Police Contract The City and LELS have completed the process of selecting an arbitrator for the contract. The arbitrator will determine the date for the final disposition. As soon as we have that date I will let you know. Community Sign As many of you are aware, the City operates the Community Sign located on CR 75 and College Avenue. While the sign in owned by the City, the advertising rights belong to Rich Feneis. The contract provides Feneis with 15 years of advertising rights. The sign has not operated well in the past and is difficult to program. Cory Ehlert has talked to Feneis and he is willing to allow the City to transfer ownership to Ehlert. Ehlert would like to utilize the advertising on the sign as well as provide community announcements. City / Township Mtg St. Joseph Township has reschedule the joint meeting to discuss the Orderly Annexation Agreement on Tuesday, November 23, 2004. Pursuant to due call and notice thereof, the City Council for the City of St. JQseph met in special session on Thursday, September 9, 2004 at 5:00 PM in the St. Joseph City Hall. Members Present: Mayor Larry Hosch. Councilors Gray Utsch, AI Rassier, Ross Rieke, Dale Wick. Administrator Judy Weyrens. Others Present: Pubic Works Director Dick Taufen, Police Chief Pete Jansky. Hosch called the meeting to order and stated the purpose of the meeting is to finalize the preliminary budget for 2005 and finalize the Water/Sewer Access fee for commercial and industrial property. Administrator Weyrens presented the Council with the final draft of the 2005 budget. The budget documents include a preliminary five year Capital Improvement Plan (CIP). The Department Heads háve been working for two years to establish a CIP and the 2005 Budget includes financing of the same. Once the CIP is adopted, the plan is amended each year with another year added. The purpose of the CIP is to plan for future equipment and personnel. Included in the budget is also the first draft of the Park Board CIP. Each year the Council must approve a budget for the Park Board which is based on the CIP. Once that is adopted the Park Board can expend funds for those projects without Council approval unless the project exceeds $ 3,000.00. Weyrens stated that the budget as presented include all the requests of the Department Heads including establishing a seal coating program. The proposed budget includes a General Property Tax levy of $ 501,000. Hosch stated that he will be voting against the budget as it includes a significant increase. He will however, support the budget after adoption. Utsch stated that while the budget includes an increase, it is his understanding that in the past levy limits have precluded the City from adopting a budget that accommodates growth. Utsch agrees the budget is . increased, but the budget is financially responsible. Rassier concurred with Utsch and stated that he is not in favor of increasing the tax rate for the City but recognizes the need to adopt a budget that provides for the cost of services. Rassier also stated that he hopes that adoption of the budget by the Council is not politically motivated and members adopt a budget that meets the needs of the City. Wick questioned the net impact of the proposed budget using projected growth. Weyrens stated that the Office staff has reviewed the growth for the past two years, which indicates the City has experienced an 18.67% growth rate. If the value of a home is increased the tax impact will also iincrease. After considerable discussion, Rassier made a motion to adopt the following resolution establishing the proposed tax levy and budget for the year 2005. The motion was seconded by Utsch. Nays: Hosch Motion Carried 4:1:0 DRAFT September 9, 2005 Page 2 of 3 RESOLUTION 2004-28 ADOPTING PROPOSED TAX LEVY · APPROVING 2004 TAX LEVY, COLLECTIBLE IN 2005 BE IT RESOLVED by the City Council of the City of St. Joseph, Stearns County, Minnesota, that following sums of money be levied for the current year, collectible in 2005 upon the taxable property in the City of St. Joseph, for the following purposes: GENERAL FUND LEVIES General Fund Tax Levy 501,000 BOND INDEBTEDNESS 1998 Street Improvement & Water & Sewer 7,450 1999 Stearns Cooperative Loan 29,863 2000 City Hall 97,000 2002 Street Improvement 45,500 2002 Equipment Certificates 69,500 2003 Fire Hall Refunding Bonds 42,578 2003 Revenue Bonds 56,000 2003 Improvement Refunding Bonds 51,200 2004 Street Improvement 15,000 2004 Equipment Certificates 75,500 Be it further resolved that these levies will support the general fund budget of $1 ,779,447 for the year 2005. The City Administrator/Clerk is hereby instructed to transmit a certified copy of this resolution to the County Auditor of Stearns County Minnesota. · Water and Sewer Access Fee: Weyrens stated that the Council has agreed to resolve the methodology used for calculating water and sewer access fees for Commercial and Industrial uses. Staff has presented and recommended the Council adopt the Met Council formula, which applies average water, uses to specific types of businesses. Access fees should be applied based on the impact to the infrastructure. Therefore, those businesses using more water and sewer should be charge a greater fee. The formula used by the Met Council has been used since 1975 and has been tried and tested in Court successfully. Weyrens stated it was her understanding that the EDA and Council had two concerns: 1) Warehouse facility; 2) Restaurants. In response to this concern, those two areas have been modified using current water usages. Weyrens further stated that the City of Sartell has been using the Met Council formula for a number of years and have implemented the fees in its original format. Further, the City of Waite Park is in the process of reviewing the same methodology with anticipation of adopting it as well. Hosch questioned if the Council would have the opportunity to amend access fees for a particular use if petitioned by a developer. Weyrens stated that a provision is included for amendment, but in doing so they must look at the classification of business not one particular developer and use. For example if a developer were constructing a movie theatre and they felt the fee was to high, the Council could amend the hookup fee for all movie theatres not just one particular development. Rassier and Utsch stated that the Council has discussed this matter for the past twelve months and it is time to finalize the rates. Therefore, Utsch made a motion to adopt Ordinance 44, Water and Sewer Access Fees with an effective date of January 1, 2005. Ordinance 44 adopts the modified Met Council access fees. OTHER MATTERS Roof Repairs: Taufen reported that the roof on Well House NO.3 is leaking and needs to be repaired. In addition, the canopy at the City Hall is leaking and should be repaired. Therefore, Taufen presented the Council with the following cost estimates to repair the roofs: Company Well House Canopy Total McDowall $ 5,470.00 $ 6,370.00 $11,840.00 Granite City Roofing $ 3,544.25 $ 3,544.25 $ 7,088.50 Horizon Roofing $ 2,927.00 $ 3,283.00 $ 6,210.00 Hosch stated that he has had an opportunity to review the bids and each of the companies use a different material and weight. All the bids provide an option to upgrade the thickness to a 60 mil rubber. The material used by Horizon is not the same quality as that of the other two companies. Therefore, Utsch made a motion to accept the quote of Granite City Roofing to repair the roof on Well House No.3 and the Canopy at City Hall and request that 60 mil rubber be used. The repairs should not exceed $ 9,000.00. The motion was seconded by Rassier and passed unanimously. Adjourn: Wick made a motion to adjourn at 7:20 PM; seconded by Rassier and passed unanimously. . City Representatives Present: City Engineer Tracy Ekola, Police Chief Peter Jansky, Public Works Director Dick Taufen. Larson Excavating. Public Comments to the AQenda: No one present wished to speak. . DEPARTMENT HEAD REPORTS - POLICE Citizen's Police Academy: Chief Jansky reported that he attended the 2nd Citizens Police Academy on this same date and stated that they are half way through the program. There are six participants from the St.. Joseph area who are participating in the 2no Citizens Academy. Tonight the academy is working on felony traffic stops and pursuits. According to Jansky, the academy will finish by November 15th at which time he will provide an update for the Council. New Patrol Car: Rassier questioned whether or not the new Patrol Car has arrived and if it is on the road. Jansky stated that it has arrived and the equipment has been transferred. The car has been on the road for approximately one week. MAYOR REPORTS MeetinQs: Hosch stated that he attended two meetings. . Stearns Municipal League Meeting: Hosch stated that at this meeting they discussed transportation issues. . APO Executive Meeting: They discussed the 2030 Transportation Plan which will be ready for presentation the last week in October. COUNCIL REPORTS RIEKE EDA: Rieke stated that the EDA met on Wednesday at which time they were informed that Midnight Haulers has withdrawn their application for Tax Increment Financing. At the same meeting the EDA Board also discussed a possible amendment to the Buettner Business Park Covenants. . SL Cloud Economic Partnership: Rieke stated that the St. Cloud Economic Partnership will appear before the Council to discuss the benefits of membership to the Partnership. Draft October 21,2004 Page 2 of 4 RASSIER . Meetinqs: Rassier stated that he too attended the Stearns Municipal League