John Scherer has been communicating with Rieke's . attorney on this matter. 10 h. I discussed the duties of Weed and Tree Inspector with Mike Sworski. He stated that he would be willing to assume the duties with guidance from the current inspector. 13. Copy of application is included in packet along with recommendations from our attorney. 14. The Council must reconvene as a Board of Review and consider by motion, the recommendations of the City Assessor, enclosed in packet. Then the Board of Review must adjourn to resume the regular Council meeting. 15. The Fire Department Building Site Committee wishes to present their findings to the Council. 16. The Stearns County HRA is meeting with the Planning Commission tonight and wishes to have the Council consider their findings at the Council meeting. Shannon Hinnenkamp (#84.53400.006 & 84.53430.042) appeared before the Board to contest the value of property which he has purchased. There has been cleaning and clearing of the property since last summer. It was determined that the assessor's pictures were taken last summer and that some of the buildings have been removed since then. Hinnenkamp stated that the buildings were removed prior to January I, and that he has not removed any buildings since then. Ollie Lesnick will view the property again and take off the -- valuation on the buildings which have been removed, and present his recommendation to the Board. - Randy and Laurette Scherr (#84.53475.019) appeared before the Board to question the value on their house. They stated that the garage has been made into a family room, which increased the square footage of the house, but the value did not increase proportionately. Ollie Lesnick will visit the house and look at the interior. He will then made a recommendation to the Board. Tony Pelzer (#84.53610.000) appeared before the Board and stated that the value of this property has increase 50% in ten years. He asked about the formula to allow increases in property values. Bob Lindvall discussed the formula] which controls excessive increases for taxation purposes. Currently the increase is limited yearly, by the taxable amount, to 10 per cent or one third of the difference] whichever is greater. Rieke arrived at 7:01 p.m. OlliLE ACCESS EOJ I HAENT: Bryan Nelson presented infonnation and demonstrated equipment for governmental or public access channel broadcasting. The system which he presented allowed for viewer interaction to request infonnation. The proposed cost of the system is $9,500 which would include installation and entering 250 pages of infonnation. Rieke asked if this would bring the infonnation to the head end of the system. After discussion of where the head end is located, Nelson stated that --~his cost does not include equipment to get the infonnation to the head end of the _ system. Nelson stated that the computer is an Amiga, and with a one year warranty. Software upgrades would be included unless they were major upgrades. CITY ENGINEPR REPCRTS MJN I CI Pi\L TEST WELL: Joe Bettendorf presented an application for pa~ent for the test well and recommended payment. Loso made a motion to approve Application for Payment No. 1 (final) of Mark J Traut Wells, Inc. of $3,505, for the test well project; seconded by Rieke. Ayes: Reber, Rieke, Loso, Hazen, Hiemenz. Nayes: None. Motion carried. CAP I TAL IMPROVEMEJ\lTS PRCCRl¥i\: Joe Bettendorf presented an outline of a Capital Improvements Program which included Public Buildings, Parks and Recreation, Public Works, Emergency Services, and a Financial Summary. He stated that the Star City Committee will need to have a completed Capital Improvements Program as part of the Star City process. .. INDJSTRL!\L Pi\RK: Joe Bettendorf introduced Peter Carlson of his firm and stated that Pete had done most of the work on the Preliminary Engineering Report on the St. Joseph Industrial Park. Carlson discussed the areas of the report including streets, - ¡water mains, sanitary sewer, and stonn sewer. He stated that this total project is projected to be $2.5 million, with assessment to cover most of the costs. The uncovered costs would be $243,762. Carlson recommended that a $400,000 grant application would be a reasonable request for this size project. Hazen asked about the proposed time frame. Carlson stated that the grant application process would take this construction season, and Phase one could be projected for next year. Bettendorf stated that the