The City is aware that it has two years from the time of discovery ofthe defect to bring a claim under the bond against Shingobee under Minnesota Statute § 541.051. Frank J. Rajkowski .. Gordon H. Hansmeier We are still waiting on a reportftom our expert, Kevin Swanson, regarding the cause of the wall separation. Mr. Swanson has reported that he needs to monitor and measure the Frederick L. Grunke gap in the wall over the winter. The gap was larger last winter, decreased over the Thomas G. Jovanovich" summer, and it could increase again this winter due to the cold weather. An expert report Paul A. Rajkowski" is premature until we can accurately measure the gap in the wall. If our expert determines that the gap was caused by your client, the City will notify Shingobee that the Kevin E Gray problem needs to be corrected. If Shingobee does not correct the problem at that point, William J. Cashman the City will pursue its legal remedies. Richard W. Sobalvarro Since our last letter, the City has experienced other problems with the Maintenance Susan M. Dege Facility. Pieces of the seal between the roofline and wall are falling off, especially when it is windy. The seal is meant to keep bats, varmints and insects out of the roof. The seal LeAnne D. Miller should have been affixed with an adhesive when it was installed. If Shingobee does not Sarah L. I have worked with many of you this year through my job as the Program Coordinator of our Home Stretch -first time homebuyer training workshop. To all of you, I look forward to continue working with you on affordable housing programs. To those I have yet to meet, I look forward to building professional relationships with all of you as my work responsibilities expand outside of Rome Stretch. To be more specific: I will be taking on an expanded role with our Life Cycle Housing Program. I will be working more closely with lenders, buyers, the financing aspects ofLCH as well as continuing my role of education and tracking. I will be the contact person at CMHP for any questions concerning Life Cycle Housing. I will have an expanded role with the new Central Minnesota Community Land Trust in Cambridge. I will be working extensively with potential buyers as I create a specialized homebuyer orientation and training curriculum as well as a network for CL T owners. I will be working with lenders and other housing professionals to promote the Heritage Greens development in Cambridge as well as work on marketing. I will be the contact at CMHP for all -- initial questions pertaining to this program. - I will also be the facilitator ofRHAG meetings and will coordinate these meetings in the same way they've been done it the past. I will be the contact for any questions pertaining to this. I understand that quarterly payments will benefit the city with increased interest income and improved cash flow. The effect for Steams County of adding more settlements is of course a loss on interest income and additional work of doing more settlements. After reviewing all these factors - and discussing with the County Board we have come up with a solution. Steams County - will provide Cities quarterly payments on special assessments if they submit the infonnation onJhe special assessment electronically into a secured web-site that we have developed. This way the county saves time by not having to re-enter this infonnation into the tax system. If a city enters all their special assessments to the county electronically through the web- site we have developed we will payout special assessments on these dates: January 26th, April 30th, July 6th and December 1 st. In addition, the Administration Fee will be $2.50 (versus $5.00 in paper) to certify each special assessment if you submit all Special Assessments electronically into the Steams County Property Management Web Portal. This letter will address those issues: . APPELLATE COURT DECISION. Frank J. Rajkowski·· Gordon H. Hammeier After the mveting, Councilperson Wick asked the question as tò whether the Amendment Frederick L. Grunke to the St. Joseph Junk Car Ordinance goes against state law and whether the City could be exposed to litigation. He raised this question based 011 a recent MÜmesota Appellate Thomas G. Jovanovich" COurt case, State of Minnesota vs Haase, C4-00-1463, (Mim1. App. 2001). Paul A. Rajkowski' This case dealt with the prosecution of a business in Oakdale which was operating a used Kevin F. Gray èar dealership in violation of the Oalcdale junk car ordinance. In upholding the violation William J. Cashman on behalf of the City, the court discussed the relationship between state law and local ordinances as it relates to junk car ordinances. In this discussion, the court addl'essed the Richard W. Saba Ivana identical state statute which is the basis of the S1. Joseph Junk Car Ordinance. Susan M. Dege LeAnne D. No conflict exists where the local ordinance, although different, is merely additional and complementary to or in aid and f111iherance of the state statute. N011hem States Power Co v Citv of Gracite Falls. 