meetings and finds them very informative. He appreciates the opportunity to meet with area decisions makers to discuss pending issues. In addition to transportation matters as reported by Hosch, the Board also discussed a proposed Meth Lab Ordinance as presented by Stearns County. When the draft Ordinance if finished it will be forwarded to Police Chiefs and Cities for review and comment. WICK - No Report UTSCH - No report Noise Violation - 29 Minnesota Street East: Weyrens reported that the Police Department responded to a noise complaint at 29 Minnesota Street East on October 2, 2004. The property is owned and managed by Rock Properties. Weyrens stated that the tenants have contacted her regarding the violation and they do not dispute that a violation occurred, they dispute that they are being fined both through the City and the landlord. Since an evidentiary hearing is not being requested the Council must acknowledge that a violation did occur. After acknowledgment the Council then must decide the disposition. Utsch made a motion acknowledging that a noise violation occurred on October 2, 2004 at 29 Minnesota Street East. The motion was seconded by Rassier and passed unanimously. Roger Schleper, owner of Rock Properties, appeared before the Council on his own behalf. Schleper stated that he has discussed the violation with the tenants and they are aware of the consequences for violating the Ordinance and challenging the Police Officers. According to Schleper, he has talked to the neighbors and he received no other complaints about the tenants. He also stated that Rock Properties is using this incident as an example to show other tenants of the consequences of violating City . Ordinances. Darryl Smoleroff, one of the renters at this property also approached the Council to represent the property in violation. He did not dispute whether or not a violation did occur; however, he did mention that this house is not a party house and that they do not want to become a party house. The tenants are aware of the consequences that they face from school, the landlord and the City. Smoleroff also gave an apology for what happened and stated that it would not happen again. Hosch stated that he understands what it is like to be a college student and also understands that sometimes it is easy to let the music get too loud or the noise get out of hand. Hosch explained that he thinks it is a good idea for students to go around and meet their neighbors, so that they can deal with issues like this without getting the police involved. He also stressed that when the police are called to this type of incident, they are just doing their job and the students need to cooperate with them. Utsch stated that the incident before the Council at this meeting is similar to the violation that the Council dealt with on October 7, 2004 and the Council needs to be consistent in the disposition. Utsch made a motion to fine the property owner $250, with $ 100.00 of the fine an additional penalty for not being cooperative with the officers at the scene. The motion was seconded by Wick and passed unanimously. DEPARTMENT HEAD REPORTS - PUBLIC WORKS Old Fire Hall: Taufen approached the Council to discuss the heaters in the garage at the old Fire Hall. Currently, the garage is being used to store the police vehicles and some of their equipment. There are five gas heaters that are used to heat the building and right now, only two of them are working. Taufen contacted Metro Plumbing & Heating for a quote and they submitted a quote for repairing the two heaters as well as replacement of the five heaters with one new heater. . Draft October 21,2004 Page 3 of 4 . Before making a decision as to whether they are going to fix the heaters or replace them, Taufen questioned what the intended use was for the property. Rassier and Utsch stated that there are no long term plans for the building, so it would make more sense to fix the heaters and keep the building operating. Taufen stated that there is little insulation in the building and to keep it at the 55-60 degrees that Jansky would like, all five heaters must be working. Rassier made a motion to repair the heaters not working in the former fire hall, accepting the quote of Metro Plumbing and Heating in the amount of $ 689.00. The motion was seconded by Wick and passed unanimously. Sewer Jetter: Rassier questioned whether or not the sewer jetter has arrived. Taufen stated that the machine has not arrived yet and he will report to the Council upon arrival. 2AM Bar Closinq: Weyrens reported that when the Legislature changed the Statute allowing bars to be open until 2AM the Council considered amending the St. Joseph Ordinance governing alcohol. The Council voted to keep the bar closing at 1AM and review the request again after six months. It was the intention of the Council to contact municipalities where bar hours were extended to see if they experienced any problems with enforcement. Weyrens stated that she was contacted by Mark Loso of Loso's Main Street Pub to request reconsideration of the closing time. Mark Loso of Loso's Mainstreet Pub approached the Council to request the extended bar hours until 2AM. Loso stated that the majority of their customers are college students and that most of them do not go out until 11 :00. Extending the bar hours would provide him an extra hour of receipts and make him competitive with the surrounding bars in other municipalities. Loso stated that his weekend receipts have not changed since the legislature has allowed the extended bar hours. Loso further stated that he has contacted all the Liquor License holders in St. Joseph and only ~ of the holders are in favor of the . extended bar hours. However, they did indicate that if the bar hours are extended and they are trying to sell their establishment, the resale value would be higher. Police Chief Jansky stated that he has some concerns about the potential 2AM bar closing. He doesn't have the staff to change the hours to allow for 3 extra hours of coverage per week. Rassier questioned Jansky if the police schedule could be modified, moving shift change back one hour. Jansky stated that there are other issues to be dealt with and that he could not change the police schedule to accommodate the extended bar hours. Jansky stated that he has discussed this matter with the Police Chiefs of St. Cloud and Moorhead. Both Chiefs indicate that extending the bar hours has shifted everything back one hour. Patrons are not spending additional money if bars, they are arriving one hour later. Both St. Cloud and Moorhead have stated that they did not experience a negative affect with the change in bar hours. Another concern that Chief Jansky expressed is that of the community. Currently, the students create noise at 1AM when they leave the bars. Changing the time of bar closing would simply mean that they would create noise at 2AM instead. With the current 1AM bar closing, it is normally 3AM before all the noise is cleared. Changing the bar hours has the potential of creating disturbances until 4 AM. Loso responded that in his opinion, it does not matter what time residents are disturbeq, rather they are disturbed period. Therefore, the extension of bar hours would not have an additional affect. Jansky further stated that in his opinion, St. Joseph is different that St. Cloud and Moorhead. St. Joseph has a high number of residential rental units throughout the City. When the bar is closed the students typically walk home, most having to go through a residential neighborhood. In addition, the bars are located in close proximity to residential dwelling units. Utsch stated that the community should not be burdened by more noise from the students. Utsch also stated that the 1AM bar closing has been okay in the City for a long time. He does not see any reason as to why it should be changed. Hosch stated that it would be safer for those who go to the bars if . they didn't have to drive to another City to stay out until 2AM. According to Utsch, the students should know their limit and know when its time to stop drinking. Draft October 21, 2004 Page 4 of 4 Hosch expressed his approval of the 2AM bar closing. He stated that we are the only city in the County . that does not have the 2AM bar closing. Because the bars in St. Joseph close earlier, he is concerned that students are driving to other cities to go to the bars for an extra hour. One student who was present at the meeting did state that they do drive to St. Cloud to go out for the extra hour due to the bars closing in St. Joseph at 1AM. Wick questioned the liquor licensing period. Weyrens responded that liquor licenses are issued for 12 months, July 1 through June 30. If the Council is inclined to extend the bar hours, the Council most authorize the staff to prepare an amendment to the current Ordinance. This amendment must also discuss the time frame for which patrons must clear the liquor establishment. Rieke clarified that if the Council does not extend the bar hours, the Ordinance would not need amendment. Wick discussed the possibility of a trial period for extension. Weyrens stated that this method was used for the Cities of St. Cloud and Waite Park. Utsch made a motion to keep the bar closing at 1AM. The motion was seconded by Wick. Ayes: Utsch, Wick, Rassier, Rieke Nays: Hosch Motion Carried 4:1:0 ADMINISTRATOR REPORTS Project Update: Weyrens reported that the 295th and Cloverdale utility extension projects are currently under design. As a result of the public hearing for 295th Street, an open house is being scheduled for October 26, 2004. This