WE ARE SLIGHTLY AHEAD OF WHERE WE WERE LAST YEAR INSOFAR AS NUMBER OF INCIDENTS, AND THROUGH MARCH 10. HI THIS fŒPOfa YOU WILL NOTICE SOME FAIRLY SERIOUS CHARGES THAT I HAD MADE MENTION TO YOU IN THE YEAR END REPORT. (RECENT CASES WE INVESTIGATED, AND SOME OF THE 1993 CARRY OVER) SUCH AS ~ CRIMINAL SEXUAL CONDUCT (RAPE> , DEFRAUDING INSURANCE COMPANY, TERRORISTIC THREATS, FALSELY REPORTING A CRIME TO POLICE, -- ETC. WE HAVE PICKED ANOTHER PERSON TO FILL BRIAN KLINEFELTERS POSITION ON THE RESERVE, I~ND HE IS READY TO START ACTIVELY WORKING WITH THE RESERVES. HIS NAME IS PAUL TOOHEY. I HAt.,..I[ TALKED TO HIM, AND PLAN ON BRINGING HIM TO THE COUNCIL MEETING FOR YOU TO MEET. PAUL ALSO WORKS AT BANKERS SYSTEMS, AND I BELIEVE HE WILL MAKE A FINE ADDITION TO OUR RESERVE UNIT. The program is entitled "local Government Program". (Note: These programs are available until NSP's limited funds run out.) The program has three main parts that can greatly benefit all city and county owned or leased buildings. 1. NSP will pay for an energy audit and engineering design expenses or 15% of the actual retrofit costs, which ever is less. Plus.... 2. NSP will pay for 50% of the new energy efficiency equipment or $.1 O/KWH saved over the first year, which ever is less. Plus.... 3. NSP will offer fiQ-interest loans for the simple payback of the improvement. This presents cities and counties an excellent opportunity to become more energy efficient. Since all of the engineering fees and 1/2 of the equipment cost are paid for in most cases there is no risk. The no interest loan insures there is no net cost to the city or county since your energy savings is always much greater than the loan payment. Associated Consultants Engineers, Inc. (ACEI) has been providing electrical, mechanical, civil/structural and environmental engineering services to cities and municipals for over 40 .'-J years and is only one of two firms certified by both the states of Minnesota and Iowa to - complete energy audits. ACEI has completed or under contract to complete over 3500 energy audits. ACE! would like to offer our services to complete energy audits of your city/county owned building including city offices, libraries, court houses, waste water facilities, pump houses, , - ,.. life stations, and garages. An energy audit for this program would include analyzing lights, motors and any electrical I aspect of HV AC equipment to determine if paybacks are within 10 years, necessary to qualify for NSP's program. If the payback is less than 10 years we will list the cost for the improvement, energy savings and simple payback. We also identify other areas that should be investigated further by the city to save additional energy. The energy audits are completed or reviewed by a professional engineer as required by NSP. ACEI will complete the energy audits for $500 per building for buildings under 10,000 Fe, $1000 for buildings 10,001 Fe to 50,000 Fe and $.05/Ff for any buildings larger than 50,000 Fe, ACEI can also help complete the NSP appiication forms and prepare bid documents to include NSP's approved equipment. The bids can then be sent to local contractors for competitive biding. At the completion of the project ACE! can verify that the required equipment was installed. As mentioned before. the NSP program will pay for the energy audit and all of the engineering costs in most cases since the engineering/audit costs are generally less than 15% of the improvement cost. This is expected to be one of the most controversial and hotly debated issues we will take up - in the 1994 legislative session and I am going to do my part to study both sides very carefully. - The central question to come before the Legislature will be this: should NSP be allowed to store nuclear wastes outside its Prairie Island plant, or should the nuclear power plant be shut down when the spent fuel pool inside the reactor building is full in 1995? Strong arguments will be presented on both sides. NSP will argue that every state agency that has looked at this proposal has found it "necessary, safe, and environmentally benign." Those opposing the proposal will stress that NSP's predicament creates a unique opportunity to reconsider how we produce and use electricity, and that the Legislature should make some fundamental decisions about our use of energy alternatives. As I mentioned, the issue is complicated. I will be spending the next few weeks listening carefully to the debate on all sides of this issue. The body of this report outlines specific and potentially hazardous conditions I noted during the survey and my recommendations for their abatement. . Fire Hall During my survey, I noted that the fire hall is extremely cramped and in need of additional space. Currently, there are three rows of vehicles and only two overhead doors. Also, I did a random survey of distances between equipment, which equated to 20 inch- es. You should give strong consideration to adding additional space for the fire hall. I noted that gasoline was stored in non-approved flammable liquid containers. You should provide an