It has also come to myatt~ntion that thereis some concern regarding the carry-over for the other
e ployees., In June of 1999, the Council clarified the .vacation policy and passed a motion that said "all the
e ployees must be in compliance with the vacation accumulation rights as stated in the Personnel Manual
. nlaterthan the individuars anniversary date in the year 2000." There have beenextenuating
..' ci cumstances which have kept staff from taking vacation (lack of an administrator, employees now out for

surgery). There are a number of employees whose anniversary dates are coming up. The memo in your -
packet and the agreement that was reached with the employees last summer was that if they did not feel that
they could use their vacation by their anniversary date they should come to the Personnel Committee. As
the personnel committee has been disbanded and the Police department was already asking for this to be
discussed, I felt it was a good time to discuss the issue for the rest of the employees as well.
City/Township owned lot on 4tb Avenue and MN - It is my understanding that this issue has been
brought up before. The Township is willing to negotiate on the jointly owned corner lot of 4th Avenue and
Minnesota Street. The original price of $11 ,000 will again be offered to the City if the lot is used for public
use. The Township would receive no return on their investment by donating the interest on the Township
money that had been invested for the past five years. If the property is used for something other than a
public use, the 50% ownership reverts back to the Township. They have expressed willingness to lli~gotiate
an outright sale.
Miscellaneous
Just a reminder of some upcoming meetings. Remember that the Building Committee meeting has been
changed to this coming Wednesday the 15th at 3:00 at the Fire Hall. We want to nail down an option so that
we are prepared for the public hearing on the 16th,
There is a rental meeting on Tuesday from 5:00-7:00 at City Hall. The Healthy Communities Partnership
will be meeting from 5:30-7:00 at the Fire Hall on Monday night. This will be the first televised meeting.
Please give me a call if you have any questions ,on the agenda-could be a busy week and a busy meeting!

1. INTRODUCTION AND LEGAL BASIS

A. Intent
i
The St. Joseph Economic Development.Authority (EDA)
proposes! to .cause to be acquired certain land. and the
existinglbuilding thereon to be remodeled, constructed
and equipped in the Redevelopment Area for use as an
approximately 9,800 square foot city hall, (the "City
Hall"). I The City of st. Joseph, Minnesota (the "City")
will lease all or a portion of the City Hall from the
EDA withl an·optiontö purchase pursuant toa lease with
option t'o purchase agreement. Revenue bonds in the
principa11 amount not to exceed approximately $995,000
are propbsed to be sold by the EDA to finance a portion
of the dostsof the City Hall. The revenue bonds will
be secu~ed by the payments to be made by the City under
the leas;e with option to purchase agreement.

In the remainder of. the Redevelopment Area the EDA
proposes<to facilitate, as appropriate, private
development by acquiring land and preparing it for
private ¡development and by constructing public
infrastIJucture improvements.

B. Statement
i
I
The City and EDA have determined that conditions exist
within the Redevelopment Area which have prevented
further!development of land by private enterprise. It
has been found that the Redevelopment Area is
potentië\.lly more useful and valuable for contributing
to the public health, safety and welfare than has been
realize~ und~r existing development.

The dev~lopment of these parcels are not attainable in
the foreseeable future without the intervention of the
. , I
EDA. . The EDA has prepared the Redevelopment Plan,
which provides ,for the elimination of, these conditions,
therebyimaking'the land useful and valuable for
contributing to the public health, safety and welfare.