open house will allow residents to view the location of the road and discuss utility placement. Weyrens stated that the proposed schedule presented to the Council includes the bid opening dates as well as a projected date for the assessment hearing. Park Board: Weyrens stated that there are currently two vacancies on the park board and Cory Ehlert . and Lonnie Abbott have requested to fill those vacancies. ~ Wick made a motion to appoint Cory Ehlert and Lonnie Abbott to the Park Board. Capital Expenditures: Wick stated that since the Park Board did not have a budget approved for 2004, all expenditures must be approved by the City Council. Therefore, the Park Board is requesting to expend the following funds from the Park Dedication Fund: Tree Planting - The Park Board is requesting to plant 10 trees in Memorial Park on the western boundary. When the city repairs the Hollow Park Storm Sewer system, additional trees will be planted around the perimeter of the park. The estimated cost, including staff time is $ 1,395.00 Parking lot/Trail extension - Kleinfelter Park. The Park Board is requesting to connect a trail system from the current parking lot to the existing trail. Currently, it is hard for bikers, rollerbladers, and those with strollers to get to the trail. The improvements will also add a handicap parking space. The estimate cost for the improvement is $ 1,415.00. Wick made a motion to authorize the expenditures from the park dedication fees for the tree planting and parking lot/trail expansion as detailed above. Both projects will be completed in 2004. The City received a loaner snowmobile £rom Bee Line Marine. Due to the mild winter, the snowmobile was not utilized very much. The grant cover overtime costs as well as the fuels needed for operation. · RECOMMENDED COUNCIL ACTION Authorize execution of the grant agreement as requested by the Police Chief FISCAL IMPACT The City will be responsible for paying the benefit amount on the wages, but the amount is limited. COMMENTS/RECOMMENDATIONS Snowmobile driving has been a consistent complaint and by utilizing them in enforcement hopefully driving habits can be changed. In addition to enforcing snowmobile rules, the City also has the W obegon Trail within the community where snowmobiles are allowed to drive. It may be necessary at some point to patrol the trail. However, your expenses may still be subject to audit at a later date. What will work best for both the DNR and local offices is for you to ask -your auditor or treasurer (i.e., whomever pays your bills) to give you a copy of their payment system printout, showing all of the expenses incurred as you work to enforce snowmobile regulations. Further, if you haven't sent in a proposed budget, we need to see one from your office. The fonn is on the DNR website, along with the . application and all other fonns needed to be included for you to receive your payment(s). Regarding the Proposed Budget, please show us what your office would do in a best-case scenario, regarding Snowmobile Safety Enforcement Program participation. While many of the past winters haven't been "nonnal", and the budget proposal does not have to be in stone, you should show how you would work in your area to provide safety training/snowmobile education to young riders, train and equip your department, and work with DNR to enforce snowmobile laws, rules and regulations? Under Minnesota Laws of2003, Chapter 128, Article 1, Subd. 5, the State is authorized to enter into this grant. 2. A Snowmobile Enforcement grant is a reimbursement grant provided to cover expenses related to labor and equipment dedicated to snowmobile enforcement. 3. The Grantee represents that it is duly qualified and agrees to perform all services described in this grant contract to the satisfaction of the State. Grant Contract 1 Term of Grant Contract 1.1 Effective date: shall be effective November 1, 2004, or the date the agreement is signed by the Minnesota CoIIIrilissioner of Natural Resources, or his delegate. This grant will cover expenses incurred for snowmobile enforcement during the fiscal year July 1, 2004 through June 30, 2005 however, no expenses will be reimbursed until there is a fully executed agreement in place. No other understanding regarding this grant contract, whether written or oral, may be used to bind either party. 8 Liability The Grantee must indemnify, save, and hold the State, its agents, and employees harmless ftom any claims or causes of action, including attorney's fees incurred by the State, arising ftom the performance of this grant contract by the Grantee or the Grantee's agents or employees. This clause will not be construed to bar any legal remedies the Grantee may have for the . State's failure to fulfill its obligations under this grant contract. State Audits Under Minn. Stat. § 16C.05, subd. 5, the Grantee's books, records, documents, and accounting procedures and practices relevant to this grant contract are subject to examination by the State and/or the State Auditor or Legislative Auditor, as appropriate, for a minimum of six years ftom the end of this grant contract. 10 Government Data Practices and Intellectual Property, if applicable 10.1. Government Data Practices. The Grantee and State must comply with the Minnesota Government Data Practices Act, Minn. Stat. Ch. 13, as it applies to all data provided by the State under this grant contract, and as it applies to all data created, collected, received, stored, used, maintained, or disseminated by the Grantee under this grant contract. The civil remedies of Minn. Stat. § 13.08 apply to the release of the data referred to in this clause by either the Grantee or the State. If the Grantee receives a request to release the data referred to in this Clause, the Grantee must immediately notify the State. The State will give the Grantee instructions concerning the release of the data to the requesting party before the data is released. 11 Workers' Compensation The Grantee certifies that it is in compliance with Minn. Stat. § 176.181, subd. 2, pertaining to workers' compensation msurance coverage. The Grantee's employees and agents will not be considered State employees. Any claims that may arise under the Minnesota Workers' Compensation Act on behalf of these employees and any claims made by any third party as a consequence of any act or omission on the part of these employees are in no way the State's obligation or responsibility. 12 Publicity and Endorsement 12.1 Publicity. Any publicity regarding the subject matter of this grant contract must identify the State as the sponsoring agency and must not be released without prior written approval from the State's Authorized Representative. For . purposes of this provision, publicity includes notices, informational pamphlets, press releases, research, reports, signs, and similar public notices prepared by or for the Grantee individually or jointly with others, or any subcontractors, with respect to the program, publications, or services provided resulting from this grant contract. The Grantee must not claim that the State endorses its products or services. 13 Governing Law, Jurisdiction, and Venue Minnesota law, without regard to its choice-of-law provisions, governs this grant contract. Accept the results as presented naming the new Mayor and Council Members that will be effective on January 6, 2005 FISCAL IMPACT None COMMENTS/RECOMMENDATIONS Obviously at the time of preparing this action fonn the results are not ready. The Statute requires that the local governing board accept the results of the City Election. For your convenience I have enclosed infonnation on the procedure. . CHAPTER 5 . M. Canvassing board: City election Minn. Stat. § 205.185, subd. 3. Within seven days after the city general election, the council must meet as a Minn: Stat. Ch. 13D. canvassing board and declare the results of the election. Cities must remember that this is a meeting that is subject to the open meeting law, and thus the meeting should be properly noticed and open to the public. Minn. Stat. § 205.185, subd. 3. After the time for contesting elections has passed, the clerk shall issue a certificate of election to each successful candidate. In case of a contest, the certificate shall not be issued until the proper court has determined the outcome. Minn. Stat. Ch. 209. Once the council has announced the results of the election and notified candidates of their election, any challenge needs to go through the county's district court under the contested elections procedure. Minn. Stat. § 205.185, subd. 3. A plurality of votes is sufficient to elect. This means the candidate receiving the highest number of votes, whether or not that number equals a majority, is elected. If the election results in a tie, the winner should be determined by lot in the presence of the council acting as the canvassing board. After sending certificates of election to the successful candidates, the clerk must also certify the results to the county auditor. The clerk shall be the final custodian of the ballots and the election returns. N. Recounts and contested elections . Minn. Stat. § 204C.36; MinD. During the time for contest elections, a losing candidate in a city primary or Stat. Ch. 209. general election may require a recount under two circumstances: (1) if the difference between the votes cast for that candidate and for a winning Minn. Stat. § 205.185, subd. 4. candidate for nomination or election is less than one-half of one percent of the total votes counted for that office; or, (2) if the difference between the votes cast for that