phases! yould be changed to meet the needs of the people. . ( . Hiemenzasked if part of the project could be done prior to getting grant money. Vic ,cWestSteel has proposed to move by September 1, 1994. Sadlo asked if part of the project could be done now. Bettendorf stated that it would be possible, but we need to get water installed to the area and that is costly. Mayor Reber stated that he would like to accommodate Vic West Steel. Council discussed the need to make a grant application. Hazen made a motion to request the St. Cloud Area EconOITÚc Development Partnership to begin the grant application process and to work with the railroad and property owners and Vic West Steel to set up a special meeting; seconded by Rieke. Bill Fahrney of St. Cloud EconOITÚc Development Partnership thanked the Council for joining the Partnership and stated that they are anxious to work with the City on this project. He also stated that the County needs to be included in this project and Council agreed that he should meet with the County Engineer and Bob Swanberg, and with Vic West Steel, to discuss plans. DBL LABS: Mayor Reber stated that he met with Jerry Hirschfeld concerning the hookup :-tharges< Jerry had told hiln that initially he was told that their total cost of the roject was to be $175,000. The additional billing for hookup charges was a shock, __ ut he was willing to pay $7,000 for hookup charges to finalize this issue. Hirschfeld also had told Mayor Reber that they are expecting an increase in jobs at DBL Labs. Rieke made a motion to accept the $7,000 as a final amount for hookup charges for DBL Labs and close the issue; seconded by Hiemenz. Ayes: Reber, Rieke, Hazen, Hiemenz. Nayes: Loso. Motion carried. PUBLI C HEAR ING .:: DEL INCUENT UT I LI TY BILLS: Mayor Reber opened the hearing to allow discussion on delinquent utility charges. No one appeared to dispute or discuss their delinquent utility bills. Mayor Reber closed the hearing. OPEN TO THE PUBLIC: Neil Loso requested signs to be installed in Clinton Village stating CHILDREN PLAYING. Hazen made a motion to purchase and have maintenance install two signs that state CHI~1 PLAYING, in Clinton Village, one on Sixth Avenue r-NJ and one on Seventh Avenue NW. The motion was seconded by Hiemenz. Ayes: Reber, Rieke, Loso, Hazen, Hiemenz. Nayes: None. Motion carried. Loso made a motion to for a ten minute recess at 8:05 p.m.; seconded by Hazen. Mayor Reber reconvened the meeting at 8:15 p.m. ~ieke stepped down fram his chair at 8:15 p.m. CITY ATTæNEY REPCRTS FENCE OONSTRL~I~J COMPLAINT: City Attorney John Scherer discussed that the fence at 41 5th Avenue NW has been sandblasted since the last meeting. The City had not I I Page 3 tllteqUired Rieke to do that. Scherer stated that at this point, in order to start an ction, the City would have to get another sample to show if the creosote is, gone and the problem resolved. The height of the fence will be detennined by the final _landscaping. Also, Dale Haug probably has not established the property lines. Rieke stated that h~would not be cannenting during this discussion. Loso stated that the Council rescinded the building pennit, and this should be followed through. Reber also stated that the City should follow through on the testing, and that he received calls on the sandblasted material that landed on the neighbors properties. Scherer stated that the city does not regulate air environmental concerns, but would help find the appropriate state or federal agencies. Hazen made a motion to have a second san¡>leof the fence taken for evidence, and to request to have the results by the next Council meeting; seconded by Hiemenz. Discussion - Scherer asked Rieke if he had any objection to having another sample taken. Rieke stated that he would consult his attorney and then contact the City. Ayes: Reber, Loso, Hazen, Hiemenz. Nayes: None. Motion carried. Rieke resuned his chair. LINNEMANN I~N: Scherer stated that he has talked to both partners of the Linnemann Inn and would like to get the issues resolved. Scherer stated that Lindgren had assured him that he would put together a parking lot plan. Hazen made a motion to send a letter to both partners of the Linnemann Inn requesting specific detailed plans of the parking lot, with fire lanes, surface, and signage detailed on the plans. Loso is preparing a letter, in his capacity as Councilor, to the Attorney General asking an opinion. John Scherer stated in order