D. Statement of Authority .
Minnesota Statutes Section 469.001-469.047 (Housing and
Redevelopment Authority Act) grants municipalitÜ~s the
authority to designate redevelopment areas within the
boundaries of the municipalities. Within these areas,
the municipality may adopt a redevelopment plan and
establish a project consistent with the municipality's
public purpose. The project as contemplated by this
plan consists of a redevelopment project as defined in
Section 469.001 Subdivision 14. The lease with option
to purchase agreement is authorized under Minnesota
Statutes, Section 465.71.
E. Findings and Declaration
The City of St. Joseph and the St. Joseph Economic
Development Authority make the following findings:
l. The certain parcels of land in the project area
would not be made available for redevelopment
without some public financial aid.
2. The redevelopment plans for the Redevelopment Area
in St. Joseph will afford maximum opportunity
consistent with the needs of the locality as a ..
whole, for the redevelopment of the area by
private enterprise.
3. The Redevelopment Plan conforms to the general
plan for development of ,the locality as a whole,
II. REDEVELOPMENT PROGRAM
A. Redevelopment Plan Objectives
The EDA, through implementation of this plan, seeks to
achieve the following objectives:
1. To provide for the least costly and most efficient
City HaJ,l for the City required to provide
adequate City services to the region.
2. To promote and seek the orderly and harmonious
development of the Redevelopment Area.
3. To provide logical and organized land use for the
entire Redevelopment Area consistent with the
Comprehensive Land Use Plan and the Zoning
Ordinance of the City.

4 . To promote the prompt development of property in
the!Redevelopment Area with a'minimal adverse
impact 'on the environment.

5. To provide general design, guidance in conjunction
with a suitable development contract in order to
enh~nce the physical environment of the area.
6. To provide adequate utilities .and other public
improvements and facilities, to enhance the
Red~velopment. Area and the.. City for new and
exi~ting development.

7. Tokssist the financial feasibility of private
projects to the extent necessary and where there
is p. corresponding level of public benefit.

B. Land Use
The proposed land use for the Redevelopment Area is
primari~y institutional city owned and operated,
Public dwned and operated facilities necessary, for the
public health, safety and welfare are permitted uses in
the Red~velopment Area.

C. Redevelopment" Activi ties

Thé EDA will acquire the property in the
Redevelopment Area on which the City Hall will be
located. Other than that property, .. other property
in! the Redevelopment Area will be acquired by the
EDA if and<when required.

2 . Relocation .
It is not expected that any persons will be
displaced as a.result of this Redevelopment Plan.
3. City Hall and Other Public Improvements.
The EDAproposes to cause to be remodeled,
constructed and equipped the City Hall within the
Redevelopment Area.
Allor a portion of the completed City Hall will
be sold to the City under a lease with option to
purchase agreement.
D. Financing Plan
1. Project Budget
Attached hereto as Exhibit B is a budget which
details estimated development costs associated
with the City Hall and any other public
improvements currently contemplated. The items of
cost and the costs thereof shown in the budget are
estimated to be necessary based upon information .
now available. It is anticipated that the items
of cost and the costs thereof shown in each
category in the budget may decrease or increase,
but that the total project cost will not exceed
the amount shown above.
2. Source of Funds and Security
The City is entering into the lease with option to
purchase agreement with the EDA pursuant to
Minnesota Statutes, Section 465.71. The lease
with option to purchase agreement is payable from
general sources including taxes, and its payment
is not limited to a specific fund or specific
source of revenues. Sources of funds for any
other public improvements include rates and
charge s , assessments and other available funds of
the EDA or Ci ty .
3 . Bond Issue Details
The EDA will issue approximately $995,000 in
public project revenue bonds to finance the City
Hall. No bonding has currently been structured to
finance costs of any other public improvements.

major environmental problems. All municipal actions

manner that will comply with applicable environmental

within the area are contained within the codes and
ordinandes of the City of St. Joseph.

The St. Joseph City Council has authorized the St.
Joseph E'conomic Development Authority to be responsible
for seeihg that the contents of this plan are promoted,
implemented ,and enforced. '

H. Modifica~ionof Plan

A Redeve:lopment Plan may be modified at any time. The
modifica~ion must be adopted by the EDA and the City,
upon notice and after the public hearing required for
the orig¡inal adoption of the Redevelopment Plan.
Changes that do not alter or affect the exterior
boundari'esand do not substantially alter or affect the
general ilanduse estat>lished in the plan, shall not
constitu'te a modification of the Redevelopment Plan,
nor requiire approval by the, City.