candidate and for a winning candidate is ten votes or less and the total number of votes cast for the nomination or election of all candidates is no more than 400. (The law contains additional provisions where two or more seats are being filled from among all the candidates.) In both of the circumstances described above, the city must conduct and pay for the recount. A losing candidate who lost by a greater number of votes may request a recount, but the candidate must pay the expenses. In addition, any individual who was eligible to participate in the voting may contest the election or nomination of any individual by filing a petition in district court within seven days after the council has completed the canvass. All affected property owners have waived their rights and agreed to the improvements. However, the Council still needs to adopt the final assessment roll and establish the tenns. · RECOMMENDED COUNCIL ACTION Approve resolutions 2004-27 and 2004-28 adopting the fmal assessment rolls for Northland Plat 8 and 16th Avenue NE. FISCAL IMPACT Adoption of the assessment rolls assures the bond issue revenue streams will be fulfilled. COMMENTS/RECOMMENDATIONS · Resolution 2004-27 CITY OF ST. JOSEPH . Northland Plat 8 - Final Assessment Adoption WHEREAS, pursuant to proper notice duly given as required by law, the council has met and heard and passed upon all objections to the proposed assessment for the improvement of street, curb, gutter, water and sewer for the 2004 Northland 8 Improvements. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 5 years, the first of the installments to be payable on or before the first Monday in January 2005, and shall bear interest at the rate of six percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31,2004. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with . interest accrued to the date of payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the county. The St. Cloud metropolitan area is anticipated to have significant growth over the next 25 years. Much of this growth will occur in the suburban areas surrounding the core metropolitan area. 2. An arterial facility has been shown in the southern part of the St. Cloud metropoliÚm area for numerous years; however, a specific alignment for this facility has not been designated. 3. Based on facility spacing guidelines, the current transportation system lacks a continuous east-west arterial facility in this area. 4. There is a lack of access to the regional system in this area due to access restrictions to 1-94, State Highway 15 and other major routes. For example, to access 1-94 in the study area, one has to either go to TH 23, TH 75 or travel up to TH 23/15 to get TH 15. 5. There are significant physical constraints to potential transportation facilities in this area including existing developments, parks, wetlands, granite outcroppings, potential archeological sites, railroads and the Sauk River. 6. Based on an MnlModel evaluation, high potential for archeological sites exist in areas around granite outcroppings and in areas adjacent to Sauk River. . 7. The APO transportation model indicates that the 2025 daily traffic volumes for the proposed facility range from 6,000 to 20,000. If 33rd Street is ever extended to the east to in~lude a new river crossing and as a connection to TH 10. the volumes on the eastern part of the corridor (east ofTH 15) increase between 2,000 and 6,000 vehicles per day. 8. Designating a continuous minor arterial in this area would provide a well-spaced transportation system for the area that will serve future growth of the area. 9. The use of existing 33rd Street for a majority of the alignment in the eastern portion of the study area minimizes the impacts to both the environment and existing developed areas. Study Recommendations 1. In order to achieve the objectives of the Southwest Arterial Alignment Study and to ensure that implementation is pursued in a uniform coordinated manner. it is recommended that all jurisdictions in the study area adopt the Southwest Arterial Alignment Study. It is also recommended that key elements of the study, such as potential alignments and access guidelines are included in updates to their comprehensive and/or transportation plans. . 28 .. .--~ ,- ·-F".'· . _ __. _ _~._~,- _-7-'~"',-'--,' _ -"._~ -_~~Þ~'"__~__'j__~___'____ ~ · .., Based on the study, segments 1,2,3, 5, 6, and 8 are recommended as the alignment east of County Highway 137. The alignment west of County Highway 137 will be determined as · part of a future north/south arterial alignment study that is being developed by the APO. . The detailed location for this concept-level alignment (eastern section) are in Appendix D. 'J 3. Local agencies should protect a 220 feet of right-of-way for a rural designed corridor or - 150 feet of right-of-way for an urban parkway corridor. The desired facility characteristics , and typical sections of these concepts are shown in Appendix C. 4. Connectivity to area parks is an important element of the facility. It is recommended that r the facility provide room for an off-street trail along the facility. Crossing points and the TH 15 interchange should also be designed to safely accommodate these trails and trail crossmgs. , 5. Access in the corridor should be managed using the following principals and policies: , A. Major crossings of controlled access facilities (free-flow facilities) should be developed to minimize conflicts and impact to major traffic flows. I Policy: The intersection with State Hightva,v 15 should be grade-separated. B. Signalized access should be managed to ensure that corridor mobility is maintained. Policy: Signalized intersections should be promoted first with non-free~....a)' principal , arterial routes, then with minor arterial routes. then ~vith collector routes. The . minimum spacing of these intersections should be l/.¡ to 1h mile. Local communities should plan arterjal and collector rolltes to accommodate this spacing guideline. " C. Other access should be minimized so as to reduce the number of conflicts in the corridor. . Policy: Intennediate access points (other than at 1/4 mile) may be permitted provided a minimum spacing of 880 feet (1/6 mile) exists }vith other intersections. These access , points should not be signalized and should be limited to right-in/right-out. D. Public access intersections should be designed so that turning traffic is separated from · through tramc to reduce the number of conflicts. Policy: Tum lanes should be prodded at all public access points and at major traffic generators. . :29 , " E. Private access should be minimized or eliminated, whenever possible, for safety reasons .~ and to protect the integrity of the corridor. ,. Policy: No additional direct private access and business access should be pennitted; existing private residences that have access should be limited to one access point; ,.. residences next to a side street (comer lot) should be accessed from the side street. Finally, access restriction should be considered (right-in/right-out) for access points ,. that cannot be served by a public street '. F. Agencies need to control parcel splits along the proposed corridor. The ability to " control access to maintain safety and mobility can be lost when parcels are divided and - split to create new parcels. This can result in agencies having to provide access to each additional parcel to the detriment of the whole corridor. Other access should be minimized so as to reduce the number of conflicts in the corridor. Policy: No additional parcel splits should be pennitted unless the resulting new parcels are served by and access point that won 't affect the future corridor. If additional parcel splits occur, access should be provide from an adjacent public street. G. Agencies need to focus development efforts towards providing access at designated full- access intersections (intersections that are consistent with identified spacing guidelines). Policy: Proposed subdivisions adjacent to the corridor must be consistent with the access policies and spacing guidelines that have been developed. Subdivisions must provide access to adjacent parcels and provide reasonable frontage and/or backage . roads to achieve the overall access goals. In addition. existing access locations that are adjacent to the new subdivisions should be reviewedfor incorporation into the proposed plats. 6. Local agencies should review their land use plans and subdivision ordinances and make appropriate changes to preserve the development of a future minor arterial corridor. It is recommended that municipalities continue to zone property in the area as agricultural land until such time as it is ready to be developed and platting of the property occurs. This will increase the communities' ability to guide development and/or preserve right-of-way for a future corridor. 7. It is recommended that the City of S1. Cloud and Stearns County more thoroughly evaluate the eastern (urbanized) end of the corridor to determine how access and right of way issues may be addressed. This will require a more detailed analysis at a preliminary design level. 8. It is recommended that Stearns County pursue State Aid designation of the arterial ali£mment in accordance with State Aid mileage rules. ~ ~ 9. The implementing agency (agency that develops constmction/improvement projects) will be required to prepare environmental reports for each phase of the project. It is . 30 ~.-., t '¥ . recommended that the County and/or Cities consider the following as they move into the -...