8 c. The Planning Commission lS hearing this rezoning request
October 3 and will recommend to the Council.
8 d. The Design Team will be in St. Joseph on Saturday, October 8,
at 9:30 p.m. and lS requesting that the Council attend an
informal gathering, location to be determined.
. 8 e. I have not looked up the last increase yet on the Assessor's
salary.
8 f. Park Rental fees currently are set at $50.00. We are
purposing to add 3.25 for the 1995 rental year to them to
cover required sales tax.
8 g. The St. Joseph Community Halloween Committee lS seeking
donations. This is for the Kennedy Elementary/St. Joseph Lab
schools.
9 a. Enclosed In your packet is page one of a letter from John
Scherer dated May 13. Also a letter was sent from my office
July 17 requesting compliance within 30 days.
9 n. Dean Otterson will be sending a notice to set the public
hearing. You need to do this by passing a resolution.
The Noise Violation hearing which was scheduled for tonight has
been rescheduled for October 20th because the property owner did
not receive notice until October 1. He called me today for the
rescheduling.
Also enclosed in your packet is information from John Scherer from
April 15 which discusses allowable use of gambling proceeds.
The Chief of Police has recommended omitting the quarterly meeting
for the Council and Police Department, which was originally set for
. election day.
I received a complaint from Bob at American Manufacturing about the
need for better drainage on Joseph Street. He stated that it
floods with each rain and people are using their parking lot
instead of the street. It is destroying their parking lot.
. August 29, 1994
The City Council for the City of St. Joseph met in Special Session
on August 29, 1994 at the St. Joseph Township Hall at the St.
Joseph Township Board meeting at 9:00 p.m. to receive the appraisal
report from the Appraisal Committee.
Members present were Mayor Donald Bud Reber; Council Bob Loso, Ross
Rieke, Ken Hiemenz, Stephanie Hazen at 9:15 p.m. City Attorney
John Scherer and Clerk/Administrator Rachel Stapleton.
The Appraisal Committee presented the appraisal report with Ken
Hiemenz as spokesperson.
After discussion between members of the Boards, Fire Department and
interested public, Hazen made a motion to proceed with negotiations
and look at options on the Roske property. The motion was seconded
and upon call for a vote the motion carried.
Joe Bechtold made a motion to have John Meyer, Ken Hiemenz and
Bernie Schloemer along with John Scherer work as a negotiation
committee. The motion was seconded by Stephanie Hazen. Upon call
for vote, the motion carried.
City Attorney John Scherer recommended to the City Council to
. ratify the motions at their next regular meeting. Joe Bechtold
requested that the City report back to the Township Board if there
are any changes in the motions.
The City Council meeting ended at 10:15 p.m.

DEAR COUNCIL MEMBERS,
PLEASE FIND ENCLOSED THE AUGUST MONTHLY REPORTS. THERE
ARE SEVERAL ITEMS WORTH MENTIONING. THE FIRST ONE IS THAT 1
HAVE SPENT THE PAST SEVERAL WEEKS WRITING AND APPLYING FOR A
COUPLE OF FEDERAL GRANTS. THEY CONCERN ALCOHOL AND ALCOHOL
· RELATED ISSUES. SUCH AS ILLEGAL USE, SALE, ETC. AND ALSO
TRAFFIC SAFETY. BOTH OF THE GRANTS BASICALLY PAY TO HAVE
UFFICERS WORK OVERTIME HOURS ENFORCING ASPECTS OF ILLEGAL
ALCOHOL USE. I DON'T KNOW HOW WE'LL DO, BUT GIVEN OUR
PARTICULAR COMMUNITY MAKE UP I BELIEVE WE'LL HAVE A GOOD
CHANCE.
LAST MONTH WAS A RELATIVELY ACTIVE MONTH FOR A SUMMER
MONTH. WE ARE APPROXIMATELY 40 CALLS UP FROM AUGUST OF 9~,
AND HAVE CITED AND OR CHARGED NEARLY DOUBLE THE AMOUNT OF
AUGUST 9,a. ADDITIONALLY, THIS PAST MONTH WE HAD AN OFFICER
OFF DUTY ( COMP, VACATION, HOLIDAY HOURS ETC) FOR THREE OUT OF
THE FOUR WEEKS IN AUGUST. SO FAR THIS MONTH, < SEPT. 13, ) WE
HAVE TAKEN APPROXIMATELY 130 CALLS AND CITED OR CHARGED
NEARLY AS MANY PERSONS IN ALL OF AUGUST. <SCHOOL'S BACK IN
SESSION t )
DURING THE MONTH OF AUGUST WE HAD 5 DRIVING COMPLAINTS.
ONE OF THESE CALLS, AN OFFICER (KLINEFELTER) FOUND THE
VEHICLE IN THE AREA OF THE SOUTH EAST PART OF TOWN. IT WAS
APPROXIMATELY 9:20 PM. THE VEHICLE DID NOT STOP, AND BEGAN
TO FLEE. THE VEHICLE STAYED IN THE SOUTH EAST AREA, DROVE
THROUGH AT LEAST ONE YARD WHERE THE DRIVER BAILED OUT AND
TOOK OFF ON FOOT. OFFICER KLINEFELTER PURSUED THE DRIVER ON
FOOT, CAUGHT AND SUBDUED THE SUSPECT AFTER HE JUMPED A FENCE.
SEVERAL RESIDENTS CAME OUT OF THEIR HOMES, SOME ASSISTED, AND
ONE TOOK PICTURES OF THE ARREST. I HAVE PHOTO COPIED THE
PICTURE, AND WILL SHOW YOU THE ACTUAL PICTURE OF THE ARREST
· AT THE COUNCIL MEETING. THE SUSPECT WAS ARRESTED AND CHARGED
WITH SEVERAL COUNTS, FLEEING, D.U.L, OBSTRUCT LEGAL ARREST,
ETC. IT MIGHT ALSO BE WORTH NOTING, THIS HAPPENED ON A
WEDNESDAY NIGHT.