BE IT RESOLVED by the City Council (the "Council") of the
City of St.· Joseph!, Minnesota (the. "City"), as follows:

Section 1. Rècitals.

1.01. It has! been proposed by the 8t. Joseph Economic
Deve opment Author¡ity (the "Authority") that. the Authority
esta~lish a Redeve:lopment proj ect Area in connection with' the
acquisition of certain land and existing building thereon to be
remodeled, constru¢ted and equipped for use as a city hall (the
"Redévelopment pro'ject Area"); and adopt the Redevelopment .Plan
for tlhe Redevelopment Project Area (the "Plan");, all pursuant to
andjn conformity with applicable law, including Minnesota
. Stattes, 8e;ctionsi 469.001.. through 469. 047 and 469.090 through
469. t081; all asr!eflected in that certain document entitled in
part "Redevelopme~t Plan for St. Joseph City Hall," dated March
16, 2000, and,pres:ented for the Council's consideration.
11.02. The cduncil has investigated the facts relating to

Section 2. Findings for the Adoption and Approval of the

2.01. The Council here;byfinds that the Plan conforms to
the eneral plan for ,the development or. redevelopment of the City
as at whole because, the Redevelopment proj ect Area is properly
zone, for the .',. intended uses, and the anticipated development is
in fhrtherance of Ilong range plans ,of the City for that area; and
that the Plan wil~ afford maximum opportunity consistent with the

enterprise because they will enable the Authority to provi.de and

2.02. The Council further finds that the Plan is intended
and, in the judgment of this Council, its effect will be, to
promote the public purposes and accomplish the objectives
specified in the Redevelopment Plan for Redevelopment Project
Area.
Section 3. Approval and Adoption of the Plan.
3.01. The Plan, as presented to the Council on this date,
including without limitation the findings and statements of
objectives contained therein, are hereby approved, ratifiE~d,
established, and adopted and shall be placed on file in the
office of the. City Clerk-Administrator-Treasurer.

1. Call to Order. pursqant to due call and notice thereof, the City Council for the City of St.
Joseph met on Thurs:day, February 3, 2000 at 7:00 p.m. in the St. Joseph City Hall.

2. ApproveAgenda:~iemenz stated that there is one itemtobe added to the agenda. The
County has requested that the Council approve a resolution relating to 133 reconstruction
and the parking. Lose;> also requested that that Council talk aboutlifting the parking ban. Loso
made a motion to approve the agenda with the additions, seconded by Ehlert. The motion
passed unanimouslYi

4. Approve Minutes - February 17 Council Meeting ~ Hiemenz pointed out a motion in the
minutes that state Ehlert made the motion,and,also seconded it. Schmidt stated she would
. correct the mistake. ¡Niedenfuer stated that in her report about CORE and the student liaison,
that the collegeswillbe starting off with two students and not just one. Loso made a motion
to, approve the minutes of February .17, 2000, seconded by Niedenfuer. The motion passed

6. Bills Payable and qvertime/Callouts - Loso made a motion to approve the bills 27978
through 28060, secoflded by Niedenfuer. The motion passed unanimously.
Niedenfuer made a 'rotion to accept the overtimeandcallouts, seconded by Twit. The

6. Public Comments, on the, Agenda - There were no public comments to the agenda.
7. Resolution on 133 +-Hiem,enz reported that Stearns County has requestedthattheCouncil
Pass ano parking resoluti()n for 133. State Aid specifications require that aresolution
restricting parking is:required when the proposed widths will not accommodate parking on
both sides and Fede:ral. and State. Aid monies are being used to fund the project. . The
proposed widths. for County Road ,133 between County Road, 134 and the north City limits are
tw03.6meter (12ft) driving lanes, one.4.26 meter (13. 78,ft) center lane and two .1.89 meter
(6ft.) shoulders. The resolution establishes that the City shall ban the parking()f motor
vehicles on both sides of County Road 133 between County Road 134 and the north City
limits at all times. Hiemenz also reported thatthe County has asked for his signature on the
plans for 133. Hiemenzwould like Joe Bettendorf and John Scherer to reviewthe plans
before he signs them. Losomade amotion to approve the resolution banning parking on
both sides of County Road 133 between. County Road 134 and the north City Limits and to
. approve the 133 plars subject to review by the City Attorney and City Engineer. Twit
seconded themotiof;1 and it passed unanimously.