~ environmental impacts of each phase: 4, 'f! . · Wetlands: As implementation occurs, agencies should continue to make efforts to >c'r avoid, minimize and finally to mitigate wetland impacts. Near State Highway 23, basin 594W has been identified as a Mn/DNR-protected waterway. The MnlDNR and the ,~ Anny Corps of Engineers would regulate any impacts on this wetland resulting from the c-(1 construction of the arterial. If this wetland were impacted, a final delineation, wetland " determination and permit application would be required once the construction limits have been determined. '1 · Cultural Resources: As stated previously, the SHPO file search determined that the east-west section of the BNSF railroad has potential historical significance. Any rail . J crossing would therefore need to minimize any potential impacts. Cultural resources .- fieldwork should be performed in any area potentially impacted by the arterial ,~T alignment that has been identified by Mru\1odel as having high probability for archaeological resources. .' · Endangered SpeCŽes: If any of the tubercled rein orchid populations or natural '1 communities within the project area are potentially impacted by the arterial alignment, .' further information should be gathered to determine their exact extent and how the t potential impacts can be minimized. Specific information can be obtained from the DNR, but field verification would be required. · Section 4(j): As previously stated, there are plans to extend existing bicycle trails into . t the project area;_ this should be kept in mind in the planning process. As plans for these . . trails become more specific, efforts to maintain potential for trailway connections within \ I the corridor should be made. ~- . , · Water Resources: Efforts should be made to minimize impacts to floodplains within the , project area. Using existing bridges where possible should be evaluated: when new crossings are unavoidable, design should minimize bank fill and impacts to flow. I · Contaminated Sites: If an alignment connecting with existing CR 138 and crossing CSAH 75 is used, the contaminated site north of CSAH 75 should be further evaluated for its potential to be impacted by construction and/or to be acquired as right-of-way. , This property would be sampled, if necessary. to determine the extent and magnitude of contaminated soil and/or groundwater in the areas of concern. The results of this investigation would be used to determine if the contaminated materials can be avoided I or if the project's impacts to the properties can be minimized. If necessary. a plan would be developed for properly handling and treating contaminated soil and/or groundwater during construction. Any soil and groundwater remediation acti vi ties should be I coordinated with appropriate regulatory agencies. ! I . 3 J I ,- 'J ~ ~:! . Coordination with Agencžes: As the preferred alignment alternative moves towards :. construction, meetings with representatives from agencies with potential concerns (DNR, Mn/DOT, SHPO, MPCA) should be set up. These meetings can be used to discuss the agencies' concerns regarding any potentially impacted resources. APPENDIX C ,~ FaciJity Characteristics and Alignment Information . . n Facility Characteristics - The study partners agreed that the corridor is envisioned as a minor arterial that will connect " adjacent communities in the region and facilitate the movement of traffic between business - concentrations and residential areas. A typical cross-section is shown in Figure C-l. The minor arterial is expected to have the following key characteristics: " - · Grade-separated interchange at junction of TH 15 and limited at-grade access in remaining sections of the corridor. .. '" · At-grade intersections should have both left and right turn lanes provided to minimize " conflicts with through vehicles. ~ · A posted speed of 40 to 50 mile per hour (mph) with minimum design speeds of 55 mph. " · Depending on the density of development, the corridor should be designed to ultimately - accommodate up to 35,000 vehicles per day. This would suggest being able to expand the ~ facility to a minimum of four through lanes and have full access intersection spacing not closer than ~4 to Y2 mile. - · · Off street trails that would connect residential, business, and park areas. There are two . - regional trail systems that are planned to connect into the study area. The Glacial Lakes State Trail is planned to expand from Richmond to 51. Cloud; this future trail would enter ~ the corridor along Highway 23 in the middle of the study area. The Lake Wobegon Trail is - also planned to link with S1. Cloud, along a path parallel to the BNSF railroad in the northern edge of the project area. Special treatments and potential trial heads should be .. considered when planning for interfaces between these different modes of travel. - · A minimum of 220 feet of right-of-way is recommended for a rural design and a minimum ,0 of 150 feet of right of way is recommended for an urban design (curb and gutter). A project number has been assigned to protect the confidentiality of the businesses prospects. Project 01-E: This project involves the expansion of a service within the community. MDG has been keeping in touch with the project contact over the past two years. Most recent correspondence occurred on September 2yth and October 1st. ~ Project 01-F: -- This company has been in contact with the EDA regarding potential sites for a commercial business since August, 2001. MDG has forwarded the contact information on a number of commercial sites at various times throughout the previous three years. MDG last followed up with the contact on October 6th via a lengthy phone conversation. The contract retains an interest in establishing a presence within the community. Project 01-1: This business originally contacted the City in 2001. In 2002 they noted their project was on-hold. The company contacted MDG again in June of this year requesting information on available commercial sites in the City. MDG has forwarded additional information and remained in contact with this prospect, including by phone on October 6th. Project 01-J: This company owns commercial lease space adjacent to CSAH 75. MDG has remained in contract with this developer over the past several years. MDG spoke with the developer re: lease space remaining and confirmed price on October 6th. Project 02-H: This development contact re-initiated contact with the City in July of this year on behalf of a client. MDG forwarded requested information and has continued to offer additional assistance. Latest correspondence occurred on October 20th via fax. Project 02-L: This project involved the construction of industrial lease space (Le. incubator space) in the Buettner Business Park. MDG last followed up with the property owner on October 20th. EDA Monthly Project Report - October 2004 Page 1 Project 02-AA: . This project is now seeking the issuance of a building permit for the construction of a facility in Buettner Business Park. MDG last followed up with the contact on October 20th and 2ih. Project 02-FF: This prospect phoned the City in December of 2001 regarding vacant industrial acreage. MDG has remained in contact with the prospect over the past few years. Late. last year the contact indicated a desire . to take a 'wait and see' approach toward land acquisition. MDG remains in contract with the prospect occasionally per his request. MDG mailed a letter to the contact on October 6th. Project 02-R: This contact owns a business in the area and is currently leasing space. Earlier in the year the developer entered an agreement to purchase an 8+ acre industrial site in the City. The developer is not prepared to undertake development on the parcel at this time. MDG continues to remain in contact with the prospect. MDG most recently followed up on October 20th and 2ih. Project 03-A: These developers are interested in a large highway commercial development in an area not yet ánnexed into the City. MDG has been working with them over the fast few years. Additional correspondence occurred via phone on September 29th and October 4, 5 and 6t. A meeting was held on October 8th and contact via phone occurred on October 20th. Project 03-5: This project involves the possible expansion of the industrial acreage in the community. MDG has been working with the property owners on the project since August of 2003. In August project representatives indicated an agreement for sale of the property appeared imminent. MDG last followed up with the property owners on October 2ih. . Project 03-U: Inquiry forwarded to MDG on October 1, 2003 regarding a potential commercial development in St. Joseph. MDG followed up on September 29th and October 20th. _ Project 04-6: This developer purchased an industrial lot in the City earlier in the year. The prospect has no immediate construction plans. MDG follows up with the prospect routinely offering to assist as needed. MDG most recently followed up on October 6th and 20th. . Project 04-D: MDG contacted the owner of industrial acreage within the corporate limits regarding interest in re-subdividing and marketing industrial lots. The property owner expressed an interest in possibly re-subdividing. MDG continues to follow up with the project representative regarding the project. MDG most recently followed up on October 6th and October 20th via phone. Project 04-F: This prospect contacted MDG in May of 2004 regarding commercial lease space in the downtown area. MDG forwarded information on potential lease space in the downtown on September 22nd following a lengthy