approved gasoline safety can with a flash arrester. A flash arrester will not allow ignited vapors to reach the inside of the gasoline can. I recommend that you store and dispense gasoline and other flammable liquids from approved flammable liquid containers. City Garage I noted that one of the hand-held grinders was not equipped with a rear peripheral guard. I recommend that your staff either in- stall a rear peripheral guard on this grinder or replace it with a new one. - - Attention to recommendations is important and we urge your prompt action. General City Recommendations lift Stations During my survey, Dick and I discussed ways to reduce the poten- tial injury hazards associated with entering lift stations on a daily basis. I recommend you place remote hour meters on lift stations. This will eliminate more than half of the lift station entries. The employees will be able to read the hour meter from the outside of the station. Of course, this will not eliminate every entry, but will greatly reduce the amount of entries over a period of one year and the time required to retrieve the hour meter readings. During my discussion with Dick, he indicated that annual right- to-know training has not yet been performed. I recommend that you perform annual right-to-know training for all employees. During our discussion, we talked about an upcoming AWAIR meeting to be held with the city of Avon. Johnson Dear City Clerk/Administrator: In talking with our neighboring cities, we find we share a similar problem - legal fees are higher than the proceeds realized when a person is found guilty by the courts. It can be as simple as dog-leash law offenses - the person pleads not guilty, is found guilty, is given a fine which they say they can't pay and, often, the system asks if they can work off the fine by community service under the City's superTision. (For the past few years, the City of Babbitt has had the policy of allowing an offender to work for the City, in this capacity, only one time.) Even when the offender does pay the fine, it's often minimal. The City receives a small percentage of the fine which doesn't even cover the legal fees charged by the attorney. (Babbitt can't afford to have an attorney on staff or on retainer.) The Babbitt City Council is asking if you'd be interested in uniting to put pressure on .the legislators to change the laws. We would like to see that those found guilty by the courts also be assessed the legal costs of prosecution. Under the present system, innocent taxpayers are paying the costs of the guilty. Small cities are "caught between a rock and a hard place". Police officers are required to do their job, yet they know it will cost the City more dollars than the City will receive. I am attaching copies of our Ordinance No. 93-32, a letter from Attorney General Humphrey III and a letter from Representative Dave Battaglia. If your Council agrees with us, will they consider passing a resolution stating something similar to ours? Then, please send one to the Attorney General, one to each of your legislators and a copy to me. Individu- ally, we can accomplish so little, but TOGETHER we can achieve much. I appreciate knowing the City Council's views on this issue. The legislature has been aware of the increased legal burden felt by cities and responded with some changes in the crime bill. In the 1992 crime bill, the state required judges to set a minimum . fine of 20% of the statutory maximum for the offense to cover legal costs incurred by the cities. In 1993, the percentage was raised to 30%, of which 20% would be divided between the law enforcement agencies that incurred the legal costs. For example, if the city prosecutes a misdemeanor with a maximum fine set at $700, 30% of that fine or $210, would be recovered and divided. However, the fine may include community service hours that hopefully will be a beneficial to the city. The 1992 crime bill change is found in MS 609.101, subd 4, and the 1993 change may be found in the 1993 Session Laws, Chapter 32.6 I article 12. The MN Supreme Court Research Department will be presenting a report to the Legislature next session. The Court will be monitoring the ways fines are being assessed throughout Minnesota and will report on successful methods used to increase the recovery rate to cities. This provision indicates that the Chief of Police should work approximately 40 hours per work. That is consistent with Section 11.06 of the Police Policy and Procedure Handbook. I have enclosed a copy of Section 11.06 for your review. Since the scheduled amount of hours are "approximately" 40 hours per week, I do believe that there is some latitude available under which the City Council could require additional hours . before payment of overtime. I believe that about 42 or 43 hours per week would be the maximum which we could request. Paragraph 6 of the Contract specifically references Section 11.06 of the Police Handbook. As you can see, section 11.06 requires the Chief of Police to work at least two evening or night shifts per month, with one being on a Saturday or