8. Parking Ban - Twit suggested that the Council leave the ban in place as it's hard to say if
this weather will last. Loso suggested that the ban only be enforced when it snows and the .
plows have to come out. Loso stated that perhaps this policy should be in place all winter,
but maybe that is a discussion for another time. Twit made a motion to leave the parking ban
in place with the understanding that the police will only ticket when it snows and the streets
must be plowed. Loso seconded the motion and it passed unanimously.
9. Personnel Manual -Schmidt stated that the two items that were left for discussion were the
overtime/compensation time policy and sick leave. The Council spent considerable time
discussing the effects if hours away from work for jury duty, scheduled vacation or paid sick
leave are not computed in hours worked when computing overtime. The City attorney
suggested the following language be added to the personnel policy: "Hours away from work
for jury duty, scheduled vacation or paid sick time will not be computed in hours worked for
the purpose of computing eligibility for overtime pay." The Council adopted this language at
the last meeting this was discussed.
Schmidt stated that the suggestion made by the City Attorney's office regarding sick leave
was for cost savings only. They suggested that the City does not need to allow the
employees to bank such a large amount. The employees currently can bank up to 720 hours.
They accrue 8 hours each month. Schmidt stated that there is no legal requirement that they
must change this provision. In addition, the City has a lot of employees that have worked for
the City many years with the understanding that they were building up their time. It seems
unfair to take that away from them now. Ehlert agreed stating that any change that should
only apply to new employees and the rest would essentially be "grand-fathered in."
Twit stated that the employees that have already reached 720 should be allowed to keHp
those hours but that the new policy should apply to the other employees. Perhaps there .
should be a future date-"a sunset" to the current policy.
Twit suggested that the Council review the current policy and come up with suggestions for
changes that can be discussed at an upcoming meeting, instead of reviewing it now.
Schmidt stated that as far as the overtime issue goes there is a need to clarify what is
scheduled overtime and what is a "callout." The weekend shifts are scheduled a month in
advance so it seems reasonable that they would be considered scheduled overtime.
Snowplowing is a different story. Dick tells the guys at 4-5:00 that they need to come in that
night to plow. There is no advance warning. Schmidt stated that this time should be paid at
time and a half regardless of how many hours have already been worked during the week.
Twit stated that he agrees with that, but that this time should not be counted as part of the
rest of the week for computing overtime. Schmidt stated that legally it has to be counted as
hours worked, but that some discussion can take place regarding the amount of time that is
needed for the night time work. The Council previously discussed wanting the employees to
only do the bare minimum during the night time hours and spend their normal shift finishing
up. Schmidt stated that she would discuss this issue with the public works employees to see
what can be done during the day. She stated that it's likely that they are just being thorough
and trying to get as much done as possible while all of the cars are off the streets. However,
there might be some things that could be done during the day instead. Schmidt stated that
she would report back to the Council on this item at a later date.
10. Mayors Report - Hiemenz reported on a Habitat for Humanity program that would be
interesting to implement in St.Joseph. Ehlert agreed and asked Schmidt to speak with the
EDA Director to see if something like this could be put into place with new developments in
S1. Joseph. .