to get an opinion the letter will have to came fran the City. The Council agreed to have Loso draft a letter for them to consider, to be sent from the City to the Attorney General. BASEBALL PARK: Pat Schneider appeared before the Council to request purchasing used bleachers for the Baseball Park. The existing bleachers are in need of much repair. The bleachers which are available are from Sauk Rapids School. Pat Schneider is seeking donations also from the local service clubs. PARKI~ LOT: Mark Làmbert, representing Summit Management, Inc., requested that the Council allow him to lease the easterly portion of the property by the water tower for overflow parking for the apar~ents. He proposed a lease rate of $500 per year, with the tenn to be one year. Summit is willing to construct and maintain a crushed rock parking lot for approximately 36-40 cars. The land north of the parking lot will be used to pile snow in the winter months. Summit will remove the snow and maintain the grass surrounding the parking lot. Summit will provide.$I,OOO,OOO liability policy naming the City as co-insured and will indemnify the City for any - claims or damages. Hazen requested consideration of the affect on the lighting I)roject. Loso stated the need to protect the Civil Defense Siren. Lambert stated - that he will have his builders make protective provisions when they are in the area doing other construction. Hiemenz asked where the overflow snow would go, and stated that the City may need to have more area to deposit hauled snow. ST JOSEPH RECREATIONAL ASSOCIATION: Gary Schleicher representing the St. Joseph Recreational Association~ appeared before the Council to discuss the Recreational Associations plans for Millstream Park softball area. They plan to move the outfield fences back. Schleicher asked for both financial help and assistance from the Maintenance Depar-tment , of both equir:rnent and labor. Loso stated that the Park Board is willing to give up $3,200 out of the original seed money for developing Millstreæn Park, which has been rebnbursed, and made a motion to approve up to $3,200 plus assistance by the City Maintenance Employees and equir:rnent ~ ~ ~~ p~. Schleicher also stated that the Recreational Association is considering future development of additional parking in the area now used as the practice field. Council stated that when additional parking is necessary, they should take their plans to the Park Board for recommendation to the Council. GAMBLING LI~JSE: The St. Joseph Recreational Association requested approval for an application for a gambling license at the La Playette. Council requested to receive tIIr. recommendation fram the City Attorney, prior to action on this matte~. MEETING CRa..JNDS: Mr. & Mrs. Jim Smith and Mr. & Mrs. John Smith appeared before the Council for approval of their plans for their coffee house, which has been considered and recommended by the Planning Commission. Hiemenz stated that the Planning Commission had discussed their plans and approved them, after confinning that there is no prohibition of tables on sidewalks or awnings. Hazen made a motion to approve the Plans for the Meeting Grounds as recommended by the Planning Commission, as follows: 1. The use of 6.5 feet of the sidewalk in front of the establishment for outdoor tables. 2. The addition of a retractable awning. 3. Placement of a handicap loading zone sign directly in front of the Meeting Grounds. The motion was seconded by Hiemenz. Ayes: Reber, Rieke, Loso, Hazen, Hianenz. Nayes: None. Motion carr ied. MAYCR ,REPCRTS : 1) A Maintenance employee approached the Mayor concerning the problem of dogs, when water meters are being read. The Mayor will get suggestions fram the Maintenance Department. 2) The overhead projector cabinet has been corrected. 3) The sidewalk fram the alley to First Avenue SE, by the Gretch Barber Shop, is icy, because it is a shaded area. The Y~yor is having Joe Bettendorf look at it for suggestions. 4. ) The Police parking in front of city hall needs to be signed better. "No Parking Between Signs .. signs will be ordered and installed. 5) Mayor requested that notice is sent to property owners of the three residences that have toilet tissue allover their property. 6) Mayor stated that he got five responses fram employees, four willing to take the DISC training and one not willing to take the DISC Training that is proposed by Dick Molohon to give to the employees. Hiemenz stated that due to the recommendations of the City Attorney, all employees that the Council requests to take the training should be required to take it ~~g Jte.g~ ~ hOWlh. Motion carried. 