phone conversation with the developer. MDG talked with the prospect again on October 6th and emailed the contact on October 20th. Project 04-H: MDG met with a representative on May 26,2004 regarding a building in the downtown. Most recent follow- up occurred on September 15th. The current commercial lessee will be vacating the building upon lease term cessation. The building has been listed for sale. MDG spoke with the project representative on October 6th. A potential sale of the property is reported. - - EDA Monthly Project Report - October 2004 Page 2 Project 04-1: . A real estate representative contacted the City in early June regarding a client seeking commercial lease space in June of 2004. MDG forwarded information and has been routinely following up. A phone conversation October 6th revealed the lead had not materialized - project closed. Project 04-K: A representative from Project 04-K contacted the City on August 11th regarding office lease space. MDG forwarded information regarding previous inquiries for office space (as authorized for distribution) and regarding current lease space available. Project representatives presented information to the EDA on September 15th re~arding their ability to retain a storefront presence in the City. The latest contacts occurred on October 6th, 11 t ,14th and 15th. Additional information may be released to the public in November. Project 04-L: MDG met with project representatives on August 25th regarding potential expansion of an existing industrial facility and the use of TIF to support said expansion. A preliminary TIF application was submitted in September and considered by the EDA. The EDA recommended conditional approval of the request. The request was rescinded just prior to the October th City Council meeting. Project closed. Project 04-M: This business is currently located in another community and is considering relocating to St. Joseph. MDG met with the project representative on September 24th and spoke with the prospect on October 6th. MDG researched requested information on October 13th and spoke with the project contact on October 20th, 26th and 2th. Project 04-N: This prospect contacted the City in late August seeking a small industrial lot. MDG forwarded information and has remained in contact with the prospect. THE COUNTY BOARD OF STEARNS COUNTY ORDAINS: SECTION 1.0 GENERAL PROVISIONS 1.1 Title This ordinance shall be known and referenced as the "Cleanup of Clandestine Drug Lab Sites Ordinance." When referred to herein, it shall be known as "this Ordinance". 1.2 Statutory Authorization This Ordinance is adopted pursuant to the authorization and policies contained in Minnesota Statutes, Chapter 145A, Minnesota Statutes, Chapter 1158 and Minnesota Statutes, Chapter 375; or successor statutes. 1.3 Purpose Professional reports, based on assessments, testing, and investigations, show that chemicals used in the production of illicit drugs can condense, penetrate and contaminate surfaces, furnishings and equipment of surrounding structures as well as the air, land and water in the vicinity of clandestine drug lab sites. A. These conditions present health and safety risks to occupants and visitors of . structures and surrounding land through fire, explosion, ingestion, skin and respiratory exposure to chemicals. B. This Ordinance establishes responsibilities for involved parties to assure the following: 1) that people are not unnecessarily exposed to the dangers of contaminated structures, air, land or water; and 2) that proper steps are taken to remove contaminates and assure appropriate tests are done to demonstrate that affected structures, air, land and water are sufficiently cleaned for human contact. C. This Ordinance assists and guides appropriate authorities, property owners and occupants to prevent injury and illness to members of the public, particularly children and vulnerable adults. D. This Ordinance is intended to help assure the reduction of human exposure to chemicals associated with the site of former clandestine drug lab operations at structures such as dwellings, buildings, motor vehicles, trailers, boats, recreational vehicles, manufactured homes or appliances, and including the contents thereof, as well as the air, land and water surrounding clandestine drug lab operations. 2 1.4 Jurisdiction . This Ordinance shall apply to all incorporated and unincorporated municipalities, within the boundaries of Stearns County. Where a municipality has lawfully passed an ordinance to regulate clandestine drug lab operations and enforces such ordinance in an equivalent or more restrictive manner, the County's administrator of this Ordinance shall coordinate regulation and enforcement with that municipality. 1.5 Interpretation and Application A. The provisions of this Ordinance shall be interpreted and applied as the minimum requirements necessary to protect public health, safety and welfare, and shall be liberally construed in accordance with the underlying policies of the County and shall not be deemed a limitation on any other powers granted by State Statute, nor a repeal of any other related County Ordinances. B. Where the conditions imposed by any provision of this Ordinance are either more restrictive or less restrictive than comparable provisions imposed by any other law, ordinance, statute, resolution or regulation of any kind, the regulations which are more restrictive or which impose higher standards or requirements shall prevail. 1.6 Severability If any section, clause, provision or portion of this Ordinance is adjudged unconstitutional or invalid by a court of competent jurisdiction, then such section, . clause, provision or portion shall be severed from this Ordinance and all remaining sections, clauses, provisions or portions of this Ordinance shall remain in full force and effect. 1.7 Limitation and Disclaimer Of Liability This Ordinance is not intended to, and shall not, impose civil or criminal liability on any government or law enforcement agency or political subdivision, nor does this Ordinance create a separate cause of action for any private party Plaintiff that does not otherwise exist at law or in equity. Stearns County's liability is limited in accordance with Minnesota Statutes, Chapter 466; or successor statute, and other applicable and related law. 1.8 Fees Fees for the administration of this Ordinance may be established and amended periodically by resolution of the Stearns County Board of Commissioners. SECTION 2.0 DEFINITIONS, RULES AND WORD USAGE For the purpose of this Ordinance, the terms or words defined in this Section have the meanings hereafter given them. Additionally, certain terms or words used herein shall be interpreted as follows: A. With respect to governmental and law enforcement agencies and political subdivisions, the term "shall" is directory; With respect to "persons", as herein defined, the term "shall" is mandatory and not discretionary; In all instances the term "may" is permissive. 3 B. The word "person" includes any individual, firm, partnership, corporation, company, trust, association, joint stock association or any other legally recognized entity, or any trustee, receiver, agent, assignee or other similar . representative thereof. C. Words used in the present tense shall include the future; and words used in the singular shall include the plural and the plural the singular. D. Words shall be given their common usage if not defined herein. 2.1 Board means the Stearns County Human Services Board. 2.2 Child means any person less than 18 years of age. 2.3 Child Endangerment in addition to the meanings and applications given in Minnesota Statute, Section 299C.52, Subd.1 (e) and Minnesota Statute, Section 626.556; or successor statutes, means any child being in a structure or on the land used as a clandestine drug lab site. 2.4 Chemical investigation site means a clandestine drug lab site that is under notice and order for cleanup and/or remediation as a public health nuisance, as authorized by Minnesota Statutes, Chapter 145A; or successor statutes, and this Ordinance. 2.5 Clandestine drug lab operation means the unlawful manufacture or attempt to manufacture a controlled substance within any area of a structure such as a . dwelling, building, motor vehicle, trailer, boat, recreational vehicle, manufactured home or appliance, including the contents thereof, or upon the land or water. 2.6 Clandestine drug lab site means any land or parts of a structure such as a dwelling, building, motor vehicle, trailer, boat, recreational vehicle, manufactured home or appliance, including the contents thereof, occupied or affected by conditions and/or chemicals, typically associated with a clandestine drug lab operation. 2.7 Cleanup means proper removal and/or containment of substances hazardous to humans and/or the environment at a chemical investigation site. Cleanup is a part of remediation. 2.8 Controlled substance means a drug, substance or immediate precursor in Schedules I. through V. of Minnesota Statute, Section 152. 02; or successor statutes. The term shall not include distilled spirits, wine, malt beverages, intoxicating liquors or tobacco. 2.9 Owner means any person, as the same is herein defined, who owns, in whole or in part, the land and/or structures such as buildings, motor vehicles, trailers, boats, recreational vehicles, manufactured homes or other appliances, including the contents thereof, at a clandestine drug lab site. 4 2.10 Public Health Authority means the Stearns County Human Services Board and . all departments and staff authorized by the Board to carry out public health activities that are the responsibility of the Board. 