Sunday. The normal work week shall be Monday through Friday, with eight hour shifts being worked. Paragraph 7 of the Contract deals with comp time. This simply provides for the payment of comp time when the Chief of Police is called back during off duty hours or vacation. It doés not . automatically require payment of comp time when more than 40 hours per week are worked. Comp time becomes payable when work is required while the Chief of Police is not otherwise on duty. I do not believe that the Employment Contract can be unilaterally amended by the City. I do believe that the City has authority to amend section 11.06 of the Police Policy Handbook. I believe that an Amendment of Section 11.06 could be used to adjust or clarify the terms of the Contract since schedule requirements set forth in Section 11.06 are adopted as part of paragraph no. 6. The Mayor was not delegated with authority to enter or amend the contract with the Chief of Police in August of 1991. The duties of the Council must be performed by the council as a body. An individual member may not perform the duties. The Mayor may sign contracts, but only when authorized by the Council. - -- ~ ---- , In the case of Martin v. Common School District No. 3 . Ramsev County, 204 N.W., 320 (Minn. 1925), the Supreme Court dealt with ,..an --.i.ssue.-.similarto this. In that case ,the school board .J!.ad.._ _.._ .,__--_< authority to hire teachers. The chairman and clerk held a meeting without proper notice and executed a written teacher's agreement of employment. It was represented to the teacher that the agreement was entered into with authority of the school board. In reliance thereon, the teacher signed the agreement which was subsequently ruled to be a nullity. In determining that the contract was invalid, the Supreme Court . noted: "Persons contracting with municipal . corporations must at their peril inquire into the powers of such corporations. The conduct of the two members of the board, and the recital in the alleged contract, cannot create an estoppel against a municipality." The court went on to hold that although the school board could later ratify the contract, the contract would be valid only by ratification of the school board. Based upon this decision, it appears clear that the Contract Amendm.ent, signed without the authority of the Council is invalid. - That left Chief Lindgren serving in the capacity of-' '---> Chief of Police under the terms of his original contract. Later in 1991, the City Council passed a motion to terminate the written contract and to continue to employ Chief Lindgren under. the terms and conditions of the City's policies and procedures. It is unclear as to whether or not this resolution was ever communicated to Chief Lindgren. This leaves a peculiar situation. The Police Chief never agreed to work under the terms of the October 17, 1991 resolution. He apparently believes he is employed pursuant to the contract as . amended in August of 1991. I believe that this leaves us with an employment contract established by the terms, salary and conditions currently existing between the parties. Therefore, it appears as though the resolution of October 17, 1991 has controlled the relationship. Box 668 St. Joseph, MN 56374 In re: Linneman Inn Hookup Charge ATTN: Rachel Stapleton · Clerk/Administrator Dear Mayor & City Council: I apologize for the delay in getting this letter back to you. It was important in this case that I have all the facts before me before sending my letter. After receiving all of the information I needed I am now ready to respond to the City's imposing additional hookup charges to the Linneman Inn. The Council is precluded from charging additional hookup charges to the Linneman Inn under Minnesota law and is further precluded by the interaction of city ordinance and state law. At the time the Linneman Inn issue arose Section 42.4 of the St. Joseph City Ordinances, Subdivision 2 provided, and still provides, that any person connecting to the sewer system shall pay a sewer hookup charge as authorized by Minnesota Statutes Section 444.075, Subdivision 5. The ordinance provides that the sewer hookup charge will be based on an equitable formula including replacement cost of then-existing waste water disposal facilities and the amount of past individual assessments levied to finance construction of the facilities. The sewer hookup charge may be adjusted from time to time by resolution of the City Council, and separate charges can be established for various types of users as deemed appropriate by the City. Supplementing Section 42.4, Subdivision 2 the City Council · enacted a schedule of fees and charges which provided that sewer hookup charge would be $800.00. When I spoke with your city attorney he represented to me that at , ¡ . Page Two February 18, 1994 some time prior to January 1, 1993, the City of St. Joseph had passed a resolution providing the procedure by which additional hookup charges could be charged upon refurbished or remodeled property. I then appeared at the City Council meeting and asked that all ordinances