8 a. Council is required to approve the election judges for the
primary to be held September 13 and general election to be held
November 8. A list of them is in your packet.
. b. The Council approved a three year proposal for the years 1992,
. 1993, 1994 fiscal year.
9 b. Mark Twain Cablevision brought in a check for $2,500 as first
payment for access equipment.
9 i. Proposed dog ordinance is enclosed. I will send out samples
of proposed terminology to control dog waste on property other than
the dog owner1s property.
12. Karen Erickson brought in information (enclosed in packet) from
the dog owners that want to have three dogs.
15. Letter from John Scherer on HRA is included in your packet.
Also included in your packet is
1. a copy of the gambling revenue report for the Confidence
Learning Center which held a license at the LaPlayette. This
is FYI.
2. Followup from the 7-21-94 meeting.

Dear Ms. Stapleton:
We are prepared to audit the City's general purpose financial
statements as of and for the year ending December 31, 1994, subject
to the City Council's approval.
Our audit will be made in accordance with generally accepted
audi ting standards and will include tests of the accounting records
I of the City of St. Joseph and other procedures as we consider
necessary to enable us to express an unqualified opinion that the
financial statements are fairly presented, in all material
respects, in conformity with generally accepted accounting
principles. If our opinion is other than unqualified, we will
fully discuss the reasons with you in advance.
Our procedures will include tests of documentary evidence
supporting the transactions recorded in the accounts, and may
include tests of the physical existence of inventories, ,and direct
confirmation of receivables and certain other assets and
liabilities by correspondence with selected individuals, creditors
and banks. We will request Written representations from your
attorneys as part of the engagement, and they may bill you for
responding to this" inquiry. At the conclusion of our auàit, we
will also request certain written representations from you about
the financial statements and related matters.
An audit is based primarily on the selective testings of accounting
records and related data; therefore, our audit will involve
judgment about the number of transactions to be audited and the
areas to be tested. Because we wïll not perform a detailed audit
of all transactions, there is a risk that material errors,
irregularities, or illegal acts, including fraud or defalcations,
may exist and not be detected by us. We will advise you, however
of any matters of that nature that come to our attention. Our
. responsibility as auditors is limited to the period covered by our
audit and does not extend to matters that might arise during any
later periods for which we are not engaged as auditors.

We understand that you will provide us with the basic information
required for our audit and that you are responsible for the
accuracy and completeness of that information. We will advise you
about appropriate accounting principles and their application and
will assist in the preparation of your financial statements, but
the responsibility for the financial statements remains with you.
This responsibility includes the maintenance of adequate records
and related controls, the selection and application of accounting
principles, and the safeguarding of assets.
We understand that your employees will type all cash or other
confirmations and prepare various schedules we request and will
locate any invoices selected by us for testing.
Our charges for these services will be based on the time of
partners and staff members participating in the engagement, but
will not exceed $ 6,800. If at any time during our audit, any
extraordinary matters come to our attention and an extension of our
services appears to be required, we will do so only after
consultation with you.
If these arrangements meet with your approval, please sign the I
duplicate copy of this letter in the space provided and return it

That Ordinance 104 of the St. Joseph Code of Ordinances is rescinded and the following

Section 1043~: DOGS:A1Thtf~ NOT TO BE PERMITTED TO RUN AT LARGE, It
shall be unlawful for'the owner"ôf"'~~y"Jeg gwmw to permit the same to run at large anywhere in

the City of St. Joseph other than the property of the owner thereof.
Section 104.+%: ALL DOGS TO BE LICENSED - FEE. It shall be unlawful for any person
to own or harbor anÿ dog or dogs within the corporate limits of the City of St. Joseph without
having first obtained a license as herein provided. Any person who desires to maintain or preserve
any right or property in such dog or dogs shall annually procure a license for the dog so owned or
harbored. The annual license fee shall be in an amount as established by resolution of the City I
Council shall be paid to the City Clerk. No license fee shall be required for any dog which is less
than three (3) months old, No person shall operate a dog kennel within the corporate limits of the
City of St. J oseph,ünd no more than two (2) dogs (over three months old) shall be lecpt in üny