HEARD ADDS SOLICITING MONEY AND OR FAX MACHINES FOR LAW
ENFORCEMENT AGENCIES AROUND THE STATE. GUR AGENCY WAS
AWARDED A FAX MACHINE. IT IS A USED CANNON FAX 230. IT
APPEARS TO 8E IN VERY GOOD CONDITION, AND HAS AN ORIGINAL
VALUE LISTED AT OVER $2,50Ø.00. UNLESS THERE ARE ANY
OBJECTIONS, I BELIEVE THE MOST COST EFFECTIVE WAY OF
INSTALLING IT IS TO CONNECT IT TO THE CITY HALL LINE 363- .
7341, AND NOT PAY THE COSTS OF INSTALLATION OF, AND
MAINTAINING A DEDICATED LINE. THIS LINE RUNS Th~OUGH ùUR
OFFICE, AND IS USED VERY LITTLE. IF ANYONE USED THE PHONE
DURING THE FAX THEY WOULD JUST GET A TONE FOR THE MINUTE OR
TWO IT WAS IN USE. AGAIN, UNLESS THERE ARE ANY OBJECTIONS TO

TO THE ISSUE OF POLICE, AND LAW ENFORCEMENT COVERAGE. WE
HAVE NOT MET AS OF YET, (SEPT 13TH) HOWEVER, I IMAGINE WE
WILL IN THE NEAR FUTURE. IN THIS LIGHT, AND AS THESE MONTHLY
REPORTS ARE PUBLIC INFORMATION, I THOUGHT IT MIGHT BE
APPROPRIATE TO SEND COPIES OF THIS LAST MONTHS INCIDENT AND
ARREST REPORTS TO THE TOWNSHIP CLERK AND SUPERVISORS.

AND MUCH WORK WENT INTO IT. THE GOOD NEWS IS WE GOT IT. A
COpy OF THE LETTER OF ACCEPTANCE IS ENCLOSED. THE TOTAL
GRANT IS FOR $31, ØØ0. Ø0. IT IS A FEDERAL GRANT ADMINISTERED
THROUGH THE MINNESOTA DEPARTMENT OF PUBLIC SAFETY. THE
PROGRAM IS CALLED SAPE & SOBER, IT TAhGETS ALCOHOL AND
ACCIDENT REDUCTION THRO~GHOUT THE YEAR, AND PAYS THE OVERTIME
FUNDS FOR OUR OFFICERS TO WORK IT. DUE TO THE SIZE UF THE
GRANT, WE WERE GOING AFTER, OUR LOCATION, AND TO INCREASE OUR
ODDS OF OBTAINING IT, WE SUBMITTED A JOINT GRANT WITH WAITE
PARK. I BELIEVE THERE WERE A TOTAL OF ONLY 14 GRANTS AWARDED
AROUND THE STATE. WE WILL SHARE THE GRANT EQUALLY WITH WAITE
PARK. THE MAJOR ENFORCEMENT AREAS THAT WILL BE COVERED
THROUGHOUT THE YEAR ARE C.R. 75 HERE & IN WAITE PARK, C. R. ¿
HERE, AND HIGHWAY 23 IN WAITE PARK. WE WILL BE WORKING
TOGETHER ONLY IN THE FACT THAT ALLfHESEROADS wILL 8E
COVERED, ; WAITE PARK WILL COVER THERE'S & WE'LL COVER OURS.
THERE WILL ALSO BE NEWS RELEASES, ARTICLES, ETC. PRIOR TO AND
AFTER PEAK ENFORCEMENT PERIODS. IF WE ARE SUCCESSFUL, WE
WILL BE ABLE TO RECEIVE FUNDING FOR AT LEAST NEXT YEAR, AND