or resolutions conforming with this be de- livered to me. The only documents that were delivered to me were copies of the above-cited ordinances as well as copies of minutes from City Council meetings occurring September 25, 1986, November 18, 1993, and November 4, 1993. Therefore, based upon my review of your City Ordinances as well as the information provided me by the City Administrator's office it is clear that the City Council did not pass an ordinance or resolution in 1986 which would provide for a rational and fair means of billing secondary hookup charges. The document which I was provided refers only to an assessment to the college, but does not implement a policy across the board. In short, based upon the evidence provided me by the City it is clear the City did not have any ordinance or resolution in place prior to November 4, 1993, concerning assigning secondary hookup charges to remodeled or reconditioned buildings which had already paid initial hookup charges at a previous time. The City's resolution . adopted on November 4, 1993, is not an ordinance which was or should have been made retroactive and therefore under Minnesota law was effective on the date it was passed, November 4, 1993. From the above it is the case that the current policy was not in place at the time the Linneman Inn "went on line". The Linneman Inn began operating in its current state several months before the resolution was passed, and in fact was the inspiration for the creation of the ordinance passed on November 4, 1993. Since the ordinance was not retroactive and could not be made so under the circumstances the ordinance passed on November 4, 1993, is in- applicable to the current situation. The question then is whether the City had any other reasonable basis for imposing any additional connection fee. Your own ordinance, Section 42.4, requires that the sewer hookup charge shall be based on an equitable formula. If there is no formula there can be no hookup charge. The evidence you have provided me shows that there was no formula in place for secondary hookup charges. You are precluded by your own ordinance from imposing the additional hookup fee on the Linneman Inn. There is a second equally valid reason why the City cannot impose the additional four $800.00 hookup charges against the Linneman Inn under the facts of this case. In January, 1993, Steve Dehler began preparation for refurbishing and opening the Linneman Inn by approaching the City of St. Joseph Planning & Zoning Commission . to determine whether he and Mr. Lindgren would need a variance. The Linneman Inn was zoned commercial/industrial. After it was . · Page Three February 18, 1994 remodeled it would be run as multiple unit housing. Planning & Zoning informed Mr. Dehler that he did not have to seek a variance in this instance because the property would remain commercial/ industrial after it had been remodeled and did not act on the request for a variance. The City Council thereafter approved the Planning & Zoning minutes, including the portion pertaining to the Planning & Zoning Commission's ruling on the issue of the variance. Mr. Dehler still submitted a $·60.00 check to the City for the pur- pose of obtaining a rental license. Under your ordinances a rental license must be obtained by R-2 rental units. The City Administrator relying upon the ruling of the Planning & Zoning Commission has re- turned Mr. Dehler's $60.00 check stating that "The Linneman Inn is a lodging house, as determined by the Planning Commission, and does not require a rental license. The City does not license businesses." Attached hereto as Exhibit #1 please find a copy of Rachel Stapleton's letter to Steve Dehler dated January 14, 1994. Based upon all of the above information it is clear that the City throughout the past year has recognized that the Linneman Inn continues to be a business which falls in continuing fashion under commercial/industrial zoning. · This being the case, let us review how the Linneman Inn would then be treated under the November 4, 1993, resolution, which as I under- stand it is the basis upon which you are attempting to seek additional hookup fees from the Linneman Inn. Under your resolution commercial/ industrial property will have additional connection fees levied if the average annual flow increases more than 20% (but at least 500 gallons per day, over the initial flow). This Section provides that one hookup fee is to be charged for every 500 gallons per day. The average daily flow is 800 gallons from the Linneman Inn. Under your existing resolution the most that could be charged to the Linneman Inn is two sewer hookups. You will note in reviewing for your file the Linneman Inn has already paid for two sewer hookups. Therefore, under your own resolution based upon the City's own classification and zoning treatment of the Linneman Inn, the Linneman Inn does not owe you any additional money for any additional hookups at this time. The owners of the Linneman Inn are not trying to put anything over on the City. They are not trying to get away with anything. It