7) Mayor Reber presented a resolution on Unity Day which is a resolution that the Minnesota Cities are united with the League of Minnesota Cities in their recommendations to the legislature. Hazen made a motion to approve City Unity Day Resolution; seconded by Rieke. Ayes: Reber, Rieke, Loso, Hazen, Hiemenz. Nayes: None. Motion carried. 8) A letter was sent to Senator Bertræn and Representative Dehler that the City is opposed to any unfunded mandates for the Cities. .. MEMBERS OF TI-JE CGJNCIL REPCRT RIEKE: 1) Nelson Lance, 109 E Minnesota Street, contacted Rieke abou1 the sidewalk in his area. Rieke recommended that the City place a high priority in replacing the --~idewalk on that block. It is in need of replacement, and should be replaced this ear if any sidewaik projects are done. 2) The Planning Commission minutes indicate that a property owner was to be sent a certified letter requesting his appearance at a Planning Commission meeting. The office staff is to check with the League and request a partial refund on the subscriptions, for the period of time which they were not received. LOSO: -1) The Personnel Comnittee interviewed ùght. individuals for the tanporary maintenance positions. The Cornrrúttee recomnended and Loso made a motion to hire Vernie Dahl uto start on April 11 and Yvonne Schreiner to start on May 2, both at $5.20 per hour; seconded by Rieke. Motion carried. 2) Last year an attempt to raÎse money for summer recreation tee shirts was unsuccessful. Loso recommended to allocate $1,000 for summer recreation tee shirts, and to have the Deputy Clerk review areas of the budget where this amount could be re-allocated and make recommendations to the Council. 3) ADA requirements will be reviewed and recommendations made by the Park Board soon. ~I~1Z: 1) Hiemenz stated that he attended a Stearns County Planning & Zoning ~eting. They reviewed proposed changes to the zoning ordinance. The major changes ~effected the rural areas, with more review of plats required, particularly in sewage treatment proposals. The Wetlands Act affects the Cities. 2) The Planning Cornrrússion met and held a public hearing on a proposal by HF"~ to consider a special use pennit to allow R-2 use in an R-3 zone. The public in attendance was unfavorable to the proposal, citing possible increased neighbor problems, due to increase in density. The neighborhood residents intend to came back to the Planning Commission to consider requireme~ts to reduce the allowable population density. 3) Terry Schmid proposed Northland III. The Planning Cornrrùssion recommended approval of the final plat of Northland III as presented. Loso and Hazen both questioned the change in location of the park land. Planning Commission Enforcement Authority. Currently the Planning Commission does not have the authority to enforce the Ordinances. The Zoning Ordinance, at section 52.5 specifically provides for enforcement by the city Council. Ordinance 25, which establishes a Planning Commission, does not extend any enforcement authority. Finally, if you look at Minn. stat. § 462.362 which provides for enforcement of zoning ordinances, it is provided that the "municipality may by . Ordinance provide for enforcement of ordinances or regulations adopted" under the zoning and Subdivision statute. This is not to say that the City Council does not have the authority to grant the Planning commission certain enforcement power. Authority may be delegated by amendments to the Zoning and Subdivision ordinances as well as Ordinance 25. For some reason the advertising was not put up for this event. 3. Missions Statement Revision: This was tabled ~e to lack of representation from the committee. 4. Meditation Proposal: Good idea if it ever got going. 5. Budget: Wasn't discussed. 6. Other matters of concern: none 7. Next Meeting: We decided that next meeting would be the last and it would have 3 objectives: a). Acknowledge leadership within the committee. b). Do an evaluation of the year and how the committee could be more effective. c). Have new members learn about the committee for next year. This meeting would be somewhat of a celeration of our accomplishments for the year, therefore it would be a potluck, in which current members would bring some type of munchie food.