IN SPEAKING WITH BOB HEIM RELATIVE TO THIS TOPIC I
THOUGHT IT MIGHT BE IMPORTANT TO WRITE UP AND LIST
APPROXIMATE COSTS, MANPOWER, EQUIPMENT, AND THE RATIONAL THAT
GOES BEHIND IT. VERSUS, WALKING INTO A MEETING COLD, AND
. DUMPING A TREMENDOUS AMOUNT OF FACTS FIGURES AND COSTS.
MANY PEOPLE ARE UNAWARE OF THE NUMBER OF CALLS, ARRESTS,
CITATIONS, TALKS, AND OTHER SERVICES OUR POLICE DEPARTMENT
PROVIDES. MANY PEOPLE ARE ALSO UNAWARE OF THE NUMBER OF
POLICE OFFICERS ST. JOSEPH EVEN HAS. AS YOU NOW KNOW, ST
JOSEPH HAS 5 POLICE OFFICERS. THIS IS THE LOWEST AMOUNT OF
OFFICERS IN THE 5 CITY ST CLOUD METROPOLITAN AREA.
CURRENTLY, WAITE PARK IS SCHEDULED TO HIRE MORE OFFICERS
JANUARY 1, 1995. I HAVE INCLUDED THE LAST TWO MONTHS OF ST
JOSEPH POLICE DEPARTMENTS REPORTS TO THE CITY COUNCIL WITH
THIS LETTER. I HOPE THIS SHEDS SOME LIGHT AS TO WHAT WE DO,
THE SERIOUSNESS OF MANY CASES, AND THE AMOUNT OF WORK WE
CURRENTLY DO.
OUR DEPARTMENT TAKES GREAT PRIDE IN THE ABILITY TO DO
OUR JOB IN THE MOST POSITIVE, CONSTRUCTIVE, EFFECTIVE, AND
PROFESSIONAL MANNER AS POSSIBLE. FROM NEIGHBOR DISPUTES AND
DOG BARKING COMPLAINTS TO FELONY ASSAULTS, BURGLARIES, RAPES,
ROBBERY, ETC. ETC.
IN OUR INCIDENT REPORTS THERE IS A CATEGORY FOR AGENCY
ASSISTS, THIS INCLUDES WAITE PARK, STEARNS COUNTY SHERIFF'S
DEP ARTMENT , OTHER LAW ENFORCEMENT AGENCIES, SOCIAL SERVICES,
ETC. WE AVERAGE APPROXIMATELY 15 ASSISTS A MONTH (150 TO 175
A YEAR). AS YOU ARE PROBABLY AWARE, MANY OF THESE ARE IN THE
TOWNSHIP IN EMERGENCY SITUATIONS WHERE EITHER PUBLIC OR
OFFICER SAFETY IS AT ISSUE. CALLS SUCH AS SERIOUS VEHICLE
ACCIDENTS, PHYSICAL DOMESTICS IN PROGRESS, MAN WITH A GUN,
. ETC. ADDITIONALLY, IF THERE IS NOT A COUNTY CAR CLOSE ON
OTHER CALLS, WE WILL ASSIST WITH THE CALL. SAME THING WITH
THE STATE PATROL AND INCIDENTS ON 194 WHEN THE COUNTY IS ON