Hiemenz reportedth1at there is another meeting with Ed Abrams from the MTC scheduled for
. the 28th at 10:00 AM ~o review the survey that was done regarding potential bus service.
Hiemenz also report~d that the St. Cloud Area Chamber of Commerce has requested that
the City ofSt. Joseph join. Hiemenz asked Schmidt if she would call Teresa Bohnen and
have her come toan!upcoming meeting regarding this possible membership.
Hiemenz attended aptearns County hearing regarding the feedlot setbacks. Hiemenz also
attended a name dedication ceremony for the St. Cloud Area Economic Development
Partnership. They will now be known only as "the Partnership." Hiemenzreported that he
spoke to Boy Scout 'Tack 84 about what the Mayor does in St. Joseph.
Hiem~nz reported thathe met with St. Cloud Mayor Meyer about the sewer negotiations.

They will be putting together a proposal that they would like the City to approve before the St.
Cloud City Council sees it. This would help the City ,avoid some of the problems that Sartell
ran into. 1
Hiemenz addressed the complaint that Fred Reber submitted to the City. Reber is
complaining that water is running into his yard due to the lack of landscaping on the south
end of his property iri Pondview 5. Hiemenz asked Schmidt to.bring it to the attention of the
City Engineer. I

11 Council Reports- Twit reported that he would be gone on vacation until the 1ih. Ehlert
re orted that he read in the paper that the funds that were raised for the events center are now
gOing toSt. Cloud State University. He stated that a lot of hard work was putting into raising
th~se funds and he isa (i,ttle disturbed that it is going to one institution. He stated that he feels
ro bed. Hiemenz agreed and stated that the other communities are getting the short end of the
. stick. The funds are onl~ there because we all worked together. Hiemenz reported that on that
safe note that he and Sphmidtattended a meeting regarding the possibility of the sales tax issue

LOtO had nothing to report. Niedenfuer reported that the Healthy Communities Partnership group
at~nded their finaltraini~g in Wadena. It was a very beneficial training and the group is looking
fo ard to putting the neY" skills they learned to work in St. Joseph.
13 Clerk/Administrator ,Report - Schmidt reminded the Council of some upcoming meetings. She
also added that the,Hpp group will nowbe meeting on a regular basis on the second Monday of
the month from 5:30-~:OO. The meetings will also be televised.
14 ClosedSess.ion: '. Hi~menz stated .that at this time, the Council would adjoum to closed session for
a discussion of the Pqlice Chief candidate selection.

jAs of this year, along with the new contract, we will be accumulating
vaoation hours as w~ earn them with each pay period. However, we all
rec~ived the hours w'e had earned last year plus the carry over we had. The
. prmlem arises is that most of the officers in our department will have too,
ma y hours to try to :get down to the 40 hour carry over allowed m the umon
co tract. For myself, it would amount to over three months vacation by the
en1 of the year 2000~ What we are asking is, that we be allowed to carry
ov~r 200 höurs this xear and 100 hours in 2001. By 2002 we should be back
to the 40 hour requirement. Weare not asking for something out of the
or~inary but just that we be allowed to scale the vacation back over two
ye~rs as was done for the other employees when they went to the present
sysrem of earning v~cation. I am requesting this clarification at this time so
that we are not left vyith everyone scrambling to get their vacation in prior to
the end of2000 or lqsing it. Please let me know what you think.

Issues discussed:
1. Judy pres(mted a revised plan that located the Police Department on the south side ofthe existing
bank building with an attached squad car garage that would be new construction, and the
Administration located on the north side. The Council Chambers could be located on the north
side with an expansion on the existing funeral home property, providing the city could purchase
this land. David noted this plan is similar to Scheme 'B' from the previous meeting. Stephanie
. noted the garage would be more costly in this location because it would need to be sympathetic to
the existing building, and would be more than slab on grade construction.
2. We reviewed the Scheme 'Cl' that had the Police Department located on the north side of the
existing bank building, the Administration located on the south side, and the Council Chambers
located in the new construction to the south. The basement has space for two offices, the break
room, the locker rooms, and the other existing conference room spaces. It was agreed that this
plan could work with minor changes.
3. We discussed the security of the Police Department and the Administration areas. It was agreed
that the Dispatch and the Squad Room need to be located within a locked area, and the
Administration could be in an open area during the day, but should be locked from the Council
Chambers area in the evening.
4. We discussed the location of the Video Room and its proximity to the Council Chambers. Tom
said the best location is in the middle to the side of the Council Chambers. This has the proper
site lines for viewing both the Council and the public. We discussed by locating it in the existing
bank building, this assumes that the Council Chambers would be added on in the first phase.
Stephanie suggested we could explore making the addition more of a square, and locating the
Council on the southern side of the addition, and locating the Video Room on the south east side.
5. David said GLT would work on the two alternatives that were discussed at the meeting, and
would present to the City staff once again. GLT would make any alterations necessary, and then
would present to the City Council.
The foregoing constitutes our understanding of items discussed and conclusions reached. Other participants are requested to
review these items and advise the originator in writing of any errors or omissions within ten days of receipt.