Section 104.~: ~~ LICENSES TO BE GRANTED BY CITY CLERK. A dog license
shall be granted upon päÿffieÏlt to the City Clerk of the fees above provided and shall continue to
be in force until the 1st day of April next succeeding the date of its issuance.
Section 104.4$: APPLICATION FOR DØi.$ LICENSE. In applying for a dog license, the

owner shall state in writing the name, sex, breed, age, color and marking of the dog for which the
license is to be procured on forms provided by the City Clerk. Every application for a license shall
be accompanied by a certificate from a qualified veterinarian showing that the dog to be licensed
has been given a vaccination against rabies,
Section 104.$9:: EVERY DOG TO WEAR A COLLAR. Every dog so licensed, must wear
a collar around its neck, to which shall be attached a metal tag, distinctly marked with the year in
which the same is issued, and a number designated by the City Clerk, which number shall be stated
in the license granted. Such metal tag shall be furnished by the City, and no other tag shall be
issued as a substitute therefore, except that in case any person owning a dog states in writing to the
City Clerk that the license tag theretofore issued has been lost, the City Clerk shall be permitted
to issue to such person a new tag upon payment by the applicant of the sum of Three Dollars ($3)
to the City Clerk. The new tag shall be in the same form as the original tag, It shall be unlawful .
for any person to make, sell, purchase or transfer in any way any such tag or counterfeit the same
in any manner, or to place or permit to be placed any tag so made, sold, purchased, transferred or
counterfeited, upon his dog or any dog in his custody or keeping or to place or permit to be placed

. any tag issued as aforesaid upon any other dog than the one for which such tag was originally issued
by the City Clerk.
Section 104.~: RECORD OF LICENSE. The City Clerk shall keep in a book to be
provided for that purpose, a record of all dog licenses issued with the name and residence of the
person to whom issued, and the number designated upon the metal tag furnished therewith.
Section 104.+.~: SEIZURE OF UNLICENSED DOGS. It shall be lawful for the dog license
inspector or any of his duly authorized assistants or any peace officer or any person duly authorized
by a member of the Board of Health to capture, seize and deliver to the dog license inspector, or
the keeper of a public pound any dog owned, harbored or permitted to run at large in violation of
the provisions of Sections 1, 2, 5 or 10 of this Ordinance.
Section 104.8}{: POSSESSION OF DOG - HOW RECOVERED. Any dog so seized and
impounded may be redeemed by the owner thereof at any time within five (5) days after such
seizure and impoundment upon payment of a penalty in an amount as established by Resolution
of the City Council, and a written statement of ownership, together with proof that a license has
been duly issued for said dog or if no license has been previously issued upon payment of the
license fee together with the aforementioned penalty. If the owner of the dog seized or impounded
under the provisions of this ordinance does not resume possession of said dog in compliance with
the foregoing provisions within five days after seizure or impoundment thereof, he shall forfeit all
right to and property in such dog.
I Section 104.10: IMPOUNDMENT OF DISEASED DOGS OR DOGS SUSPECTED OF
BEING DISEASED. Any dog which has bitten a person in the City of St. Joseph or which may be
suspected of having hydrophobia may be immediately seized whether on or off the premises of the
owner and may be impounded for such period as directed by the Health Officer. All costs incident
to and part of such impoundment shall be paid by the owner of said dog. In the vent the dog is
determined to be rabid said animal shall be destroyed under the direction of the Health Officer.
If the dog is determined not to be rabid, said dog shall be returned to is owner upon payment of
all costs of impoundment. If the owner shall fail to pay the costs of impoundment within five days
after receiving written notice of the amount then the animal shall be destroyed or sold for
impoundment costs. Whenever the prevalence of hydrophobia renders such action necessary, to
protect the public health and safety, the Mayor may issue a proclamation ordering every person
owning or keeping a dog to confine it securely on his premises unless it is muzzled so that it cannot
bite. No person shall violate such proclamation, and any unmuzzled dog running at large during
the time affixed in the proclamation shall e killed by the police without notice to the owner.
Section 104.00::~:î~: ANY PERSON HARBORING A DOG !¥~îr::.~:~:r:~ SHALL BE
DEEMED ITS oWNË1t Any person owning or harboring iHieg M#å!ww!ffor"'ihreë (3) consecu-
tive days shall, for the purpose of this ordinance, be deemed the owne'i"'ihereof, and if that person
be a minor, the parent or guardian of the said minor shall be deemed to be the owner thereof.
Section 104.+lf-Ã: INTERFERENCE WITH OFFICERS OR OTHER PERSONS. It shall
be unlawful for any pëison to molest or in any way interfere with any peace officer, poundmaster,
or any of their duly authorized assistants or with any duly authorized agent or any person
authorized by the Health Officer while engaged in the performance of work under the provisions
. of this ordinance.

shall have the power to order the destruction of any dog g~t::~:::i~nmmrwhich he may deem
dangerous and vicious, whether licensed or not, after three (3fdàysnwnÜefi notice to the owner
thereof, and after affording the owner or keeper of such dog 9f:i::9níl-\::~ßffi1M an opportunity to be
heard. Whenever it shall appear to the satisfaction of the Health Officer that any dog, while
running at large has bitten one or more persons, such dog shall be deemed to be a vicious dog.
Section 104.-8-'Í$: DISPOSmON OF UNCLAIMED DOGS::~. At the expiration
of five (5) days from the time a dog Qt:::iiï is impounded as providedfornillthiS ordinance, if said
dog 9r::':ª-îf has not been reclaimed in accordance with the provisions hereof, it shall be the duty of

humane and approved methods or otherwise disposed of, as directed by the Health Officer.
Section 104.±41:~: PENALTY. Any person violating any of the provisions of the Ordinance
shall be deemed guilty of a misdemeanor.