OTHER CALLS, OR NOT CLOSE. THERE IS ANOTHER ASPECT TO, AT
LEAST BE AWARE OF. IT MIGHT SOUND TRITE AT FIRST, BUT WHAT I
ADDRESSED PREVIOUSLY IN TAKING PRIDE IN OUR ABILITY, ETC.
EACH OF OUR OFFICERS ARE VERY POSITIVE, AND LIKE THE IDEA OF
POSSIBLY COVERING THE TOWNSHIP IN THE FUTURE. ALMOST IN THE
SAME BREATH IS THE QUALIFIER, IF WE HAVE THE PROPER MANPOWER
AND EQUIPMENT. WE AS PUBLIC OFFICIALS, MUST SERIOUSLY
CONSIDER THIS LAST SENTENCE. WITHOUT THE PROPER MANPOWER AND
EQUIPMENT, WE WOULD BE DOING A GREAT DISSERVICE TO THE
CITIZENS WE CURRENTLY SERVE, INADEQUATELY, AND HENCE
UNPROFESSIONALLY ATTEMPTING TO SERVE A MUCH GREATER AREA AND
PROBABLY AS MANY CITIZENS. THE BOTTOM LINE IS, IF WE ARE
GOING TO DO IT, LETS DO IT RIGHT. WE OWE IT TO OURSELVES AND
THE CITIZENS WE ALL SERVE.
I HAVE TRIED TO COME UP WITH REALISTIC NUMBERS AND
FIGURES. THEY ARE GOOD FIGURES WHEN COMPARED TO WHAT IS
BEING ACCOMPLISHED, VERSES CONTRACTING OR FORMING ANOTHER
DEPARTMENT. I HAVE BEEN UNABLE TO OBTAIN LAW ENFORCEMENT
STATISTICS FOR ST JOSEPH TOWNSHIP FOR 1993. I DO RECALL THE .
TOWNSHIP STATISTICS FOR THE YEAR PRIOR THOUGH. ST JOSEPH
TOWNSHIP WAS THE SECOND LARGEST AREA FOR POLICE SERVICE
CALLS, BEING JUST BEHIND ST CLOUD TOWNSHIP, FOR THE STEARNS
COUNTY SHERIFF'S DEPARTMENT. IT WAS AROUND 600 OR 70Ø CALLS,
INCLUDING FATAL ACCIDENTS, BURGLARIES, RAPE, ROBBERY,
ASSAUL TS, ETC. ETC. IF WE POLICE THE AREA THE NUMBER OF
CALLS WILL BE HIGHER BY VIRTUE OF: THE CONSTANT PRESENCE OF
POLICE IN THE AREA AND OFFICER INITIATED ACTIONS SUCH AS,
TRAFFIC STOPS, CHECKS ON SUSPICIOUS VEHICLES & PERSONS,
BUILDING CHECKS, ETC. ETC. ADDITIONALLY, EASIER
ACCESSIBILITY TO POLICE OFFICERS. IT IS EASIER TO STOP IN
OUR POLICE DEPARTMENT, VERSES GOING TO ST. CLOUD, OR TO PICK
UP THE PHONE AND DIAL 363-, AND HAVE AN OFFICER TO SPEAK TO
OR ARRIVE IN MINUTES. WE CURRENTLY GET CALLED EVERY WEEK
FROM ST JOSEPH TOWNSHIP RESIDENTS, IN ADDITION TO RESIDENTS
FROM PLEASANT ACRES. NON EMERGENCIES ARE DIRECTED TO THE
COUNTY.
MANPOWER: I HAVE FIGURED 3 ADDITIONAL OFFICERS WITH AN
APPROXIMATE FIGURE OF $30,ØØØ EACH PER YEAR TO COVER SALARY,
INSURANCE, WORK COMP, PERA, ETC. THIS WOULD ON THE AVERAGE
PROVIDE DOUBLE COVERAGE 7 DAYS A WEEK, 20 HOURS A DAY ON 4
DAYS AND 15 HOURS ON THE REMAINING 3, AND ALWAYS HAVE ONE
OFFICER ON AT ALL TIMES. I WOULD ALSO SUGGEST TO SET ASIDE
$lØ,ØØØ FOR PART TIME HELP FOR TWO REASONS. IN THE EVENT WE
NEED TO AUGMENT THE ABOVE HELP DUE TO NUMBER OF CALLS, .
ACTIVITY ETC. ALSO, IN THE EVENT WE NEED TO FILL IN SHIFTS
DUE TO SICK TIME, COMP TIME, HOLIDAY'S, VACATION, ETC. TOTAL

WITH THE MUCH GREATER AREA TO COVER WE COULD EXPECT TO AT
LEAST AVERAGE 100,000 MILES PER YEAR. THIS WOULD EQUATE INTO
1 CAR PER YEAR. THE CITY CURRENTLY BUDGETS $7,000.00 PER
YEAR, AN ADDITIONAL $7,000.00 WOULD COVER A CAR PER YEAR.
(THROUGH STATE BID CONTRACTS WE ARE ABLE TO BUY NEW CARS FOR
UNDER $14,000.00) SAME WITH GAS, TIRES, AND REPAIRS, THE CITY
BUDGETS APPROXIMATELY $7,500, MATCH THIS FIGURE ALSO. TOTAL
VEHICLE COSTS $14,500.
THE CITY ATTORNEYS FEES WOULD ALSO GO UP, BUT WE WOULD
RECOUP MOST OF THESE FEES IN FINE MONEY, HOW YOU WOULD SET
THIS UP, BUDGET WISE, ETC. IS UP TO YOU, BUT IN THE LARGE
PART IT WOULD BE A WASH INSOFAR AS ACTUAL ADDED COSTS. THERE
WOULD ALSO BE A SEVERAL THOUSAND DOLLAR OFFICER START UP COST
. FOR INITIAL UNIFORM, NEW WEAPONS, BADGES, PORTABLE RADIOS,
ETC AND A COUPLE OF THOUSAND FOR CONTINUED TRAINING.
REMEMBER WITH TRAINING WITH MORE OFFICERS, THE MORE FUNDS WE
RECEIVE BACK FROM THE STATE. AROUND $400.00 TO $500.00 PER
OFFICER.