Bob Herges presented the Preliminary Plat for Pond View Ridge Six. Herges stated that after the Planning .
Commission meeting on January 5th, there are three issues that needed to be addressed at tonight's hearing.
Herges stated issue number one is to save as many trees as possible in the development area. All the utility
companies met last Thursday to discuss the construction of utilities in the development area. The meeting focused
on the joint trenching, saving trees and placement of utilities in the road right-of-way or utility easement. '
Carlson stated that all the utility companies will joint trench in the road right-of-way, other then Stearns Electric
Association. Steams Electric Association is concerned with the cost of replacing or relocating utilities if the road is
ever expanded or reconstructed. Steams Electric Association made it very clear that they will place the electric line
within the utility easement of the development. However, at the end of the meeting Stearns Electric Association
requested that NSP submit a price listing for the joint trench and may consider a joint trench if the cost isn't too
high.
Graeve stated that the City should consider if it is legally possible to require the utility companies to joint trench and
locate in the road right-of-way if it is in the best interest of the community to save the trees. Graeve further stated
that it his opinion that 12th Avenue will never be widened to a four-lane road and utilities should be comfortable
with putting the utilities in the road right-of-way.
Herges stated that even though little progress was made with Steams Electric, they did agree to walk the proposed
development after the survey stakes identify the road corridor. Herges stated that Carlson, Steams Electric
Association and himself would identify the larger trees that need to be saved when placing the utilities.
Herges stated issue number two is the access to Klinefelter Park fi:om 12th A venue. The Planning Commission, On
January Sth, required a l2-foot walkway path from 12th Avenue to Klinefelter Park. The access has been identified
south of Lot 11, Block 1.
Klein questioned the location of the access in relation to the wetlands in the park. Elhert added that Mr. Taufen is .
suggesting that the access be located between Lot 2 and 3, closer to Eagle Ridge Drive. Herges stated that the
current location eliminates that impact to the wetland that is adjacent to the rear of Lots 5,6,7 and 8 and should serve
as a convenient access to the east side of the park for maintenance. Herges further stated that a sidewalk will be
constructed on the west side of 12th Avenue.
Mr. Bob Rassier questioned the Planning Commission regarding the extension of 12th Avenue south, through his
property, to Jade Road and the time of construction.
Klein stated that it is difficult to say when the road would be extended south. Development of the area south of
Pond View Ridge Six will dictate the construction of 12th Avenue to Jade Road. There are many wetlands in the
road corridor and careful planning will determine the exact location. Ehlert further added that the APO, Stearns
County and the Planning Commission have fundamentally preserved the 12th A venue Corridor to Jade Road for
planning purposes and to ensure future right-of-way. Ehlert stated it was his opinion that the road will not be
constructed anytime soon, and possibly never.
Klein referenced two letters fi:om concerned residents of the Pond View Ridge Four Addition., Klein stated that lots
16, 17, and 18 may impact the wetland in that area. The residents are concerned with the preservation of the
wetland
Herges stated that a consultant is currently studying the area and will determine the proposed impacts to the wetland
by the development. The consultants and Steams County will inform them on how to proceed with the development
and measures taken to preserve or mitigate the wetland.
Graeve stated that there are many Wlanswered questions as this time and the development should be delayed Wltil
the wetlands and the questions raised by Mr. Bettendorf and the City Attorney are addressed. Herges stated that .
delaying the preliminary plat doesn't solve the issues at hand. The County and the consultants will provide the

forward rwards the final plat, at jhiCh time all the issues raised tonight will be addressed and completed.
Lesnick ~tated that sheis concern~d with the grading and drainage issues as identified by Mr. Bettendorf. Lesnick
further stated that drainage has be~ a problem with past developments in the area and must be address with this