is my job simply to protect their rights and to make sure that they are not treated differently by the City than any other business in the City of St. Joseph. I believe you can see from the above that Mr. Dehler's and Mr. Lindgren's arguments are well-founded and well-reasoned. Under the facts of this case, based upon the actions · of the City Council, the Planning & Zoning Commission and further based upon all ordinances and resolutions applicable in the City of St. Joseph, I ask that you withdraw the City of St. Joseph's claim . Page Four February 18, 1994 that the Linneman Inn owes four additional hookup fees totaling $3,200.00. If after reviewing this letter you wish to have me appear at the City Council meeting to discuss this matter I will be happy to do so. If you do not believe my attendance is necessary or would be helpful to you in your making a decision simply have the City Administrator inform Mr. Lindgren and he will tell me so and I will not appear. All sidewalks in the City unless otherwise specially ordered by the City Council, shall be constructed of concrete and shall conform to the grade lines established by the City Council under its discretion. All existing sidewalks in the City shall be maintained, repaired or rebuilt at their present width. All sidewalks hereafter to be constructed shall be six feet in width and the side of the walk toward the center of the street upon which it is built is to be six feet from the side of the street on which it is built. unless otherwise specially ordered by the City Council. .-:.:~-. Section 33.2: SIDEWALK ASSESSMENT. The cost of construction, repair and .;,.-. maintenance of the sidewalks shall be borne by the lots, parts of lots and lands fronting upon the side of the street upon which sidewalks are built and shall be determined and assessed by the City Council in the manner provided by law; provided, however, that the City Council may by resolution levy and assess only a part of the cost of the construction of the sidewalks upon the lots, parts of lots and lands fronting on the side of the street upon which the sidewalks are built. but not less than one-half of the cost. . ection 33.3: REMOVAL OF SNOW AND OBSTRUCTIONS. The owner of each lot, , part of lot, parcel and piece of land within the City shall remove or cause to be removed from the sidewalks or walks adjacent thereto all snow, ice, dirt and rubbish within twenty-four hours after the same has been deposited on the sidewalk or walk. If such owner fails or neglects to remove the same within twenty-four hours, the City Council may cause the same to be removed and shall assess the cost of removal against the fronting lots, parts of lots, parcels and pieces of land. The City Clerk shall notify the owner of the lot, part of lot, parcel or piece of land so assessed with the cost of removal, by advising of the amount of the assessment and requiring the owner to pay the amount of the assessment to the City Treasurer within thirty days of the date ~., of notice. In the event that the owner fails or neglects to pay the assessment within this time, .' the City Clerk shall certify the assessment to the County Auditor for certification and taxation. Any notices to the property owner shall be by mail addressed to the owner at his last known address which is the address of the property in question. Section 33.4: SIDEWALK REPAIR. If any sidewalk in the City is found to be defective and in need of repair, the City Council may direct the City Clerk to notify the owner of the lot, part of lot, piece or parcel of land abutting upon the sidewalk and require the owner to repair the sidewalk within sixty days after the date of notice. This notice shall be served on the owner by either delivering a copy to the owner personally or by mailing the notice to the owner at his last known post office address or at the address of the property in question. If the owner fails or neglects to make repairs within sixty days after delivery of notice, the City Council may cause a defective sidewalk to be repaired and assess the cost of repair against the abutting lots, parts of lots, pieces or parcels of land. Tom Thelen of the League of Minnesota Cities discussed the upcoming legislative seSSlon. TIF's will be an important issue. Other issues will be absentee voting and . consolidation of local elections, clarification of the open meeting law, Land use and annexation issues, revenue sources. He recommended watching for erosion of the Local Government Trust Fund by the state. The scope of our work was limited to: 1. Obtaining one sample of the wood fence. 2. Performing chemical analysis to determine the presence of the wood preservative creosote. 