PUBLIC NOTICE OF SPECIAL ASSESSMENT
This is a PUBLIC NOTICE for a special assessment.
Notice is hereby given that the City Council for the City of St. Joseph will meet at 7:00
PM on February lO, 2005 at the St. Joseph City Hall, 25 College Avenue North. The purpose of
this meeting is to consider, andpossibly adopt, the proposed assessment for the 2005 street and
utility improvement for property abutting ih Avenue SE, Dale Street and Callaway Street. The
improvement will consist of street, curb and gutter, water and sewer. Adoption by the Council of
the proposed assessment may occur at the hearing. The following is the area proposed to be
assessed: all property abutting 7th Avenue SE, Dale Street and Callaway Street that is located in
the City of St. Joseph that currently does not have municipal water and sewer services.
Such assessment is proposed to be payable in equal annual installments extending over a
period of 15 years. The first installment is to be payable on or before the first Monday in
January of 2006, and will bear an interest rate of 6% percent per annum from the date of the
adoption of the assessment resolution. The first installment will have an added interest on the
entire assessment from the date of the assessment resolution until December 31,2005. An
interest for one year on all unpaid installments shall be added to each subsequent installment
when due.
. At any time prior to certification of the assessment to the County Auditor, you may pay
the entire assessment on such property, with the interest accrued to the date of payment, to the
City Administrator, PO Box 668, 25 College Avenue North, St. Joseph MN 56374. No interest
shall be charged if the entire assessment is paid within 30 days from the adoption of this
assessment. You may at any time thereafter, pay to the City Administrator the entire amount f
the assessment remaining unpaid, with interest accrued to December 31 of the year in which such
payment is made. Such payment must be made before November 15, or interest will be charged
through December 31 of the succeeding year. If you decide not to prepay the assessment before
the date given above, the rate of interest that will apply is 6% percent per year. The right to
partially prepay the assessment according to Ordinance No. 37.01 is available.
The proposed assessment role is on file for public inspection at the City Clerk's office.
The total amount of the proposed assessment is $ 570,890.00. Written or oral objections will be
considered at the hearing. No appeal may be taken as to the amount of an assessment unless a
written objection signed by the affected property owner is filed with the Municipal Clerk prior to
the assessment hearing or presented to the presiding officer at the hearing. Upon such notice, the
Council may consider any objection to the amount of a proposed individual assessment at an
adjourned meeting upon such further notice to the affected property owners as it deems
advisable.
Pursuant to Minn. Stat. § 429.081, a property owner may appeal a special assessment to
. the district court by serving notice of the appeal upon the Mayor or Clerk within 30 days after the
adoption of the assessment and filing such notice with the district court within 10 days after
service upon the Mayor or the Clerk. A special assessment appeal is the nature of a special .
proceeding. There is no right to a jury trial. The trial judge makes a detennination de novo of
the special benefit, that is, the increase in market value ofthe property as a result of the
improvement, or the trial judge may set the assessment aside and order the Council to do a
reassessment.
The City Council may defer the payment of any special assessment on homestead
property owned by a person who is sixty-five (65) years of age or older, or who is retired by
virtue of a pennanent and total disability for whom it would be a hardship to make the payments.
Minn. Stat. § 435.193. The factors constituting a "hardship" and the amount of interest on
deferred payments are detennined by ordinance or resolution. The homeowner shall make
application for deferred payment of special assessments on fonns prescribed by the County
Auditor. Minn. Stat. § 435.194. The option to defer payment shall tenninate on any of the
following events: death of the owner, provided that the spouse or co-owner is not otherwise
eligible; sale, transfer or subdivision of the property; loss of homestead status; or if no hardship
exists. Milll. Stat. § 435.195.

Short-term road closure at south end of 7th Ave (gas
easement) is expected. Affected properties will be
notified prior to road closures (24 to 48 hour notice).