Herges stated that there will be n~ impactto his property due to the fact they have no right to cross his or anyone's
propertyj, Herges further stated ,that past preliminary plats are reviewed by the Planning Commission and approved
with ce~inconditions or request~amendments to the plat. After the developer makes the changes as suggested by
the PI ing Commission, the, preliminary plat is then submitted to the City Council for approval. If the preliminary
plat is a proved, the final platting process will begin.

Ehlert c ,ncurred with Berges statenient and advised the Planning Commission that this is just a preliminary plat

Carlso .'. reviewed ,the prOCedurJ and timing of the platting process, preliminary andfmal. Carlson further stated that

determtatiòns and course of ac¡tion. The final plat cannot be approved until Stearns County provides instructions to
the Ci .' and developer. j

Graev~ stated he ,will not suppÓrtadeVeloPl1lentthat eliminates any type of wetland. Even with mitigation and
creating a wetland somewhere ~lsedoes notwork for the environment. The community as a whole needs to support
and m~intain the existing wetlands within .the City's boundary. Graeve further stated that he has seen the approval
of preliminary plat constitute approval of the final plat without any further discussion or amendments. If any type of
Wetljd exists in the area, the developers should be comfortable with losing lots.
Heid restated,thatstearnscouAty will instructthem howto handle the wetlands. The wetlands will be replaced or
. left al, e. The developers or the Planning Commission don't have the expertise to make this decision.

Klein stated that the City Engineer requested that the Planning Commission make a decision whether or not . 12th .
Avenue will follow the Klinefelter Park propertyJine or will there be houses in between 12th Avenue and the park.
Ehlert stated that the Planning Commission gave direction to the developers at the last Planning Commission
meeting that lots should be located in between 12th Avenue and the park.
Carlson requested that the Planning Commission review page 174, items I and K. of the Ordinance book for
direction on how to proceed with the proposed preliminary plat.
Kalinowski stated that the Planning Commission can move forward by approving the preliminary plat with
conditions as stated in the Ordinance.
Herges requested that he review one other item with the Planning Commission prior to making a motion. . Herges
called attention to the three lots on 12th Avenue and Minnesota Street, which are included on the preliminary plat.
Herges stated that the City made arrangements to provide three water and sewer services to the property. The
property was then divided into three lots as proposed. All three lots are buildable but require a variance to the
minimum 75-foot width requirement. The lot on the corner of Minnesota Street and 12th Avenue includes the 50-
foot permanent easement required on Minnesota Street (County Road #134) by Steams County.
Ehlert stated that the lots meet the minimum requirement ofll,OOO square and a variance to the width requirement
should be considered. During negotiations with Mr. Krestreiba, the City Council, wanted to maintain three lots for
the property and concessions were made and dollars spent to ensure three lots would exist.
Klein stated that the negotiations took place without the adjacent properties being notified. In his opinion, the
installation of the water and sewer stubs should have never been approved. Utsch questioned if the Planning
Commission was consulted during the negotiations.
Carlson stated that the City Council and the landowner negotiated the arrangements and made a decision based on .
their discussions.
Ehlert questioned if the lot lines could be redesigned to comply with the requirements of the Ordinance. "There
appears to be enough property to make three lots without a variance and to have enough room for the house to align
with the properties on Minnesota Street.
Utsch stated that the City Council approved service to three lots without consideration to the Ordinance
requirements. Now the City Attorney is suggesting that the Planning COmmission consider a variance to make it
work. The Planning Commission should have been advised of the proposal and they could have informed the City
Councilofthe Ordinance.
Herges stated that the lots, could be redesigned to have two lots, fronting on Minnesota Street and one facing 12th
Avenue. ,The utility lines would have to rWlalong the back property line and an easement would need to be created.
The houses would then be able to align with the homes on Minnesota Street but a variance would still be needed to
address the minimum width requirement.
Ehlert suggested leaving the design as is, but moving the lot lines to create a minimum withof75 feet on all the lots.
There appears to be enough property to accomplish .the intent of the Ordinance.
Kleinstated thaìthere is an Steams Electric easetnent along Lot 3 and will make the lot too small todevelop.