463 NW2d 541,544-45 (Minn. App. 1990). The St. Joseph Junk Car Ordinance is derived from Minn. Stat. § 168B.01 through 101 which deals with junk and abandoned cars. The state statute states: "Abandoned motor vehicles constitute a hazard to the health and welfare of the people of the state in that such vehicles can harbor noxious diseases, fl,Jrnish shelter and breeding places for vermin, and present physical dangers to the safety and well-being of children and other citizens. Abandoned motor vehicles and other scrap metals also constitute a blight on the landscape of the state and therefore a detriment to the environment. , . It is therefore in the public interest that the present accumulation of abandoned motor vehicles and other scrap metals be eliminated, that future abandonment of motor vehicles and other scrap metals be prevented. . ." Minn. Stat. § 168B.01 The state statute also provides that local governments may adopt ordinances and regulations to . cOlltroljunk and abandoned vehicles "so long as the ordinances and regulations are not less stringent than theprovisions of section 168B.01 to 168B.101". The subdivision of the Junk Car Ordinance which the Council amended was the subdivision which created exceptions to a junk car. The state statute also defines abandoned vehicles and . junk: cars and creates exceptions. However, it appears that the St. Joseph ordinance creates greater exceptions to the definition of a junk car than the state statute. TIns creates a question as to whether the 81. Joseph ordinance is invalid. Under the state statute, the only exceptions to an abandoned vehicle are either a classic car or vehicles on the premises ofjunl)'ards which are defined and licensed accordance to lv'illm. Stat. § 161.242. Additionally, there are no exceptions to the definition of a junk vehicle under the state statute. The state statute dealing with julikyards provides that a junkyard may not exist or be operated outside an industJ.i~1 area unless the al'ea is screened to effectively conceal it from the view of motorists using state highways. The St. Joseph ordinance appears to go beyond the state statutes in that it creates an exception for junk cars which is greater than that allowed by state statutes. Specifically, the ordinance allows an exception to the definition of an abandoned vehicle or junk car for a motor vehicle repair business. This is not allowed by state statute, Additionally, the amended ordinance now allows . - - -- -_. ---. - . . ..-. ......- . ...-...- - - -- - - . . - ---- n_ v . It possibly could create liability on the p81i of the City iTom other property owners. However, the answer to that question is somewhat complex and would táke a substantial amount of research because it raises 111e issue of govemmental immunity which is very complex. Again, this is most likely contrary to the prohibitions 'ofthe state statutes. Pursuant to the state statutes, it is clear that junk cars are only allowed in junkyards. Since J.R.' s business is a repair shop, it is questionable whether state law would penllit junk vehicles on tills location. It is my opinion tIlat the amended ordinance is most likely defective because it permits what tile state statute forbids. Specifically, it allows junlc cars to be exposed to a public view and it creates an exception for the storage of junk vehicles at motor vebicle repair shops. The ordinance could be corrected ifit would clearly state that any junk vehicles be screened in a manner which would conceal them ITom the public and place a limitation on the number of vehicles. CONTR-<\.CT WITH J.R. STUDINSKI I have revie\ved the proposed contract with J,R. Studinski. It is ambiguous in tenns of what type of screening and the placement of the screening. It states tIlat J.R. agrees to "construct a eight . (8) foot fence upon my place of business. The fence will be constructed on the NOliheast comer of the building, and extend eight (8) feet to the north." It is llilclear whether the location and length of an eight foot fence will screen the junk vehicles and other related iron ITom the public. Ordinarily such screening would form a perimeter around the location of the vehicles so adjoining property owners would not have to view tile junk. NONCONFORMING USE Another concern vlith respect to the amended ordinance has to do with the nonconforming use of lR. Studinski's business. TIlls place of business was a nonconforming use since 1976. I believe tills was before J.R. purchased the propeliy. The purpose of a nonconfonning use is to eventually eliminate the nonconfonning use over a period oftime. It is a technique used to balance the interest of the public good versus the interest of the landowner who has llsed the propeliy in a certain way in the past. A noncollfonning USe may not be changed from one type of use to another tyPe, For instance, an auto repair business is not ajunkyard. Accoròingly, J.R. has no right to change the business from an auto repair business to a business which stores junlc cars since the storage ofjunl\: cars is a different type of use. CONCLUSION It is likely that the amended Junk Car Ordinance is contrary to Minnesota law. It is difficult to detennine whether this would place the City at risk of a lawsuit from the state.