ALREADY OPERATIONAL, WE HAVE BASE & MOBILE RADIO'S, 2 SQUADS,
EQUIPMENT, COMPUTERS, DESKS, PHONE SYSTEMS, AND THE ACTUAL
PHYSICAL POLICE DEPARTMENT TO OPERATE FROM. THE BASE IS
PAID, SET UP, AND CURRENTLY OPERATING. IF THE TOWNSHIP
. STARTED IT'S OWN POLICE DEPARTMENT (WITH THREE OFFICERS) IT
WOULD CONSERVATIVELY COST DOUBLE THE FIGURE ABOVE, AND
WOULDN'T HAVE NEARLY THE COVERAGE, MANPOWER, AND EQUIPMENT WE
ALREADY HAVE.
CONTRACTING: THE FIRST THOUGHT IS ,IN THE EVENT OF A

THAT CITIES CRIME. THE CITY POLICE AGENCY IS THE PRIMARY LAW
ENFORCEMENT AGENCY, THE CRIME IS REPORTED, CALCULATED, AND
ENTERED BOTH STATE AND NATIONALLY AS THAT CITIES CRIME. IT
IS CODED, ENTERED AND TRACKED BY THAT CITIES NATIONAL NCIC
IDENTIFICATION NUMBER, ETC. OTHER AGENCIES MAY COME IN AND
ASSIST, BUT THAT IS ALL WHAT IT IS, ASSISTING THE ORIGINATING
AGENCY WHO, HAS THE PRIMARY RESPONSIBILITY OF THAT CASE'S
INVESTIGATION. I DON'T KNOW HOW THE TAXES WOULD WORK IN A
MERGER BUT WOULD DIFFERENT RESIDENTS BE TAXED DIFFERENTLY
DEPENDING ON WHO WAS THEIR LAW ENFORCEMENT. ANOTHER THOUGHT
COMES TO MIND, IF THE CALL COMES IN SAY A QUARTER MILE AWAY,
IN A CONTRACT DISTRICT, AND THERE IS NO ONE TO COVER IT, WHO
DOES, DO WE? ARE WE OBLIGATED TO UNDER LAW? I DON'T KNOW? I
DO KNOW THAT IT WOULD BE VERY DISRUPTIVE TO THE OFFICERS OF
THE AGENCIES TAKING THE CALLS, AND NO DOUBT TO THE CITIZEN
WHO PLACED THE CALL. e
FINALLY COSTS, I BELIEVE THE CURRANT CONTRACT PRICE WITH
THE COUNTY IS $30.00 PER HOUR. TAKING AWAY ALL OF THE AFORE-
MENTIONED ADVANTAGES, AND COMPARING HOUR PER HOUR 7 DAY A
WEEK 24 HOUR COVERAGE FOR 1 CAR WOULD EQUAL:

SUMMARY PUBLICATION OF ORDINANCE 42 OF TIlE
ST. JOSEPH CODE OF ORDINANCES: SEWER USE ORDINANCE
. The City of St. Joseph has enacted Ordinance 42, entitled "the Sewer Use
Ordinance". This Ordinance sets forth uniform requirements for the discharge of waste into the
sanitary sewer system owned and operated by the City of St. Joseph. Included among the matters
regulated by this ordinance are the following:
a. Regulation of private sewage disposal systems.
b. Regulations regarding connection to the City sanitary sewer system.
C. Establishment of a' sewer hook-up charge.
d. Permit requirements for industrial waste generators.
e. Prohibited discharge into the sanitary sewer system.
f. Pre-treatment requirements of waste prior to discharge into the City's
sanitary sewer system.
. g. Accidental discharges of slug and other matters into the system.
h. Monitoring, inspection and sampling requirements with regard to discharge.
1. Enforcement provisions of the Ordinance.
J. Penalties for violation of the Ordinance.
A printed copy of the entire text of the Ordinance is available for inspection at the
office of the City Clerk for the City of St. Joseph during regular business hours. A copy of the
Ordinance is also publicly posted at St. Joseph City Hall for public inspection.
This Ordinance was adopted by the City Council the day of