Klein further stated that the Ordinance requires that the lots are deep enough to align the new home with the
existing homes on Minnesota Street. Klein stated that his home is 40 feet of the property line and the proposed lot is

Herges stated that the study will, more then likely, identifY all different types of wetlands due to the type of
vegetation that exists. There is every intention to avoid the wetlands, but mitigation of some areas m~
occur. Again, Stearns [Jounty will tells us how to proceed.
Ehlert stated Stearns Cqunty will provide their determination prior to thefif'.al plat and the Planning
. Commission and City Council can make an education decision about the wetlands when the data is
available. We can not make that determination at this point. A cost/benefit analysis a/mitigation should
be provided to educate (he City Council and Planning Commission.

Mr. Mark Hiltner added that most of the wetlands in the area are dry and after the development occurs, the
large wet may not hold:wateranymore with the design of the drainage ~ystem.

Kalinowski suggested that the motion not be amended to include Graeve's request and that Graeve could

Heid stated that they could not support the motion. The motion hand ties the development from occurring if .
any wetland is present in the development area. Essentially, the development would not happen.

Kalinowski stated that once the consultant study is complete and Stearns County submits their report, a discussion
can take place. At this time, there is just not enough information regarding the wetlands to make an educated
decision.
Herges stated that they would continue to work with the City and Stearns County regarding the proposed
development. Their intentions are not to destroy all the wetlands in the development area.
The Public Hearing closed at 8:50.
Carlson reported on the City Council's decision to impose a rental license moratorium. Ehlert stated that the City
Council would appoint a 8-member committee with adequate representation from the community and landlords. The
moratorium will last for six (6) months, with a recommendation from the committee within 90 days.
Utsch suggested that the Planning Commission have a meeting with the committee to address the uses within the
Zoning Ordinances. Ehlert stated that the Planning Commission should be kept up to speed with the committee's
work. Ehlert further stated that he will approach the City Administrator to request that members of the Planning
Commission become a part of the committee.
Carlson informed the Planning Commission that the City Council approved the Super America Variance request .
contingent upon the City retaining ownership of the easement area from the County.
Klein stated his disappointment with the Planning Commission's ,decision to, approve the three lots on Mill11esota
Street as a part of the Pond View Ridge Six Addition. Klein further stated that creating the three lots in this area
promotes development that doesn't have enough room to occur. In his opinion, people havelost respect for their
neighbors and their property. Creating three lots in this area will only ensure more property will be damaged in the
community.
Commissioner Reports:
Kalinowski suggested that Planning Commission and City Council start sch~duling joint meetings as they did in the
past. Ehlert stated that he would bring the request to the City Council at the next meeting. The Planning
Commission suggested an April meeting.
Utschrestated his request to geta summary of the 1999 building permits issued in the City of St. Joseph. Carlson
stated he would provide them at the next meeting.
Graeve expressed his appreciation to Carlson for his work to arrange the utility meeting for the Pond View Ridge
Six Addition. The meeting was a success by getting all the parties at one table to discuss saving as many trees as
possible in the development. Graeve also thanked Carlson for the all.the information prepared for tonight's meeting.
The information regarding the Pond View Ridge Six preliminary plat \Xasextremely helpful for the discussion.