3. Preparing a written report. Our work was authorized by Ms. Rachel Stapleton of the City of St. Joseph, Minnesota on January 21, 1994. FJELD OBSERV A TION$ AND SAMPLE IDENTIFICATION: On February 7, 1994, Huntingdon/TCT personnel visited the residence at 41 5th Ave. in St. Joseph, Minnesota.. A wooden fence was observed on the west side of the residence. The fence was running in an east-west direction on both the north and south property lines. SampJes of the fence material were obtained from the excess lumber located in the backyard of the residence. ~ The samples were approximately 2" x 6" in size and dark brown in color. PROJECT NO: 412294-5038 DATE: March 2, 1994 PAGE: 2 REVIEW OF WOOD FENCE TEST PROCEDURES: Chemical analysis of the wood samples was conducted in accordance with HuntingdonlTCf Project Number 4411 94-2588. A summary of the test procedure is as follows: Several portions of the wood sample were scraped with a surgical blade, and the resulting powder was collected ir1 a 4 mL vial. A small amount of methylene chloride was added, and the vial was agitated to extract soluble material. The extract was cast as a thin film on a potassium bromide optical plate. The infrared spectrum was obtained using a Digilab FTS-60 Fourier transfunn infrared spectrometer equipped with a Model 3200 computer. RESULTS: . The following is a summary of test results: Based on the infrared spectrum, the methylene chloride extract from the wood ~ple appears to be a coal tar (creosote) type preservative. This conclusion is based on similarities between the sample spectrum and reference spectra of coal tar. REMARKS: The wood samples will be retained for thirty days from the date of this report unless further arrangements are made by the client. The Spectni will be archived for ninety days from the date of this report and discarded. Joseph City Employees ::;, L, . 27 October 1993 Using the DISC social style instrument as a basis for self dlscovery, participants will learn the differences between their own style of "on the job" behavior and that of the others 1n their '.....ork groups. When people understand that each style has both advantages as well as limitations in the work place, discussion opens and awareness begins. Typically, the DISC '.....ould be used in department sessions lasting about 2 - 2 1 / Q hours max. All the lssues like Communica~ions, .J ~ Priorities and Goal Setting, Customer Expectations and Participation I n Sma 1 1 Group Meetings are dealt with from a standpoint of social style and how to be more effective. These sessions are guided but not highly structured. The outcome we a.f8 after is a better understanding between department members about how and why others think and act ì i ke they do. Only then can the departments begin to think and function as teams. I'd recommend a seperate session for the Administrative Staff of 3 and a combined session of the Administrative Staff plus the Public Works · head and the Police Chief. So, there would be two sess'cns ana each session would require an investment of $400. I'd furnish the DISC instruments for the participants and accomodate their time schedules. I would not recommend any further training of this kind for any other City staff unless the Department Heads made a strong recommendation to do so. In my opinion, opening up communications between these key personnel based on a better understanding of social styles is the single best investment at this time. If it does what I think it can do, great! We've got some solutions at a pretty nominal investment. If it does not do what ~ think it can do.. .and that is always a possibility.. .then you have not wasted a lot of time and money. If you think this idea has merit, you should implement it in November of this year. If you're not impressed with the simplicity of this idea, then I'd recommend that we have a private and more serious discussion about budgets and other outside resources. I'd like to do this job for the Counc 1 . Mayor Reber called the meeting to order at 3:00 p.m. and stated that this is an informal meeting to discuss any matters which the Members of Council and the Police Chief and Police Officers wish to discuss. He stated that this is an informational meeting and to increase commQnication with the Police Department. chi ef Lindgren stated that he had sent a memo to the officers informing them of the meeting. Matters discussed and cleared were bills brought before the Council, specifically, tires, nametags, and a flashlight. Other matters of concern were amount of camp time accumulation, requirements to use it within a specific peÜod, holidays, and scheduling. Cllief Lindgren brought up the fact that the Police officers are aware of the costs oÍ e~JÌpment and services and discussed the mechanisms they use to save the city money. Currently a sir~n box will have to be replaced. Additionally, he discussed with the Members of the Council the police budget. Also the Police Departn~nt requested to have another location found for storing ~rist~as ornaments, air conditioners and other equipment, in order that they ¡nay -- ark both patrol cars in the garage. Mayor Reber will look at other locatioD~ for storage and report to the Council. The Council and Police disctœsed the flIDctioning of picking up dogs rur~ing at large. It was suggested that the Police Officers prepare short memos to the Chief on any situation which the COlli1cil should be informed. The Chief could report these matters to the C01-IDcil.