Pursuant to due call and notice thereof, the City Council for the
City of St. Joseph met in special session on Wednesday, September
28, 1994 at 7:00 p.m. in the City Hall.
MEMBERS PRESENT: Mayor Donald Bud Reber; Councilors Bob Loso, Ken
Hiemenz, Stephanie Hazen, Ross Rieke; Clerk/Administrator Rachel
Stapleton.
OTHERS PRESENT: Dick Taufen, Al Stellmach, James Marthaler, Jeffrey
Young, Ray Bechtold, Mike Sworski, Judy Weyrens, Mary Generous.
Mayor Reber called the meeting to order at 7:07 p.m. and stated
that the purpose of the meeting is to discuss a Special Use Permit
request, Local Government Radio Frequency, and the 1995 Wage and
Benefit Package.
Minutes from the September 28, 1994 City Council meeting.
SPECIAL USE PERMIT REQUEST: Al Stellmach discussed with the
Council, his and his partner, Steve Hoffmann's request to renew the
Special Use Permit of June 17, 1993, which allowed construction of
183 cold storage units on the property legally described as Lot 3,
. Block 1, Neu Addition. The Council approved the extension for one
year of the Special Use Permit request as recommended by the
Planning Commission, with a motion by Hiemenz¡ seconded by Rieke.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
LOCAL GOVERNMENT RADIO FREQUENCY: Dick Taufen discussed that the
local government license for the radio frequencies needed to be
renewed or to reapply for a license since the current one has
lapsed. Taufen indicated that this license covers the local
government frequencies including the police frequency. Hazen
questioned why it had lapsed. Taufen indicated that the license is
for a four year time period and it was unclear where the forms were
sent. The Police Chief had indicated to Dick that he had sent in
forms of application for the frequencies, but had not received a
response yet. The Council discussed prevention of this type of
occurrence in the future. Hiemenz questioned if this is the same
frequency that Waite Park uses. Taufen indicated that it is.
Hiemenz made a motion to reapply for the frequencies; seconded by
Rieke. Discussion - Loso requested that the notification process is
investigated.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.

1995 , WAGE AND BENEFIT PACKAGE: Bob Loso, for the Personnel
Committee discussed the employee requests and the Personnel
. Committee's recommendations. He discussed the regular employees

requests and recommendations along with the items that effect all .
employees first with the Police Federation requests fOllowing. The
following items which state all employees includes the Police
Federation.
1. Wage increase - Employee request was 2.5% January 1 and an
additional 2.5% July 1. Committee recommendation was 1.5% in
January and 1.5% in July. Mayor Reber made a motion to approve
the Personnel Committee's recommendation of wage increase of
1.5% January 1 and 1.5% July 1; seconded by Rieke. Hazen stated
that this increase is to be spread throughout the entire step
system.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
2. Employee request and Committee recommendation - Reduce the
employee participation in health insurance premium to 15% of
total premium / for all employees. Hazen made a motion to
approve the Employees request and Committee's recommendation to
reduce the employee participation in the health insurance
premium to 15%; seconded by Rieke.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
3. Dental coverage - Not all employees are in favor of having
full dental coverage but the Committee recommended that it is .
offered with the City paying at the same rate of 15% as health
insurance. As a group, all the employees would be required to
have this insurance if it is offered. Discussion with the
employees present indicated that the employees would be paying
less than they currently are paying for the full premium on
preventative dental. Most of the employees present indicated
that they were not opposed to this benefit. Hazen stated that
she was in favor of full dental coverage as a majority of the
employees want it and made a motion to approve it; seconded by
Rieke.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
4. Retroactive longevity pay for years prior to 1989, request
was for $20 per year (currently it is at $10 per year prior to
1989), requested by employees and recommended by Committee.
Mayor Reber moved to approve the request for all employees;
seconded by Rieke.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
5. Callout policy requested by employees would return it to a
two hour minimum. The Committee did not recommend. Hazen asked
the reason for the increase. Marthaler stated that it should be
worth two hours to the City for an employee to be called back to
handle equipment or safely problems. Call outs require that the.

. employee leave whatever he is doing, change clothes go to the
problem, take care of it, clean up after it is taken care of and
return home. The equipment and safety are costly items to the
city and it should be worth two hours overtime. Mayor Reber
indicated that most ca110uts are in the winter and will take
longer than a few minutes. It was clarified that the two hours
minimum is at time and one half. Loso made a motion to approve
the request; seconded by Rieke.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
6. Floating holiday in honor of birthday requested by the
employees (Federation employees already have this.) Mayor Reber
made a motion to approve the request; seconded by Hazen.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
7. Request to increase sick leave to 10 hours per month. The
Committee recommended denying this. Council discussed putting
a cap of 96 hours per year on sick leave earned, as is the
current amount with 8 hours per month earned. After further
discussion Hazen made a motion to support the Committee's
recommendation to deny the request; seconded by Loso.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
. 8. Request for uniform allowance for office staff; Committee
recommended denial. Council discussed with office employees who
stated that the other employees get uniform allowance and some
other cities have begun this practice. Mayor Reber stated that
the office clothes can be worn outside of work. Other employee
uniforms would not be appropriate clothing off the job. Hazen
made a motion to deny the request¡ seconded by Loso.
Ayes: Reber, Rieke, Loso, Hazen, Hiernenz.
Nayes: None. Motion carried.
9. Request for comp time calculated at one and one half time for
all employees is already implemented.
Hazen requested to talk about exempt non-exempt employees later in
the meeting.
Loso discussed the cost to the City on the items as they are
figured. He stated that the total package increase is $12,405.52.
Loso then presented an amendment to the Personnel POlicy manual to
clarify training and education hours to be paid. After discussion
of the need to clarify that any hours of training beyond the
mandatory training hours must be approved by the Council. Also
approved was to pay overtime for training hours outside the regular
. work hours along with transportation time be paid. Mileage will be
paid at the current IRS rate.