2.11 Public health nuisance shall have the meaning given in Minnesota Statutes, Section 145A.02, Subd. 17; or successor statutes. 2.12 Remediation means methods such as assessment, evaluation, testing, venting, detergent scrubbing, enclosure, encapsulation, demolition and/or removal of contaminated materials from a chemical investigation site. 2.13.1 Structure means a dwelling, building, motor vehicle, trailer, boat, recreational vehicle, manufactured home, appurtenance thereto or other appliance, including the contents thereof. 2.14 Vulnèrable adult shall have the meanings given in Minnesota Statute, Section 609.232, Subd. 11 and Minnesota Statute, Section 626.557; or successor statutes. SECTION 3.0 ADMINISTRATION 3.1 Declaration of Site as a Chemical Investigation Site Public Health Nuisance Clandestine drug lab sites as defined above are declared by this Ordinance to be "chemical investigation site public health nuisances". . 3.2 Medical protocol for assessing health status of exposed persons A medical protocol for assessing the health status- and determining medical care needs of persons, particularly children and vulnerable -adults, that are found or known to be frequent visitors af a clandestine drug lab site, may be established by resolution of the Stearns County Human Services Board, after consultation with the public health medical consultant, as a Standing Order that may be updated as necessary. 3.3 Law Enforcement notice to affected public, public health, environmental and child and vulnerable adult protection authorities A. Law enforcement authorities who identify a clandestine drug lab site or a clandestine drug lab operation shall notify the Stearns County departments responsible for public health, environmental issues, vulnerable adults and child protection within one working day of identifying the clandestine drug lab site. B. The obligation to notify may be delayed to accomplish appropriate law enforcement objectives, but only to the extent that public health and vulnerable adult and child protection responsibilities are not unnecessarily compromised. C. When law enforcement completes their work and prepares to leave clandestine drug lab sites, they shall leave a warning sign posted on the entrance of the affected part of the structure or land. The warning sign shall be those that have been prepared in advance for such situations through the collaboration of the County's Clandestine Drug Lab Task Force. The warning sign shall be of a size and contain information sufficient to alert visitors or returning occupants to the site that the area is a chemical investigation site, may be dangerous to enter, 5 may have the potential for public health risks and must not be entered except by authorization of the agency identified on the sign. Removal of a warning sign by anyone not authorized by the Board to do so is a violation of this Ordinance. . D. The notices, referenced in Section 3.3 C of this Ordinance, shall include sufficient information to inform the recipients of the following: 1) property location by street address and other identifiable location; 2) property owner's and occupant's identities, including the identities of any vulnerable adults, children and women of child-bearing age found or known to be associated with the site; 3) chemicals found and indications of chemical residues; 4) presumed duration of the lab; 5) equipment in a dwelling, structure or on the land that is typically associated with the manufacture of a controlled substance; and 6) conditions typically associated with a clandestine drug lab site or operation including, weapons, illicit drugs, filth, fire, electrical hazards, hazardous materials and other harmful conditions as determined by Minnesota law, E. Upon identification of the clandestine drug lab site or operation, law enforcement agencies may treat, store, transport or dispose of all hazardous waste found at the site in a manner consistent with Minnesota Department of Health, Minnesota Pollution Control Agency and Stearns County rules and procedures relating to hazardous waste. 3.4 Notice of Chemical Investigation Site Public Health Nuisance to Owner and . Occupant A. After the Public Health Authority receives adequate information from law enforcement that they have identified a clandestine drug lab site and posted the appropriate Chemical Investigation Site Public Health Nuisance sign, the Public Health Authority shall act to contact the lawful occupants and owners of the site to also inform them of their responsibilities relative to the chemical investigation site public health nuisance. B. The Public Health Authority shall notify and order the property owner and occupant to have the public health nuisance removed or abated as provided in Minnesota Statute, Section 145A.04; or successor statute, and this Ordinance. The following shall be included as part of the notice and order: 1) A replica of the Chemical Investigation Site Public Health Nuisance declaration that is posted at the site's entrance(s). 2) Information about the potentially hazardous condition of the dwelling, 3) A summary of the property owner's and occupant's responsibilities under this Ordinance. 4) I nformation that can help them locate appropriate services necessary to remove and resolve the chemical investigation site public health nuisance status as provided in this Ordinance and Minnesota Statute, Section 145A.04; or successor statute. 6 C. The Public Health Authority shall also provide information about the Chemical . Investigation Site Public Health Nuisance declaration and potential hazard(s) to the following concerned parties: 1) Occupants of the affected structure; 2) Neighbors in proximity that can be reasonably affected by the conditions found; 3) The clerk of the municipality in which the chemical investigation site public health nuisance is located; 4) The law enforcement agencies responsible for investigating clandestine drug lab operations in the municipality in which the chemical investigation site public health nuisance is located; and 5) Other state and local authorities, such as the Minnesota Pollution Control Agency and Minnesota Department of Health, which may have public and environmental protection responsibilities applicable to the situation. 3.5 Notice Filed with Property Record and/orMotor Vehicle Record A. If, after 10 days notice and order, the Public Health Authority is unable to obtain any reasonable assurance or acceptable plan from the property owner or occupant that the property, dwelling or structure is being properly vacated, cleaned, remediated and tested, the Public Health Authority is authorized to provide a copy of the Chemical Investigation Site Public Health Nuisance notice and order to the County Recorder and to the lien and mortgage holders - of the affected personal property, structure and/or real properties. The County Recorder is authorized to record that information with the deed of the affected - property to help assure that persons with interest in the property have access to information about the property's chemical investigation site public health nuisance status. B. Similarly, when the affected property is a motor vehicle, boat, recreational vehicle or trailer, the Public Health Authority shall provide notification to the appropriate State and local agency that maintains motor vehicle, boat, recreational vehicle or trailer records and to the lien and mortgage holders of the affected properties. 3.6 Property Owner and Occupant Responsibility to Act A. Property owner(s) and occupant(s) provided with a notice, which may include the posted warning notice informing them about the chemical investigation site public health nuisance, shall promptly act to vacate occupants, including children and vulnerable adults, from those parts of a structure or property that are a chemical investigation site public health nuisance. This includes land, dwellings, structures, motor vehicles, trailers, boats or appliances and any contents thereof. B. Within ten (10) business days of receiving the Public Health notice and order to clean up the Chemical Investigation Site Public Health Nuisance, the property owner(s) and/or occupant(s) shall act to accomplish the following: 1) Notify the Public Health Authority that the affected parts of the dwellings, buildings, and/or motor vehicles have been and will remain vacated and 7 secured until the Public Health Authority acts to remove the chemical hazard investigation public health nuisance declaration. 2) Contract with one or more acceptable environmental hazard testing and . cleaning firms (acceptable firms are those that have provided the Minnesota Department of Health and Stearns County assurance of appropriate equipment, procedures and personnel) to accomplish the following: a) Conduct a detailed on-site assessment of the real and personal property affected by the clandestine drug lab; b) Determine the extent of contamination, including conducting soil, water and air testing of any property, soil, water or air in proximity to the site that the environmental hazard testing arid cleaning firm determines may have been affected by the conditions found at the site; c) Carry out and/or direct remediation operations, including, but not limited to, clean up or removal of contaminated plumbing, ventilation systems, fixtures, structures, soil or water or a demolition of the site and a complete clean up of the site; d) A complete clean up or disposal at an approved solid waste facility, of all personal property in or on the site; e) a complete clean up of all property, soil and water in proximity to the site that is found to have been affected by the conditions found at the site; d) Perform and/or direct follow-up sampling and testing; and e) Determine that the risks are sufficiently reduced, according to Minnesota Department of Health guidelines, to allow safe human occupancy or use of the dwelling, structure, personal property or land. - 3) Provide the Public Health Authority with the identity of the testing and cleaning firm the owner has contracted with, for remediation of the dwelling, - structure or land as described above. 