Re Pemussion to bring our three dogs to St. Joseph when we move to the commumty
To the Members ofthe City Council:
Charlene and I are moving to S1. Joseph on 18 August 1994, When we were informed about the
CIty ordinance limiting households to two dogs. we asked Dr, Karen Erickson and Dr James Poffto
present our request to bring our three dogs with us at the 7 July City Council meeting, We appreciate
vour decisIOn to amend the ordinance to permit evaluations on a case-bv-case basIs Dr, Erickson IS
presenting our case for your review at the 21 July City council meeting and has asked us to wnte a brief
descnptlon of our pets.
· Gus_ the largest is a two year old male golden retriever, He is neutered and is current on all of hIS
vaccinations (receipts enclosed), He weighs 65 pounds, is very quiet gentle, and loves children.
· · Dee Anna is a two year old female Australian cattle dog, She is spayed and is due for all of her shots
in August. We will make sure to obtained them before we move to the city Dee Anna weighs 35
pounds. is very playful (she plays tetch endlessly), and never strays tàr tfom Charlene,
· Zachary is a two year old male miniature dachshund, He is neutered and is current on all of his
vaccinations (he was vaccinated at the same time as was Gus. but we have lost his receipt; a copy of
Dee Anna's heartworm test is enclose to show that Zach is due for his shots in February 1995 like
Gus), Zachary weighs 15 pounds and likes to spend most of his time mdoors,
Our dogs are not noisy, Dee Anna and Zach will bark if a stranger approaches the house, but they stop
after the person has entered the house, None of our dogs has bitten anyone.
Shortly after we move to S1. Joseph, we will be enclosing our back yard with a four foot high
chain link fence with a reinforcing tension wire to prevent Zach ITom squeezing beneath it. This will
allow our dogs to play in our yard without straying and bothering our neighbors, We have solicited
estImates ITom two firms that install fence in the S1. Cloud area and will hire one of them in the first
month that we live at 411 West BIrch S1.
We view our dogs as our fanuly, and take very good care of them. We apprecIate your
consideration of our request to bring our dogs to St. Joseph We hope that your response will be
favorable,

I have received a 'copy of the memo dated July 19, 1994,

800'445·9617 eminent domain proceeding. I have discussed the

representing the HRA. The only reason that the city
has received notice is due to the fact that the city
apparently has a utility easement underneath the
property in question. The HRA would have no intent on

copy of the Resolution amending the Ordinance which may be
published. Upon publication, please provide me with a copy of
the Affidavit of Publication, and I will have the changes made in
the Ordinance Book. If you need anything else regarding that
ordinance, please let me know.
You also raised a question as to whether or not the City may have
some liability for costs incurred by residents due to the changes
in the street numbering system. I do not believe that the city
has any such liability, and I would recommend that you not pay
any bills submitted by residents to cover these expenses.
Finally, I have also enclosed a copy of a letter received from
st. John's University regarding Pinestock. I also received a
personal phone call from the attorney representing st. John's,
Kevin Hughes. On behalf of the University, Mr. Hughes informed
me that the problems created in the city are a real concern of
the University and will be taken seriously be the Administrations
of the two colleges. He felt that the suggestions contained in
my letter of June 23, 1994, warranted strong consideration, and
the Administrations of both colleges would consider other
alternatives for addressing the concerns of the city and its I
residents. I assume that I will receive more information
following the meeting of August 12, 1994. I will keep you and
the City Council advised accordingly.

Dear John:
Since there seems to be considerable confusion with regard to parkland for the Northland plats,
I ran some quick calculations to be sure we're all in agreement (summary is enclosed). The
numbers are approximate, but close.
r have also reviewed the developer's agreement and am enclosing an Exhibit B for incorporation
· into the agreement. Do we also include such things as street signs here? I believe the escrow is
too low. I expect the Engineering costs to be as follows:
Preliminary and final plat review, Council and Planning Commission
presentations, preliminary and final review of construction plans,

Depending on the agreement we reach with the developer, there may be some City cost to
deepen the stonn sewer so it serves the City Park in the future. I am meeting with the Planning
Commission on August 1, 1994 to go over the plans for the park, and will know the following
Tuesday if we need to add anything to the Agreement.