paragraph of the amendment "Any training above the mandatory 48
hours in three years for police officers shall be subject to
Council approval, and the first pp should be added to the paragraph
in the personal manual.

reviewal to the policy; seconded by Rieke.

The Council then considered the Police Federation 1995 contract
requests.
1. Hiemenz made a motion to approve the request, as recommended
by the Committee, to change article 20 DURATION of the contract
to state that the agreement is in effect from January 1, 1994
through December 31, 1994 and shall remain in effect from year
to year thereafter unless either party gives written notice 90
days prior to any anniversary date of its desire to amend or
terminate the agreement. The motion was seconded by Rieke.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
2. Loso discussed the recommended increases as for the regular .
employees. Hiemenz made a motion to approve a 1. 5% increase
January 1 and 1 and July 1 as recommended by the Committee;
seconded by Hazen.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
Officer Jeff Young asked if the Police Federation gets any
input. He questioned the negotiation process. Employees were
requested to give feed back, and they did in a commendable
manner. Rieke stated that the Personnel Committee met with the
employees after receiving their requests and came away thinking
that the only issue left to adjust was wages and felt that this
should be a good year for the employees. Officer Young stated
that the 1.5 per cent increase is considerably less than area
police departments and requested to start the year off with at
least 3.02% increase. Hazen discussed revenue restrictions and
that the City receives LGA and Taxes mid year, as a response to
the mid year increase. Loso stated that the Personnel Committee
requested specific reasons for the wage and benefit increases.
Rieke felt that this was not an arbitrary increase and he feels
this is a fair offer.
3. The Council discussed that the step increases would be
approved on recommendation of the Chief of Police at the
anniversary dates.

6. Police Federation requested to allow sick leave at 10 hours
per month. Hazen made a motion to allow the Federation
employees to accumulate 10 hour of sick leave per month not to
exceed 96 hours per year of accumulation; seconded by Loso.

Nayes: None. Motion carried.
7. Differential Pay change proposed was differential pay will be
applied to regularly scheduled work hours from 5:00 p.m. through
7: 00 a. m. (Not to include overtime hours). It is payable in
multiples of one hour, scheduled between 5:00 p.m. and 7:00 a.m.
of the next day. The rate requested is $.25. Rieke made a
motion to allow the change of hours allowed to 5:00 p.m. through
7:00 a.m. and increase the rate by $.10 to $.20 per hour
differential pay. The motion was seconded by Loso.
Discussion - Hiemenz made a motion to amend the hourly rate to
$.15 per hour differential pay; seconded by Hazen.
Vote on the amendment:

Nayes: Rieke. Motion carried.

8. Uniform and equipment allowance requested increase was by $25
per quarter. Officer Young stated that the Federation was
withdrawing that request. Hiemenz made a motion to accept the
Federation's withdrawal of the clothing allowance request that
they have submitted; seconded by Rieke.

9. Request is to increase Christmas Eve to a full day holiday.
The Personnel Committee's recommendation was to deny. Officer
Young was requested for comment. He stated that this was not a
high priority item. Loso made a motion to accept the Personnel
Committee's recommendation to deny the request; seconded by
Rieke.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
Hiemenz requested clarification that the amendment to the
Personnel Policy manual on training time would apply to all
employees.
. Mayor Reber thanked the Personnel Committee of Loso and Rieke

Hazen requested clarification of the change in exempt non-exempt
employees and the effect. Hiemenz commented on the various
problems and situations, along with allowances to work at home
in some instances, and the need for flexibility. Mayor Reber
asked the Personnel Committee to check with the City Attorney on
this matter.
NORTHLAND ADDITION PLAT THREE AND DEVELOPERS AGREEMENT: Hiemenz
made a motion to approve Northland Addition Plat Three and the
Developer's Agreement¡ seconded by Rieke.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
ASSESSOR'S SALARY REQUEST: Council considered the request of
Ollie Lesnick to increase his salary by the amount of new
properties. Hazen stated that she thought the Council had
increased his salary recently. Council requested that the
assessor's salary increase history be presented to them.
Hazen asked the status of evaluations, and if the Council was
going to do them. Rieke stated that he and Loso have reviewed
some evaluation forms and that he feels inadequate to evaluate
the employees. Mayor Reber concurred. Rieke also stated that .
he felt that the employees should be receiving some feed back
from the Council and talking to the employees. Hazen questioned
if the Council is going to do it or not. Hiemenz stated that a
bench mark should be set for them to let them know what is
expected of them. The Personnel Committee agreed to confer on
this matter.