4) Provide the Public Health Authority with the contractor's plan and schedule for remediation leading to removal of the chemical investigation site public health nuisance declaration. 5) The property owner or occupant may also seek authorization for an extension of time from the Public Health Authority to allow the owner time to consider options for arranging cleanup or removal of the affected parts of the dwelling, structure or land. The owner or occupant shall show good cause for any such extension. Any such extension shall be dependant on the owner's assurance that the affected parts of the structure, dwelling or land will not be occupied pending appropriate cleanup or demolition. C. In addition to the requirements of this Ordinance, property owners and occupants shall also be subject to the requirements of Stearns County Ordinance Number 272, "An Ordinance Regulating Rental Dwelling Units in Stearns County"; or successor ordinances. 3.7 Clean up standards The current Minnesota Department of Health guidelines entitled "Clandestine Drug Labs General Cleanup Guidelines"; or successor guidelines, are hereby adopted by reference. Those guidelines shall serve as the standard for clean up of clandestine drug lab sites in Stearns County. 8 3.8 Property Owner Responsibility for Costs and Opportunity for Recovery . A. Consistent with Minnesota Statutes, Chapter 145A; or successor statutes, the property owner shall be responsible for 1) private contractor's fees, cleanup, remediation and testing of chemical investigation site public health nuisance conditions; and 2) Stearns County's fees and costs of administering notices and enforcing, vacating, cleanup, remediation and testing of affected parts of the property. . B. Nothing in this Ordinance is intended to limit the property owner's, occupant's or the County's right to recover costs or damages referenced in this Section from persons contributing to the public health nuisance, such as the operators of the clandestine drug lab and/or other lawful sources. C. The County's administrative and enforcement services, referenced in Section 3.6 of this Ordinance, include but are not limited to, the following: 1) Posting the site; 2) Notification of concerned parties; 3) Remediation services; 4) Laboratory fees; 5) Expenses related to the recovery of costs, including the assessment process; 6) Securing the site, providing limited access to the site and prosecution of unauthorized persons found at the site; - 7) Collection of administrative fees; and - 8) Other services associated with assessing, vacating and remediation of the property. 3.9 Special Assessment to Recover Public Costs The Public Health Authority is authorized under Minnesota Statutes, Section 145A.04, Subd. B(c); Minnesota Statutes, Section 429.101; or successor statutes, to proceed within ten (10) business days of service of a notice for abatement or removal of the public health nuisance, to initiate the assessment and cleanup when a) the property owner is not located, or b) the Public Health Authority determines that the owner refuses to, or cannot pay the costs, or arrange timely assessment and cleanup that is acceptable to the designated Public Health Authority. " A. Authority. 'Chemical Investigation Sites' and 'Clandestine Drug Lab Sites' are hereby declared public health, safety and welfare hazards and public nuisances. B. The County Administrator (or the Administrator's formally identified designee) shall be fully authorized to act, consistent with Minnesota Law, on behalf of the County to direct funds to assure prompt remediation of chemical investigation sites. C. When the estimated cost of testing, cleanup, and remediation exceeds seventy five (75) percent of the County Assessor's market value of the structure, the 9 County Administrator (or the Administrator's formally identified designee) is authorized to notify the property owner of the County's intent to remove and dispose of the affected real or personal property instead of proceeding with . cle.aning and remediation. D. The property owner shall be responsible for all costs, including those of the County, incurred to abate the public health nuisance, including contractor's fees and public costs for services that were performed in association with a clandestine drug lab site or chemical dump site cleanup. The County's costs may also include, but shall not be limited to those set forth in Section 3.8 of this Ordinance. Fees and costs specified above that are not paid for in any other way may be collected through a special assessment on the property as allowed by Minnesota Statutes, Section 145A.08; or successor statutes, or by any other applicable Federal, State or County Laws, Rules, Ordinances and/or applicable County Board Resolution. E. Payment on the special assessment shall be at the annual rate of at least one thousand dollars ($1000) or more as needed to assure full payment to the County within ten (10) years; or as determined by the Stearns County Board of Commissioners. This amount shall be collected at the time real estate taxes are due. The amount due and/or payment rate may be adjusted by action of the Stearns County Board of Commissioners. F. The County may also seek recovery of costs through other methods allowed by Federal or State law. - ~ 3.10 Authority to Modify or Remove Declaration of Chemical Investigation Site Public Health Nuisance A. The designated Public Health Authority may modify conditions of the declaration and order removal of the declaration of Chemical Investigation Site Public Health Nuisance. B. Such modification or removal shall be only after the Public Health Authority has determined levels of contamination are sufficiently reduced through remediation to warrant modification or removal of the declaration. The Public Health Authority may rely on information from competent sources, including those supplied by the property owner and/or others such as state and local health, safety and pollution control authorities to reach such decisions. C. When the declaration is modified or removed, the Public Health Authority shall forward that information to the County Recorder for addition to the property record if the Recorder has been notified as described in Section 3.5 A of this Ordinance. Similarly, notice shall be provided to the motor vehicle or other license records agency and lien holders if a notice had previously been provided to them. 10 · 3.11 Waste generated from cleaning up a clandestine drug lab Waste generated from chemical investigation site public health nuisances shall be treated, stored, transported and disposed in accordance with applicable Minnesota Department of Health, Minnesota Pollution Control Agency and Stearns County rules and regulations for solid waste and for household hazardous waste and other hazardous wastes. SECTION 4.0 APPEALS 4.1 The Stearns County Board of Adjustment, as presently established in Steams County Ordinance Number 172; or successor ordinance, shall have the authority to order to hear and decide appeals from and review any order, requirement, decision or determination made by the Public Health Authority with respect to the administration of this Ordinance. 4.2 An appeal from any decision of the Public Health Authority regarding administration of this Ordinance may be requested by any aggrieved party in accordance with Section 8, Steams County Ordinance Number 172; or successor ordinance. The appeal shall be in writing and signed by the appellant and include the following information: - A. The particular order, requirement, decision or determination from which the appeal is requested. - B. The name, address and telephone number of the appellant. C. The grounds for the appeal. D. The relief requested by the appellant. SECTION 5.0 ENFORCEMENT 5.1 Any person, as the same is herein defined, who violates any of the provisions of this Ordinance, or who fails, neglects or refuses to comply with the provisions of this Ordinance, or who knowingly makes any false statement in any document required to be submitted under the provisions hereof, shall be guilty of a misdemeanor and upon conviction thereof, shall be punished by a fine not to exceed $1,000 or by imprisonment not to exceed 90 days, or both. Each day that a violation continues shall constitute a .separate offense. 5.2 In the event of a violation or a threatened violation of this Ordinance, the Public Health Authority, in addition to other remedies may institute appropriate civil or criminal actions or proceedings to prevent, prosecute, restore, restrain, correct or abate such violations or threatened violations. 5.3 All rights and remedies of Stearns County and the Public Health Authority arising under this Ordinance, at law or in equity, are cumulative and may be exercised in such manner with such frequency as is deemed necessary by Stearns County and/ or the Public Health Authority in protecting public health, safety and welfare. 11 SECTION 6.0 EFFECTIVE DATE .
