and/or before infrastructure is in place may expose occupants to unsafe and/or unhealthy conditions. Proposed Solution: Not allow occupancy before a Certificate of Occupancy has been issued. If Occupancy does occur before a certificate is issued, the City will shut off the water to the property. 4. Emergency Vehicle Access to Construction Sites and Properties with Private Drives. Problem: Fire safety codes applicable during construction are not being uniformly followed. Propeliies are difficult to locate because of a lack of addressing or signing. Proposed Solutions: Subdivision agreements will include language requiring the developer to provide and maintain temporary street and address signs during . construction. The city will install permanent signs at the time the first paving lift is placed. Problem: During construction, some temporary streets do not accommodate . emergency vehicle (fire truck) access. Proposed Solution: Construct a temporary street capable of suppoliing a fire truck and other large vehicles needed for construction. Problem: Addressing of homes on private streets is causing confusion and making it difficult for emergency vehicle operators and the general public to find properties. Proposed Solutions: In subdivisions with private drives, the subdivision agreement will require the developer/builder to place permanent address range signs adjacent to the public road serving the property. 5. Sixty Day Rule: Posting of Inspection record card and approved plans Problem: If the city staff is forced to issue building pelmits in a 60 day time frame, all construction plan components, i.e. site, mechanical, electrical, plumbing, fire protection system, etc, could not be review and approved in the time allotted. Proposed Solution: Submit all plans together and in enough sets to allow simultaneously review by the multiple agencies responsible for revie\'\'ing the plans. City staff will meet weekly to coordinate, review and move plans through the system. 6. Limiting Cul-de-sacs in New Residential Subdivisions Problem: Cities experience an extraordinary high cost to remove snow and ice from cul-de-sac streets. The small turning radius, the high number of driveways accessing on to a cul-de-sac, the very limited area to store snO\'\' and the special equipment needed (i.e. . front end loaders and/or special plows) make cul-de-sacs very expensive to maintain. Proposed Solution: Limit the use of cul-de-sacs to provide access to lots that have unusual topographic features and/or wetland areas. B. CMBA Issues 1. Turn Around Time for Building Permits Problem: Delays in issuing building penllits also mean construction delays. Proposed Solution: Additional staff, especially at peak building permits in spring and fall, could alleviate permit delays. Review processes and time at each step to determine \"lhere bottlenecks occur, and adjust. 2. Tapping Mains Problem: St. Cloud requires that water mains be tapped by city employees, limited to four per day, \"lhich delays construction. Proposed Solution: As in other municipalities, allow road contractor (with credentials) to tap water mains to avoid construction delay. 3. Sidewalk Requirement Problem: Sidewalks required for every lot in all developments even when there is little or no benefit/usage for the cost. . . Proposed Solution: Sidewalks not be required for every lot in every development where there is little or no benefit to the residents. 4., Drive over Curbs Problem: Drive over curbs are not an option to full curbs. Proposed Solution: Allow drive over curbs, as they are a low cost option and can meet the same functionality as full curbs. 5. Over Engineered or Designed Problem: Solutions are often over engineered/designed and too expensive for the problem. Proposed Solution: Discontinue reimbursement of designing fees as a percentage of total cost, design to straight fee structure and to logical solutions. 6. Testing of Sanitary Sewer and Water Mains Problem: Tested in stages over several days that can result in delays to construction. Proposed Solution: Change testing procedure to complete testing at one time avoiding delays. 7. City's Untimely Installation of Infrastructure Problem: Construction and occupancy delays because city and/or city's road . contractor do notbegin and complete road on schedule. Contractor penalty amount is . minor compared to the builder's penalty for delayed construction time. Proposed Solution: Adopt aggressive contractor penalties, less rigid on weather rules for roadwork. .