The courts have also recognized that expenditures must be looked
at on a case by case basis. The circumstances specific to a case
will qovern.
Generally, the Public Purpose Dootrine has ~een broadly
construed. The courts have given great deference to the decision
of a city Council in this regard. There is a presumption that
the expenditure is proper¡ although that presumption is certainly
reÞuttable.
The history of the court decisions reqardin~ this issue indicate
that a broadening of the Public Purpose Doctrine has occurred.
Expenditures which would not have been permissible 70 years ago
now appear to be recognized as a permissible pUblic purpose.
I have had an opportunity to review a copy of the Attorney
General's opinion from 1934 dealing with this issue (AG opinion
1934.99) . That particular issue dealt with the city of
Faribault's intent to make a donation to a community chest fund,
the Faribault Visiting Nurse Association, an~ the Faribault
Baseball Association. The first two organizations were
recognized as incorporated, non-profit associations.
. The city of Faribault was a home rule charter city¡ and the
charter did not specifically authorize an expenditure to a
private charitable orqanìzatìon. Therefore, the Attorney
General's Office reached its conclusion based upon the issue of
public purpose. The Attorney General's office reached the
following conclusion:
"However, we do not believé that the time has
come where the diversion of public funds or
public property to such organizations for the
purpose of carrying on their admittedly good
and quasi public work would be sustained by
our courts in the absence of specifio
statutory Q~ charter authority. . .. .. You are,
therefore, advised that unless expressly
authorized by charter or statutory provision,
a munioipal corporation has no authority to
appropriate or give away public monies as
donations to any person, corporation or
private institution not under ãirect control
of such municipality so making such donation
or appropriation. II
I do wish to point out that this opinion dates back to 1934.
. Certainly, the hard and fast rules once applied witb regard to
the PUblic Purpose Doctrine have sinca been relaxed. From my

research, I am unaware of &ny court decisions dealing with this
type of expenditure having been reported since 1934.
Although I do believe that there are circumstanùês where a
contribution to a private foundation or charitable organization
could have such broad-reaching public benefit to the community as
a whole so as to justify the contribution, I am not convinced
that the contribution requested under these circumstances would
rise to that level of pUblic p~rpose. Therefore, it would be my
recommendation that the Council follow the past recommendations
of the Attorney General's office with regard to the circumstances
currently before the Council.

RE: Part Time help
Due to the unusual fall, I am requesting an extension for the
part time help. We- currently have one part time helper, Gary
Donabauer. I am requesting help for the rollowing reasons:
1. We are busy cleaning sanitary sewers and it takes three
people to do this effectively and sarely.
2. The grass is still growing and needs to be cut.
. 3. The parks have not been closed and need to be cleaned
before closing.
4. Various miscellaneous jobs need to be completed.
Therefore, I am requesting a six week extension, allowing Gary
Donabauer to continue working for an additional six weeks at 30
hours per week.
I am also requesting that the Counci I consider part time help
during the snow season. This would be especially helpful in snow
removal of sidewalks and snow hauling. I have discussed this
matter with Gary Donabauer, and he would be willing to work on an
on call basis, only employing him after a snow fall.

RE: Crosswalk - West of 2nd Ave NW
At the September 15, 1994 City Council meeting I was directed
to paint a crosswalk on the West side of 2nd Avenue NW. As this is
a County Road, I contacted Marv stransky and Doug Weiszhaar of the
County Engineer's Office. They had the following recommendation:
Remove the curb on the south side of Minnesota street and
install a handicap ramp and a section of sidewalk to meet the
one that is there.
. They will not go along with a crosswalk dumping on the street
ramp that is currently in place. What are the wishes of the
Council?

On Tuesday, October 18,1994, beginning at 1:00 p.m. the Stearns
County Board of Commissioners shall hold a public hearing regarding
Stearns County Ordinance Number 170. The public hearing will be
held in the County Board Room, Stearns County Administration
Center, 705 Courthouse Square, St Cloud, Minnesota.
. The purpose of Ordinance 170 is to amend Stearns County Ordinance
147 by adopting the revised Flood Insurance Study for the
unincorporated areas of Stearns County and by adopting the revised
Flood Insurance Rate Maps for the unincorporated areas of Stearns
County.
For your information and review, I have enclosed a copy of
Ordinance 147. Please note that the present text of Ordinance 147
is in the left column and the proposed changes are in the right
column.
If you have any questions in regard to the proposed Ordinance, you
may contact the Stearns County Environmental Services Department,
